TOWN OF POMPEY TOWN BOARD MINUTES The Regular Monthly Meeting of the Town Board of the Town of Pompey was held on September 3, 2014 at the Pompey Town Hall. In attendance: Supervisor Carole Marsh; Councilors Carl Dennis and Greg Herlihy; Town Attorney Jeffrey Brown, Highway Superintendent Tom Purcell and Town Clerk Ann Christmas. Absent: Councilors Victor LaFrenz and Craig Smithgall Supervisor Marsh called the meeting to order at 7 p.m. followed by the Pledge of Allegiance and a moment of silence for our servicemen and women, Phyllis Ferguson whose husband, Jim, was a former constable for the town and Barbara Lipe. Highway Superintendent Purcell reported that the salt prices are going up 24.3% or an increase of $9.18/ton. The state has not come out with their contract for salt for the coming year but he has been informed that it should be out on September 15 th. Last winter was very tough on his budget. He also reported that his road work is almost completed for the year. They paved one mile of a road and resurfaced 10 miles of roads this year. The Preserve is being slurry sealed this week. Supervisor Marsh reported that she had received an email from Jill LaFrenz informing her that the PASS program in Delphi will not take place this year due to lack of volunteers. R-118-14 Made by Marsh, seconded by Dennis to authorize Terry Christmas to perform a marriage on October 4, 2014. All in favor. Motion carried. There was a discussion on the drainage issue along Broadfield at the town of Manlius line. Supervisor Marsh stated that she had received a letter from the Town of Manlius about the Whetstone Road

flooding. She has spoken to Brian Donnelly at Onondaga County Dept. of Transportation. He will be setting up a meeting. Councilor Herlihy has been working with Supervisor Marsh on this along with Highway Superintendent Purcell and Town of Manlius Highway Superintendent Rob Cushing. Steve Snell, our engineer from O Brien & Gere, stated that the Town has a drainage easement there and he isn t sure if there is enough capacity on the Manlius side of the Road. The Town of Manlius is looking for us to help with the flow on the Pompey side. The Code Enforcement Officer gave his monthly report of building permits issued and zoning complaints. Attorney Brown reported on the status of the Chen property on Oran Delphi Road. He has initiated enforcement proceedings to be held in Town Court on September 9, 2014. The appearance tickets have been issued to both owners. There has been a problem getting personal service on them. He will explain to the Judge the efforts taken to the get tickets served personally. The supporting deposition has been given to the Court. Attorney Brown also reported on the potential permitting process for solar systems on houses. Town Clerk Christmas had sent him the expedited permitting process that is used in LaFayette. It is a several page document that is filed with the Code Enforcement Officer. He discussed with the Town Board the different ways the Town Court enact this. One way is just by a resolution but there would be nothing in our Code. Another way would be to have a very extensive set of regulations similar to the wind energy systems where there would need to have board approval. This would be very regulatory. The final way would be to enact a brief local law. It would put someone on notice and you would see it in our zoning code which would point individuals to the simplified process the state has set up. It was agreed that Attorney Brown will write up a local law and send it to the Town Board members to review and then set up a

time for a public hearing on the proposed law. R-119-14 Made by Dennis, seconded by Herlihy to approve the monthly reports and bank reconciliations of the Town Clerk, Tax Collector and Supervisor. All in favor. Motion carried. R-120-14 Made by Dennis, seconded by Herlihy to approve the payment of General Fund Abstract Nos. 285-310, totaling $16,936.79; Highway Fund Abstract Nos. 137-153, totaling $39,495.55, Special District Abstract Nos. 25-26, totaling $480.41 and Trust & Agency Abstract Nos. 26-29, totaling $1,302.91. All in favor. Motion carried. R-121-14 Made by Herlihy, seconded by Dennis to approve the following Resolution: WHEREAS, historian Kerry Rose is a 1962 graduate of Fayetteville- Manlius High School and is in the process of writing a book about the high school and centralization which occurred in 1951-1953, and WHEREAS, Mr. Rose has requested permission to use certain text and photos from the book entitled Pompey: Our Town in Profile, which was published by the Town of Pompey in 1976, and WHEREAS, the Pompey Town Attorney and Pompey Historical Society have reviewed the request and are comfortable providing permission to use limited portions of the book for the stated purpose, therefore

RESOLVED, that the Town Board hereby authorizes Mr. Kerry Rose to use the following text and photos from Pompey: Our Town in Profile for the sole purpose of including the information in a book about the F-M High School and centralization which occurred in 1951-1953: Limited to the following: Common School District No. 5 (page 294 text and illustration & text) Salem Corners Consolidated District #6 1813-1951, Indian Hill School (page 295 text) Common School District No. 16 Pompey District No. 13 Root District 1831-1951 (page 308 text) Common School District No. 21, Costello District (page 308 text) Pompey District No. 22, 21: Buellville, 1813-1951 (pages 308 and 309 text and picture) Pompey District No. 16/22 (page 309) text Oran *First request included Chart on page 264 Pompey Schools showing district number and date when established *Picture of cobblestone school from Town of Pompey Historical Society file will need text on page 304. All in favor. Motion carried.

Supervisor Marsh informed the Town Board that she has asked Code Enforcement Officer Penhall to look over the antennae on Sevier Road. She would like him to determine which property goes with which tower and who the owner is. She feels that there may be some antennae that are unused and if they are unused they should be taken down.
