THE BANGLADESH HOMOEOPATHIC BOARD. THE BANGLADESH HOMOPATHIC BOARD REGULATION, 1985. In exercise of the powers conferred by section 47 of the Bangladesh Homoeopathic Practitioners Ordinance, 1983(XLI of 1983), the Bangladesh Homoeopathic Board, With the previous approval in writing of the Government, is pleased to make the following regulation, namely:- These amendments shell come into force immediately. 1. (1) Short title and commencement. These regulations may be called the Bangladesh Homoeopathic Board Regulations 1985. (2)These regulations shall come into force at once. 2. Definitions- In these regulations, unless there is anything repugnant in the subject or context - (a) appointing authority means the Board and includes, in relation to any specified post or class of such posts of the board, any officer authorized by the Board to make appointment, to 1 / 18

such post or class of post; (b) College means an institution recognized by the Board where in there are provisions for diploma and degree courses of studies; (c) Course of study means the diploma course and the degree course and other higher courses under section 20 of the Ordinance. (d) Degree means an academic rank conferred, as mark of proficiency, honor, privilege, or license to teach, practice, prepare, or deal in Homoeopathic medicine, upon a candidate on successful completion of a prescribed course of studies in a recognized college or institution; (e) diploma means a document granted by the Board, conferring honor, privilege, or license to teach, practice, prepare or deal in, Homoeopathic medicine, upon a candidate on successful completion of prescribed course of studies in a recognized college or institution; (f) Hospital means an institution for the care and treatment of the sick or wounded under the Homoeopathic system of medicine. (g) Internship means attachment of a candidate on successful completion of a Prescribed course of studies to a college hospital for a period prescribed under section 20(1), read with regulation 2(6) and 3(7); (h) 1983); Ordinance mans the Bangladesh Homoeopathic practitioners Ordinance 1983 (XLI of (i) recognized institution means Colleges or any institution recognized by the Board in 2 / 18

which Homoeopathy is taught; (j) recognized Board means a Board of Intermediate and Secondary Education established by or under any law and includes a Board recognized by the Government for the purposes of these regulations; (k) recognised university means a university established by or under any law for the time being in force and includes any other university recognized by the Government for the purpose of these regulations. (l) Schedule means a schedule appended to these regulation; (m) Section means a section of the Ordinance; (n) Section Committee means a committee approved by the Board for the purpose of selection of candidates for appointment of teachers and employees of Homoeopathic colleges and institution; (o) Year means a year commencing on the first day of July in each year and ending on the 30 th day of June in the year next following; 3. COURSES OR STUDY FOR TRAINING AND QUALIFYINGEXAMINATIONS:- (1) Diploma course ; The diploma course shall be of a period of four years with internship for an 3 / 18

additional period of six months. (2) Syllabi of the diploma course containing the subjects and topics to be studied shall be prescribed by the Board, with the previous approval in writing of the Government, separately as Schedule-I to these regulations. (3) At the and of each year, examination shall be conducted by the Board in subjects prescribed for that year and just after the theory examination practical and viva voce examination shall also be conducted on such subjects with the help of an external teacher deputed by the Board and an internal teacher. (4) Any candidate who has passed the Intermediate Science Examination or Higher Secondary Certificate Examination from or recognised university or a recognized Board may be exempted from appearing in an examination on any premedical subjects: Provided that the case of such candidate shall not be considered in the matter of determination of the order of merit in the results of the examinations. (5) Subject to the provisions of exemption under clause (4) the candidates shall have to appear in the examination in the subjects prescribed in the syllabus for the relevant year. Full marks for each subject or paper where there is more than one paper on a subject, shall be 100 marks of which 75 marks shall be assigned to written portion and 25 for viva voce or practical tests. A candidate to be declared successful in any examination shall have to secure 45% of full marks in each written portion, 60% in viva voce or practical tests, as the case may be, and 50% of the total marks in the aggregate. (6) Candidates passing the final examination of the course shall have to remain in internship training in attached hospital for an additional period of six months. (7) Degree course: The degree course in Homoeopathy shall be of a period of five years with internship for an additional period of one year. 4 / 18

