Trivium Charter Transition Plan Section 1: Background In Anderson Union High School District v. Shasta Secondary Home School (2016) 4 Cal. App. 5 th 262 (Anderson), the Third District Court of Appeal (Third District) held that the geographic restrictions in EC sections 47605(a) and 47605.1(d) apply to nonclassroom-based charter schools operating out-of-district, in-county (ODIC) resource centers. Thus, in order to ensure compliance with this court opinion, all charter school resource centers must operate within the boundaries of its authorizing school district, unless one or more exceptions apply. Blochman Union School District submitted a waiver request to the State Board of Education (SBE) for the purpose of giving Trivium Charter time to comply with the Anderson court decision for any resource centers deemed out of compliance in accordance with the Third District Court of Appeal decision. On May 11, 2017, the SBE approved the waiver with five specific conditions to bring all out-of-district, in-county (ODIC) resource centers into compliance by June 30, 2018 as follows: SBE Waiver Conditions 1. Require the charter school s governing body to approve a transition plan that details how the charter school s resource center(s) will come into compliance with the Anderson court decision. 2. Pursuant to EC Section 33051(b), the waiver shall expire on June 30, 2018 and shall not be retroactive. 3. Require the charter school to submit the transition plan to the charter school s authorizer (authorizer) and to all school districts where the resource centers are located within 30 days after approval of the waiver. 4. Require the charter school to provide a status update to parents. 5. If the authorizer has not visited the resource center(s) pursuant to EC Section 47604.32(a)(2), require the authorizer to visit the resource center(s) within a reasonable time frame. Section 2: Resource Center Compliance Action Steps On May 11, 2017, the SBE approved Trivium Charter s waiver request to include the following resource centers: 1

Resource Center 1: Santa Maria Resource Center, 1026 Sierra Madre, Santa Maria 93454 Districts in which Resource Center is currently located: Santa Maria-Bonita Unified School District and Santa Maria Joint Union High School District Students Currently Served: 151 TK-12 students Educational Activities Provided: Special Education, ELL instruction, tutoring, small and large group work, social learning, academic support and counseling, science experiments, history re-enactments, debate, art, music, literature, elective classes Longevity: Families have remained with Trivium for years and enroll younger siblings as they become schoolage. This longevity combined with family support creates a stable and positive climate for the students enrolled. Compliance Action Steps for 1026 Sierra Madre, Santa Maria 93454 1) In order to satisfy the State Board of Education s waiver compliance requirements as expediently as possible within the time frame allowed, we shall submit a material revision for Trivium Charter School s current charter to Blochman Union School District on or prior to June 30 th, 2017, to utilize the exception rule in Education Code section 47605(a)5, which states A charter school that is unable to locate within the jurisdiction of the chartering school district may establish one site outside the boundaries of the school district, but within the county in which that school district is located, if the school district within the jurisdiction of which the charter school proposes to operate is notified in advance of the charter petition approval, the county superintendent of schools and the Superintendent are notified of the location of the charter school before it commences operations, and either of the following circumstances exists: (A) The school has attempted to locate a single site or facility to house the entire program, but a site or facility is unavailable in the area in which the school chooses to locate. Trivium Charter School meets the conditions set forth in this education code section as it has determined that no single site or facility exists to house our entire program within the geographical boundaries of our authorizer, Blochman Union School District. 2) Per education code requirement above, we shall notify Santa Maria-Bonita Unified School District and Santa Maria Joint Union High School District prior to approval of our charter school s material revision. 3) Per education code requirement above, upon approval of Trivium Charter School s material revision, and prior to beginning operation of the site for the 2017-2018 school year, we shall notify the Santa Barbara county superintendent of schools and the Superintendent of the location of the charter school s facility at 1026 Sierra Madre, Santa Maria. Should our request for a material revision be denied, the following action steps will also be taken for compliance for the Santa Maria resource center: 4) Submit a new charter school petition for Trivium Charter School, Experience to the Lucia Mar Unified School district in San Luis Obispo County on or prior to September 30, 2017, to operate as a Personalized Learning Public Charter School beginning July 1, 2018. Upon approval, transfer enrollment of currently enrolled students in Trivium Charter who use the Santa Maria resource center and who indicate an interest in enrolling in Trivium Charter School, Experience, and transfer Santa Maria resource center assets and liabilities from current school to new school in accordance with required best practices (GAAP) on or prior to June 30, 2018, using the adjacent county exception rule stipulated in education code section 47605.1(a)(3)(c) as follows: 2

