1 WORKLOAD RESOURCES 1. Amend Article Departmental co-ordination and program committee as set out in Appendix A. 2. Amend Article Teaching Load as set out in Appendix B. 3. Add teaching resources (Type 1). These resources must be used for the purposes for which they are allocated. See Appendix C for the resources added in each year of the collective agreement for the headings mentioned therein. For , the provincial parties agree to establish transitional measures in accordance with colleges undertakings resulting from federal transfers (92 FTEs). For , the provincial parties agree to change the weekly student period coefficient (PES, for période élève-semaine) from 0.04 to 0.05 for teachers with a weekly student period value equal to or greater than Departmental and program co-ordination - replace 19 with 18 in the 2 nd paragraph; - replace 5 with 5.5 in the 3 rd paragraph. These changes are applicable as of Committee for follow-up on resources under point 3: mandate the advisory committee on teaching loads (CCT, for Comité consultative sur la tâche) provided for in to: distribute the new Type 1 resources added (with the exception of the 92 FTEs for under point 3) among colleges no later than March 31 of each year; follow up on the Type 1 resources allocated for each year, review problems submitted by the provincial parties and make recommendations; distribute uncommitted resources each year. 6. Appendix I-9 Letter of agreement on guarantees Adjust the Letter of agreement on guarantees to take into account the additional resources allocated for each year covered by the collective agreement, for all Types set out in clause (FEC) or (FNEEQ). For , the Ministry undertakes that when the Budget Appendix (SO26) entitled Consolidation de l offre de formation (Consolidation of training offered), used to support programs with small enrolments (small cohorts), is applied to data, it will generate at least FTEs, to which will be added 31 FTEs. For each year of the collective agreement starting in , the Ministry undertakes that when the Budget Appendix (SO26) entitled Consolidation de l offre de formation, used to support programs with small enrolments (small cohorts), is applied to data, it will generate at least FTEs, to which will be added 55 FTEs. Appendix I-2 FTE allocation for each Type of workload: review of the distribution of fixed resources between Types 1 and 2 for colleges where the union was previously affiliated with the FAC: In order to take into account the distribution of activities and associated resources among the various Types, withdraw the fixed resources for supervision (Pi EN) from Type 1 and transfer them to Type 2 in Appendix I Funding method - mandate the provincial committee (CNR Comité national de rencontre) provided for in clause to: examine the funding method set out in clause , in particular the variable resources for Type 1; - report on its work to the Minister no more than 24 months after the collective agreement is signed. 9. Application of clause : mandate the provincial committee (CNR Comité national de rencontre) provided for in clause to: examine problem situations in certain CEGEPs at the request of either provincial party and, if need be, make the appropriate recommendations to the provincial parties. 10. Emerging clientele: mandate the provincial committee (CNR Comité national de rencontre) provided for in clause to: analyse the issue of students with special needs (students with pervasive developmental disorders, behavioural disorders, learning disorders, mental health problems or attention deficit disorders with or without hyperactivity (ADD/ADHD), and students with disabilities, in particular visual or hearing disabilities) and its impact on teaching loads; - make recommendations to their respective parties no more than 12 months after the collective agreement is signed. 11. Recognition of course equivalencies: mandate the provincial committee (CNR Comité national de rencontre) provided for in clause the following mandate: analyse current practices with respect to recognition of course equivalencies (REC reconnaissance des equivalences de cours) with a view to determining what the role of teaching personnel should be; - make recommendations to their respective parties no more than 18 months after the collective agreement is signed. Nursing clinical teaching: mandate the advisory committee on teaching loads (CCT) provided for in clause to: propose one or more models for calculating an individual teaching load (CI) adapted to the realities of teaching, especially clinical teaching, in nursing; analyse the issue of field placements (or internships) in nursing, in particular orientation days; - make recommendations to their respective parties no more than 18 months after the collective agreement is signed. Complex health technology programs: mandate the advisory committee on teaching loads (CCT) provided for in clause to: examine the specific characteristics of clinical teaching in complex health technologies (radiodiagnosis, radiation oncology, emergency pre-hospital care, nuclear medicine, medical electro-physiology, etc.) and if need be report on problems observed in relation to the supervision of field placements (or internships) and their impact on teachers teaching loads. - make recommendations to their respective parties no more than 18 months after the collective agreement is signed. 