(8) Syllabi of the degree course containing the subjects and topics to be studied shall be prescribed by the Board, with the previous approval in writing of the Government, separately as schedule II to these regulations. (9) At the and of each year, examination shall be conducted by the in subjects prescribed for that year, Practical and viva voce examination shall also be conducted on such subjects with the help of an external examiner deputed by the Board and an internal examiner. (10) The candidates shall have to appear in the examination in the subjects prescribed in the syllabus for the relevant year. Full marks for each subject or paper where there is more than one paper on a subject, shall be 100 marks of which 75 marks shall be assigned to written portion and 25 for viva voce or practical tests. A candidate to be declared successful in any examination shall have to secure 45% of full marks in each written portion, 60% in viva voce or practical tests, as the case may be, and 50% of the total marks in the aggregate. (11) Candidates qualifying in the final examination of the course shall have to remain in internship for an additional period of one year. (12)The condensed degree course in Homoeopathy will be arranged in a degree college or recognized institution for a diploma holder in Homoeopathy who has experience of standing practice in Homoeopathy for at least three years to his credit after passing the diploma final examination and completion of internship as prescribed in sub-regulation(i) (13)The duration of the course shall be two years. (14)Syllabi of the condensed degree course containing the subjects and topics to be studied shall be prescribed by the Board, with the previous approval in writting of the Govt. separately as Schedule III to these regulation. 5 / 18

(15) A candidates shall have to appear in the examination in the subjects prescribed in the syllabus for the relevant year. Full marks for each subject or paper where there is more than one paper on a subject, shall be 100 marks of which 75 marks shall be assigned to written portion and 25 for viva voce or practical tests. A candidate to be declared successful in any examination shall have to secure 45% of full marks in each written portion, 60% in viva voce or practical tests, as the case may be, and 50% of the total marks in the aggregate. (16) At the and of each year, examination shall be conducted by the in subjects prescribed for that year, Practical and viva voce examination shall also be conducted on such subjects with the help of an external examiner deputed by the Board and an internal examiner. 4.Course of study for training:- One of the courses of study for training shall be named as refresher course and may be arranged for registered Homoeopaths as such places and times and for such period as may be determined the Board from time to time. The Board shall, from time to time, determine the syllabus of such course which shall include important topics of Homoeopathic Materia Medica with Repertory, Organon with Philosophy & Chronic Diseases and basic knowledge in allied subjects like Anatomy, Physiology, Pathology, Obs-Gynae and Surgery. At the end of the course certificates shall be awarded by the Board to those attending the course and passing the examination. The medium of instruction and examinations of the course prescribed under these regulations shall be Bengali or English, but preference will be given to Bengali. 6 / 18

5. ADMISSION OF STUDENTS TO RECOGNISED COLLEGES AND INSTITUTIONS (1) Applicants for admission to diploma course (DHMS) in a recognized or institution shall have passed the Secondary School Certification Examination or equivalent examination of a recognized Board preferably in second or higher division or GPA-2.5 and shall, if allowed after written and viva voce by a selection committee, be admitted to the first year class. Any student, who abandons his studies during the second, third or fourth year class for any reason, may be admitted to the same class with the approval of Board within 3 years from the year in which he abandons his studies. A student of a recognized college or institution seeking admission to another recognized college or institution may be admitted to the same class on production of necessary certificate of transfer under intimation to the Board by the recognized colleges or institution to which he is admitted. (2) Applicants for admission to diploma course (DHMS) in a recognized or institution shall have passed the Secondary School Certification Examination or equivalent examination of a recognized Board preferably in second or higher division or GPA-2.5 and shall, if allowed after written and viva voce by a selection committee, be admitted to the first year class Any student, who abandons his studies during the second, third or fourth year class for any reason, may be admitted to the same class with the approval of Board within 3 years from the year in which he abandons his studies. A student of a recognized college or institution seeking admission to another recognized college or institution may be admitted to the same class on production of necessary certificate of transfer under intimation to the Board by the recognized colleges or institution to which he is admitted. (3)An applicant for admission to condensed degree course in a college or recognized institution shall be a diploma holder in Homoeopathy from a college or recognized institution and shall have experience of at least three years standing practice after passing the diploma final examination and completion of internship as prescribed in regulation 3. A candidate shall be admitted to the first year class of the course, if allowed after written and viva voce tests by a Selection Committee constituted in this behalf by the Board. 7 / 18

