Responsibilities Re HOSTS: 1.Remember: You are guests in their home and HKU Faculty of Law ambassadors act accordingly. 2.Be courteous, and considerate of host institution, staff and fellow students at all times. 3.Stay in touch with administration and advisers, reply promptly to inquiries/ requests for information etc. 4.Observe all academic rules (including class attendance, reading and writing requirements, no plagiarism etc). 5.ARRIVE on time as required by Host. Do not leave or ask to leave before end of your assessments, for any reason, especially NOT internships, holidays etc. 6

The relationship between the Faculty Scheme and the University Scheme 1. Symbiotic we work together to maximise exchange. 2. The Faculty has law specific agreements with some law faculties. HKU has university wide agreements with some institutions. Some of those include formal and informal quotas for students who wish to study law. Our application form lists both Law Faculty places and OISE places assigned to the Faculty. Together these places for the Faculty of Law Exchange Scheme. 3. If you wish to study law on exchange, you must apply through the Faculty of Law Scheme. 4. Only apply through OISE if you do not want to study law or you have asked me specifically first. OISE scheme students may not be permitted to study law at all. 8

If You Go Through Either Exchange Scheme: 1. HKU or the Faculty does the initial liaison with the host school although you have to fill out & send the formal application yourself and apply for courses, accommodation etc as advised; 2. You only have to pay HKU tuition fees; 3. With prior agreement with exchange team, transfer of credits is virtually guaranteed; 4. You can receive limited financial and other assistance from HKU and some law scholarships. 9

Application Process for Faculty of Law Scheme 1.Explore the list of possible hosts on our Exchange combining HKU (OISE) and Law Faculty partners. 2.That list will be incorporated into the Law Faculty online application form. Students are required to list up to 5 choices, in ranked order, Law Faculty and OISE hosts together, on one list. 3.We will then make the initial allocation for all law scheme places. 4.Students allocated OISE law places will be given an opportunity to comply with OISE procedures later. 10

The Law Faculty Application Form 1. Fill in and submit the Law Faculty on-line form 2. Choose up to 5 options, ranked according to your preference, from Law Faculty or OISE partners on the list. Be as flexible as possible to maximise your chances of a place. 3. You can choose to go to: - one place for one semester - one place for a full year if host school permits - two places in one year only if those places are: (i) civil law country + common law country (ii) mainland China + any other country 4. If you are get a one semester place in January you will not normally be allowed to choose additional place in August. 11

How to Choose? 1. Research the partner universities fully yourself first. 2. CGPA 3.6: don t strategize, give us your preferences 3. CGPA 3.4, be realistic & flexible (not UCL, KCL, Durham, Bristol, Nottingham, Warwick, Duke, Cornell, Michigan, Toronto) 4. It is sometimes good judgment to select only a limited range of schools it is certainly better than including places you don t really want to go. 5. Ticking Not willing to negotiate will NOT mean extra priority for the schools of they have chosen and will be taken seriously. Other choices will NOT be offered even if the places on their list are full or simply inappropriate. 6. Each cohort will be ranked separately then choices will be made with the object of achieving a fair distribution between the different programmes. 7. Look for subjects and professors that interest you. Exchange should not be about substitute core courses. 12

The Golden Rule 1. Only put down places you are definitely willing to go to. 2. If you are given an offer for a host on your list, you are expected to accept that offer, even if it is No 5 on your list. 3. If you decline an offer for a host on your list, you will probably not get another offer this year. 4. Naturally, exceptions are made for exceptional cases. 13

Other Rules 1.Take care with your order of choices. Changes will not be accepted for any reason after applications close. And order of choices does count for something. 2. Students may withdraw from the programme for any reason before accepting an offer. 3. However, any student who rejects an offer made for any partner included within that student s list of 5 choices is very unlikely to receive a second offer within the same year. 4. A student may reject an offer for any institution NOT included within the student s 5 choices without penalty. 14

Important 6. Any student who withdraws AFTER accepting an offer will forfeit their deposit unless: the Director is satisfied the reason for withdrawal is valid and beyond the student s foreseeable control, and the withdrawal is made as soon as reasonably practicable. Note: taking up employment or a concern about grades are both foreseeable! 15