(c) Notwithstanding any other law, a charter school may establish a resource center, meeting space, or other satellite facility located in a county adjacent to that in which the charter school is authorized if the following conditions are met: (1) The facility is used exclusively for the educational support of pupils who are enrolled in nonclassroom-based independent study of the charter school. 5) Submit a new countywide benefit charter school petition for Trivium Charter School, Explore to the Santa Barbara County Education Office on or prior to January 31 st, 2018, to operate as a Personalized Learning Public Charter School beginning July 1, 2018. Upon approval, transfer enrollment of currently enrolled students in Trivium Charter who use the Santa Maria Resource Center and who indicate an interest in enrolling in Trivium Charter School, Explore, and transfer Santa Maria resource center assets and liabilities from current school to new school in accordance with required best practices (GAAP) on or prior to June 30, 2018. Upon denial, no appeal process is possible under current law. 6) Submit a new countywide benefit charter school petition for Trivium Charter School, Navigate to the San Luis Obispo County Education Office on or prior to January 31 st, 2018, to operate as a Personalized Learning Public Charter School beginning July 1, 2018. Upon approval, transfer enrollment of currently enrolled students in Trivium Charter who use the Santa Maria Resource Center and who indicate an interest in enrolling in Trivium Charter School, Navigate, and transfer Santa Maria Resource Center assets and liabilities from current school to new school in accordance with required best practices (GAAP) on or prior to June 30, 2018, using the adjacent county exception rule stipulated in education code section 47605.1(a)(3)(c) as cited above. Upon denial, no appeal process is possible under current law. Upon denial of steps 4, 5, and 6 the following actions will be taken as needed to ensure compliance: 7) Upon denial of the Trivium Charter School Experience petition through the Lucia Mar Unified School District, we will appeal the district denial to the San Luis Obispo County Office of Education and, if that is also denied, we will submit an appeal to the California State Board of Education following all 8) Upon denial by Lucia Mar Unified School District and the San Luis Obispo County Office of Education, we will confer with our current authorizer, Blochman Union School District, about possible restructuring options on or before March 30, 2018. 9) Upon denial of the new charter petitions by the district, county and state, we will submit a waiver request extension to State Board of Education to seek additional time to bring the Santa Maria resource center into compliance. Resource Center 2: Lompoc Resource Center, 1600 Berkeley Dr. Lompoc, CA 93436 Districts in which Resource Center is currently located: Lompoc Unified School District Students Currently Served: 128 TK-12 students Educational Activities Provided: Special Education, tutoring, small and large group work, social learning, academic support and counseling, science experiments, history re-enactments, debate, art, music, literature, elective classes Longevity: Families have remained with Trivium for years and enroll younger siblings as they become schoolage. This longevity combined with family support creates a stable and positive climate for the students enrolled. 3

Compliance Action Steps: Lompoc Resource Center, 1600 Berkeley Dr. Lompoc, CA 93436 1) Submit a new charter school petition for Trivium Charter School, Adventure to the Lompoc Unified School District on or prior to September 30, 2017 to operate as a Personalized Learning Public Charter Trivium Charter who use the Lompoc Resource Center and who indicate an interest in enrolling in Trivium Charter School, Adventure, and transfer Lompoc resource center assets and liabilities from 2018. 2) Submit a new charter school petition for Trivium Charter School, Experience to the Lucia Mar Unified School District on or prior to September 30, 2017, to operate as a Personalized Learning Public Charter Trivium Charter who use the Lompoc Resource Center and who indicate an interest in enrolling in Trivium Charter School, Experience, and transfer Lompoc resource center assets and liabilities from 2018, using the adjacent county exception rule stipulated in education code section 47605.1(a)(3)(c) as follows: (c) Notwithstanding any other law, a charter school may establish a resource center, meeting space, or other satellite facility located in a county adjacent to that in which the charter school is authorized if the following conditions are met: 1). Upon denial, no appeal process is possible under current law. Upon denial of steps 1-4, the following actions will be taken as needed to ensure compliance: 5) Upon denial of the Trivium Charter School Adventure petition through Lompoc Unified School District, we will appeal the district denial to the Santa Barbara County Office of Education and, if that is also denied, we will submit an appeal to the California State Board of Education following all submission timelines and guidelines. 6) Upon denial of the Trivium Charter School Experience petition through the Lucia Mar Unified School District, we will appeal the district denial to the San Luis Obispo County Office of Education and, if that is also denied, we will submit an appeal to the California State Board of Education following all 4

