Absent was Mike Rinke, Ryan Nelson and Erin Davis. Recited Pledge of Allegiance. The Chairman read the standard ex parte statement. Commissioner Fry reported having conversations with the developers of RZ No other Commissioner reported having any ex parte communications. 4 P PC Minutes March 28, 206 Page 2. Comments: The following is a final plat for Forest Hills Estates, Tenth Plat, for 29 lots on 8.72± acres. The subject property is located in the vicinity of 72 nd Terrace and Brougham Drive. A rezoning to R- district (RZ-05-07) and preliminary plat for the Forest Hills Estates (P ) was approved in A revised preliminary plat (P-5-009) was approved in Final Plat Review: a. Lots/Tracts The final plat has a total of 29 single family residential lots with a gross density of 3.3 units per acre. All the lots meet the minimum area and setback requirements for R- districts. The final plat is consistent with the revised preliminary plat. There are four common tracts located along Brougham Drive. These tracts will be used for landscaping, open space and amenities. The tracts will be owned and maintained by Forest Hills Estates Homes Association. The dedication section needs to be updated to identify Tracts R, S, P and Q. b. Public Utilities This property is located within the City of Olathe water service area and Johnson County Wastewater District. The applicant shall coordinate with the respective utility providers for required water and sewer connections. c. Streets/Traffic The subject property includes two local street connections and a collector road for Brougham Drive. The preliminary plat included a stipulation for an agreement between the adjacent property owners to coordinate the location and construction of the future street and bridge improvements. A draft agreement for Brougham Drive has been submitted and staff supports the proposed location and timing of construction for the future street. The agreement shall be signed and executed prior to recording the final plat for Forest Hills Estates, Tenth Plat. d. Landscaping/Screening Master landscaping/screening plans and street tree plans are required with final plats. A street tree and master landscape plan has been submitted for this plat. Tract P on the east side of Brougham Drive has an existing tree row. If the trees need to be removed for construction of the street, new trees would be required in this area with future residential development east of Brougham Drive per Unified Development Ordinance (UDO) H. 3. Excise Taxes: A small portion of the final plat, 0.07 acres, is located within a benefit district for Mur-Len Road. The remaining property is subject to the required street excise tax of $0.25 per square foot of land. Based on the net plat area, 8.65 acres, the required street excise tax is $8,0.6.

Staff Recommendation: Staff recommends approval of P with the following stipulations: a. Comments: This is a request for approval of a minor plat for The Villas of Asbury, 44 th Plat (a replat of Lot 39, The Villas of Asbury), on 0.26± acres, located at 5554 South Hillside Street. A preliminary and final plat (P-29-0) for The Villas of Asbury and site development plan (PR-38-0) was approved by the Planning Commission in 200. As the townhomes are completed, the existing lots are subdivided (replatted) for the sale of the individual units. No public easement or right-of-way will be dedicated with this replat and therefore the plat will not require City Council approval. 2. Final Plat Review a. Lots/Tracts The replat includes four (4) lots for four (4) individual but attached villa units. b. Utilities/Municipal Services The property is located in the WaterOne service area and the City of Olathe sanitary sewer area. c. Streets All units will have access to Hillsdale Street which is a private street. Hillsdale Street connects to Brentwood St. which is part of the public street network.

Amenities A private asphalt trail currently loops around The Villas of Asbury and the preliminary site development plan shows the final segment of trail to the north of the subject property in Tract H. This section of trail will need to be completed prior to certificate of occupancy for these units. e. Street and Signal Excise Taxes No excise fees are due with this application since the property has already been platted. 3. Staff Recommendation: Staff recommends approval of P with the following stipulations: a. An asphalt trail is required in Tract H according to the preliminary site development plan. The trail shall be constructed prior to certificate of occupancy for units in the 44 th Plat. b. The developer is responsible for planting street trees, subject to UDO G. Such trees shall be planted at the completion of each phase of development. c. Prior to recording the plat, a digital file of the final plat (pdf format) shall be submitted to the City Planning Division. d. Comments: This is a request for approval of a final plat for Lone Elm 55. The subject property is located on the northeast corner of 67 th Street and Lone Elm Road. A preliminary site development plan (PR-5-023) for 67 th and Lone Elm Industrial Park was approved in 205 and a final site development plan for a 55,000 square foot office/warehouse building is pending. 2. Final Plat Review: a. Lots The plat consists of one industrial lot and two common tracts. The plat shows the required building setbacks for M-2 districts. b. Public Utilities The site is located within the City of Olathe sewer area and Johnson County Water District #. A sanitary sewer main extension will be required to serve the proposed development. Public utility easements are identified on the

Streets/Right-of-Way The plat includes additional street right-of-way for Lone Elm Road and 67 th Street per City requirements. The owner is improving 67 th Street as part of the final development plan. d. Stormwater/Detention Easements are identified for Best Management Practices for stormwater detention. The plat includes a "Permanent Stormwater Quantity/ Quality Easement". A stream corridor maintenance agreement and water quality/water quantity maintenance agreement is required prior to development. e. Excise Taxes There is an agreement between the owner and the City for exemption of street excise tax due to the costs of improvement for 67 th Street. Therefore, a street excise tax is not required for the final plat. The final plat is subject to a traffic signal excise tax of $ per square foot of land area for office districts. Comments: The applicant requests approval of a Zoning Amendment for a revised preliminary development plan within an existing RP-3 district. This property was originally approved for a two-story assisted living facility as part of the 998 preliminary development plan for

