Members Present: Bruce Burrows, Mayor David Gibby, Councilor Doug Peterson, Councilor Gary Griffiths, Councilor Shelly Jenkins, Councilor Don Hunt, Councilor Others Present: Larry Hansen, Chief Administrative Officer; Steve Brooks, City Attorney; Randy Daily, Community Development Director; Doug Illum, Fire Chief; Jeannette Hall, Community Services Director; Marilyn Banasky, City Recorder; other city staff and 9 citizens. A. Welcome & Roll Call Mayor Burrows called the meeting to order and welcomed all those present. He noted that all Councilmembers were present. B. Pledge of Allegiance Councilor Jenkins offered the Pledge of Allegiance. Mayor Burrows read a quote from James Madison. C. Moment of Silence Mayor Burrow s quote was followed by a Moment of Silence. D. Open Communications Steve Carruth stated that he would like to register a complaint of nuisance regarding the Sanders Brine Shrimp Company that he and his fellow citizens have numerous concerns about. He reported that he spoke with Randy Daily and is now bringing his concerns forward to the Mayor and Council. Mayor Burrows stated that there have been previous conversations regarding this business. He reported that the City has met with the owners to resolve some of the neighborhood concerns and thought they had resolved those issues. Mr. Carruth reported that the issues have not been resolved to their expectations. Mayor Burrows asked Mr. Carruth to register the actual complaint with Mr. Daily and let his department follow through. Stacey Haws stated that he would to comment on the field rental fee that will be discussed tonight. He feels that the City fields are small and are not in good enough condition to rent out. He explained that because the fields are small that only youth games could be played on them. He reported that he finds it interesting that the City wants to charge a fee to use the scoreboards as he has never seen the scoreboards on and doesn t even know if they work. He stated that the cities used in the comparison chart showing what they charge for field rental, have much better facilities than Riverdale. Riverdale City Council Meeting 1 April 7, 2009

2 E. Presentations and Reports 1. Mayor s Report Mayor Burrows reported that light bar over I-84 on the bridge on Riverdale Road has been put up and that the edge work that was started last year should be finished in about two weeks. He stated that the next phase of the Riverdale Road widening project is moving forward with a lot of the properties being acquired for right-of-way. He stated that there will be an upcoming open house for the public and business owners. 2. Status report on the 1500 West road extension by Larry Hansen Larry Hansen reported that the City has closed on the residential property that it purchased on Ritter Drive to complete the road extension and connect 1500 West with Ritter Drive. He explained that a preliminary asbestos inspection has been done on the home and that the homeowners will be out on April 15, 2009, after which utilities will be disconnected and the house demolished. He stated that he has received a bid for less than $10,000 to demolish the home and excavate the site. He stated that the engineer will be preparing a bid package for the road construction and that he would like to advertise the first part of May and anticipates that the bid package will be presented to the City Council to award the bid at their May 19, 2009 meeting. Mr. Hansen stated that the Cinedome properties were foreclosed upon and that he attended the sale of that property last week, which sold for two million dollars. He reported that he spoke with the buyer and told them that their property was in a redevelopment project area and they indicated a desire to divest themselves of that property without taking a loss and don t want to develop it themselves. Councilor Peterson inquired if the City has the right-of-way on the road that goes behind the Cinedome property. Mr. Hansen replied that it does. Councilor Peterson wondered if that would be an impediment to development. Mr. Hansen explained that the buyers are aware of that and that they will need to demolish the building. Councilor Gibby stated that this may be a good time to have a conversation with UDOT regarding the intersection in front of the Cinedome and see if it could be re-engineered. Mr. Hansen reported that he will bring that up in his conversations with UDOT. F. Consent Items 1. Approval of meeting minutes from: March 17, 2009 Work Session March 17, 2009 Regular City Council 2. Review and Comment by April 14, 2009 on Ordinance #732 amending Title 2, Land Use Authority and Land Use Appeals Board. This item was removed from the agenda. Councilor Jenkins moved to approve the consent item as listed under item #1. Councilor Gibby seconded the motion. G. Action Items 1 Consideration of Resolution # amending Title 1, Chapter 12 - Consolidated Fee Schedule, Section 11 - Community Service Fees. Jeannette Hall reported that she received a phone call a few weeks ago from Jim Urry of the Sand Lot inquiring if they could rent fields at Golden Spike Park for competition baseball/softball league play. She explained to him that only the younger boys could play on those fields and that there are no lights and that she is not sure the scoreboards work. 3 have a field rental fee, she is proposing to add one to the Consolidated Fee Schedule. She stated that she contacted surrounding cities to find out what they charge and based Riverdale s fees on that information. Councilor Hunt stated that he is not opposed to implementing a field rental fee for a business, but wondered if someone wanting to hold a family reunion would be subjected to the same fees. Ms. Hall replied that they would need to reserve the field and pay the fee if they want to guarantee that they have the fields. Councilor Peterson inquired about the requirement that the renter provide a one million dollar liability insurance policy and didn t feel that was fair to require of a non-business entity. Mayor Burrows reported that he is concerned that Riverdale residents are being charged the same as a non-profit organization and just slightly less than a non-resident. He stated that he likes the idea of scheduling the fields but doesn t want the leagues to take away the ability of