6. Conditions for admission to different courses and qualifying and other examinations:- 1.(a)Subject to the conditions laid down in regulations while selecting candidates for admission to diploma and degree courses in Homoeopathy in order of merit in written and viva voce examinations, such quota system in respect of admission as the Government may direct from time to time shall be observed.(b)application for admission to a recognized college or institution shall be submitted in Form A appended to these regulations and shall be accompanied by attested copies of all academic certificates and mark sheets, character certificate and nationality certificate. (2)(a) Subject to the provisions of regulation 3, written examination and viva voce examinations and practical a shall be conducted by the Board at the end of each year of the course concerned. (b) For conducting examinations of the diploma and degree course an examining body shall be appointed by the Board annually subject to the approval of the Government. (c) Examiners, paper-setters, tabulators, moderators and head sexaminers shall be appointed annually by the examining body. Examiners and tabulators shall have at least three years, papers setters shall have at least five years and moderators and head examiner shall have at least ten years of teaching experience in a recognized Homoeopathic college in the relevant subject. (d) A student shall attend at least 75% of the classes held during a year to acquire eligibility for appearing in the examination of that year. (e) A student who fails in any year in two subjects only may get himself admitted in the next higher class, but he shall have to appear in that subject in the compartmental examination to be held within three months of the declaration of result. A student who fails in the compartmental examination shall revert to the preceding year. (f) A student who fails in the examination of any particular year consecutively for three years shall be disqualified for further studies that year in any college or recognized institutionprovided that he may, if he so opts, be admitted in the first year class in a recognized college or institution under intimation to the Board. 8 / 18

(g) A recognized college or institution shall conduct internal periodical examinations, in each year in addition to the test examination before the examination of each year. 7. Conditions for appointment as teachers in a college or recognized institutions:- Conditions for appointment of teachers in a college or institution shall be as following below:- (1)For a college or institution for diploma course:- (A)Principal : (a) Degree in Homoeopathy with at least 10 years teaching experience or degree in any other faculty and diploma in Homoeopathy with 12 years teaching experience,or degree in any other faculty and registration in Homoeopathy with teaching experience in Homoeopathy for 15 years. (b) Age shall be not less than 40 years and not mire than 50 years at the time of appointment as a Principal. Provided that in the case of promotion of a person to the post of Principal, the upper limit of the age will be relaxable by three years. (c) In all case, preference shall be given to candidates having administrative experience. (B) Vice-Principal: 9 / 18

(a) Degree in Homoeopathy with 8 years teaching experience or degree in any other faculty and diploma in Homoeopathy with 10 years teaching experience,or degree in any other faculty and registration in Homoeopathy with teaching experience in Homoeopathy for 12 years. (b) Age shall be not less than 35 years and not more than 45 years at the time of appointment as Vice- Principal. Provided that in the case of promotion of a person to the post of Vice- Principal, the upper limit of the age will be relaxable by three years. In all case, preference shall be given to candidates having administrative experience. (C) Teachers of Homoeopathic subjects:- (a) Degree in Homoeopathy or degree in any faculty and diploma in Homoeopathy or degree in any faculty and registration in Homoeopathy or diploma in Homoeopathy with experience of standing practice for 3 years. (b) Teachers of pre-medical subjects shall be holders of degree in respective subjects. (c) Age shall in both the case, be as prescribed for a teacher of a Government college. (d)preference shall be given to a candidate having at his credit research work and better results in the final examination of diploma or degree course. (2) For a college or institution for degree course:- (A) Principal : (a) Degree in Homoeopathy with at least 12 years teaching experience or degree in any other faculty and diploma in Homoeopathy with 12 years teaching experience,or post-graduate 10 / 18