The applicant desires to revise the plan in order to construct a three-story senior apartment complex, which is also a permitted use within the RP-3 zoning district. The proposed apartment complex includes two separate three-story buildings, containing a total of 8 units. At the corner of 5 th Terrace (incorrectly labeled as 5 th Street on the plans) and Lone Elm Road, Building 2 includes a clubhouse and common space amenities, as well as an outdoor swimming pool. The attached Project Summary provided by the applicant describes the project in more detail. 2. Neighborhood Meetings: Prior to this application, the applicant submitted a different application to rezone the property to R-4 in order to allow four-story apartment buildings (RZ-5-04). However, after conducting a neighborhood meeting on December 22, 205 and receiving staff s comments, the applicant agreed to reduce the building height to three stories, withdrawing the rezoning request (RZ-5-04) and submitting a new application for a Zoning Amendment (RZ-6-00) to seek approval for a revised plan that fits within the existing RP-3 zoning classification. The new application required an additional neighborhood meeting to discuss the revised plan with the neighborhood. This second meeting was held on February 2, 206. The minutes for both neighborhood meetings are attached. At the December 22 nd meeting for application RZ-5-04, residents asked informational questions about the project, and expressed concerns about traffic & street improvements, financing & income restrictions, impact to nearby properties and property values. At the February 2 nd meeting for application RZ-6-00, residents voiced similar questions and concerns to those raised at the December 22 nd meeting. New concerns mentioned included the enforceability of age-restriction, long-term maintenance and ownership, appropriateness of the use for this location, building height, stormwater, and site design. 3. This property is located within a Mixed Use Residential Neighborhood, so it is subject to Site Design Category 3 and Building Design Category B. a. Outdoor Amenity Space The plan includes a variety of different types of outdoor amenities, with a swimming pool, common green, and plaza. The plans also indicate that the detention basin is intended to serve as a natural area and count toward the outdoor amenity space (see also Drainage Features ). 2. Pedestrian Connectivity The development includes an internal system of sidewalks which connect to the public sidewalks along Lone Elm Road and 5 th Terrace. The internal system includes cross-property connections; colored stamped concrete may be required for crosswalks at key internal locations with the final development plan. 3. Drainage Features The site includes a dry-bottom detention basin at the northwest corner of the site. The applicable Site Design Standards option for a dry-bottom basin requires it to be maintained as extensively landscaped open space with shallow slopes and a curvilinear shape. The basin is defined by retaining walls on three sides, with a gentle :3 slope on the south side. It is circled by trees, but generally rectangular in shape. b. Building Design Standards: The following is an analysis of the composite building design requirements for the proposed buildings. The development is subject to Building Design Category B standards (UDO ). The applicant submitted a design narrative to address specific building design requirements; this narrative is not attached, but portions of it are quoted within this report.

Horizontal Articulation Category B buildings are required to incorporate horizontal and vertical articulation every 50 feet of primary façade width. The proposed buildings include 6 foot wide balconies that project 5 feet from the façade, with balconies spaced approximately 40 feet apart. 2. Vertical Articulation Some of the projections used for horizontal articulation are also slightly taller than the rest of the building, and the horizontal projections are substantial enough on these three-story buildings to provide the illusion of additional height variation as viewed from the street. Corner tower elements also contribute toward the required vertical articulation. 3. Transparent Glass The applicant s design narrative states that: Percentages of the windows to wall surface exceeds 25% in all apartment units on every façade, not just primary. (Example 40 unit 400 s.f. surface 2-6x6 windows 8x7 glass door unit 28/400 = 32%). However, the building materials percentages provided by the applicant for the building elevations indicate that glazing is used along 5% of most facades, with a maximum percentage of 24%. The intent of the transparent glass design standard is to ensure adequate proportions of transparent glass for building scale and aesthetic purposes. The internal garages, which are a highly-desirable feature, serve to reduce the percentage of transparent glass on some facades. After reviewing the elevations, staff finds the percentage of transparent glass on the apartment buildings to be appropriate as proposed. 4. Ground Floor Pedestrian Interest The applicant s design narrative states: All ground floor apartments have glass entries in masonry clad patios surrounded in landscape beds. Garage doors are located off the main public way and garage doors have banding of glass in the top panel. Apartment units and amenity spaces exceed the 25% transparent coverage residential requirement. (# Transparent Glass) Again, the highly-desirable internal garages complicate this analysis. Furthermore, the applicant has not provided the actual percentage of transparent glass for just the ground floor of each façade. However, the intent of this standard is to ensure pedestrian interest, and a review of the building elevations and color renderings satisfies staff that the intent of the standard is met. 5. Finished Floor Elevation The applicant s design narrative states: We will attempt to make all patio floors 8 min. out of grade. This will present some challenges due to requirements of fair housing and ADA for a senior apartment complex. The façade along the pool patio will be level with the building finish floor so the pool deck grade will be 8 above sidewalk grade. Because this is a senior apartment complex, stairs are undesirable, and staff believes an exception may be warranted to ensure the safety of residents. However, the applicant has indicated that an exception may not be necessary, so this will be analyzed more closely with the final development plan application.