7) Upon denial by Lompoc Unified School District and the Santa Barbara County Office of Education, and by Lucia Mar Unified School District and the San Luis Obispo County Office of Education, we will confer with our current authorizer, Blochman Union School District, about possible restructuring options on or before March 30, 2018. 8) Upon denial of the new charter petitions by the district, county and state, we will submit a waiver request extension to State Board of Education to seek additional time to come into compliance. Resource Center 3: Santa Barbara Resource Center, 4597 Hollister Ave, Santa Barbara, CA 93110 Districts in which Resource Center is currently located: Santa Barbara Unified School District and Hope Elementary School District Students Currently Served: 95 TK-12 students Educational Activities Provided: Special Education, tutoring, small and large group work, social learning, academic support and counseling, science experiments, history re-enactments, debate, art, music, literature, elective classes Longevity: Families have remained with Trivium for years and enroll younger siblings as they become schoolage. This longevity combined with family support creates a stable and positive climate for the students enrolled. Compliance Action Steps: Santa Barbara Resource Center, 4597 Hollister Ave. Santa Barbara, CA 93110 1) Submit a new charter school petition for Trivium Charter School, Voyage to Santa Barbara Unified School District on or prior to September 30, 2017 to operate as a Personalized Learning Public Charter Trivium Charter who use the Santa Barbara Resource Center and who indicate an interest in enrolling in Trivium Charter School, Voyage, and transfer Santa Barbara resource center assets and liabilities from current school to new school in accordance with required best practices (GAAP) on or prior to June 30, 2018. 2) Submit a new charter school petition for Trivium Charter School, Voyage to Hope Elementary School District on or prior to September 30, 2017 to operate as a Personalized Learning Public Charter School beginning July 1, 2018. Upon approval, transfer enrollment of currently enrolled students in Trivium Charter who use the Santa Barbara Resource Center and who indicate an interest in enrolling in Trivium Charter School, Voyage, and transfer Santa Barbara resource center assets and liabilities from 2018. 3) Submit a new charter school petition for Trivium Charter School, Experience to the Lucia Mar Unified School District on or prior to September 30, 2017, to operate as a Personalized Learning Public Charter Trivium Charter who use the Santa Barbara Resource Center and who indicate an interest in enrolling in Trivium Charter School, Experience, and transfer Santa Barbara resource center assets and liabilities from current school to new school in accordance with required best practices (GAAP) on or prior to June 30, 2018, using the adjacent county exception rule stipulated in education code section 47605.1(a)(3)(c) as follows: (c) Notwithstanding any other law, a charter school may establish a resource center, meeting space, or other satellite facility located in a county adjacent to that in which the charter school is authorized if the following conditions are met: 5

Section 3: Status Update for Parents 1. Final Board approved transition plan will be posted on our website on or before June 9, 2017. 2. Email notification of Board approved transition plan and access and explanation will be forwarded to all parents of enrolled students on or before June 9, 2017. 3. Parents will be given advance notice via email of all charter petition hearings as they are scheduled. 4. Parents will be given follow up notice via email of the results of all charter petition hearings as they are finalized. 5. Depending on the results of the charter petition hearings, parents will be given detailed instructions on available enrollment options well in advance of the 2018-2019 school year. District Contact 1. Submit this transition plan to all districts where our resource centers are located within their boundaries, including our sponsoring district by June 9, 2017. Section 4: Authorizer Resource Center Visits Our current authorizer, Blochman Union School District, has always been and will continue to be in compliance with the required Resource center visits by visiting each resource center annually. Certification Trivium Charter School s transition plan was approved on Friday, June 2, 2017 by the Trivium Charter School Board of Directors. 7
