Carriage of analogue signals and/or unencrypted signals after l"april 2017 is a violation of Sec4A of the Cable Television Network (Regulation) Act 1995 for which Authorised Officers (District Magistrate, Sub Divisional Magistrate & Commissioner of Police) have powers under Sec.1 1 to seize the equipment of the defaulting Cable Operators. 2. In this connection the Ministry has been receiving a number of complaints alleging that analogue signals still are being transmitted by some of the Cable Operators. These complaints are being sent to the concerned Authorised Officers i.e. District Magistrate, Sub Divisional Magistrate & Commissioner of Police for taking immediate necessary action as per the extant Cable TV AcURules, but no response is being received in most of the cases from the Authorised officers. 3. Ministry had also prepared a check list for inspection of MSOs by the Authorised Officers and the same was sent to them on 25.4.2017 with the request to plan regular inspection and take prompt action against the defaulters. Very poor response on carrying out of inspection by the Authorised Officers have been received. 4. In view of the above, as already requested vide the letter of even no. dated 12.6.2017 (copy enclosed), I once gain request you to direct all the DMs in your State to take action within their powers under Section 11 against the defaulters.

.l -2-5. lt is reiterated that as per sec 'r1 of cabre Terevision Networks (Regulation) Act 1995, the Authorised officers have power to seize the equipment of the defaulting cable operators. To ensure that the cable TV digitisation is complete and its benefits start accruing to all stakeholders, I request you to: i' Direct all the DMs in your state to take action within their powers under Sec 11 against the defaulters. ii' Allot about half an hour time to the Ministry, in any one of the meetings to be held by you with DMs in near future, to highlight their role/powers. iii' Get the issue monitored by senior officers like Divisional Commissioner, Revenue Secretary or lg police also.