The side elevations of the 2-bay garages are not very detailed, so staff recommends a stipulation for additional architectural details (e.g. windows) to be added to the sides of these buildings. 9. Transition Standards The applicant s design narrative states: Our property is over 00 feet from R- or R-2 districts. However, this statement is not accurate, because RP- and RP-2 districts are considered synonymous with R- and R-2 districts. The property is adjacent to RP-2 districts on the east and west, and adjacent to an RP- district on the north. The transition standard applies only to portions of buildings that are located within 00 feet of the applicable zoning district. Building 2 is greater than 00 feet from any adjacent properties, but Building is 3-stories in height and only about 65 feet from the RP-2 district to the west. An exception to this transition standard would be necessary for the proposed development. 0. Mechanical Equipment Mechanical equipment is not indicated on the plans but will be required to be screened in accordance with Unified Development Ordinance requirements. Vents are visible on the buildings adjacent to patios and balconies, and are required to be painted to match the building wall. The use Elderly housing, Multi-family Residences requires one parking space per dwelling unit, for a total of 8 parking spaces required for this complex. Residents of the proposed apartments will have several options for parking. The two buildings contain a total of 38 internal garages. 48 additional garages are located in freestanding garage buildings scattered throughout the site. The surface parking lots include an additional 8 spaces, five of which are ADA-accessible spaces. Altogether, the garages and surface parking spaces could accommodate a total of 66 vehicles.

Traffic: Traffic Engineering staff initially recommended a southbound right turn lane be constructed at this development s proposed driveway on Lone Elm Road. The applicant subsequently completed a Traffic Impact Study (TIS), which was submitted to staff on March 8, 206. The TIS suggests that consideration be given to constructing northbound and southbound left turn lanes instead of the right turn lane recommended by staff. Overall, the projected turning volumes for this development are low, but the TIS correctly points out that the City s Access Management Plan requires left turn lanes on arterials at all median breaks. With additional development in the Sunnybrook area, additional streets may be constructed that could alter traffic patterns. The City will need to monitor Lone Elm as new development occurs to determine what improvements are needed and when. If the developer opts to construct the left turn lanes suggested by the TIS, these lanes will need to be constructed in accordance with the Access Management Plan, which requires 200 feet in length plus taper. Regardless of whether the left turn lanes are constructed, staff continues to recommend a stipulation requiring construction of the southbound right turn lane on Lone Elm Road. 7. Landscaping and Screening: There are no existing trees on the site. A master fence/screening plan is required along Lone Elm Road, within a minimum 25 foot wide landscape tract or easement in addition to required yard setbacks. The applicant proposes a 25 foot landscape buffer, but allows one corner of the building to encroach into the buffer, making the buffer only 9.27 feet at its narrowest point. Because there is no minimum yard setback, and there is actually a maximum setback of 5 feet, staff is comfortable with the proposed minor encroachment. However, the landscape tract will need to exclude the area of encroachment. The master fence/screening plan requires 8 evergreen trees, 2 shade trees, and ornamental tree per 00 linear feet, all of which are provided on the submitted landscape plan. Street trees are required with an average spacing of 40 feet between trees along 5 th Terrace. Nine trees have been provided to meet this requirement. Additional landscaping has been provided along this frontage in accordance with the Type 3 Buffer requirements. A Type 3 Buffer is required along the west property line, adjacent to the RP-2 district. A Type 3 Buffer is 20 feet in width, with.5 shade trees, ornamental tree,.5 evergreen trees, and 35 shrubs and grasses per 00 linear feet, with a minimum 6-foot high wall or berm required. The landscape plan shows the required plantings, but allows encroachment of the freestanding garages and the detention basin into the 20-foot buffer area. The applicant requests that these encroachments be permitted since the walls of the one-story garage can function like the required wall as part of the Type 3 buffer, the detention basin is open space, and the required landscaping materials have been provided. A wood fence is also provided, which will screen the remainder of the property line with the exception of the detention basin. The free ends of the fence will be capped with brick columns. The applicant proposes to substitute evergreen trees for a number of the required shrubs on a :3 ratio ( evergreen = 3 shrubs) since evergreen trees will provide a more effective screen. A Type 5B Buffer is required along the south property line, adjacent to the CP-2 district. A Type 5B Buffer is 75 feet in width, but does not include any required landscaping or constructed features. The applicant requests to instead provide a Type 2 Buffer, which is only 5 feet in width, but includes 2 shade trees, 3 ornamental trees, 2 evergreen trees, and 35 shrubs and grasses per 00 linear feet. Staff agrees with the applicant that

20 RZ-6-00 PC Minutes Mar. 28, 206 PC Mtg. Page 9 landscaping is needed along the southern property line, and sacrificing some width to achieve a higher level of landscaping is reasonable. Landscaping is provided in accordance with the Type 2 Buffer requirements, except that 0 additional evergreen trees have been substituted for 30 shrubs, and this substitution still leaves the buffer lacking 4 shrubs. A stipulation is recommended to ensure that the south buffer will meet a minimum Type 2 Buffer standard. Parking islands are provided as required. The applicant indicates that parking lot screening has also been provided, but staff recommends a stipulation for shrubs along the parking area adjacent to Lone Elm Road to ensure adequate screening. A note on the landscape plan indicates that building facades fronting a public right-of-way or a parking lot shall have a minimum 6-foot wide planting area along at least 25% of each building façade in accordance with the building façade/foundation landscaping requirements. Multifamily residential developments are also required to provide interior landscaping of at least one tree for every dwelling unit. This requirement is not addressed by the landscape plan. 8 trees are required based on the number of dwelling units, and 48 are shown on the plan. Additional drawings were provided to show a section extending from the development to the Foxfield Court subdivision, along with more detailed views of what the landscaping along Lone Elm Road will look like. 8. Lighting: A photometric plan was not provided and will be required with the final development plan. The project is expected to comply with the Unified Development Ordinance lighting requirements. 