1 OXFORD BOROUGH COUNCIL MEETING September 20, 2012 The meeting of Borough Council was held on September 20, 2012 at the Borough Municipal Building. The meeting was called to order by Vice President Andrews at 7 p.m. Vice President Andrews then led Council in the Pledge of Allegiance which was followed by a moment of silence. IN ATTENDANCE Mrs. Andrews, Vice President Mr. Cole Member Mrs. Lombardi, Member Mr. Henry, Mayor (Arrived at 7:08 p.m.) NOT IN ATTENDANCE Mr. Hershey, President Mr. Saranetz, Member Mr. Teel, Member Ms. Brantner, Secretary Mr. Thompson, Member SCHEDULED VISITORS There were no scheduled visitors. AGENDA ADOPTION Mrs. Lombardi made a motion to adopt the agenda; Mr. Cole seconded the motion. Motion carried to adopt agenda. PUBLIC COMMENT Ashton Dorety Mr. Dorety asked Ms. Brantner if she had spoken to the lady from the school regarding the mural painting. Ms. Brantner said she called on Tuesday and she returned her call. She has left her a few messages but has not heard back from her yet. Ms. Brantner took her address. REPORT OF THE MAYOR Mayor Henry said he needed approval for 33 ½ hours of overtime. Mayor Henry gave his report on accidents, incidents, citations and fees collected for the month of August. Mr. Cole made a motion to approve the 33 ½ hours of overtime; Mr. Saranetz seconded the motion. Motion carried. Mr. Cole made a motion to approve the Mayor s Report; Mrs. Lombardi seconded the motion. Motion carried. COUNCIL COMMITTEE REPORTS

2 Codes Committee Mr. Cole said that a meeting was not held. Finance and Personnel Mrs. Andrews said a formal meeting was not held. Police and Public Safety Mr. Saranetz said there were no major decisions and everything you see in the report was discussed. He mentioned the Radar Speed Analysis Recorder had to be returned to the manufacturer for a warranty repair. The OMI 5K Run will be held on Sept. 29th and will require a full department detail. Chief Slauch attended the Dedication Ceremony for the new Chester County Emergency Services Training Center on September 9th in Coatesville. Mr. Saranetz said Chief Slauch, along with DA Tom Hogan and ADA Michelle Fry, will be recognized by the Domestic Violence Center at their annual event on Oct. 9th at the Methodist Church in West Chester. He mentioned that David Larson, resident attended their meeting and thanked the police for trying to curb speeding along S. 5th Street. Local Traffic Advisory Committee A meeting was not held. Public Works A meeting was not held. Special Projects A meeting was not held. Planning Commission (June 26, 2012) Minutes of June 26th were submitted for review. Historical Commission Minutes of May 9, July 11 and August 8, 2012 submitted for Council s review. Chief s Activity Report Not submitted. Public Works Supervisor s Report Report submitted for review. Oxford Borough Workplace Safety Committee Report Minutes submitted for review. Union Fire Company Report (July and August) Reports submitted for review. There were some questions on the reports. The Fire Company will be contacted regarding the questions. Oxford Area Recreational Authority No report submitted. Mr. Saranetz made a motion to accept the reports; Mr. Cole seconded the motion. Motion carried. BUSINESS CARRIED FORWARD Approval of Ware Presbyterian Village Expansion Resolution - # Mr. Saranetz said that they made their recommendation at the August 28, 2012 Planning Commission meeting to approve the Final Land Development Plan for Expansion of Ware Presbyterian Village contingent upon the items of the SSM letter of August 13, He made a motion to accept the Final Land Development Plan for the Expansion of Ware Presbyterian Village and to adopt Resolution # specifying that the Final Land Development Plan has been accepted; Mr. Cole seconded the motion. Mr. Saranetz amended his motion and added the approval was contingent upon Items 4, 5, 6, 9,10, 11, 12, 13, 14, 15, & 16 in the letter from SSM dated August 13, Motion carried. Petro Vend Fuel Management System Ms. Brantner said John Schaible had come in and spoke to Council regarding this purchase. Ms. Brantner referenced an from Stacey Fuller to John Schaible which said it was fine to proceed with your recommendation to Council for approval of the $17, proposal. There was a question about whether that had to be bid out but it is under the new $18, bid amount. Mr. Saranetz asked if there was a purchase order for the system. Ms. Brantner said the purchase order will be done after the purchase is approved. Ms. Brantner said this system will give us a better accounting of our fuel. Mrs. Lombardi said this will benefit both the Police and Public Works. Mrs. Andrews said it will also give us a better tracking system. Mr. Teel asked what we are paying per gallon. Ms. Brantner said she would have to check with Mrs. Anderson. Mr. Teel said with all the liabilities with fuel storage is it more feasible for us to use local services. Mrs. Lombardi said we had that conversation at Police and Public Safety meeting. They came to the conclusion that this system made more sense. Ms. Brantner said it is more feasible because you can t get all the vehicles, the lawn mowers, front end loaders, etc. into a gas station, plus we can get a better rate then we could at a gas station. Mr. Teel asked what the cost was the last time to move the tanks. Ms.