14. École des pêches et de l aquaculture du Québec: mandate the advisory committee on teaching loads (CCT) provided for in clause to: analyse the working conditions of teachers at the École des pêches et de l aquaculture du Québec who work on the training ship. 15. Updating of terms of reference given to the provincial committee (CNR) and the advisory committee on teaching loads (CCT) in the collective agreement Clause provincial committee (CNR): withdraw c) and d) from the terms of reference; Clause continue the terms of reference concerning small cohorts, in accordance with Letter of Agreement no. 14; Clause advisory committee on teaching loads (CCT): withdraw d) and e) from the terms of reference. 16. Report on use of resources The report on the use of resources is presented by discipline for each of the Types and for column D (as is done in the Statement of use). 17. Terrebonne Starting in , withdraw Terrebonne from the list of small teaching units so that it is covered by the guarantee (clause ). Starting in , Appendix I-2: replace 1.85 FTEs with 1.35 FTEs for Type 2 resources. 18. Ad hoc committee Cégep de l Abitibi-Témiscamingue Appendix III-2 Within thirty (30) days of the agreement in principle, review the distribution of resources allocated for the organization of regular teaching in the context of regionalization at the Cégep de l Abitibi-Témiscamingue. 19. Calculation of seniority and the seniority list Article Issue a single seniority list on October 15 of each year, valid for one year (12 months). The seniority recognized in the seniority for the previous year; the list includes everything done (actual seniority based on services rendered) except for supply teaching paid at an hourly rate (short-term supply teaching). Seniority of newly hired teachers is determined by their date of hiring, regardless of teaching loads, until the next seniority list is published. June 13, :30 p.m. page 3
4 20. Calculation of experience Article Amend clause on the calculation of professional or industrial experience and the calculation of experience in college teaching as follows: 1. Withdraw the rule providing for the calculation of one year of experience for every two (2) years after 10 so as to calculate each year of relevant professional or industrial experience. 2. Withdraw the rule stipulating that only whole numbers are taken into account, so as to include fractions of a year of professional or industrial experience in the experience that is recognized. 3. Amend the rule on the number of hours per day: seven (7) hours instead of eight (8), when experience is given in weeks, days or hours. 4. For college teaching experience, convert the current rule of 90 and 135 days into FTEs as follows: o Recognized experience is calculated by hiring year. o If a teacher reaches 0.75 FTE, one year of experience is recognized; if, however, a reaches less than 0.5 FTE, he or she advances to the next step, but must reach 0.75 FTE before accumulating another year of experience. o If a teacher accumulates more than 0.75 FTE in a given year of teaching, no more than one year is recognized. o For sessional lecturers, 0.5 FTE equals 262 periods (525 periods/2). CONTINUING EDUCATION 21. Continuing education: mandate the provincial committee (CNR) provided for in clause to: analyse the current practice of teachers in continuing education covered by clause , taking into account the specific organizational, structural and pedagogical characteristics of this sector and the ensuing working conditions; - inform the provincial parties of the progress in the work by June 15, 2011 at the latest and give them a report by April 15, 2013 at the latest. analyse current practices with respect to prior learning and skills assessment in order to determine what the role of teaching personnel should be; - make recommendations to their respective parties no more than 18 months after the collective agreement is signed. JOB SECURITY 22. Salary protection for teachers on availability I) Salary protection is reduced to 60% for a teacher on availability who is eligible for retirement without penalty. Amend the provisions of clause Retraining for a reserved position as follows: a) The maximum length of retraining is 8 sessions. b) A tenured teacher not on availability who obtains retraining for a reserved position exchanges his or her status with a teacher on availability and remains on availability, if need be, with the ensuing obligations. c) At the end of the retraining, the teacher must fill the reserved position for a length of time equal to the length of the retraining, failing which he or she must reimburse 20% of the salary received for each of the sessions involved in the retraining, for a period equal to the length of time that he or she did not fill the reserved position. d) If the retraining is interrupted during the first year, no reimbursement is required for the first two sessions; for subsequent years, if a teacher placed on availability interrupts the retraining, he or she must then reimburse 20% of the salary received for each of the sessions involved in the retraining, for a period of time equal to the length of the retraining. 24. Article The provisions of Article on obtaining leave for earning a degree giving the holder access to the Master s salary scale and Step 18 must be amended in clause to stipulate that the teacher undertakes to provide services in his or her or another college in the network for a length of time equal to the planned length of training, failing which he or she will have to pay back the salary received in accordance with the current terms and conditions for paid professional development leave (clause ). 