9. Utilities: The site is within Johnson County Water District # and the City of Olathe sewer service areas. A sanitary sewer main extension will be required to serve this development. 0. Stormwater: The proposed development includes a stormwater detention basin at the northwest corner of the site, and post construction stormwater quality BMP s as per Title 7 requirements.. Rezoning Analysis: The following are criteria for considering applications as listed in Unified Development Ordinance (UDO) Section G and staff findings for each item: A. The conformance of the proposed use to the Comprehensive Plan and other adopted planning policies. The future land use map of the Comprehensive Plan identifies this as a Mixed Density Residential Neighborhood. The proposed use is appropriate within this future land use designation. B. The character of the neighborhood including but not limited to: land use, zoning, density (residential), floor area (non-residential and mixed use),

The overall Sunnybrook Development was envisioned as a mixed-use development, and includes several different types of residential development, commercial development, and business park development. Portions of the area remain undeveloped, but with an approved preliminary development plan. The property is already zoned, and is adjacent to multifamily residential. The building height, density, and intensity are higher than any other development in this area, but could be appropriate within the pattern of a well-planned mixed use development. C. The zoning and uses of nearby properties, and the extent to which the proposed use would be in harmony with those zoning districts and uses. As noted, senior apartments are a type of multifamily residential development, and the surrounding area includes a mixture of single-family and multifamily residential development. The use is therefore consistent with other uses in the area, and the site is already zoned for this and similar types of uses. D. The suitability of the property for the uses to which it has been restricted under the applicable zoning regulations. The site is already zoned, but was planned and approved for an assisted living facility. This application proposes to change the preliminary development plan to allow a senior apartment complex which is a similar land use but requires a different site development plan. The property is suitable for both types of uses. E. The length of time the property has remained vacant as zoned. The property is and has been vacant since rezoning and platting of the Sunnybrook Development nearly 20 years ago. F. The extent to which approval of the application would detrimentally affect nearby properties. The proposed development is not anticipated to detrimentally affect any nearby properties. G. The extent to which development under the proposed district would substantially harm the values of nearby properties. The proposed development includes a high level of design and introduces a new housing type and additional population to this area. Comments about future impacts to property values are best made by a real estate appraiser, but staff does not anticipate that the project would harm the value of any nearby properties. H. The extent to which the proposed use would adversely affect the capacity or safety of that portion of the road network influenced by the use or present parking problems in the vicinity of the property.

A turn lane is recommended to help alleviate the increase in traffic. The development provides surface parking and garages in a quantity that exceeds the minimum parking required by the Unified Development Ordinance. I. The extent to which the proposed use would create air pollution, water pollution, noise pollution or other environmental harm. The site includes proper stormwater drainage and detention, and is not expected to create excessive pollution or environmental harm. The development will follow all regulations and codes pertaining to prevention of environmental harm. J. The economic impact of the proposed use on the community. The proposed development will generate new real estate taxes on land that is currently vacant. Furthermore, it will add a new housing product to this area, and additional population to support the nearby commercial businesses. K. The gain, if any, to the public health, safety and welfare due to denial of the application as compared to the hardship imposed upon the landowner, if any, as a result of denial of the application. The proposed development will generate new real estate taxes on land that is currently vacant. This project is not anticipated to negatively impact public health, safety, or welfare. The landowner would maintain an approved preliminary development plan for an assisted living facility if the application is denied; however, this is a real project that is ready to build here, whereas it could take some time to find a developer willing to build a project in accordance with the approved plan. L. The recommendation of professional staff. See below for staff s recommendation. M. Any other factors which may be relevant to the application. The Planning Commission recommended approval, subject to a stipulation that concerts only be acoustic music, out of concern for potential noise. The City Council then approved the permit for a period of three years with an expiration of May 0, 205. The council chose to allow amplified music, subject to noise monitoring at the property line and restrictions on loudspeaker location. The special use permit renewal (SU-5-002) was reviewed by the Commission in April 205. The winery was permitted to have concerts with amplified music on Fridays until 0:00 p.m. and non- amplified, acoustic music on Saturdays and Sundays. The approval also stipulated that buildings on-site comply with the Fire Department regulations and Building Codes. The Special Use Permit was approved with a one () year time limit. 2. Details of Operation: Stone Pillar Vineyard and Winery is a farm winery that grows its own grapes and manufactures its own wine on premises. The applicants operate the winery under the Kansas Alcohol Beverage Control Handbook for Farm Wineries which allows for the manufacturing, sampling and selling of wine at the site. Please see the attached mission statement and project narrative provided by the applicant. The vineyard and winery is a family owned business with two employees and twenty-five part-time workers. Volunteers are also recruited to help harvest the grapes in late summer and early fall. The tasting room is open most of the year from 2:00 p.m. 6:00 p.m. Wednesday through Sunday. During the months of June, July and August the tasting room is open until 8:00 p.m. The site also hosts a variety of events, concerts and fundraisers. The applicants constructed an open shelter approximately 27 feet from the north property line to house bands that perform. The shelter has since been fitted with removable walls to host events inside the structure. Concerts at the site are held on Fridays and end at 0:00 p.m. Acoustic musicians perform on Saturdays and Sundays. Staff suggested