Important 7. The Exchange Team work extremely hard and with great care to ensure the fairest possible allocation of places amongst many eligible students. Inevitably, a significant number will not be able to achieve their first choice or their second. Some will be offered their 5 th choice. Please do not come and ask for your allocation to be reconsidered our answer must be no. Remember, changing your allocation would mean disappointing someone else why is your dream the most important? Instead, start working on how to make the most of what you have been offered. 16

ACADEMICALLY Am I Qualified to Apply? 1. CGPA of 2.8 for OISE scheme, CGPA of 3 for scholarship 2. CGPA of 3.0 under Faculty scheme, for most institutions you will need a little better. Our hosts courses are demanding. 3. Double Degree students: you may apply on the basis of your overall CGPA and that is important but law grades matter too! Both will be considered. PERSONALLY: willing to commit to the responsibilities of exchange in a host university, willing try new things, courteous towards others, tolerant of difference, a (learning?) problem solver. FINANCIALLY: exchange costs money start earning and saving now! 17

If You Want to Apply to Both Schemes You must: (i) Fill in and submit BOTH forms: (ii) Indicate on the Faculty of Law form that you have applied for HKU as well (iii) Decide as between competing offers promptly. 18

When Should I Apply for BOTH Exchange Schemes? You should only apply for both schemes if you are willing to either: (i) study law if allocated a place (ii) or study non law subjects only if allocated an OISE place. Please indicate on your Faculty of Law application form if you have also applied to study non law subjects with OISE. Otherwise, you will only need to apply for one scheme. Students who have applied for the Visiting Scheme may also apply for the exchange schemes. 19

Visiting Student Scheme (maximum 10 students) This Scheme provides an opportunity for students to spend a year at top rank schools that do not have exchange programmes ONLY students selected by the Exchange Team for the Visiting Student Scheme will be able to apply for advance standing for subjects taken outside the exchange programme. Students may still choose to take a year off and study at any institution of their choice but if you are not selected for the Visiting Student Scheme, NO credits will be transferred or accepted for advance standing even if you go to Oxford or Cambridge. 20

Visiting Student Scheme (continued) We now have visiting student arrangements with: Hertford College, Oxford (1-2 full year students) Caius College, Cambridge (1-2 full year students) Law/double degree students may also apply for the HKU/ Yale College places you may be able to study some law there. You pay HKU fees and HKU pays the rest! Other selected students may apply for Harvard, other Oxford or Cambridge colleges, LSE perhaps other institutions accepted by HSBC scholarship. Important (Yale apart) Visiting Students pay the host institutions fees. There may be limited help for Caius and Hertford College and HSBC loves these institutions BUT there are no guarantees. If you know anyone who wants to provide scholarship funds.. 21

Visiting Student Scheme (continued) Eligibility: current LLB and Double Degree students ranking within the top 10% of their respective cohorts at the close of applications Application Procedures: Students wishing to participate in the Visiting Student Scheme may apply using the standard exchange application form. You will be asked to indicate whether you wish to apply for Hertford College, Caius College, Yale College (not the law school) or to indicate your other choices. Apart from the three named colleges, you should apply to the other institutions according to their specific timetables. There is a special application process for the Yale College programme. Eligible applicants will be interviewed and up to 12 students (including 2 reserves) selected AFTER the December examinations. 22

Transfer of Credits Going on Exchange does NOT require a deferral of your studies. You can transfer the credits you earn at the partner institution to your HKU LLB degree. With reasonable planning, most students can go on exchange AND still graduate with their classmates! START PLANNING NOW! 23

Reordering of Courses 1.Going on exchange may require that courses that would ordinarily be taken in year 3 should be taken in year 2 or year 4 or other variations. 2.It may be necessary to take additional course loads in earlier years so as to free up time for exchange. 3.The details for each programme varies. The options will be discussed in detail in the programme specific meetings. 4.NOTE: There is a special form for applying for leave to reorder courses. It can be down loaded from our website. Please use it. Emailing a member of the exchange team is NOT sufficient. 24