3 Brantner said she did not know that figure since that was over five years ago. She said that is when L&I came through and they approved the move. The money for the purchase will be coming from the Gift Fund. Mrs. Lombardi made a motion to approve the Petro Vend Fuel Management System in the amount of $17, Mr. Saranetz asked if this included installation. A lengthy discussion ensued. Ms. Ms. Brantner said if you are not certain about it we can carry it over. Mr. Teel said he would like to see us do that. Ms. Brantner said John did speak to Council about this previously. Ms. Brantner said she thought John Schaible would prefer to come back in if there are still questions. Item carried forward. Water Department Monitoring Upgrade Ms. Brantner said Jim Seeley did explain the Water Department Monitoring Upgrade on September 17th but several Council members were not in attendance. Ms. Brantner said we are not able to find replacement parts for the system we now have. Mr. Saranetz said he would like to take more time to review this. He said his concern is that it is relying on a cloud base computer. He thinks there is a possibility we could lose a significant amount of data. Ms. Brantner said we can ask Mr. Seeley to come back and speak with Council. Mr. Teel asked if he could bring a cost analysis sheet if he does come back. Ms. Brantner said he did have all that the last time. Item carried forward. NEW ITEMS OF BUSINESS 2013 Minimum Municipal Obligation Ms. Brantner said this is the amount we are responsible for paying towards the Borough of Oxford Police Pension; and the Non-Uniformed Employees Money Purchase Pension Plan. Mrs. Andrews said Council reviewed the 2013 Minimum Municipal Obligation for the Borough of Oxford Pension Plans. Act 205 of 1984 requires the chief administrative officer of the pension plans inform the governing board of the municipality of the Minimum Municipal Obligation for the following year by the last business day in September. It was noted it should read 2013 Minimum Municipal Obligation on the Police Pension Revised, not Mrs. Lombardi made a motion to approve the 2013 Minimum Municipal Obligation, with the correction made to read 2013 on the Police Pension Revised; Mr. Cole seconded the motion. Motion carried. Oxford Area Community Enhancements 3rd Annual Free Veteran s Breakfast Contribution Request Ms. Brantner said they are asking if the Borough would like to donate any money to this event. She noted the event had grown considerably. Mayor Henry asked if we contributed last year. Ms. Brantner said she thought people donated individually last year. Mr. Teel said they had a much better turnout. Ms. Brantner said Mr. McCoury was in the other day to discuss this and said they had reached out to people from other areas. He said they have people already calling in to make reservations and they expect about 200. Mr. Teel said he thought we were just having local people. Mr. Cole asked how everyone felt about it. Mrs. Andrews said she felt we should do something. Mr. Teel said he thinks this would be a good gesture and he is on this committee. He said he does not want to see a situation where we have excess funds and it has to be held year after year. He said if they get too much money donated they will have a fund that has to be monitored. Mayor Henry asked if the extra money would go into the Oxford Area Community Enhancements treasury. Mr. Teel said that is what he assumes. Mr. Cole asked if $500 would be too little. Mr. Teel said if they wanted to wait till next month after the next meeting he would be able to get more information. Members agreed they would like to donate something. Permission to Advertise Ordinance Amending Chapter 15, regarding Metered Parking Ms. Brantner said this is for parking off of Broad Street. Mr. Cole made a motion to advertise the ordinance amending Chapter 15, regarding Metered Parking; Mrs. Lombardi seconded the motion. Motion carried. Ms. Brantner mentioned this also included Niblock Alley. HD Supply Waterworks Water Dept. PO # Water Meters - $2, Ms. Brantner said the purchase order is for water meters. She said the money is in the budget and they are continuing to upgrade