that the concerts end at 9:00 p.m. instead of 0:00 p.m. The applicant stated that 7:00 p.m. start time gives concert goers plenty of time to get home after work and to grab dinner. The later ending time also creates a longer window of activity that is more attractive to the patrons. The applicant also states that a procedure will be implemented to end concerts at 9:45 p.m. 3. Vineyard Events: The special use permit approved in April 205 permitted the applicant to hold summer concerts on the weekends with amplification permitted on Fridays and acoustic music permitted on Saturdays and Sundays. The stipulations attached to the permit addressing the possibility of loud music disturbing nearby houses remained from the 202 approval. The applicant had to face speakers to the south or west, away from the houses to the north. The applicant was also required to take decibel readings at the north property line for each concert and provide those readings to staff. The decibel readings at this property line had to be below 55 decibels which is required by the Olathe Municipal Code. The bands perform under the shelter built on the property. The structure has a noise absorbing ceiling and removable side walls have been installed. The applicant has stated that the installation of the walls on the shelter has helped reduce the noise coming from the bands. To show compliance with noise standards, the applicant has provided staff

31 SU-6-00 Staff Report continued April, 206 Page 3 with videos showing the noise decibel readings being taken for each concert with a decibel reader. The decibel readings are required to be taken at the nearest property line, which is the north property line, however, decibel readings at various locations has been provided. The highest recorded decibel reading was 54.6 for the June 26 concert. The videos show that the readings were below the 55 decibel maximum. Decibel readings at times were above 55 due to the wind, other noises or nearby traffic. In addition to having amplification on Friday nights, the applicant is requesting the use of amplification for presenters and for acoustic musicians on Saturdays and Sundays. The amplification would be for speakers to present in front of groups such as the Rotary Club or for guests at weddings to make toasts. The applicant states that the amplified acoustic music is necessary for guests to hear the musician sing at these events. 4. Police Reports/Decibel Readings: The Police Department also monitored the noise levels coming from the winery throughout the concert season, starting with the May 8 concert date. Staff created a spreadsheet based on the data (see attached). There were 27 Friday night concerts and the police officers recorded one instance where the decibel level was above 55db on July 3. There were noise complaints on four of the concert dates including on July 3 with a neighbor reporting decibel readings in excess of 60 dbs. The police reported music after the 0:00 p.m. stop time on four concert dates with the latest recorded time being 0:08 p.m. The last concert to end after 0:00 p.m. was July 3 with the remaining concerts ending before the mandatory stop time. The police reports also state that for many of the concerts it was difficult to get a reading on the music due to traffic and other noises and that in order to get a reading on the music the officer had to be on the winery s property. Staff is stipulating that the applicant purchase a sound reader/data logger to record decibel readings over the entirety of each concert. Such a device will provide additional data over a longer period of time. The applicant shall provide the data recorded from each concert to the Planning Division. 5. Parking/Traffic: The Unified Development Ordinance (UDO) does not provide a specific parking requirement for an amusement and recreation establishment. The site has a parking area containing 44 parking spaces with additional parking available on the interior drives and on grassy areas when the weather allows. There have been no complaints or issues with concert traffic or on-site parking. 6. Neighborhood Meeting/Staff Contacts: The applicant held a neighborhood meeting on March 2, 206. Two residents from the Fallbrook subdivision attended the meeting and expressed support for the renewal. The applicant has provided meeting minutes which have been included in the Planning Commission packet. Staff was contacted by one resident with complaints about noise from the concerts. The resident also expressed concern about the City using Police resources on monitoring the winery and the winery putting up prohibited banners in addition to other concerns (see attached).

32 SU-6-00 Staff Report continued April, 206 Page 4 Staff has received 66 s and messages of support for Stone Pillar. The messages of the supporters stated that they enjoy the concerts and activities at the vineyards; that the business contributes to local charities; and the residents living close to the winery state that they cannot hear or can minimally hear the music on concert nights. Staff was able to break out the locations of the supporters. Of the 66 messages, 50 came from the Stone Pillar neighborhood (less than mile from the vineyard), 80 are Olathe residents and 36 are outside Olathe or undetermined (see attached). 7. Fire/Building Codes: The venue had several outstanding Fire and Building Code violations as of the last special use permit renewal. Stipulations were added to last year s approval that the business had to meet current fire and building codes for existing structures. The Fire and Building Codes Departments have visited the site and has determined that all the stipulations have been met. 8. Time Limit: Staff is recommending a one () year approval period to expire on May 3, 207. Any violation of the special use permit stipulations shall result in the immediate proceedings to revoke the special use permit. The Planning Commission can recommend shorter or longer time limits based on the circumstances of the renewal application. 9. Staff Recommendation: Staff recommends approval of SU-6-00 with the following stipulations: a. The special use permit shall be approved for a one () year period and shall expire on May 3, 207. b. Any violation of the special use permit stipulations shall result in the immediate proceedings to revoke the special use permit. c. The applicant shall purchase a sound reader/data logger to record the decibel levels over the entire duration of each concert and provide the data to the Planning Division. d. Activities and uses of the winery/vineyard shall be limited to those areas designated on the site plan submitted by the petitioner with this Special Use. e. Concerts with speakers shall be limited to Fridays from the hours of 7:00pm to 0:00pm. Acoustic music is permitted Saturdays and Sundays. f. Speakers for any concert must be faced south or west, away from the houses in the residential subdivision to the north. The owners shall take measurements of the decibel level for each concert at the north property line and record the reading to assure noise levels of Olathe Municipal Code Section are met. g. No tents or temporary structures shall be permitted with winery activities.

