Prior to this, Michiga was the oly state without such a requiremet. Here is MVMA s uderstadig of what will occur: Whe will madatory CME take effect? The Michiga Departmet of Licesig ad Regulatory Affairs says the followig: Begiig i 2019, a applicat for a veteriaria licese reewal who held a licese for the three-year period immediately precedig the expiratio date of the licese shall have eared, withi the three-year period immediately precedig the date of the applicatio, 45 hours of approved cotiuig educatio. Begiig i 2019, a applicat for a veteriary techicia licese reewal shall have eared, withi the three-year period immediately precedig the date of the applicatio, 15 hours of approved cotiuig educatio. Licesees must complete approved cotiuig educatio for all reewal cycles thereafter. How ofte will I eed to reew my licese? ICVIs must be issued by a veteriaria licesed ad USDA-accredited i the state of the aimal s origi. I order to correctly issue ICVIs, always follow these five good maagemet practices: All ICVIs must be filled out completely ad legibly. Icomplete forms will be rejected ad the issuig veteriaria will receive a letter of educatio. I additio, there may be discipliary actio for the issuig veteriaria ad or your cliets. 6 i late Jue 2015, the MSU Diagostic Ceter for Populatio ad Aimal Health (DCPAH) was oe of seve Natioal Aimal Health Laboratory Network laboratories ivited by the USDA Aimal ad Plat Health Ispectio Service (APHIS) Wildlife Services to participate i a atio-wide avia iflueza surveillace of wild birds. This large-scale surveillace targeted testig of approximately 45,000 wild waterfowl was i respose to the devastatig outbreaks of highly pathogeic avia iflueza (HPAI) H5 i domestic poultry that affected up to 15 states from December 2014 to Jue 2015 ad resulted i the loss of early 50 millio birds. The HPAI H5 virus was also detected i wild birds from six states, icludig Michiga where sick Caada geese collected from Macomb Couty tested positive for HPAI H5N2 i Jue Low Pathogeic Avia Iflueza H5 Virus Detectios i Michiga Wild Birds Aabel G. Wise ad Richard M. Fulto From July 2015 to March 2016, DCPAH tested a total of approximately 5,500 wild bird samples submitted by the USDA ad state wildlife agecies from seve states, icludig Michiga. Of local importace, the Michiga Departmet of Natural Resources (MDNR), i collaboratio with USDA Wildlife Services i Michiga, collected ad submitted approximately 850 wild waterfowl samples from 49 couties i Michiga durig the ie-moth surveillace period. The samples were take mostly from huter-harvested birds, with a few from morbidity ad mortality cases. No HPAI H5 was detected; however, there were positive detectios of low pathogeic avia iflueza (LPAI) H5 i wild bird samples, mostly from mallard ducks, collected from 10 of the 49 couties sampled (see Figure). No-H5/ H7 AI virus detectios were made i four other couties. All LPAI H5 detectios were cofirmed by the Natioal Veteriary Services Laboratories i Ames, Iowa. The fidig of LPAI H5 i wild waterfowl i 10 couties i Michiga is sigificat, but ot uexpected because these viruses aturally occur i some wild waterfowl. LPAI H5 has bee diagosed previously i a Michiga commercial poultry flock, as well as a commercially-raised release for hutig mallard flock. Although H5/H7 or o-h5/h7 AI viruses were ot foud i other couties, it does ot mea that the waterfowl i those couties are ot able to harbor those viruses. Wild waterfowl are recogized to be the atural reservoir host for avia iflueza viruses. LPAI ifectios i these birds are geerally asymptomatic with the virus remaiig geetically stable as it cycles through the wild populatio. LPAI viruses, upo trasmissio to highly susceptible poultry species, such as chickes ad turkeys, oly cause mild cliical sigs or o apparet disease at all. However, as these LPAI viruses cycle through these poultry species, the H5 ad H7 subtypes i particular have the propesity to udergo a series of mutatio evets that lead to host adaptatio ad a switch from low to high pathogeicity. This geetic switch is marked by the acquisitio of a polybasic cleavage site i the hemagglutii (HA) gee that the gives the HPAI virus urestricted ability to replicate throughout the host ad cause devastatig disease. I Jauary of this year, a HPAI H7N8 outbreak occurred i a poultry farm i Dubois Couty, Idiaa where there were simultaeous detectios of the LPAI H7N8 o eight differet farms i a cocetrated poultry area. Geetic aalyses of the strais led to the coclusio that the HPAI H7N8 strai arose from its low pathogeic precursor as it circulated from farm to farm. The chace of wild birds trasmittig avia iflueza ifectio to domestic poultry is highest amog domestic birds reared i the ope ad close to bodies of water where wild birds may reside. This freerage set-up allows for domestic flocks to be exposed to cotamiated water ad/or food sources from the fecal droppigs ad 6 the michiga veteriaria summer 2016

