Part D Acceptance Procedure Read the offer letter carefully and ensure that you understand all the requirements of the offer and that you meet all conditions associated with the offer 1. Read and complete all sections of the Enrolment agreement including the refund arrangements 2. Return a completed and signed copy of all sections of the Enrolment agreement to Gold Coast International College by post or email 3. Forward a copy of the 'details page' of your passport to Gold Coast International College by post or email 4. Prior to Confirmation Of Enrolment (COE) of the course pay the required payments to Gold Coast International College by bank cheque, credit card or telegraphic transfer 5. Provide any transcripts relating to RPL or Credit Transfer within 1 week of your chosen intake date or you will be inducted as a completely new student. Note: fee will not be accepted until the Gold Coast International College has received and accepted a completed and signed copy of the Enrolment agreement. After your acceptance documents have been received and accepted and fee paid, Gold Coast International College will send you a copy of your Confirmation of Enrolment (ecoe) so that you can apply for your student VISA. Part E Refund Conditions 1 Tuition fee paid prior to the course commencement date will only be refunded as detailed below. Refund applications must be made in writing to the Institute. The student refund application form, available from the Institute, must be used as the written application. The Institute will accept requests by phone, mail, or email to have the student refund application form sent to them. Refunds will be made within 28 days of receipt of a written application and include a statement explaining how the refund was calculated. The list of which fee are subject to refund arrangements, calculation formulae and sample refund calculations appear below in this agreement. 2 The following is a list of all applicable and possible fee payable. Airport meeting Out sourced contact staff for details Refundable in accordance with the service provider s contract with the student. 3 Student Default Defined: An overseas student or intending overseas student defaults, in relation to a course at a location, if: a) the course starts at the location on the agreed starting day, but the student does not start the course on that day (and has not previously withdrawn); or b) the student withdraws from the course at the location (either before or after the agreed starting day); or c) the registered provider of the course refuses to provide, or continue providing, the course to the student at the location because of one or more of the following events: the student failed to pay an amount he or she was liable to pay the College, directly or indirectly, in order to undertake the course; the student breached a condition of his or her student visa; misbehaviour by the student. 1 Students are entitled to 3 assessment attempts for each unit. If the student is unsuccessful after 3 assessment attempts they will be required to repeat the unit and pay the repeat unit fee. Students found to have cheated or plagiarized work will not be entitled to re-sit assessments, instead they will be required to repeat the unit and pay the repeat unit fee. 4 Refund Amounts for Student Default as described in 3a) or 3b) or 3c) above Gold Coast International College agrees to refund within 28 days of the receipt of written notice of cancellation by the student. All tuition fee paid by or on behalf of the student will be refunded as detailed below: a) If an offshore student visa application is refused 100% of Tuition Fee b If written notice is received 14 days or more prior to the course commencement date. 50% of Tuition Fee c) If written notice is received within 14 days prior to the course commencement date. No refund of Tuition Fee d) If a student breaches a visa conditions, does not pay fee on time, or has their enrolment No refund of Tuition Fee. suspended or cancelled. e) Student default except if written notice is given as indicated in items a), b) or c) above No refund of Tuition Fee. 5 In the case of Provider Default and Student Visa Refusal after course commencement students will receive refunds in accordance with the Australian Government Education Services for Overseas Students (Calculation of Refund) Specification 2014. Copies of the calculation method are located on the Institute website and can be requested from Reception at Gold Coast International College The refund will be paid to you within 14 days of the day on which Gold Coast International College defaults on the commencement or delivery of the course. Alternatively, you may be offered enrolment in an alternative course by Gold Coast International College at no extra cost to you. You have the right to choose whether you would prefer a refund as outlined above, or to accept a place in another course. If you choose placement in another course, we will ask you to sign a document to indicate that you accept the placement in another course without payment of a refund. If Gold Coast International College is unable to provide a refund or place you in an alternative course the Tuition Protection Service will be responsible for providing refunds or providing assistance to locate an alternative. However, students are primarily responsible for finding another college that will accept them into an alternative course. 6 Refund Calculation Example Provider Default and Student Visa Refusal after Course Commencement 1. The refund amount = weekly tuition fee x the number of weeks in the default period 2. The weekly tuition fee = total tuition fee for the course / number of calendar days in the course x 7. This amount is rounded up to the nearest whole dollar. 