Playing there for several years has been an absolute pleasure. George Hoff takes the city's noise requirements very seriously, checking our decibels before and during each performance. My grandmother and great grandfather were born on that particular property in 893 & 865 respectively. During the civil war, on that very property, my great great grandfather was struck down but not killed- by Missourians seeking to impose their will on the residents of the new state of Kansas. Every time I go to one of the events at Stone Pillar it is a proud reminder of my family heritage. 2. That property has been associated with one family name, longer than any other property in the state of Kansas. Hoff is that name: the name on the stone pillar at the corner of College & Woodland. And the success of this small family agricultural business is in part dependent upon their ability to serve as such a unique venue. 3. I am a life-long Johnson County resident. The evening events at Stone Pillar Winery have created opportunities not elsewhere available in the county, for our friends and neighbors, and for my wife and me to relax, visit and socialize with friends from our church, (located in Olathe) both of our places of employment and old friends from college. These special events and festivals represent a valuable and wonderfully unique venue otherwise unavailable in our community. 5. In the late 70s I was visiting the farm during harvest one particularly sunny day when new suburban neighbors to the north came by complaining that the chaff from combining was blowing into the swimming pools and clogging their filters. At the time I laughed. But business models as well as communities and tastes evolve. And that is exactly what the Hoff family has done with their family business. Such evening events are a celebration of our roots as well as the fruition of family dreams: to deny a special use permit is to suggest that our dreams might best, be left to wither on the vine. To be clear, I have no financial interest or investment in the Winery. My grandmother sold her interest in the family farm to her youngest brother, Lucien Hoff, the grandfather of the Winerys owners, in the mid950s. Please support the renewed issuance of a special use permit for the Stone Pillar Winery. It's a day today struggle to attract new clients, create raving fans and support your employees. My significant other, Jonathan Braswell, and myself support and love the city of Olathe. We own a house there and we belong to the Chamber of Commerce. So far the city had done a tremendous job of creating a community that is a joy to take part in. I would be very sad to see Stone Pillar not be able to offer their summertime events as it is such a great way to pull together a community of people. A couple years ago I moved from the Seattle area and if there was ever a great example of summer music offerings, Chateau St. Michelle has it figured out. I've attended a number of their summer concerts and while I know their scale is much larger, it might be good to contact them and the city of Woodinville to see how they handled objections and limitations. The vineyard is such a neat aspect of our community. As a member of the social committee in Prairie Point, the neighborhood just to the west of Stone Pillar, we were planning to have a neighborhood outing to one of the concerts this summer. So many of us have been and had a wonderful time and several others have always wanted to go. Everyone I know in our neighborhood loves and supports the vineyard and the concerts and even the people closest do not have complaints about noise. It is such a fun and unique aspect of our community. At past concerts I've ran into friends from across Johnson County and was proud to see that they were choosing to spend their evening at a concert at the vineyard in our community. I do not live in Olathe, but over the last two years my wife and I have been to around 30 concerts and events at the winery and each time we do some shopping and eat in Olathe before we go there and listen to music, pick grapes, of whatever event is going on. If they are not permitted to have the concerts and other events we will not be spending as much at Stone Pillar or in Olathe. There are many other nice wineries in the area and without the events at Stone Pillar we will spend more time at some of the other wineries and towns they are in. My wife and I moved to Olathe a little over 3 years ago, and we immediately took advantage of our proximity to the winery. Along with our sons we took in numerous Friday night concerts, picked out pumpkins at Halloween, and enjoyed being able to invite friends from around the city to come with us to take in the events. In the summers of 203 and 204, we enjoyed being able to walk out of our front door on a Friday night and know that something fun was happening next door. From our yard, the music was never loud. It sounded as though someone in the neighborhood might be listening to a radio on their porch. It was something fun and special that we loved about our new neighborhood. Unfortunately with the decision not to approve Stone Pillar's permit request last year, we missed that piece that was unique and special about our neighborhood. It's only appropriate that I write you today, on National Drink Wine day. I encourage you to support Stone Pillar and the Hoff family that has been on the corner of College and Woodland for so many years! I personally support Stone Pillar for many reasons. It's only a couple of miles from my home. My wife and I have attended several events--sometimes we've gone for the food, sometimes we've gone for the music, sometimes we've gone for yoga; and of course we've gone to simply enjoy the wine! My youngest loves cooking and gets really excited about the food truck visits. My older son enjoys the live music. My wife and I regularly participate in Yoga, the annual grape stomp, and love their food pairings. The hill on which Stone Pillar sits is a beautiful place to sit out and unwind after a busy day in the office or a hot summer day of working in the yard. It's fantastic to sit out on the patio and feel a cool summer breeze. It's a treasure within this great city that honors our farming heritage and promotes a sophisticated future. The entertainment hosted at Stone Pillar thoughout the summer months are tasteful. The musicians are generally local--or at least regional--and keep the tone and music family friendly. I have no reservations in bringing my boys to