25. Retraining for a reserved position concerning the total number of teachers in retraining under clause C) in a given year for teachers unions previously affiliated with the FAC and now affiliated with the FNEEQ: A total number of 5.85 FTEs. or 78% of 7.5 FTEs, a year is maintained for retraining plans for a reserved position under clause The remaining resources provided under clause that can be used for the purposes of clause , are to be granted in accordance with the terms and conditions specified in Letter of Agreement no. 13, that is, 78% if the balance remaining on the date the collective agreement is signed. OTHER MATTERS 26. Sending notice and publication Recognize as valid written notice under the collective agreement sent electronically, such as by fax or . Amend clause on costs for printing, distributing and translating the collective agreement, as follows: o The employer party pays printing and distribution costs for two hundred (200) copies of the collective agreement for the provincial union party and for a number of copies for each local union equal to 10% of FTEs in , or a minimum of 10 copies for colleges with 100 or fewer FTEs. o The provincial employer party pays the cost of translating the collective agreement. 6 o Savings generated as a result of changes to clause of the collective agreement are converted into FTEs for the purposes of provincial leave for union work, based on the average salary in force in the network, for one year only. Make the collective agreement and letters of agreement available on the CPNC web site. 27. Arbitration Amend clause of the collective agreement to make it valid to send notice of arbitration via the on-line Arbitration Roll (Greffe). Following the integration of unions previously affiliated with the FAC, a total of twenty (20) days a year is added to the number of days of hearings provided for in clause Re-wording of Within sixty (60) days of the date on which the collective agreement is signed, some of the wording in the article on terms and conditions of job security is to be re-written to make it easier to understand. 29. Introduction of certain appendices in the FAC collective agreement for colleges whose union was previously affiliated with the FAC: o Appendix I-5 Pavilions and sub-centres o Appendix III-2 Appendix concerning the Collége de l Abitibi-Témiscamingue o Appendix III-4 Appendix concerning the Cégep de la Gaspésie et des Îles o Appendix III-5 Appendix concerning the Centre d études collégiales en Charlevoix o Appendix III-7 Appendix concerning the Centre linguistique du Collége de Jonquière 30. Professional development following the integration of unions previously affiliated with the FAC: Considering the number of FTEs in all colleges where the union is affiliated with the FNEEQ and the number of FTEs in all colleges where the union was affiliated with the FAC and is now affiliated with the FNEEQ, for , and considering the amount now budgeted for professional development for the FNEEQ ($195) and the FAC ($190), and considering the amount now allocated to the provincial professional development fund for the FNEEQ ($40) and the FAC ($55), starting in , the current total amount budgeted for professional development for all the colleges concerned will be $237 per FTE, and the amount will be distributed between the two (2) funds as follows: - $195 per FTE allocated to each college; - $42 per FTE allocated to the provincial professional development fund. Family-work balance Special leave and family responsibilities Amend this article to include a clause on leave for family responsibilities in accordance with Sections 79.7 and 79.8 and following (79.9 to 79.12) of the Act respecting labour standards, and in accordance with the joint recommendations from the Joint technical committee on parental rights. 32. Remuneration For the first four steps of the pay scale, the length of time spent at that step is set at 6 months (clause ). N.B.: For all the amended articles that involve local clauses, the amended wording is preceded by: The provincial parties recommend that the local parties amend local provisions as follows:. 8 Article Departmental co-ordination and program committee All resources allocated for departmental co-ordination are set out in article Program committee a) The Parties agree on the creation of a program committee for each of the programs of study leading to a DEC offered by the College. The committee includes teachers in disciplines taught in the program. The committee may also include members from other classes of personnel. Teachers on the committee are appointed by their department. b) The committee s terms of reference are to: define its internal rules and set up such committees as may be necessary; ensure the quality and educational harmonization of the program, the integration of learning and interdisciplinary consistency; participate in the development, implementation and evaluation of the program; make any recommendations that are likely to improve the quality of the program; develop guidelines for the comprehensive assessment; submit a work plan and file an annual report. c) The committee appoints a program committee co-ordinator. Generally speaking, this person is a teacher on the program committee. The College may remove the program committee co-ordinator from office for good reason. d) The program committee co-ordinator does the following: organizes and facilitates meetings; ensures follow-up on the work of the committee and any sub-committees; ensures the communications necessary to fulfilling the program committee s terms of reference with the CEGEP, departments, other bodies, individuals or groups outside the program; participates in program co-ordinators meetings, in accordance with local practices; writes up the work plan and annual report. If necessary, this work is done by the co-ordinator of the Co-ordinating Table (Table de concertation) or the General Education Committee (Comité de la formation générale), with the necessary adjustments. The following provisions are part of a recommendation made jointly by the Fédération des cégeps and the FNEEQ (CSN) and are subject to the application of Section 59 of Bill 37, if agreed upon and signed by the local parties For the purposes of this collective agreement, a department consists of all teachers in regular education in one or more disciplines at a given college or campus The criteria for creating and deciding on the number of departments are established by the College after consultation with the Commission pédagogique. 