Credit Transfer Rules 1. You must get prior approval for each specific subject from the appropriate exchange team member/ relevant non-law department in order to transfer any credits to HKU. 2. Ordinarily, an average full load of approved courses at a host university will transfer as 60 HKU credits/ per year, 30 HKU credits / semester. 3.When selecting courses, please note: You must take at least one true elective during each semester of study see next slide. Compulsory courses transfer for the same number of credits as their HKU equivalents, eg 12 HKU credits for Equity & Trusts, 6 HKU credits for Intro to Legal Theory, 6 credits for most non law one semester courses. Remaining approved credits transfer as law/ non law electives or non law compulsory courses. 25

True LAW Elective Rule Explained ALL HKU outgoing exchange students must take at least one course per semester (including one full year course) which is a true law elective, that is, NOT a required course for the LLB or the PCLL and not a non-law elective. (For three semester schools that means three electives!) Compulsory introductory courses on the host jurisdiction s legal system do NOT count. Non law courses don t count for this purpose either although you may ALSO take a non law course if your degree permits. Note: You are encouraged to take law elective courses not offered at HKU. There is no need to look for equivalents of HKU electives. Part of the point of exchange is to study abroad what you can t study here. 26

Credit Transfer (continued) - The 10 HKU law elective credits rule is now more of a guide than a rule. - You are going to practice law, if at all, in HK. It makes sense to study most of your HK PCLL prerequisites at HKU. Think about it! - You should only be taking equivalents of PCLL prerequisites if: (i) You have an opportunity to learn from an exceptional professor (ii) Your degree structure makes it essential to take some PCLL prerequisites (iii) You do not intend to enter the PCLL EVER but your degree requires these courses and they look especially interesting Trying to avoid tougher HKU courses really isn t a good reason! 27

ALERT! The Steering Committee on Legal Education and Training wishes to ensure consistency between: (i) courses accepted as equivalent to PCLL prerequisites taken at our host universities while on exchange; (ii) courses accepted as satisfying PCLL prerequisites by the CONVERSION BOARD. The current system is that if Law/ PCLL Department teachers accept a host institution course as a suitable equivalent, our PCLL admission will do so also. From 2015-16, this is not enough! Law Department approval will always be sufficient for LLB graduation but CONVERSION BOARD approval is a separate requirement for PCLL admission. We are preparing two lists CHECK BOTH. If a course is not listed as CONVERSION BOARD APPROVED, we will need to ask. 28

Students should plan to transfer 30/ 60 HKU credits not less and not more. HKU students are expected to take an average load within the host institution s range of a normal load in each exchange semester. The only exceptions are: (i) When a host university insists upon a lower number of courses/ credits for exchange students (ii) When a student has been given special permission to overload/underload. See next slide. 29

Overloading Specifically 1. Overloading on exchange is generally NOT a good idea. Exchange itself is challenge enough and is NOT all about study. 2. Try overloading at HKU instead. 3. However, exceptions may be made for exceptional students, and for students who need 66-72 HKU credits for their exchange year or who are attempting a specialization. 4. Strong mixed degree students may be able to take one semester of maximum credits at a North American host or take an additional business or social science course to enable transfer of 36/ 66 credits. All may take additional language courses. 5. Overloading is always at the host institution s discretion. 30

Important If you leave compulsory subjects for a final year exchange even Legal Theory You may loose your exchange opportunity. There is no guarantee you will be able to take an approved equivalents!!!! 31

Important Final decisions on course admission are for the host university. DO NOT RELY ON MIRACLES! NOTE: We do not allow visiting exchange students to do our compulsory courses/ PCLL prerequisites. Our host universities may have the same policy or have quotas on particular courses, priorities for local students etc. This is entirely reasonable and must be respected. You must take this into account in your choice of institution and study planning. 32

