Federal s Federal requirements for K-12 student are addressed in the Elementary and Secondary Education Act (ESEA), Section 1111(b) (3) and (7), and the Code of Federal Regulations (Title 34). The specific requirements are found below. Federal Regulatory s for K-12 Academic s (FCAT 2.0, NGSSS Biology 1, Florida Standards s) and English Language Proficiency s (Comprehensive English Language Learning ) ESEA, Section 1111 - Plans (b) Academic Standards, Academic s, and Accountability (3) Academic s Appendix D (A) IN GENERAL- Each plan shall demonstrate that the educational agency, in consultation with local educational agencies, has implemented a set of high-quality, yearly student academic that include, at a minimum, academic in mathematics, reading or language arts, and science that will be used as the primary means of determining the yearly performance of the and of each local educational agency and school in the in enabling all children to meet the 's challenging student academic achievement standards, except that shall be required to meet the requirements of this part relating to science until the beginning of the 2007-2008 school year. (B) USE OF ASSESSMENTS- Each educational agency may incorporate the data from the under this paragraph into a -developed longitudinal data system that links student test scores, length of enrollment, and graduation records over time. (C) REQUIREMENTS- Such shall-- (i) be the same academic used to measure the achievement of all children; (ii) be aligned with the 's challenging academic content and student academic achievement standards, and provide coherent information about student attainment of such standards; (iii) be used for purposes for which such are valid and reliable, and be consistent with relevant, nationally recognized professional and technical standards; (iv) be used only if the educational agency provides to the Secretary evidence from the test publisher or other relevant sources that the used are of adequate technical quality for each purpose required under this Act and are consistent with the requirements of this section, and such evidence is made public by the Secretary upon request; (v)(i) except as otherwise provided for grades 3 through 8 under clause vii, measure the proficiency of students in, at a minimum, mathematics and reading or language arts, and be administered t less than once during-- (aa) grades 3 through 5; (bb) grades 6 through 9; and (cc) grades 10 through 12; (II) beginning t later than school year 2007-2008, measure the proficiency of all students in science and be administered t less than one time during-- (aa) grades 3 through 5; (bb) grades 6 through 9; and (cc) grades 10 through 12; 5

Appendix D (vi) involve multiple up-to-date measures of student academic achievement, including measures that assess higher-order thinking skills and understanding; (vii) beginning t later than school year 2005-2006, measure the achievement of students against the challenging academic content and student academic achievement standards in each of grades 3 through 8 in, at a minimum, mathematics, and reading or language arts, except that the Secretary may provide the 1 additional year if the demonstrates that exceptional or uncontrollable circumstances, such as a natural disaster or a precipitous and unforeseen decline in the financial resources of the, prevented full implementation of the academic by that deadline and that the will complete implementation within the additional 1-year period; (viii) at the discretion of the, measure the proficiency of students in academic subjects t described in clauses (v), (vi), (vii) in which the has adopted challenging academic content and academic achievement standards; (ix) provide for (I) the participation in such of all students; (II) the reasonable adaptations and accommodations for students with disabilities (as defined under section 602(3) of the Individuals with Disabilities Education Act) necessary to measure the academic achievement of such students relative to academic content and student academic achievement standards; and (III) the inclusion of limited English proficient students, who shall be assessed in a valid and reliable manner and provided reasonable accommodations on administered to such students under this paragraph, including, to the extent practicable, in the language and form most likely to yield accurate data on what such students kw and can do in academic content areas, until such students have achieved English language proficiency as determined under paragraph (7); (x) twithstanding subclause (III), the academic (using tests written in English) of reading or language arts of any student who has attended school in the United s (t including Puerto Rico) for three or more consecutive school years, except that if the local educational agency determines, on a case-by-case individual basis, that academic in ather language or form would likely yield more accurate and reliable information on what such student kws and can do, the local educational agency may make a determination to assess such student in the appropriate language other than English for a period that does t exceed two additional consecutive years, provided that such student has t yet reached a level of English language proficiency sufficient to yield valid and reliable information on what such student kws and can do on tests (written in English) of reading or language arts; (xi) include students who have attended schools in a local educational agency for a full academic year but have t attended a single school for a full academic year, except that the performance of students who have attended more than 1 school in the local educational agency in any academic year shall be used only in determining the progress of the local educational agency; (xii) produce individual student interpretive, descriptive, and diagstic reports, consistent with clause (iii) that allow parents, teachers, and principals to understand and address the specific academic needs of students, and include information regarding achievement on academic aligned with academic achievement standards, and that are provided to parents, teachers, and principals, as soon as is practicably possible after the is given, in an understandable and uniform format, and to the extent practicable, in a language that parents can understand; (xiii) enable results to be disaggregated within each, local educational agency, and school by gender, by each major racial and ethnic group, by English proficiency status, by migrant status, by students with disabilities as compared to ndisabled students, and by ecomically disadvantaged students as compared to students who are t ecomically disadvantaged, except that, in the case of a local educational agency or a school, such disaggregation shall t be required in a case in which the 6

