1 RECTOR OF THE WARSAW SCHOOL OF ECONOMICS ADOIL-ZOWA-0161/ZR-13/14 ORDER NO. 13 of 23 April 2014 on the conditions and mode of commencing university studies at the SGH by foreigners under the rules other than binding for Polish citizens Pursuant to 56 sec. 1 of the Statutes of the SGH it is hereby ordered as follows: Chapter 1 Preliminary provisions 1 1. This order, hereinafter called order, regulates the conditions and mode of foreigners, i.e. persons not being Polish citizens, commencing first-degree and second-degree studies, hereinafter called: university studies, conducted in the form of full-time studies and extra-mural studies at the Warsaw School of Economics (hereinafter: the SGH ). 2. The provisions of the order are applicable to foreigners stipulated under Article 43 sec. 3 of the Higher Education Act (Journal of Laws (Dz.U.) No. 164, item 1365 as amended), i.e. foreigners applying for admission to university studies under the rules other than binding for Polish citizens. 3. The basic rules for foreigners stipulated under sec. 2 commencing and pursuing university studies are determined by the provisions of Article 43 sec. 3 and 4 of the Higher Education Act and the provisions of the Ordinance of the Minister of Science and Higher Education dated 12 October 2006 on commencing and pursuing studies and trainings by foreigners and their participation in scientific research and development projects (Journal of Laws (Dz. U.) No. 190, item 1406 as amended) Admission to full-time and extra-mural first-degree studies ensues without determining the field of studies; selection of the field of studies takes place during the
2 first year of studies. The above rule does not pertain to admission to studies in English language which may be conducted to specific fields of studies. Studies in respective fields at full-time and extra-mural studies in English language are launched subject to at least 50 (fifty) applicants with Polish citizenship and foreigners commencing studies under the rules binding for Polish citizens are qualified to the given field of studies, unless the Rector takes a decision on lowering this number. The preceding sentence is applied as appropriate to the condition for launching studies at respective fields of studies in the Polish language after the second semester of studies. 2. Enrolment for full-time and extra-mural second-degree studies is conducted to fields of studies stipulated in the Rector s order mentioned under 16 sec. 1 of this order and published on the SGH s website. Studies in respective fields of full-time and extra-mural studies (hereinafter called fields of studies ) are launched subject to at least 50 (fifty) applicants with Polish citizenship and foreigners commencing studies under the rules binding for Polish citizens are qualified to the given field of studies, unless the Rector takes a decision on lowering this number. 3. If the number of applicants stipulated under sec. 1 and 2 qualified to the given field of studies is lower than the minimum stipulated under sec. 1 and 2, the Admission and Promotion Center notifies thereof the foreigners applying for admission to studies and may suggest commencing studies at a different field of studies Subject to the following provisions of the order, foreigners may commence university studies at the SGH pursuant to two alternative rules: 1) under the rules binding for Polish citizens; 2) under rules different than binding for Polish citizens. 2. The following persons may commence university studies under the rules binding for Polish citizens: 1) foreigners who were granted a settlement permit; 2) foreigners with a refugee status granted in the Republic of Poland; 3) foreigners enjoying temporary protection within the territory of the Republic of Poland; 4) migrating employees who are citizens of a European Union member state, Swiss Confederation or a member state of the European Free Trade
3 Association (EFTA) party to the agreement on the European Economic Area, as well as their family members if they live within the territory of the Republic of Poland; 5) foreigners granted a European Communities long-term residency permit within the territory of the Republic of Poland; 6) foreigners granted a temporary residency permit within the territory of the Republic of Poland due to a circumstance stipulated under Article 53 sec. 1 item 7, 13 and 14 of the Act on Foreigners dated 13 June 2003 (Journal of Laws (Dz. U.) No. 128, item 1175, as amended); 7) foreigners granted subsidiary protection within the territory of the Republic of Poland; 8) holders of a valid Polish Card [Karta Polaka]; 9) citizens of European Union member states, European Free Trade Association (EFTA) member states parties to the agreement on European Economic Area or citizens of the Swiss Confederation and members of their families with a right of permanent residence. 3. Applying for admission for university studies under the rules binding for Polish citizens means participating in enrolment under the terms determined in the relevant resolution of the SGH Senate on the conditions and mode of enrolment for the first year of university studies; in particular it entails the obligation to register in the Internet Enrolment System (IRS) and submit documents stipulated in the said resolution within the deadlines stipulated in the schedule of the enrolment procedure for the given academic year Foreigners not listed in 3 sec. 2 may commence university studies at the SGH under rules other than binding for Polish citizens on the basis of: 1) international agreements, under the terms stipulated in the said agreements; 2) agreements concluded by the SGH with foreign entities, in particular universities and scientific institutions, under the rules stipulated in the said agreements; 3) a decision of the minister competent for higher education; 4) a decision of the SGH Rector;