Important An exchange opportunity is a once in a lifetime precious thing. It does not come free! We try to facilitate exchange as much as we can we are already liberal in our transfer of credits for electives. You should not be surprised or distressed if you have to do an extra 6 credits in one semester for double degree students perhaps two or more semesters in order to fulfil both your exchange and your HKU LLB requirements. 33

Grades EARNED ON Exchange DO NOT Count Towards Your CGPA 1. If you want to improve your CGPA for whatever reason, you need to think very carefully about your exchange options and courses. 2. You will have a transcript of your exchange results to show the PCLL admissions and future employers. If you do well, this could help you. 3. Exceptionally high grades may assist a student who is totally boarder line for a class of honours but this is so rare, you should not consider it. 34

Which Courses Can I Transfer? 1. Law electives and LLB Compulsory Courses that are NOT PCLL equivalents: transferrable with prior approval of HKU Faculty of Law exchange team member. 2. PCLL pre-requisites: - may also need the prior approval of the Conversion Board. HKU students are NOT permitted to take conversion examinations for any reason. 3. Non-law subjects Transferrable with prior approval of the appropriate HKU teachers. This too will be dealt with in the special sessions. 35

Courses that must be done in Hong Kong: Hong Kong Constitutional Law Hong Kong Legal System Land Law III (for PCLL only) Some courses are more difficult to match than others (Civil & Criminal Procedure courses Equity and Trusts in North America) [If you don t want to do the PCLL ever we can be more flexible here.] AND For civil law jurisdictions, matching Intro LTH is often the only option. HOST institution always has the final say!!!! 36

Applications for APPROVAL for the LLB Core Subjects or PCLL Prerequisites Check website for list of already approved / disapproved courses See: www.law.hku.hk/prospectivestudents/outgoing.php If the course is not on the list at all you may be the first to ask. (i) First, obtain the opinions of relevant HKU course teachers (ii) Forward the teacher s opinion to Miss Cindy Kwan (cindyank@hku.hk), together with your application. DO NOT APPROACH DIRECTORS FIRST. (iii) For PCLL prerequisites, again, CHECK the separate CONVERSION BOARD approved list. If the course you want is not on the Conversion Board approved list, first contact an HKU teacher and, if approved by that teacher, then apply to exchange team through Miss Cindy Kwan for Conversion Board approval. DO NOT APPLY ON YOUR OWN! 37

continued COURSE APPROVAL APPLICATIONS Include course descriptions, unit or credit weighting, contact hours, assessment, content information) Specific approval of Head of Department (Law) required for: - Acceptance as part of specialisation - deferral of compulsory mooting - over or under loading at HKU or exchange institution But requests for this approval should be made to Ms Janice Brabyn through Miss Cindy Kwan first. 38

Common Law Jurisdictions It is dangerous to count on doing compulsory courses on exchange. Something can easily go wrong and you may have to choose between your exchange and deferring. - Equity and Trusts: increasingly difficult in USA and Canada (some combinations of courses accepted but not recommended) - Evidence: compulsory in Canada now so hard to get into - Business Associations/ Commercial Law: missing parts - Administrative Law: often not offered as separate course and / or too much human rights/ constitutional law content - Civil/Criminal procedure: unless you are not interested in the PCLL, with very few exceptions, do them here! 39

Civil Law Jurisdictions PRC Universities - Excellent for Chinese law and Putonghua, possibly Legal Theory - Courses cannot satisfy any of PCLL prerequisites. European Universities - Excellent for really interesting law options, a possibility for Legal Theory - Courses cannot satisfy any of PCLL prerequisites. 40

Policy with Respect to Pass / Fail Courses Courses in our partner universities that are only marked as pass/ fail courses, that is, courses for which letter grades are not available, may nevertheless be accepted for transfer of credits on a case by case basis. Include this information in your study plan. We prefer one or two such courses only. 41

Can I Go on Exchange and Still Fulfill My Specialisation Requirements? YES! We approve each application personally though so allow time Chinese Law: PRC courses but courses in other schools will be considered. Commercial, Corporate and Financial Law AND International Trade and Economic Law: both common law and civil law courses may be accepted. Name or content need not match any HKU course. 42