WHAT IS AN AGREEMENT NOT TO COMPETE? A agreemet ot to compete (also kow as a ocompete agreemet ) is a cotract betwee a employer ad a employee that restricts the employee from workig i the same or similar type of employmet for a competitor of the employer for a specified time period. Employers use ocompete agreemets to protect their busiess from ufair competitio. Ordiary competitio caot be legally prohibited. After all, competitio is part of the America ecoomic culture. But if the departig employee or the ext employer who hires the departig employee would gai a ufair advatage i future competitio with the first employer, the a ocompetitio agreemet ca be a effective ad eforceable mechaism to prohibit that activity ad protect the first employer s busiess. WHAT CAN AN AGREEMENT NOT TO COMPETE PROTECT? Not all ocompete agreemets are eforceable. Courts recogize that ocompetitio agreemets restrict a idividual s ability to ear a livig. If the agreemet limits the employee beyod what is reasoably ecessary to protect the employer s reasoable competitive busiess iterests, a court is ulikely to eforce it. A veteriary cliic may acquire a reasoable competitive busiess iterest i several ways. Givig employees access to cofidetial busiess ad proprietary iformatio or trade secrets, permittig the veteriaria to establish goodwill with the cliets of the cliic, ad ivestig i specialized traiig for the veteriaria beyod the ormal day-to-day operatios of the cliic are some of the may ways employers may gai a competitive edge i the busiess. If a veteriaria would have a ufair competitive advatage if she were to go to work with a competitor with the free use of that trade secret, the a ocompetitio agreemet may be advisable. Cliet goodwill. A veteriaria s cotacts with the employer s cliets ca, ad probably should, evetually result i the veteriaria becomig very familiar with the pet owers ad their eccetricities, the aimals ad their variable characteristics, ad the medical eeds ad histories of the aimals they treat. The relatioship veteriarias establish with the cliets ad the persoal iformatio the veteriaria acquires is commoly referred to as goodwill. Those relatioships are particularly importat i a serviceorieted busiess like a veteriary practice. If a veteriaria becomes the face of the cliic i the mids of the cliets, the the employer likely has a legitimate busiess iterest i protectig that goodwill. A employer ca protect that goodwill by prohibitig its veteriarias from solicitig the cliic s cliets with whom he or she has a substatial relatioship. Whe asked to eforce a o-competitio agreemet, courts will look at the ature ad extet of the cotact betwee the veteriaria ad the cliets, as well as the type of veteriary services beig provided. Traiig. To remai competitive, some employers provide cotiuig educatio to veteriarias. Other veteriary practice owers may establish a reasoable competitive iterest by ivestig substatial time ad expese i traiig a ew employee. A o-compete agreemet may help protect those legitimate iterests of the veteriary practice. LIMITATIONS ON ENFORCEABILITY I Michiga, if a court fids that a agreemet ot to compete or ay provisio of that agreemet is ureasoable i ay respect, it may refuse to eforce the agreemet or oly eforce specific provisios of it. As metioed earlier, a cotract desiged to protect a veteriary cliic from all competitio is ueforceable. A practice ower ca reasoably rely o a court eforcig its ocompete agreemets if the restrictios o the employee are o greater tha ecessary to protect the cliics legitimate ad reasoable busiess iterests. This meas the prohibitio agaist competitio must be for a reasoable, specified time, ad restrict the employee from workig i a clearly defied distace from where the employer operates. Determiig what is reasoable requires a careful examiatio of the veteriary practice sought to be protected. Cosequetly, a oe size fits all approach is ill-advised whe draftig ocompete agreemets. NON-COMPETE CLAUSES IN THE SALE OF A VETERINARY PRACTICE A o-competitio clause i a purchase agreemet, or a separate o-competitio agreemet betwee a vet practice ower ad the purchaser of the busiess are permissible ad ofte highly advisable. I some istaces, the veteriaria sellig the busiess agrees to become a cosultat for the ew practice ower; i other situatios, the sellig veteriaria is retirig. NEGOTIATE NON-COMPETITION CLAUSES It is ot ucommo for veteriarias to cotact me ad tell me they have quit their job ad wat to work somewhere else or establish their ow practice but they are cocered about the ocompetitio agreemet they have with their former employer.
