The college creates a Blackboard shell for every course section (online, hybrid and web-assisted) in the college. In the 2016-17 fiscal year, approximately 48,950 credit hours were attempted via Distance Learning (online and hybrid classes). This is approximately 15% of the college s FTE s. Reasons for Recommendation: SUNY System Administration executed a University-wide contract with Blackboard. All license fees are billed directly from SUNY System Administration. The renewal of the PIA License will give the college access to Blackboard through December 21, 2020. Fiscal Implications: The PIA costs are broken down into three payments. PARTICIPATING INSTITUTION AGREEMENT (PIA) SUNY/Blackboard Contract T003184 License for: Blackboard Learn Bundle (Learning Core - Courses, Community and Content and Mobile) Participating Institution ( PI ): Erie Community College SUNY System Administration ( SUNY ) and Blackboard ( Bb ) have an agreement under which PIs may obtain Bb software and services. The above-named PI agrees to the following: 1. Participation: X Blackboard Learn Bundle (Learning Core Courses, Community and Content and Mobile) 2. Adherence to SUNY/Bb Agreement: PI acknowledges that appropriate parties at the institution are familiar with, and the institution agrees to comply with, the terms and conditions as set forth in the SUNY-wide Bb Master Agreement T003184. The PI agrees to be bound by and comply with all terms and conditions of the Master Agreement, as applicable to PIs. 3. Term: This Agreement shall take effect on December 22, 2017 and shall remain in effect until December 21, 2020, unless terminated in accordance with the Master Agreement. 4. Software: PI is entitled to Bb software as provided in the Master Agreement. 5. License Fees/Payment: In accordance with the Master Agreement between SUNY and Bb, Blackboard Learn Bundle license fees are billed centrally to SUNY. The cost is then passed on to the individual PI via the annual Direct Charge process and PI agrees to reimburse SUNY for PI s share of the products for which SUNY pays Bb. Individual campus license cost information is included as an attachment to this PIA (Campus License Cost Worksheet). As part of System Administration s continued work to account for its costs and activities, all charges will be subject to the New York State Indirect Cost Recovery Rate for Non-Federal Funds (currently 2.64%, subject to change). 6. Services: PI is responsible for service fees in accordance with the Master Agreement for services specified on the Order Form or a subsequent Work Order.
7. Reports and Inspections: PI shall, promptly upon request, furnish to SUNY or to Bb any information reasonably requested in connection with this Agreement. Directions: 1. SUNY Erie Board of Trustees Resolution The SUNY Erie Board of Trustee Resolution regarding a purchase with SUNY System Administration for Blackboard the SUNY Erie Board of Trustees has been presented a request to approve a Participating Institution Agreement (PIA) for SUNY/Blackboard Contract T003184 with SUNY System Administration following a request for proposal process; and Blackboard was chosen by SUNY System Administration as the learning management system (LMS); and it is requested that SUNY System Administration and Blackboard be approved for a three year program with a total cost of $283,843 spread over the three years; and SUNY Erie has budgeted the funds available to pay for this expenditure; and the Erie County Legislature must approve contracts in excess of $50,000 for the College; NOW, THEREFORE, BE IT RESOLVED: RESOLVED: that SUNY Erie is hereby authorized to obtain the Erie County Legislature's approval to award an agreement to SUNY System Administration and Blackboard; and be it further that upon approval of this expenditure by the Erie County Legislature, the President of SUNY Erie or his designee, is authorized to enter into a Standard Agreement with SUNY System Administration and Blackboard as outlined above.