degree in any other faculty and registration in Homoeopathy with teaching experience in Homoeopathy for 15 years. (b) Age shall be not less than 40 years and not mire than 50 years at the time of appointment as a Principal. Provided that in the case of promotion of a person to the post of Principal, the upper limit of the age will be relaxable by three years. (c) In all case, preference shall be given to candidates having administrative experience. (B) Vice-Principal: (a) Degree in Homoeopathy with 10 years teachingexperience or post-graduate degree in any other faculty and diploma in Homoeopathy with 12 years teaching experience,or degree in any other faculty and registration in Homoeopathy with teaching experience in Homoeopathy for 12 years or degree in any other faculty and registration in Homoeopathy with teaching experience in Homoeopathy for 15 years (b) Age shall be as preseribed in regulation7(1) (b) above. (c) In all case, preference shall be given to candidates having administrative experience. (C) (a)teachers of Homoeopathic subjects:-degree in Homoeopathy or degree in any faculty and diploma in Homoeopathy or degree in any faculty and registration in Homoeopathy or diploma in Homoeopathy with experience of standing practice for 15 years. 11 / 18

(b) Age shall be (i) in the cases of a person having degree in any other faculty and registration in Homoeopathy, not less than 35 years and not more than 45 years, and (ii)in any other cases as prescribed for a teacher of a government college. (D) Teachers of pre-medical subjects shall be holders of degree in respective subjects with 5 years teaching experience. (E) Preference shall be given to a candidate having at his credit research work and better results in the final examination of diploma or degree course. 8. Managing committee:- (1) Every college and recognized institution shall have, subject to the approval of the Board, a managing committee cons isting of the following members: (a) the Deputy commissioner of the civil district concern if the college or institution is situated in head quarters of the district, or Upazila Hibachi Officer of the Papilla concerned if the college or institution is situated in a place other than the head quarter of a civil district, who shall also be the Ex-officio chairman of the committee. (b) One person interested in Homoeopathy to be nominated by the Board.For this purpose name and bidet of such three persons to be sent to the Board by the Principal and any one of them shall be nominated by the Board. (c) One representative of Founders of the college or institution to be elected from amongst 12 / 18

themselves. (d) The senior physician of the hospital attached to the college or institution concerned who shall be the ex-officio member-secretary of the committee; (e) Two representatives of guardians of the students to be elected by the guardians from amongst themselves. (f) One person who or whose parents donated the highest amount in cash or kind to the college or institution, the donation being certified by the principal of the college or institution. (g) One person from amongst who founders of the college or institution to be nominated by the principal and, in the absence of founders, one person from among the donors to be nominated by the principal. (h) One representative of the registered Homoeopaths, other than a member of the teaching staffer guardian of students, to be nominated by the Board. For this purpose name and biodata of such three persons to be sent to the Board by the Principal and any one of them shall be nominated by the Board. (i) One person from amongst the members of the Board belonging to the division in which colle ge or institution is situated. (j) the principal of the college or institution conserved who shall be the ex-officer secretary of the committee (2)The members of the committee shall elect a Vice-Chair-man of the committee from amongst 13 / 18

themselves: Provided that a member who is a teacher or physician shall not be eligible for election to office of the Vice-Chairman. (3)The member of the committee shall elect a treasurer of the committee from amongst themselves. (4)A member of the committee, except an ex-officio members shall, unless he resigns, or is removed by the Board, earlier from membership, hold office for a period of three years. (5) The functions of the committee shall be in general, to supervise the general administration and management of the business of the college or recognized institution concerned and, in particular, the receipts and expenditure, acquisition and disposal of lands, construction and repair of the buildings and other structures, appointment, promotion and removal of employees, teaching as well as non-teaching and disciplinary action if any, against any student. 9. Designation, status, promotion, age of retirement, etc:- Designation, status, condition of promotion and age of retirement of teachers of a college or recognized institution shall be determined with the approval of the administrative Ministry, by the Board, keeping in view the principle and policy followed in respect thereof in a college or institution for other faculties. 10. In the matter of disciplinary action, if any, required to be taken against a principal, Vice-Principal or any teaching or non-teaching staff of a college or recognized institution, the 14 / 18