experience the live music offerings--or some of their tasty culinary options. I know George maintains order and have never witnessed any social misconduct by any of his guests. Furthermore, what Stone Pillar brings to the community goes beyond entertainment and grapes. I know it takes a lot of hard work to maintain his vineyard, and I know he employs multiple teenagers in the summer months to work over the vines. These teens undoubtedly learn much more in life values working at Stone Pillar than they'd learn at typical teen jobs like those of the fast food industry. In fact, I will encourage my boys to seek employment with Stone Pillar when they become of appropriate age. I know they'll learn the value of hard work and perhaps glean off some of George's entrepreneurial spirit. The point I'm getting to is that our community needs Stone Pillar as much as Stone Pillar needs community support. Olathe is a better place because of Stone Pillar. I think we Olatheans, should reciprocate support in approving their permit--and approve it for a long term. Allow them to continue the fun, relaxing, and enjoyable activities that make Stone Pillar the destination we love. Thank you for your consideration. This is such a wonderful addition to the Olathe area. We visited their winery last summer for the first time on a Friday night when we had some out of town guests visiting. We wanted something inexpensive and relaxing to do, but didn't want to drive into downtown KC, or to one of the outlying areas just to listen to the music at one of the many wineries. I participated in a grape stomping event once; and even though we didn't win, I had a great time that day. We have had groups include Stone Pillar in our wine tours. Local entertainment! Stone Pillar is a local business. When we can't buy electronics, some of our food and some of our cars, etc. with a USA source, we should value small local businesses over chains and imports. I have heard some of the neighbors don't like the noise. I remember feeling their wasn't anything to do in Olathe. I've lived here since 970 and the City of Olathe has done a good job of making Olathe livable. Local entertainment is part of "livable". Olathe has done a good job of attracting businesses to our area but there is always someone who will complain or want a berm built. You can't please all the people all of the time. My friends and I thoroughly enjoy the live music events and festivals hosted by Stone Pillar. We are committed to supporting local businesses, and believe that doing so is important to our community. I live close to the Stone Pillar in Stratton Oaks Villas. Part of the attraction of this venue is the proximity to my home. The employees at the winery are warm, friendly, welcoming individuals who have come to know us by name. There are a wide variety of events hosted at Stone Pillar all of which are tastefully done. The atmosphere on Friday evenings is suitable for families. Everyone I have met at the events have been polite, respectful, and friendly. Stone Pillar carefully monitors the volume of the music, and ensures that the events end on time. I have been a resident of Olathe since 986. I moved from the east side of town to Stratton Oaks on the west side of town in July of 204. I was excited to find that the winery is within an easy walk or bike ride from my current home. This past summer I was able to share the Stone Pillar experience with my uncles, sisters and their families who were visiting from the east coast. They, too, were impressed with the pleasant surroundings, the quality of the wine, and the welcoming staff. Having a place like Stone Pillar makes it possible for people to really enjoy being in Olathe! Please work to expedite the special use permit for Stone Pillar so we can all have another enjoyable summer there! A Special Use Permit makes perfect sense to me because Stone Pillar and its regularly scheduled activities such as: concerts, exercise events, couples activities, group painting events, ladies craft activities, food tasting vendors, charitable events, weddings, and local sporting activities are such a benefit to our community. My wife and I moved to the neighborhood of Fallbrook over one year ago, which is directly across the street from Stone Pillar, and the location of Stone Pillar was one of the deciding factors of us choosing Olathe and the neighborhood. Since we've moved in,we have been patrons of Stone Pillars concerts on numerous occasions. We've made new friends, met other families in our neighborhood, all while enjoying concerts, and in doing so; supported a vital local businesses and its workers. Stone Pillar is the first place we look to for out of town guest that visit to give them an experience of Olathe. A Special Use Permit is a step toward ensuring that Stone Pillar stays a viable business and venue in our community. A Special Use Permit makes good sense for, economic reasons, community relations, and for supporting a place where adults in our community can enjoy local art, music, and food. Businesses like Stone Pillar and the service they provide are essential to this community. When the benefits are so great and there is no harm done to existing businesses and/or neighbors, it makes good sense to support Stone Pillar and a Special Use Permit. We don't live far from Stone Pillar and it is a wonderful place to take visitor's when they come and are intrigued by the idea of Kansas wine. I know that the city also has it's Friday night concerts, but there's enough of us to go around and it's nice to have a choice of venues and music types. The Saturday and Sunday concerts are also important and fun on a warm summer's day. We need more live music as well as the work that gets accomplished when these concerts support charities such as those for pet rescues which are near and dear to our hearts. 119 3/2/6 Greg Bachman 445 Craig Overland Park Hi Jim, I am writing in support of the issuance of a special use permit for the Stone Pillar Winery. Specifically, I am strongly supporting a permit that will allow live music and festival type events at the winery. My motivation is based in multiple realities:. My grandmother and great grandfather were born on that particular property in 893 & 865 respectively. Also on that property during the civil war, my great great grandfather was struck down - but not killed- by Missourians seeking to impose their will on the residents of the new state of Kansas. Every time I go to one of the events at Stone Pillar it is a proud reminder of my family heritage. 