9 In carrying out its responsibilities, the departmental meeting takes into account the strategic development plan (which includes the institutional educational success plan). The responsibilities of the departmental meeting are as follows: 1. Responsibilities complementary to the work of the program committees in which its discipline participates: 1.1 Give advice to the program committees in which its discipline participates or contributes. 1.2 Designate the teachers who are to sit on the program committees in which its discipline participates or contributes. If need be, a teacher in shared general education who is a member of a co-ordinating table (Table de concertation) or a general education committee (Comité de la formation générale) may play the above-mentioned role, with the necessary adjustments. 2. Responsibilities stemming from academic administration related to teaching of its discipline: 2.1 Define the department s internal rules and set up committees, if appropriate. 2.2 Distribute and weight academic activities, including teaching loads, in accordance with allocated resources and activities related to professional services rendered. 2.3 Designate the teachers who are to sit on selection committees in regular education in accordance with Article as well as the teacher called upon to participate in the selection process for continuing education in accordance with Article Designate the teachers who are to sit on MELS committees and advise the College thereof. 2.5 Make recommendations to the College on the choice of complementary courses. 2.6 Make recommendations to the College and the Commission pédagogique, if applicable, on special conditions of admission for students in the framework of the general conditions set by the College Education Regulations (CER). 2.7 Give its opinion on retraining plans in the case of retraining for a reserved position. 2.8 Make recommendations the professional development committee on applications submitted b teaching personnel. 2.9 Analyse needs for human, material and technological resources and make recommendations on hiring support staff (e.g., practical work technician, equipment set-up worker to be validated when written up) or purchasing materials Participate in preparing the department s projected budget Make a recommendation to the College and the Commission pédagogique on a policy aimed at having departmental resources benefit the region Develop an annual work plan, help carry it out and report on it annually Define objectives, apply teaching methods and establish evaluation methods for each of the courses for which the department is responsible, taking into account the Institutional Student Evaluation Policy Approve the course plans prepared by members of the department. 10 2.15 Make recommendations to the College or the Commission pédagogique likely to improve the quality of teaching in its discipline Select locations for field placements (or internships) and share in responsibility for their practical organization In the framework of professional services rendered, research and establish supervision strategies with a view to improving students success, taking into account the institutional success plan Provide professional assistance to new teachers By April 1 at the latest, teachers in a department must designate, using their own procedure, the departmental co-ordinator for the following teaching year. If need be, they designate other teachers in the department to be in charge of specific activities among those listed in clause In such a case, the department may distribute the leave provided for under clause accordingly. The department informs the College of the name of its co-ordinator and the other teachers designated, if any Should teachers in a department fail to designate a departmental co-ordinator, the College takes on this role directly and clauses and do not apply for that department. The College may revoke a co-ordinator for good reason. The College may also remove a co-ordinator at the department s request. The parties may agree on the designation of a person to act as trustee. They then agree on the use of the amounts coming from the allowance for departmental co-ordination purposes The departmental co-ordinator is a teacher who is employed by the College at the time he or she begins work in this position. Designating a teacher on availability or without tenure may not, however, result in exceeding the number of teachers allocated for the department s discipline or disciplines The departmental co-ordinator is appointed for a term of one (1) year, which may be renewed The departmental co-ordinator co-ordinates the activities required to fulfil the department s responsibilities as set out in clause and performs the administrative duties inherent in his or her position. To this end, the co-ordinator performs the following specific duties. In the framework of activities related to internal governance, the co-ordinator: 1. organizes and facilitates departmental meetings; 2. enforces departmental rules, taking institutional policies into account; 3. prepares for submission to the departmental meeting a plan for the distribution of teaching loads and activities related to professional services rendered within the norms set by the collective agreement and the College; 4. facilitates the circulation of information and communications among members of the department; 5. forwards requests from the department to various levels and bodies of the College or outside organizations. 