3. The number of weeks in the default period = number of calendar days from the default day to the end of the period to which the payment relates / 7 Example Calculation 1 Provider Default Sabrina is enrolled in a course in a 42-week (294 calendar days) course that costs $8,000. She pays the provider $4,000 in tuition fee before commencing the course. This payment relates to the first 12 weeks (84 calendar days) of the course. The provider defaults on day 20 of the course. a) Weekly tuition fee = ($8,000 / 294 calendar days) 7 = ($27.210884) 7, rounded up to the nearest whole dollar = $191 b) Weeks in default period = (84 calendar days to which payment relates 20 calendar days from start of course to default day) / 7 = 64 / 7 = 9.1428571 weeks, rounded up to the nearest whole week = 10 weeks c) Refund amount: Weekly tuition fee weeks in default period = $191 10 = $1,910 Under section 7 of the new refund specification, Sabrina s refund would be $1,910. Example Calculation 2 Student Visa Refusal After Course Commencement Rani is living in Sydney and has just completed a Certificate IV in Hospitality. She decides she would now like to undertake a 40-week (280 calendar day) VET Diploma, and she applies for a new visa. The tuition fee for the whole course are $10,000, but Rani pays $5,000 tuition fee up front for the first half (140 calendar days) of the course. Rani also pays the provider $500 in non-tuition fee. Rani starts the course while awaiting the outcome of her new visa. Two weeks into the course she is refused a visa. She informs her provider and withdraws from the course with effect from the day she was refused the visa (14 calendar days into the course). a) Weekly tuition fee = ($10,000 / 280) 7 = $250 b) Default occurs at day 14, therefore number of calendar days between the default day1 and the end of the period to which the payment of $5000 relates (140 days) is 140 days minus 14 = 126 days (126 / 7) = 18 (weeks in default period) c) Refund amount: Weekly tuition fee weeks in default period = $250 18 = $4,500 7 Prior to a student enrolling fee may be altered without notice. Once a student has completed enrolment, fee will not be subject to change for the normal duration of the course. If a student extends a course length then any fee increases will be required to be paid for the extended component of the course. 8 Any course fee or tuition fee collected by an agent on behalf of Gold Coast International College are treated as fee collected by Gold Coast International College for the purposes of calculating any refund entitlements. Fee collected by Agents and commissions paid to Agents are not deducted from any refunds Gold Coast International College is required to pay to students. Part F Other Information 1 Students may initiate a request to defer commencement of studies or suspend their studies on the grounds of compassionate or compelling circumstances. Students wishing to defer the commencement of studies or suspend their studies must apply to do so in writing to Gold Coast International College. Gold Coast International College may decide to suspend or cancel a student s enrolment on its own initiate as a response to misbehaviour by the student. Deferral of commencement, suspension of enrolment and cancellation of enrolment has to be reported to the Department of Education and the Department of Immigration and Border Protection and may affect the status of a student visa. 2 Students must notify Gold Coast International College of changes of address, telephone number, email address and fax number within 7 days of the change. This is required by visa condition 8533. Failure to do this may mean the student may not receive important information which may affect their course, their enrolment or their visa. On commencement and at least every six months whilst you are enrolled at Gold Coast International College you will be asked to review and update your contact information with Gold Coast International College. 3 This enrolment agreement, and the availability of complaints and appeals processes, does not remove the right of the student to take action under Australia s consumer protection laws. 4 Students are entitled, at no additional cost, to a formal Statement of Attainment on withdrawal, cancellation or transfer, prior to completing the qualification, provided the student has paid in full for the tuition related to the units of competency to be shown on the Statement of Attainment. Course credentials will not be issued to students who are in breach of any part of this agreement. 5 Letters of release will not be issued to students who are in breach of any part of this agreement. 6 Students are entitled to 3 assessment attempts for each unit. If the student is unsuccessful after 3 assessment attempts they will be required to repeat the unit and pay the repeat unit fee. More details are in the Student Handbook. Part G - Student declaration and acceptance of the enrolment agreement I understand the terms of this enrolment agreement and the refund conditions and confirm that I am over 18 years of age and have been fully advised of the fee, refund conditions and conditions of enrolment and agree to be a student at the Institute. Information is collected on this enrolment agreement and during your enrolment in order to meet the Institute obligations under the ESOS Act and the National Code 2007; and to ensure student compliance with the conditions of their visas and their obligations under Australian immigration laws generally. The authority to collect this information is contained in the Education Services for Overseas Students Act 2000, the Education Services for Overseas Students Regulations 2001 and the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2007. Information collected about you on this form and during your enrolment can be provided, in certain circumstances, to the Australian Government and designated authorities and, if relevant, the Tuition Protection Service. In other instances information collected on this form or during your enrolment can be disclosed without your consent where authorised or required by law. I confirm that all the information provided in this enrolment agreement is complete and correct. I agree to be bound by Gold Coast International College rules and regulations in force from time to time and otherwise to follow acceptable codes of behaviour, attendance and academic performance and show a concern for other students. I agree that all fee and charges required under this agreement must be paid in full prior to course commencement unless a payment plan is arranged with the Institute.