2. That property has been associated with one family name, longer than any other property in the state of Kansas. Hoff is that name: the name on the stone pillar at the corner of College & Woodland. And the success of this small family agricultural business is in part dependent upon their ability to serve as such a unique venue. 3. I am a life-long Johnson County resident. The evening events at Stone Pillar Winery have created opportunities not elsewhere available in the county, for our friends and neighbors, and for my wife and me to relax, visit and socialize with friends from our church, (located in Olathe) both of our places of employment and old friends from college. These special events and festivals represent a valuable and wonderfully unique venue otherwise unavailable in our community. 5. In the late 70s I was visiting the farm during harvest one particularly sunny day when new suburban neighbors to the north came by complaining that the chaff from combining was blowing into the swimming pools and clogging their filters. At the time I laughed. But business models as well as communities and tastes evolve. And that is exactly what the Hoff family has done with their family business. Such evening events are a celebration of our roots as well as the fruition of family dreams: to deny a special use permit is to suggest that our dreams might best, be left to wither on the vine. To be clear, I have no financial interest or investment in the Winery. My grandmother sold her interest in the family farm to her youngest brother, Lucien Hoff, the grandfather of the Winery's owners, in the mid950s. Please support the renewed issuance of a special use permit for the Stone Pillar Winery. Better yet, I encourage you to propose an ordinance permanently exempting the winery from having to regularly endure such a perpetual challenge to their very common business model. Sincerely, Gary E. As a resident of Olathe, and a neighbor of the winery, I can say without a doubt that I feel the winery is an asset to our community and the city at large. We love telling people where we live - across from the winery! Stone Pillar offers a unique recreational opportunity for residents to enjoy music, food and friendship! We have many times walked across the street to hear the music on Friday nights. It is rare to find these kind of venues out in the suburbs and we should do everything we can to keep it around. I am sorry to hear that a few (grumpy) neighbors have an issue with the "noise". I for one love to hear the (very faint) sounds coming from the winery on a Friday night if I am home with the windows open. The quality of musicians that the winery is able to draw is amazing as well which is a testament to its popularity among residents. I attend the concerts both as a customer of the winery and as a performer with my band Landrush. I both live and work within 0 miles of the winery, and we are always seeking fun and entertaining social events within the community to attend with our friends and family. The summer concert series is perfect for that. Without events like these, we would have to drive to downtown Kansas City to find fun outdoor live music. I would rather spend my entertainment dollars somewhere close to home. The city of Olathe is particularly lacking in entertainment venues. As a performer, I find Stone Pillar as a venue to be wholesome and refreshing. Although I'm happy to have the support of local bars as a performer of live music, personally I'd rather be outside in a relaxed and beautiful environment. Playing there for several years has been an absolute pleasure. George Hoff takes the city's noise requirements very seriously, checking our decibels before and during each performance. I have to say, we have never played in ANY other venue where our decibels have had to be checked. We work with many other venues in Johnson County, and Olathe has been the only city to have any problems like this. It's sad that the city can't stand up to a few naysayers in order to support a local venue that meets the greater needs of the community. Dan, It has come to mine and my families attention that the city of Olathe is looking to reduce the hours Stone Pillar Winery is able to provide their summer Friday night concerts. I would sincerely hope you would reconsider yours and the Olathe City board's decision. Let me tell you how my wife and I became familiar with the winery. I am a small business owner in Shawnee and my wife and I ride motorcycle to escape business and all the demands placed on small businesses today. One Friday night last summer, 205, my wife and I had gone for a ride with my accountant and his wife. We had eaten dinner and wondered what our next destination would be. My wife suggested a winery she had heard about in Olathe. We rode up, parked and were instantly greeted and had some wonderful conversations through the night with various people. On of the guys we met was a paramedic who worked with a close friend of ours in Lawrence. The music was relaxing, the people nice and the conversations were a marvelous way to start the weekend. Since that first night my wife and I have been back several times and even joined in on the Fall harvest. We have made plans to return with our accountant friend and his wife, and I've talked with my sister and her husband, along with my folks. Stoney Pillar is a great place to start the weekend. It would be a shame to cut back their usage and limit their, and ultimately Olathe's, outreach into the KC metro area. Oh, and by the way, the first Chris Houser ~

We live less than mile from the winery and go there at least once a week. Our family greatly enjoys visiting wineries both in Kansas and out of state. However, out of all the wineries we have been to in the local area, Stone Pillar is by far our favorite. The staff are incredibly friendly and knowledgeable. They have a great selection of wine and a beautiful property. We are greatly looking forward to the Friday night music this year, as well as the acoustic music on Sundays. It is my hope that amplified music will continue to be allowed on the grounds. We have thought about renting the Stone Pillar Pavilion before, however, if there is no amplified music, it would make any event we want to host very difficult. Stone Pillar is an important part of our local community. We recommend a renewal of their Special Use Permit with the City of Olathe so we can continue to enjoy the events that the winery offers.