4 and under the terms stipulated by the provisions of this order. 2. Foreigners stipulated under sec. 1 may commence studies: 1) as scholarship holders of the Republic of Poland; 2) for a fee; 3) free of charge and without scholarships; 4) as scholarship holders of the referring entity without incurring charges for education 5) as scholars of SGH. 5 Foreigners stipulated under 4 sec. 1 commencing studies for a fee or studies conducted in a foreign language settle the payment for tuition in the amount stipulated in a separate order of the SGH Rector in the mode and within the deadline stipulated under 18 of the Ordinance of the Minister of Science and Higher Education mentioned under 1 sec Citizens of European Union member states, the Swiss Confederation or European Free Trade Association member states parties to the agreement on the European Economic Area and their family members who are in possession of the funds necessary for covering the costs of maintenance during studies may commence studies at their discretion: 1) under the rules binding for Polish citizens, subject to the stipulation that the said persons are not entitled to a social scholarship, special scholarship for disabled persons, and special assistance grants, or 2) under rules different than binding for Polish citizens, i.e. pursuant to 4 and Chapter 3 of this order. 2. Foreigners holding a valid Polish Card [Karta Polaka] may commence studies at their discretion: 1) under the rules binding for Polish citizens, or 2) under rules different than binding for Polish citizens, i.e. pursuant to 4 and Chapter 3 of this order.
5 3. Foreigners stipulated under sec. 1 and 2 are obligated to submit written declarations on their selection of the principle governing their admission to and pursuit of studies. Chapter 2 Registration of the applicants for the studies 7 1. The registration of the applicants is conducted only in the electronic form. 2. During the enrolment process the Registration System for Foreigners is accessible for applicants from any computer with the Internet access on a 24/7 basis. 3. Dates of commencing and completing the registration of candidates via the RSF for full-time studies and extra-mural studies are established by the Rector in orders mentioned in 16, subject to the stipulation that the deadline for the registration is on the last day at 4 p.m. of the official time in the Republic of Poland In order to register, an applicant is required to create his/her personal enrolment account in the RSF, complete the Internet enrolment form within the required scope and approve it. 2. Until the deadline for the registration the applicant may supplement and modify the data entered in the Internet enrolment form. 3. The applicant s registration is legally binding at 4 p.m. of the official time in the Republic of Poland on the last day of the registration period relevant to the specific enrolment mode, after: 1) Filling in all the required personal data; 2) Indicating form and/or field of study; 3) Choosing the foreign language, which learning should be continued during the studies (if the applicant has such an obligation). 4) In the case of continuation of learning the foreign language during the studies, the applicant choose one from the following foreign languages: English, French, Spanish, German, Russian and Italian on the condition that its proficiency level is at least B1 according to the Common European
6 Framework of Reference for Languages (published i.e. on the Admission and Promotion Center s website) or Polish if the applicant is obliged to learn it. Choosing the foreign language in an internet form is binding for a candidate The SGH is not responsible for the lack of possibility to register or modify the entries in the RSF due to Internet failures beyond the control of the SGH or periodical overloads of the SGH s servers. 2. The SGH is not responsible for results of erroneous filling in of the personal enrolment account s fields, their omission or filling in with untrue information. 3. The applicant is required to keep secret the access password to the personal enrolment account. The SGH is not responsible for the results of disclosing the password to third parties, in particular for changes made in the RSF data against applicant s will which were authorized with his/her password nor for the disclosure of the applicant s personal data in this mode The applicant s personal enrolment account should be used for: 1) Filling in the personal data and submitting statements required in the enrolment process; 2) Declaring the applicant s preferred priority of fields and/or forms of studies for which he/she would like to be enrolled; 3) Passing the information on enrolment procedure, including: a) Date and place of the Entrance test on the knowledge of Polish language (if concerns the applicant), b) The qualifying procedure results, c) Date and place for submitting the documents, d) Admission or non-admission to studies, e) Declaration of a form of collection of the decision on admission, f) Other information required for the communication with the applicant. 2. The information sent to the applicant via the personal enrolment account is considered successfully delivered.
