Annexure-II INSTRUCTIONS (To be returned with the duly filled in application form) 1. The application must be submitted in the prescribed proforma downloaded from the Tezpur University Website www.tezu.ernet.in 2. A Quotation Fee (non refundable) of `. 5000/- ( Rupees Five thousand ) only by bank draft in favour of Registrar, Tezpur University payable at State Bank of India, Tezpur must be submitted along with the application. Application without the prescribed Quotation Fee will be rejected. 3. The selected candidate (or applicant) hereafter called caterer shall have to deposit a security money of `. 100,000/- (Rupees One Lakh) only to the University by Demand Draft drawn in favour of Registrar, Tezpur University, payable at State Bank of India, Tezpur Branch, or by Cash before taking over the charge of the cafeteria. This security deposit is refundable on successful completion of the term. However, in case of any fault/damage to the property of the University, recovery will be made from the security deposit if the fault/damage is not repaired to the satisfaction of the University by the caterer. In case the maintenance/repair work is done by the University from the security deposit of the caterer, the amount spent in such works has to be deposited in order to replenish and maintain the Security Deposit at the level of `. 100,000/-. 4. Terms and Conditions (To be signed and submitted with the application) 1. The contract will be effective from the date of acceptance of the office order awarding the contract. The offer has to be accepted with fifteen (15) days of the issue of the office order. 2. The caterer will be responsible for all article issued by the University for the Cafeteria/dhaba/ food hut service.maintenance of the kitchen equipments, premise etc., would be the sole responsibility of the Contractor through authorized service providers of the University. In case the maintenance/repair work is done by the University from the security deposit of the caterer, the amount spent in such works has to be deposited in order to replenish and maintain the Security Deposit at the level of `. 100,000/-. 3. The caterer shall have to arrange for good/standard quality utensils, earthen waves, cutleries, etc. in addition to the items provided by the University. 4. The caterer shall have to serve breakfast, lunch, evening tea and dinner in the cafeteria regularly in addition to providing normal restaurant service. 5. The prices of the items will be charged as per the approved rates by the Canteen Committee from time to time. 6. The caterer shall have to maintain adequate stock of food items. 7. Food served in the cafeteria/dhaba/ food hut service must be fresh and hygienic. 8. Food items must be prepared with certified food ingredients including good quality of oil and spices (if necessary the party may display their most wanted food products) 9. The responsibility of maintaining clearness and hygienic condition in the cafeteria shall be with the caterer. 10. Periodic check on the hygiene, quality, purity and validity in terms of the self lives of served items will be conducted by designated officials of the University/members of the Canteen Committee. 11. The Cafeteria/dhaba/Food Hut service staff must be well behaved, well dressed and presentable. 12. All persons engaged in the cafeteria/dhaba/fast food service must obtain pass with photo identity from the University. 13. Two sets of the prescribed uniforms for the cafeteria/dhaba/food hut service staff, as stated shall have to be provided by the caterer: (i) Male waiters: White (ii) Female waiters: Light Blue (iii) Cooks: Grey with cap (iv) Kitchen helpers: Grey with cap. (v) Cooks: Apron and Head Gear. 14. The caterer must not engage any child labour in the cafeteria/dhaba/food hut. 15. The cafeteria/dhaba/ food hut service shall function from 8.00 a.m. To 9.00 p.m. everyday. The working hours may be modified by the University authority as and when necessary. 16. The cafeteria/dhaba/food hut service must not be kept closed without prior approval of the university authority. 17. The University authority reserves the right to withdraw the contract by serving advance notice of one month, if any of the terms and conditions is violated.
18. Electricity bill/house Rent will be paid by the caterer as per actual basis of the consumption of power without any subsidy. 19. Monthly contract fee quoted by the quotationer and accepted by the University must be deposited to the University within the first week of every month. Late payment charges shall be levied for default in timely and correct payment of rent. 20. The contract for the cafeteria/dhaba/fast food service will be allotted for a period of 2(two) years. However, initial allotment will be one year and service shall be reviewed after 11 months to be extended for the full term for which the allottee shall have to execute an agreement with the University. The agreement of contract may be terminated within the contract period by either side by giving two months notice. 21. The allotment period may be extended further, subject to satisfactory service of the caterer. 22. The caterer will submit interest free refundable security deposit of `. 100,000/- (Rupees One Lakh) only. The security deposit will be forfeited partly or fully if the caterer fails to render proper service at any time during the contract period or fails to pay the monthly rental charge regularly. 23. The caterer will be responsible for any loss or damage of the University property of the allotted building and the cost of the property will be deducted from the security deposit/or will be recovered from the concerned individual/caterer as per rules. 24. University may provide unfurnished accommodation to the staff engaged of the contractor free of charge and staff will avail the allotted accommodation accordingly subject to availability. 25. The Contractor shall be responsible for payment of claims for compensation due to loss of life/injury etc. of any labour engaged in the University work. Medical Insurance cover of the labour engaged by the Contractor shall be the responsibility of the employer (Contractor). Payment of minimum wages as fixed by the Ministry of Labour & Employment, Govt. of India modified from time to time must be ensured by the Contractor. 26. Payment to the staff engaged, must be made within the first week of the month without delay and all payment must be recorded in a proper register. The register must be produced to the authorized Officer on demand. 27. In case of any violation of any law by the Contractor, the Contractor shall be wholly responsible and the University cannot be called or dragged into litigation in any manner. In case, due to violation of any law, including labour law etc. any liability is placed upon the University, the Contractor must indemnify the University completely. 28. The Contractor must be available on call and for this purpose he/she must have a cell phone. A responsible person must be stationed at Tezpur by the contractor to act as the liaison. 29. The University reserves the right to accept or reject any or all quotations without assigning any reason thereof.
