Short title and commencement. (1) These regulations may be called the Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College (Amendment) Regulations, 2013. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Establishment of New Medical College, Opening of New or Higher Course of Study or Training and Increase of Admission Capacity by a Medical College Regulation, 2003 (hereafter referred to as the principal regulations), in regulation 6, - (i) in sub regulation (1),- (A) for clauses (b) and (e), the following clauses shall be substituted, namely:- (b)(i) for intake capacity upto sixty seats single piece of land, not less than three acres; for intake from sixty one to hundred seats, the land shall not be less than five acres and in not more than two plots at a distance not exceeding two kilometer; (ii) the plot, if separated by a road or canal or rivulet but connected with a bridge, shall be treated as one piece of land. The land should be owned by the college or possessed on lease, in the name of the college, of not less than ninety nine years or maximum permissible period as per State regulations. Renewal of permission shall, however, be required on expiry of lease; (e) owns and manages a hospital in Indian medicine as specified in the notified Minimum Standard Requirements Regulations of concerned system of Indian medicine; ; (B) after clause (e), the following clause shall be inserted, namely:-
¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 (ea) is in a position to establish infrastructure and manpower in phased manner as specified in the notified Minimum Standard Requirements Regulations of concerned system of Indian medicine; ; (C) for clauses (g), the following clause shall be substituted, namely:- (g) is in a position to provide performance bank guarantee from a Scheduled Commercial Bank valid for a period of five years in favour of the Central Council of Indian Medicine, New Delhi, for the establishment of medical college as follows: Upto 60 seats - rupees one crore 61-100 seats - rupees one crore and fifty lakhs. Provided that it shall not apply to the colleges governed by the State or Union Territory Governments, if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per the time bound programme indicated by them; ; (ii) in sub regulation (2),- (A) for clause (d), the following clause shall be substituted, namely:- (d) is recognised by the Central Council for running Under-Graduate or Post-Graduate courses in Ayurveda or Siddha or Unani for at least four years six months and three years respectively; ; (B) for the portion beginning with the words, brackets and letter (g) the Ayurveda and ending with the words on the same subject, the following shall be substituted, namely:- (h) the Ayurved or Siddha or Unani Tibb College or institution provide an undertaking to furnish a bank guarantee in favour of the Central Council of Indian Medicine, New Delhi, from a Scheduled Commercial Bank for a period equivalent to the duration of the course for providing additional infrastructural facilities for each discipline as follows:- Post-graduate course - rupees fifty lakhs Post-Graduate diploma Course - rupees ten lakhs Super-specialty course - rupees one crore Any other recognised course - rupees thirty lakhs Provided that it shall not apply to the colleges governed by the State or Union Territory Governments, if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per the time bound programme indicated by them; ; (C) after the clause (h) so added, the following new clause shall be inserted, namely:- (i) in a position to establish infrastructure and manpower in such manner as specified in the notified Post- Graduate Regulations of concerned system of Indian Medicine and any other concerned regulation. ; (iii) in sub regulation (3),- (A) for clauses (d), the following clause shall be substituted, namely:- (d) has completed a period of four and a half year in case of Under-Graduate course and three years in case of Post-Graduate course and two years in the concerned subject in case of Post-Graduate Diploma course; ; (B) for clause (h), the following clause shall be substituted, namely:- (h) provide an undertaking to furnish a bank guarantee in favour of the Central Council of Indian Medicine, New Delhi, from a Scheduled Commercial Bank for a period equivalent to the duration of the course for providing additional infrastructural facilities for each course or discipline as follows:- Under-Graduate course : Up to 60 seats : rupees twenty five lakhs 61 to 100 seats : rupees fifty lakhs Post-Graduate degree : per seat : rupees five lakhs Super-specialty course : per seat : rupees ten lakhs Any other recognised course : per seat : rupees two lakhs
6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III SEC. 4] Provided that it shall not apply to colleges governed by the State or Union Territory Governments, if they give an undertaking to provide funds in their Plan Budget regularly till the requisite facilities are fully provided as per the time bound programme indicated by them;. 3. In principal regulations, for regulation 9, the following regulation shall be substituted, namely:- 9. Permission Order. (1) The Central Government on the recommendation of the Central Council shall issue a Letter of Intent to set up a new medical college or open new course or increase intake capacity with such conditions or modifications in the original proposal as may be considered necessary. (2) The Letter of Intent to set up a new medical college shall include a clear cut statement of preliminary requirements to be met in respect of buildings, infrastructural facilities, medical and allied equipment, faculty and staff before admitting the first batch of students. (3) The Letter of Intent to open new course or increase intake capacity shall include a clear cut statement of preliminary requirements to be met in respect of buildings, infrastructural facilities, medical and allied equipment, faculty, staff and obtaining the permission or conditional permission for existing under-graduate and/or postgraduate courses. (4) The Letter of Permission shall be issued after the above conditions and modifications specified in subregulations (2) and (3) are accepted and the performance bank guarantees for the required sums are furnished by the person and after receiving the recommendations of the Central Council of Indian Medicine. (5) The formal permission shall be include a time bound programme for the establishment and expansion of the medical college and the hospital facilities and it shall also define annual targets as may be fixed by the Central Council to be achieved by the person to commensurate with the intake of students during the following years. (6) The permission to establish a medical college and admit students shall be granted initially for a period of one year and shall be renewed on yearly basis subject to verification of the achievements of annual targets. It shall be the responsibility of the person to apply to the Central Council of Indian Medicine for the purpose of renewal six months prior to the expiry of the initial permission. This process of renewal of permission shall continue till such time the establishment of the medical college and expansion of the hospital facilities are completed and a formal recognition of the medical college is granted. However, admissions shall not be made at any stage unless the requirements of the Central Council are fulfilled. The Central Government shall at any stage convey the deficiencies to the applicant and provide him an opportunity and time to rectify the deficiencies. (7) The Central Council may obtain any other information from the proposed medical college as it deems fit and necessary. (8) The order passed by the Central Government under sub-section (9) of section 13A of the Indian Medicine Central Council Act, 1970 shall clearly indicate the preliminary requirements about setting up of buildings, infrastructural facilities, medical and allied equipment, faculty and staff before admitting the students of first batch and subsequent batches. 4. In principal regulations, in Form-1, in serial number 23, for sub-serial (b), the following sub-serial shall be substituted, namely:- (b) bed distribution, bed occupancy and whether the norms specified in Minimum Standard Requirements Regulations of the concerned system of Indian Medicine would be fulfilled. 5. In principal regulations, in Form-6,- --------------------------------------------. (i) for paragraph 2, the following paragraph shall be substituted, namely:- 2. The inspection report and all other related papers were placed before the Executive Committee of the Council in its meeting held on. On careful consideration of the proposal, the Executive Committee decided to recommend for approval or disapproval of the Scheme for issue of letter of Intent or Permission. The decision of the Executive Committee has been approved by the General Body in its meeting held on. ; (ii) in paragraph 3, for sub-paragraph (iii), the following paragraph shall be substituted, namely:-