7 3. During the enrolment procedure the applicant is required to familiarize him/herself on the current basis with information sent to his/her personal enrolment account. 4. The SGH is not responsible for the effects of the applicant not familiarizing him/herself with the information sent to his/her personal enrolment account. Chapter 3 Enrolment procedure 11 Foreigners may commence university studies under the rules different than binding for Polish citizens subject to the condition that: 1) they hold a visa or a residency card or another document entitling them to remain within the territory of the Republic of Poland; 2) they prove they have a good state of health documented with a medical certificate stating no contraindications against commencing education within the given field and form of studies; 3) they hold an insurance policy in case of illness or personal accident insurance for the period of education in Poland or a European Health Insurance Card or they take out an insurance with the National Health Fund immediately upon commencing education Foreigners can be admitted for the first-degree studies who hold one of the following documents: a) Polish secondary school-leaving certificate; b) International Baccalaureat diploma; c) European Baccalaureat diploma; d) a certificate or other document obtained abroad, legalised or endorsed with an apostille, entitling them to apply for admission to studies at universities of all kinds in the country in whose system the institution granting the certificate operates, such certificate being considered equivalent to the Polish secondary school-leaving certificate pursuant to the regulations on nostrification of school certificates and secondary
8 school-leaving certificates obtained abroad or considered equivalent to the Polish secondary school-leaving certificate or considered as entitling its holder to commence such studies in the Republic of Poland under an international agreement may be admitted to first-degree studies. 2. Foreigners can be admitted for the second-degree studies who hold one of the following documents: a) Bachelor s or Master s diploma, or inżynier degree or any other equivalent degree awarded by a Polish university; b) diploma or another document, legalised or endorsed with an apostille, proving graduation from a university abroad entitling them to commence seconddegree studies in the country of its issue Furthermore, the condition for commencing studies conducted in the Polish language is: 1) completion of a year-long preparatory course for commencing education in Polish, conducted at entities identified by the minister competent for higher education, or 2) holding a certificate of the knowledge of the Polish language, issued by the State Commission for the Certification of Proficiency in Polish as a Foreign Language, or 3) taking a qualification test on the knowledge of the Polish language before a commission appointed by the SGH Rector. The condition stipulated in the preceding sentence need not be met by a foreigner holding a Polish secondary school-leaving certificate or higher education diploma from university where studies were conducted in the Polish language. 2. In order to commence studies conducted in the English language, a foreigner should submit one of the document stipulated in Annexe no. 1 to this order. 14 Foreigners commencing studies under the rules different than binding for Polish citizens may be admitted to studies in the following modes: 1) under a referral addressed to the SGH:
9 a) by the Bureau for Academic Recognition and International Exchange (BUWiWM), if they were qualified to studies by BUWiWM without the obligation to commence a preparatory course in the Polish language, or b) by a head of the entity in which the foreigners referred by BUWiWM undertook the preparatory course in the Polish language, authorised by the minister competent for higher education; 2) upon the application for the studies in individual mode; 3) pursuant to the provisions of agreements concluded by the SGH with foreign entities. 2. Admission for studies in modes mentions in sec. 1 is valid upon the prior registration in the RSF which is equivalent to the application of the foreigner for admission and upon meeting the conditions stipulated in the order Enrolment for first-degree studies is conducted to studies commencing in the winter semester, subject to sec Enrolment for second-degree studies may be conducted also to studies commencing in the summer semester. 3. Admission to studies organised under agreements stipulated under 4 sec. 1 point 2 may be conducted in times established in the said agreements The schedule of enrolments conducted within the modes stipulated under 14 point 1 and 2, in particular the deadlines for the registration in the RSF, submitting the required documents and the date of conducting the Entrance test on the knowledge of the Polish language, as well as the fields of studies subject to enrolment are stipulated by the Rector in the form of an order by 15 February in the case of enrolment for studies commencing in the winter semester and by 31 October in the case of enrolment for studies commencing in the summer semester. Orders stipulated in the preceding sentence are published on the SGH website and are relayed for information to institutions stipulated under 14 point Rector s orders stipulated under sec. 1 may determine the maximum number of foreigners to be admitted to studies under rules different than binding for Polish