What If I Want to Do a Minor? - LLB regulations permit LLB students to take not more than 48 or, now, 36, non-law credits, enough for a minor in another discipline. - We are happy for you to take a non law subject at your host University for this purpose BUT 1. You need to check with the host University - they may not allow law students to take non-law credits; & 2. You need to consult the relevant HKU department re transfer of non-law credits so allow time. 43

DOUBLE DEGREE Non-Law Subjects We are happy for our students to fulfill some of these non-law requirements at partner universities IF partner universities are willing AND relevant HKU departments approve the courses for credit transfer. But consider: Summer courses for non-law subjects if possible Our partners are selected for their excellence in law, not necessarily business In US and Canada, 14-15 law credits and 1 non-law subject may be a good option. PRC business courses are also an option. 44

Application Deadlines For Faculty Exchange Programme:- First Round of Application: Applications will open in December. Application Deadline: 28 December 2015 (starting Sept / Oct 2016 or Jan/ Feb 2017) Second Round of Application (subject to availability of places): Application Deadline: August 2016 (starting Jan / Feb 2017 only) For HKU Worldwide Exchange Programme:- Briefing session in November 2015 Application Deadline Early December 2015 45

Interviews There is no general interview requirement. However, the Exchange Team may decide to interview candidates for a small number of destinations as required. 47

Before you leave: Important Warnings! Make sure you have all your courses expressly approved. After you leave: Get approval for any course/ credit changes FIRST. (Don t just drop/add/change courses) Do NOT take silence for consent. Do NOT fail ANY of your exchange courses. (You may need to do 2-3 make-up courses!!) 49

BBA (LAW) FIRST PRINCIPLES 1. Decide whether you wish to do a BBA exchange OR a law exchange. It is not possible to do both. 2. If you wish to do a BBA exchange, maximum possible law credits is 12 credits at the discretion of the Director. Apply through BBA in the usual way, making your wish to study some law very clear and giving full details and BBA will liase with me. 52

Principles continued 3. Exchange is a privilege and a great opportunity. It does not come free. Most of you will need to use your 72 credit/ year overload allowance to clear away sufficient space for exchange, certainly for a full year exchange. You should be happy with that. 4. Your object should be to try to have as many law elective and free elective credits available for exchange as is possible. Even so, you may end up earning more law elective credits than you strictly need to graduate an education bonus, not a problem. 53

Principles continued 5. Conversely, you should try to clear away as many compulsory/ PCLL prerequisites as possible to maximize your exchange options. 6. Don t concentrate all your attention on the UK. North America, Europe, Israel are excellent destinations for business related law courses not so good for transferring PCLL prerequisites but that really shouldn t be the point of exchange. 54

Advice for Specific Years First Years: Do well in your law subjects. Hint: the best law students are committed readers! Second years: Overload Constitutional Law (normally a third year course for you but second year for LLB so no problem), perhaps one business course. Third years: You are advised to swap your 3 free electives for Land Law I and II and Introduction to Chinese Law. (Generally not available on exchange) and overload business courses. NOTE: Even if you overload, you must do at least 60 HKU credits every year you are at HKU. Taking extra courses simply improved you mind and exchange flexibility. 55

Advice for Current Fourth Years Accountancy majors: Only one semester exchanges please. Three + Two curriculum. Assuming front loading of Introduction to Chinese Law and Constitutional Law, and at least one or some business courses, take 72 credits of PCLL prerequisites this year and you should have just enough room for Introduction to Legal Theory + 54 elective credits (including the 3 x 6 credits from this year, years 2 and 3 and 36 from year 5). NOTE: it is extremely risky to leave any PCLL prerequisites to your final year exchange. 56

Four + 1 Assuming Land Law I and II were taken last year as advised, take the remaining full year course, procedure courses, Land Law III, evidence and business electives this year. If you are planning a one semester exchange, don t leave any compulsory courses to the final year. If you are planning a full year, leaving Introduction to Legal Theory is the safest bet never underestimate the risk of not finding an equivalent that year. Again, it does not matter if you graduate with excess electives. 57