Appendix D number of students in a category is insufficient to yield statistically reliable information or the results would reveal personally identifiable information about an individual student; (xiv) be consistent with widely accepted professional testing standards, objectively measure academic achievement, kwledge, and skills, and be tests that do t evaluate or assess personal or family beliefs and attitudes, or publicly disclose personally identifiable information; and (xv) enable itemized score analyses to be produced and reported, consistent with clause (iii), to local educational agencies and schools, so that parents, teachers, principals, and administrators can interpret and address the specific academic needs of students as indicated by the students' achievement on items. (7) ACADEMIC ASSESSMENTS OF ENGLISH LANGUAGE PROFICIENCY- Each plan shall demonstrate that local educational agencies in the will, beginning t later than school year 2002-2003, provide for an annual of English proficiency (measuring students' oral language, reading, and writing skills in English) of all students with limited English proficiency in the schools served by the educational agency, except that the Secretary may provide the 1 additional year if the demonstrates that exceptional or uncontrollable circumstances, such as a natural disaster or a precipitous and unforeseen decline in the financial resources of the, prevented full implementation of this paragraph by that deadline and that the will complete implementation within the additional 1-year period. Federal Regulatory s for K-12 Academic s for with Significant Cognitive Disabilities (Florida Alternate ) 34 C.F.R. 200.6(a)(2) Inclusion of all A 's academic system required under 200.2 must provide for the participation of all students in the grades assessed in accordance with this section. (2) Alternate. (i) The 's academic system must provide for one or more alternate for a child with a disability as defined under section 602(3) of the Individuals with Disabilities Education Act (IDEA) whom the child's IEP team determines cant participate in all or part of the under paragraph (a)(1) of this section, even with appropriate accommodations. (ii)(a) Alternate must yield results for the grade in which the student is enrolled in at least reading/language arts, mathematics, and, beginning in the 2007-2008 school year, science, except as provided in the following paragraph. (B) For students with the most significant cognitive disabilities, alternate may yield results that measure the achievement of those students relative to the alternate academic achievement standards the as defined under 200.1(d). 7

Appendix E LOCAL ASSESSMENTS. Local s in Section 1008.22(6), F.S. (a) Measurement of student performance in all subjects and grade levels, except those subjects and grade levels measured under the statewide, standardized program described in this section, is the responsibility of the school districts. (b) Except for those subjects and grade levels measured under the statewide, standardized program, beginning with the 2014-2015 school year, each school district shall administer for each course offered in the district a local that measures student mastery of course content at the necessary level of rigor for the course. As adopted pursuant to Board of Education rule, course content is set forth in the state standards required by s. 1003.41 and in the course description. Local may include: 1. wide. 2. standardized, including nationally recognized standardized. 3. Industry certification. 4. District-developed or district-selected end-of-course. 5. -selected or principal-selected. (c) Each district school board must adopt policies for selection, development, administration, and scoring of local and for collection of results. Local implemented under subparagraphs (b)4. and 5. may include a variety of formats, including, but t limited to, project-based, adjudicated performances, and practical application assignments. For all English Language Arts, mathematics, science, and social studies courses offered in the district that are used to meet graduation requirements under s. 1002.3105, s. 1003.4281, or s. 1003.4282 and that are t otherwise assessed by statewide, standardized, the district school board must select the described in subparagraphs (b)1.-4. (d) The Commissioner of Education shall identify methods to assist and support districts in the development and acquisition of required under this subsection. Methods may include developing item banks, facilitating the sharing of developed tests among school districts, acquiring from state and national curriculum-area organizations, and providing technical assistance in best professional practices of test development based upon state-adopted curriculum standards, administration, and security. (e) Each school district shall establish schedules for the administration of any district-mandated and approve the schedules as an agenda item at a district school board meeting. The school district shall publish the testing schedules on its website, clearly specifying the district-mandated, and report the schedules to the Department of Education by October 1 of each year. 8