4 water meters. Mr. Cole made a motion to approve PO # in the amount of $2, for water meters; Mr. Saranetz seconded the motion. Motion carried. Approval to Advertise Public Notice of BID Renewal Hearing October 15 at Ware Village (Chapel) Ms. Brantner said this is a Hearing that we have along with our Council meeting. She expects to have a larger audience so we are holding it at Ware Presbyterian Village Chapel. Ms. Brantner said it is a required Hearing for the renewal of the bid. Mr. Cole made a motion to approve the advertisement of a Public Notice for the BID Renewal Hearing and Council meeting on October 15, 2012; Mr. Teel seconded the motion. Motion carried. DISCUSSION ITEMS There were no Discussion Items. PUBLIC COMMENT Ashton Dorety Mr. Dorety wanted to know if there was anyone looking into the Slow Bump signs on North Third Street. He noted Mr. Ware sent a letter regarding this to the Borough about two months ago. Mr. Saranetz said the matter was put forth in front of John Thompson and the LTAC Committee. He said unfortunately he has been away and LTAC has not been able to meet. Mr. Saranetz asked why the storm drain cannot be raised. Mr. Teel said it is a state road and there are regulations as to how it is supposed to be set so that it does not run over. Mr. Dorety asked how pedestrians are supposed to cross the road to Wal-Mart. Mr. Teel said there are no pedestrian cross-walks at Wal-Mart. Mr. Teel said there is a sign saying no pedestrian crossing. It is illegal. PRESIDENT S COMMENTS Vice President Andrews had no comments. MAYOR S COMMENTS Mayor Henry said that last night at the Town Watch meeting Officer Coverly did an excellent presentation on what appears to be an increase in organized fighting within the Borough. He showed some pretty heart wrenching videos. He said it does not only involve young people, but parents and adults. Mayor Henry said that Officer Coverly hopes that if you see something that does not look right to please call the Police. The Mayor said he knows people are afraid to call 911 if it is not a true emergency. He said they can call It is the same switch board that answers 911 calls, but in a different fashion. Mayor Henry said Officer Coverly told him that when an Officer responds to a call the average time spent is approximately 45 minutes. Mayor Henry said some are longer, some shorter. He said the police are spending an average, of about 51 minutes per call. He said if you take 300 calls a month times 51 minutes it is approximately 300 hours a month spent on responding to calls. Mayor Henry said that Officer Coverly did an excellent presentation. Ms. Brantner asked if a presentation similar to this could be done here on Borough Day. Mayor Henry said they could probably do something here. Mayor Henry said there was a bomb scare at Penn s Grove yesterday and the school was evacuated. He said bomb sniffing dogs were brought in. He said it was an expensive prank that someone had played. An intruder event was held at Penn s Grove to give everyone an idea of what would happen if there was to be an intruder. Mr. Cole asked if the fighting was gang related. Mayor Henry said the fights are organized but it does not appear to be gang related. Mayor Henry said at one of the fights when the police showed up a juvenile started running away; Officer Coverly finally did catch him. He was told the next day that at times the individual that

5 ran away was known to carry a weapon. Mayor Henry again encouraged all to call the Police if they see anything suspicious. Ms. Brantner said she does call 911 and she said they respond in minutes. Mr. Saranetz asked if it would be possible for Officer Coverly to do a presentation at the Oct. 15th meeting at Ware because a large attendance is expected. Members said this is expected to be a long meeting. BOROUGH MANAGER S REPORT Ms. Brantner said she had no comments. Her report was enclosed. EXECUTIVE SESSION Council went into Executive Session at 8:19 p.m. to discuss the Police Contract, Non-Uniformed Contract; Artemis Anderson s Contract and a Police Pension matter. Mayor Henry excused himself from the Executive Session. Council came out of Executive Session at 8:47 p.m. No decisions were made. Ms. Brantner said Borough Day will be set up the first Monday in December to give the public the opportunity to come in and look at the budget. The public has so many days to review it. Borough Day is held from 7:30 a.m. to 7:30 p.m. at night. Ms. Brantner said the art teacher had called her. She said she called her back at school twice and tried another number. Mrs. Lombardi said it is hard to reach teachers during the day. ADJOURNMENT Mrs. Lombardi made a motion to adjourn at 8:50 p.m.; Mr. Cole seconded the motion. Motion carried.