Government servants(discipline and appeal Rules, 1984 shall be taken by the Managing Committee of the college or institution concerned with the approval of the Board. 11. Requirements to be fulfilled by a college or recognized institution:-the following requirements shall be fulfilled by a college or recognized institution, namely:- (a) it shall follow the subjects and syllabi and curricula to be determined by the Board. (b) it shall have an attached hospital with facilities for internship and practical surgery. (c) it shall provide necessary facilities for dicities for dissection and surgery. (d) it shall have proper accommodation for class, room, staff room, office laboratory, demonstration room and prater room and will try to provide hostel facilities for the students. (e) In a class or section of a class of a year the number of student shall be not less than thirty and not more than one hundred and fifty. (f) it shall have at least one teacher in a subject and such number of physicians as the Board many direct having regard to the number of the students (g) it shall submit each year the least of teaching and non-teaching staff to the Board showing therein their qualifications, experience, present pay with pay scale. (h) it shall be financially so sound as to meet expenditures on buildings, equipment, maintenance, salary of staff and other related matters. 15 / 18

(i) it shall maintain the following records, registers and documents:- (i) General Register of Admission containing full particulars of students admitted. (ii) Attendance Register of students. (iii) Attendance Register of the teaching and non-teaching staff. (iv) Receipt Books, Cash Book, Ledgers, Bill Registers with Bills, Acquaintance Rolls, other accounts papers, Bouchers, Registers of out door and indoor patients, fees received from them and expenditure in-curred for their treatment. (v) Registers of assets, investment, stores, equipment, furniture, and fixture. (vi) Register of Examination Results for each year. (vii) Any other Register, prescribed by the Board from time to time 12. Bank accounts of the- (i) Tuition and other fees shall be realized from the students of a college or recognized 16 / 18

institution at the rate to be fixed by the Board and shall be deposited in an account in a bank approved by the Managing committee; (ii) The accounts of a college or recognized institution shall be operated under the joint signatures of the secretary and treasurer of the Managing Committee. 13. Audit of the Accounts: All accounts shall be audited annually by auditors authorized by Board and relevant audit reports be submitted to the Board. 14. College or recognized institution to produce records, documents etc. to inspectors and persons deputed for enquiry:- Every college and recognized institution shall provide all necessary facilities to the inspectors and person deputed by the Board to make an inspection or enquiry into the affairs of the college or institution concerned and shall produce all necessary records, registers, ledgers, books of accounts and other document required for the purpose of the inspection or inquiry. Any person who being responsible to full fill the requirements of this regulation, fails or refuses to full fill them or creates any impediment in the fulfillment thereof, shall be liable to disciplinary action under the ordinance and the rules made thereunder. 15. The meetings of the Board:- (1) The Board shall hold at least one meeting in every quarter of a calendar year. Notice of such meeting of the along with the agenda thereof shall be issued to all members by the Board at least fifteen days before the date fixed for the meeting. (2) The Chairman of the Board and, in the absence of the. Chairman for any reason, the most senior member in age in the panel of three members, selected by the Board in this behalf, 17 / 18

convey a meeting of the Board: Provided that no meeting of the Board shall be convened by the most senior member except after consultation with the three members on the panel and obtaining the written consent of other members. The notice of the meeting shall be issued by the Registrar with the previous approval of Chairman or the most-senior member of the panel, as the case may be. (3) The meetings of the Board shall, unless the Board decides otherwise, be held in Dhaka. (4) The proceedings of a meeting of the Board shall be recorded by the Registrar and shall be placed before the next meeting of the Board, or circulated among the members of Board, for confirmation. After the confirmation of the proceedings, resolutions, if any, contained therein shall be given effect to. 16.Diploma, degree and certificate to be conferred by the Board:- (1) The Board shall confer the following diploma, degree and certificate:-diploma and degree in Homoeopathy to be called Diploma in Homoeopathic Medicine and Surgery and Bachelor of Homoeopathic Medicine and Surgery, which shall be expressed with abbreviations of D.H.M.S. and B.H.M.S. respectively. (2) Certificates to registered and enlisted Homoeopaths attending and completing successfully the refresher courses arranged by the Board under the provisions of clauses (e) and (f) of section 13. 18 / 18