10 citizens (hereinafter: quota ) to first-degree or second-degree studies as well as to respective forms or fields of studies, taking into consideration respective modes of enrolment stipulated under If the Rector s order stipulated under 16 does not determine the quota, all foreigners who submitted the documents required under the regulations of this order together with the documents confirming their knowledge of the relevant language pursuant to 13 sec. 1 point 1 and 2 and sec. 2 within the deadline or who passed the Entrance test stipulated under 13 sec. 1 point 3 or are qualified for admission to studies. 2. If the Rector s order stipulated under 16 introduces a quota, it establishes at the same time the rule of admission qualification different from the one described under sec Documents stipulated in the Annexe no. 2 to the present order should be submitted to the SGH Admission and Promotion Center in person or by courier upon confirmation of receipt or by registered mail upon confirmation of receipt within the deadline established in the schedule of enrolment, subject to 19 sec Admission to studies takes place on the basis of the Rector s decision which establishes in particular the financial conditions of pursuing studies, according to 4 sec The decision on admission to studies is final; however, a foreigner is entitled to submit an application to the Rector for reconsideration of the given case within fourteen days from the delivery of the decision. 3. A foreigner has the right to appeal against the Rector s decision on admission to studies taken upon reconsideration of the case to the court of administration within 30 days from the delivery of the Rector s decision. 4. A foreigner who failed to submit the required statement on the nostrification of a certificate may be admitted to studies solely on the basis of the Rector s decision issued upon the obligation of delivering to the SGH the said statement or copy of the
11 resolution of the SGH Senate within the deadline stipulated under 6 of the ordinance of the Minister of Science and Higher Education stipulated under 1 sec. 3 of this order. If the foreigner fails to submit the abovementioned statement, the decision on admission to studies is revoked pursuant to Article 162 sec. 2 of the Code of Administrative Procedure and the tuition fee settled by the foreigner is not refunded in the part pertaining to the first semester of studies The Admission and Promotion Center notifies the foreigner of the decision on admission to the studies and determines the deadline by which the foreigner may collect that decision in person at the seat of the SGH, unless the applicant did not declare in the RSF this form of the collection of the decision on admission. 2. If the decision on admission to studies is not delivered by an SGH employee to the foreigner at the seat of the SGH within the deadline stipulated in the notification mentioned under sec. 1, or the foreigner did not declare in the RSF the collection of the decision on admission in person, the Rector s decision is delivered upon confirmation of receipt by post, sending it to the address for correspondence provided by the foreigner during registration in the RSF or in a mode stipulated in the agreement mentioned under 14 sec The lists of persons admitted to respective forms and fields of studies, signed by the Rector, are posted at the seat of the SGH and published on the SGH website. 21 If the agreements stipulated under 4 sec. 1 point 2 provide for conditions for foreigners to commence studies organised or co-organised by the SGH other than stipulated in this order, the provisions of the abovementioned agreements are applied within the limits of absolutely binding legal regulations. 22 In circumstances unforeseen by this order and pertaining to enrolment of foreigners for studies, the Rector has the decision-making power.
12 Chapter 4 Final provisions 23 Order no. 15 of the Rector of the Warsaw School of Economics dated 26 March 2012 on the conditions and mode of commencing university studies at the SGH by foreigners under the rules other than binding for Polish citizens hereby becomes null and void. 24 This order comes into force on the day of its signing.