the residents to use them. Councilor Gibby suggested including the field rental as part of the pavilion rental. Ms. Hall stated that there are two diamonds at Golden Spike Park and that they could leave one open for the residents to use and charge for the other one. Councilor Jenkins stated that she doesn t want to see the residents treated as second in line, and likes the idea of having a field available for the residents to use. Councilor Griffiths inquired as to the current use of the fields. Ms. Hall replied that the middle of May through the end of June the fields are used for the City s recreational leagues and would not be available for rent until after July 4 th. Larry Hansen suggested adding language under item F in the Consolidated Fee Schedule indicating that only the Golden Spike East field would be available for rent. Councilor Gibby moved to approve Resolution # and only allow field rental at the Golden Spike Park East field. Councilor Peterson seconded the motion. Roll Call Vote: Councilor Jenkins; Aye, Councilor Peterson, Aye; Councilor Griffiths, Aye; Councilor Hunt, Aye; and Councilor Gibby, Aye. A discussion was held as to whether or not the motion included deleting the language to charge Riverdale residents a field rental fee. It was determined that a new motion would be needed to add that language. Councilor Peterson moved to reconsider the action. Councilor Gibby seconded the motion. Councilor Gibby moved to approve Resolution # to only allow field rental at the Golden Spike Park East field and delete the Resident Fees. Councilor Peterson seconded the motion. 4 2. Consideration of request from Riverdale Elementary for placement of temporary classroom at Riverdale Park. Randy Daily introduced Maloy Hales, Principal at Riverdale Elementary School, who is the petitioner on this item. Mr. Hales reported that Riverdale Elementary receives incredible support from the City and expressed his appreciation. He stated that Riverdale Elementary is running out of room and will need an additional 2 ½ classrooms to start the next school year. He explained that he is requesting that the City allow the school to place a portable classroom on City property in a corner of Riverdale Park. Councilor Gibby inquired why the portable classroom couldn t be placed on school grounds in front of the tennis courts on the blacktop. Mayor Burrows replied that would take away area on the blacktop for children to play. Councilor Peterson reported that he has three children who currently attend Riverdale Elementary and that next school year he will have four attending the school. He thinks the question is not how to rearrange the blacktop to put the classroom on it, but why can t it be put where Mr. Hales is suggesting. He asked why they shouldn t accommodate the request and make more room for the increasing number of students at the elementary school while allowing for full use of the blacktop and the play area. He stated that he read the notes from Lynn Moulding, but doesn t see that corner of the park as valuable to the City as it could be to the elementary school. Councilor Jenkins wondered if they continue to allow Riverdale Elementary to use pods as portable classrooms if that would stop the progress of the School Board to look at a future expansion plan for the school as it seems that the temporary classrooms become permanent fixtures of the schools. She reported that she has talked to some parents who told her that the portables don t have bathrooms but that they are air conditioned and asked if Principal Hales had any idea of the direction the School Board might be going. Mr. Hales replied that they have a plan but that that plan has not been approved. He indicated that the Board is looking at expanding from the front of the school down to the bottom parking lot and building a gym and 8 classrooms. He stated that they are looking for answers to house the students and would like to keep any room they have to move about, especially during the snowy and colder months of the year. Councilor Gibby reported that he has no problem putting it in the park but wanted to see other options. He stated that his only remaining concern is that the City retain rights to the property and if the need arises that the City has the right to have the temporary structure removed. Mr. Brooks reported that an agreement could be drafted between the City and the School District which would outline those conditions. Councilor Peterson suggested revisiting the lease agreement after ten years. A discussion was held regarding a ten year sunset period and having some review periods during that time. Councilor Peterson moved to approve the request from Riverdale Elementary for placement of a temporary classroom at Riverdale Park with added contingencies that a sunset provision of ten years and two review periods be put in place and have Mr. Brooks draft an agreement with the School District for this use. Councilor Gibby seconded the motion. H. Discretionary Items Councilor Jenkins inquired if the City would entertain the idea of providing land and water for a neighborhood garden. Larry Hansen replied that there is a neighborhood garden at the Senior Center. Councilor Jenkins stated that she was thinking of having a place that the entire City could participate. Councilor Gibby reported that they have a farm in St. George and have put aside five acres for a Riverdale City Council Meeting 4 April 7, 2009

5 community garden in conjunction with the City. He stated that the City is responsible to keep it clean and pay their share of the irrigation costs. He suggested that there might be a private land owner who might be willing to do something similar. Mayor Burrows stated that they could look into having a community garden on City property. Mr. Hansen stated that the west bench area is prime property and has water in a ditch but that the City doesn t have any water rights to it, but that area could be looked in to as a possible site. Councilor Gibby reported that the water shares are available and rentable on that ditch. Mayor Burrows asked for consensus to check into it. Consensus was reached. I. Adjournment With no further business to come before the Council at this time, Councilor Peterson moved to adjourn the meeting. Councilor Gibby seconded the motion.