6. follows up on the various requests to the department from students, individuals or outside organizations, in accordance with departmental policy. 11 In the framework of activities related to teaching, the co-ordinator: 1. follows up as necessary for the establishment of activities for the intake and integration of studies in the framework of professional services rendered; 2. sees to it that course plans are approved; 3. does the follow-up needed to ensure that everything related to course delivery, evaluation procedures, requirements for rooms and equipment, schedules and field placements (or internships) happens; 4. does the follow-up needed to establish activities providing assistance towards success in the framework of professional services rendered. In the framework of activities related to the budget and material resources, the co-ordinator: 1. helps prepare budgets; 2. administers the department s operating and capital budgets; 3. recommends purchases of teaching and instructional materials (books, journals, DVDs, etc.) and proceeds with purchase orders in the absence of technical personnel; 4. does follow-up on renovation projects, defines needs for specialized rooms and the physical organization of laboratories. In the framework of activities related to peer relations, the co-ordinator: 1. ensures that teachers having problems receive assistance; 2. does follow-up to ensure that professional assistance is provided to new teachers. In the framework of activities related to relations with the College, the co-ordinator: 1. participates, in accordance with local practices, in the meeting of departmental co-ordinators. 2. Follows up with the Academic Dean (Direction des etudes) on the following departmental activities: a) distributing and weighting teaching activities within the norms set by the collective agreement and the College; b) ensuring that objectives are defined, teaching methods applied and evaluation methods established for each course for which the department is responsible, taking into account the Institutional Student Evaluation Policy; c) ensuring that all courses for which the department is responsible are given and ensuring their quality and content; d) developing the department s budget projections; e) examining, establishing and maintaining, as needed, the appropriate relations with institutions, organizations and businesses, taking into account the means and resources made available to it by the College; f) setting up a review committee composed of three (3) people, including the teacher concerned, authorized to alter, if appropriate, a student s final grade; g) developing the department s annual work plan, seeing that it is followed and making an annual report on departmental activities The co-ordinator forwards the department s annual work plan and report to the College. The information contained in these documents may not be used to evaluate teachers. The department s annual report sets out: activities in the work plan, which specifies the methods or resources put in place to implement them; adjustments required in the course of implementing them; relevant recommendations; the information stipulated in d). 12 Hospitals or clinical fields are chosen in conjunction with the departments concerned; the same goes for the practical organization of field placements (or internships) a) For the purposes of this article, the College gives leave to full-time teachers or the equivalent resulting from the application of clause to take on the workload of departmental co-ordinator and the co-ordination of departments delivering vocational training in the form of internships or workshops as provided for in the Cahiers de l enseignement collégial, subject to clause b) The College distributes the reduction in workload resulting from paragraph a) of this clause after submitting the matter to the Labour Relations Committee (CRT Comité des relations du travail). This reduction may vary from one department to another. June 13, :30 p.m. page 12
13 APPENDIX B Article Teaching Load A) Type 1 The teaching load for each teacher includes all activities inherent in teaching, in particular: preparation of the course outline; preparation of classes, labs and field placements (or internships); teaching of classes, labs and field placements (or internships); adaptation; support and supervision of students; preparation, invigilation and marking of examinations; review of marking at a student s request; participation in professional development days organized by the College; participation in departmental meetings and in the activities required for the accomplishment of departmental functions. B) Type 2 return to the status quo C) Type 3 return to the status quo Amendment to clause Professional services rendered... d) The time spent on a teaching activity includes preparation, implementation and follow-up on the activity. At the end of each year, each teacher informs members of the department about the teaching activities carried out in order to assess the consequences and make recommendations.
