1 (4) The ordinances of Omnia Education contain regulations concerning the student s rights and obligations, which are based on the current legislation on education. The objective of the ordinances is to promote unhindered learning and guarantee Omnia s students, learners, trainees and entire personnel a safe and comfortable working environment. The ordinances are applied in Omnia facilities and courtyards as well as other environments related to studying. The rules must be observed in all events organised by Omnia or a third party where the student is participating as a representative of Omnia. 1. A SAFE AND COMFORTABLE LEARNING AND TRAINING ENVIRONMENT The student has the right to a safe learning or training environment. Omnia has the duty to ensure the student s health and safety with the necessary means (L738/02). The student must promote a positive atmosphere by his or her behaviour. Mental and physical abuse, bullying and disturbance are not allowed in any shape or form. Bullying will be dealt with immediately. The student acknowledges responsibility for his or her part in the proper use of the premises and courtyards and their cleanliness. The student has an obligation to familiarise him or herself with the departmental and field-specific safety regulations and plans as well as follow them and the instructions given by the personnel. The student must wear the appropriate work and protective clothing and other protective equipment as instructed both in class and in his or her work. It must be possible to identify the student participating in learning situations or when visiting the educational institute. The student is obliged to advise the personnel of any defects or shortages in teaching equipment, the property, general safety or work safety. Sensitive and confidential information received in the course of learning or at the workplaces is governed by confidentiality. Traffic and parking on the premises of Omnia are subject to traffic rules and property-specific guidelines. Omnia has a recording camera surveillance system. Omnia has an operational policy to promote peaceful learning and prevent bullying (www.omnia.fi) Omnia has operational principles to guarantee equal treatment for all students (www.omnia.fi). 2. SMOKING, SNUFF AND INTOXICANTS Omnia is a smoke-free institution. Smoking and the handling or use of smoking paraphernalia (including e-tobacco) is prohibited on Omnia s premises and courtyards (L639/76 and L765/94). Supply, possession and use of intoxicants and drugs and appearing under their influence are prohibited (L1143/1994, L1289/1993 and L1304/1993). Omnia has policies in place to intervene with the consumption of intoxicants (www.omnia.fi) 3. OTHER REGULATIONS No such items or materials in any shape or form are allowed in the institution whose possession is against the law or that can endanger the personal safety or the safety of others or that are particularly well-suited for damaging property and for whose possession no acceptable reason is found. All matters related to study records will be dealt with integrity and honesty. The use of the information network and systems of Omnia by students and trainees is governed by separate user regulations (www.omnia.fi). The use of mobile phones or other mobile devices and photography and audio-visual recording in learning situations is subject to permission.

Publication of picture or video material recorded in Omnia s premises and events without the express permission of the persons who can be identified from the material is prohibited. Running one s own business in learning situations and on Omnia s premises is subject to permission. 2 (4) PARTICIPATION IN STUDIES The following apply to all Omnia Education students and also to activities provided by upper secondary school for adults, liberal adult education and adult education centre courses or youth workshops, where applicable. The student has a right to receive tuition and guidance in accordance with the curriculum. Omnia is responsible for providing the education in accordance with the curriculum and schedule. The student must complete his or her tasks conscientiously and prepare him/herself for learning situations according to the teacher s advice with the relevant tools and supplies. The student must participate in the tuition in accordance with the personal study plan, unless he or she has been exempted or awarded recognition/acknowledgement of competence or unless the individual study plan contains alternative completion methods. During on-the-job learning and work experience periods, the student must adhere to the working times and regulations agreed with the workplace. It is the student s duty to advise unavoidable absences immediately to the teacher or tutor. Medical certificates from a doctor or nurse must be submitted for absences of more than five days or upon request. The student shall negotiate and agree on any predictable unavoidable absences and their compensation in advance. Permission for authorised leave of absence is granted by the head of education. The student must complete his or her studies within the time prescribed in applicable law. More specific instructions on participating in tuition and studies are provided in specific tuition guides. DISCIPLINARY PROCEDURES FOR A BREACH OF THE REGULATIONS The student will be instructed primarily by means of discussion and advice, so that he or she has the opportunity to complete his or her studies. As a rule, student absences and minor disputes will be taken up with the tutor, head of education and sector principal. When necessary, a multidisciplinary team of experts of student welfare services will be assembled to address matters concerning a single student or group of students. Before a disciplinary decision, the student will be heard and a required review will be conducted. Cooperation with the guardians of underage students is important. Omnia Education has prepared more detailed guidelines on disciplinary methods and procedures. The following apply to all Omnia Education students and also to activities provided by upper secondary school for adults, liberal adult education and adult education centre courses or youth workshops, where applicable. The teacher will record student absence and lateness in the student management system. If the student causes disturbance or behaves violently, the teacher/workshop instructor may remove the student from the lesson for a period of the remaining lesson and from the event organised by the institution for a period of the remaining working day. The teacher or another member of personnel may give the student a verbal admonition for a breach of the regulations. A second verbal admonition follows the same guidelines as the first one. The headmaster may give the student a written warning if the breaches continue after verbal warnings or directly if the gravity of the breach so requires. If there is a risk that the student s violent or aggressive behaviour will endanger the safety of others, or if the student s disruptive behaviour will inordinately complicate activities, the head of education may ban the student from participating in tuition for a maximum period of three working days.

The head of education will deem the student as resigned if he or she has not completed his or her studies within the prescribed time or if the student remains absent from tuition without a valid reason and it is obvious that he or she does not intend to continue his or her studies. Forbidden items and materials The principal/sector principal/head of education/workshop instructor and teacher, together or separately, may confiscate forbidden items or materials found on student during the working day. In case the student resists the procedure and the items and materials in question are endangering the immediate safety of the student and others, the principal/sector principal/head of education/workshop instructor and teacher may use force to obtain the forbidden item or material. During the working day, the teacher and head of education/sector principal/principal/workshop instructor have the right to inspect Omnia storage facilities in the student s possession and his or her clothing by patting in order to confiscate a forbidden item or material if the possession of such item or material is obvious and he or her refuses to surrender it upon request or does not reliably demonstrate that no such items or materials are in his or her possession. Confiscated items and materials will be returned to the student or guardian of an underage student or other appropriate representative. Confiscated drugs, firearms, parts of weapon, cartridges, projectiles and pepper sprays as well as explosives and such like will be handed over to the police immediately. Items and materials to be returned to the student him or herself will be returned after the working day. If the items and materials are not collected within three months of the notification, they may be disposed of in a verifiable way. Cancellation of the right to tuition Student s legal protection committee will decide on the possible cancellation of the right to tuition if it has become obvious that the student is unfit to participate in the practical tasks or on-the-job learning included in the studies. Student s legal protection committee may make the decision on the temporary dismissal of the student, if the breach is serious or if the student continues the unauthorised behaviour after a written warning. The student can be dismissed for a maximum period of one year. The student and the guardian of an underage student will be heard before dismissal. If the student refuses to allow health examinations and inspections (including the so-called drug test) to determine his or her health, the student s right to tuition may be withdrawn until such time that he or she allows the required examinations and inspections. Liability for damages Liability for damage or loss by negligence to Omnia s property will be determined in accordance with the Tort Liability Act (412/74). Omnia s insurance covers students participating in the Omnia Education s curriculum-based activities. If the student is absent without permission from the school premises or other learning environment, his or her insurance is not valid. MONITORING AND REVIEW OF THE ORDINANCES The tutor/group supervisor/workshop instructor will go through the ordinances with all students at the beginning of the term. The ordinances will be reviewed annually or when necessary. The ordinances are available at www.omnia.fi.
