Town of East Fishkill Board Meeting Minutes February 23, 2017 1 REGULAR BOARD MEETING MINUTES TOWN OF EAST FISHKILL TOWN BOARD MEETING FEBRUARY 23, 2017 7:00 p.m. The Town of East Fishkill's Town Board Meeting on February 23, 2017 was called to order at 7:00 p.m. by Supervisor John Hickman, Jr. with the Pledge of Allegiance to the Flag. Supervisor's Announcements Supervisor Hickman stated the East Fishkill Fire District is looking for EMS volunteers. He thanked all the volunteers for their time. He also talked about the freeze on the EPA contracts and the EPA has said the Ryan Drive, Hopewell Precision Superfund has been funded and will begin work this spring. Roll Call: Supervisor Hickman asked Town Clerk Hurray to call the rolls. Board Members in Attendance were Peter Nicolas Thomas Emanuele John Cassidy D Alessandro Franco Marinaro Hickman Also in attendance were: Tom Wood, Attorney; and Mark Pozniak, Comptroller. Approve Minutes: January 12, 2017 January 26, 2017 Motion to approve the minutes from the January 12 and January 26, 2017 meeting: Board Member Cassidy. Seconded: Board Member Franco. All voted in favor. Motion carried. Receive and File: Supervisor Hickman stated there was nothing received. Public Comments on Agenda Items Only: Supervisor Hickman asked if there was anyone to speak on the agenda items only.

Town of East Fishkill Board Meeting Minutes February 23, 2017 2 A resident spoke about moving the Recreation Department to Lime Kiln. Marty spoke about moving the Recreation Department to Lime Kiln. Public Hearing: None Resolutions: 1. Authorize a Referendum to consider dissolving the Hillside Lake Park District (REFERRING PETITION SEEKING TO DISSOLVE THE HILLSIDE LAKE PARK DISTRICT) WHEREAS, on January 12, 2017, a Petition was filed with the Town Clerk seeking to dissolve the Hillside Lake Park District pursuant to Article 17-A Title 3 of the General Municipal Law; and WHEREAS, the Town Attorney had previously suggested an alternate procedure due to concerns that Article 17-A does not fully address the limits on the transfer of park land; and WHEREAS, the Town Clerk determined that the Petition contains sufficient signatures to be considered under the General Municipal Law; NOW, THEREFORE, BE IT RESOLVED, that the Petition and the questions presented be referred to Thomas Myers, Esq. of Orrick Herrington and Sutcliffe, LLP, experts in Special District creation and dissolutions; and BE IT FURTHER RESOLVED, that their recommendations be received by the Town Attorney who will keep this Board advised Motion to authorize a referendum to consider dissolving the Hillside Lake Park District: Board Member Marinaro. Seconded: Board Member Franco. All voted in favor. Motion carried. 2. Authorize Town Pi Day Recognition (MATH RECOGNITION DAY)

Town of East Fishkill Board Meeting Minutes February 23, 2017 3 WHEREAS, The Town of East Fishkill is proud to recognize March 14 th as Pi Day Math Recognition Day; and WHEREAS, Pi Day is observed throughout the nation and the world; and WHEREAS, the Math & Physics Exploration, Inc. will be recognizing the Town s outstanding mathematic students of Gayhead Elementary School; and WHEREAS, this day promotes the importance of mathematics education for our youth to grow and prosper in an innovative and economic way; and NOW, THEREFORE, BE IT RESOLVED The Town of East Fishkill does hereby proclaim March 14, 2017 as Pi Day. Motion to authorize Town Pi Day Recognition: Board Member Marinaro. Seconded: Board Member Cassidy. All voted in favor. Motion carried. 3. Appointing Camp and Red Wing Directors (AUTHORIZING THE HIRING OF DIRECTORS FOR CAMP AND RED WING PARK) WHEREAS, the Town of East Fishkill conducts extensive summertime programs for the youth of the Town; and WHEREAS, the Director of Recreation has requested the hire of Hannah Oppenheim and James Traill as Co-Directors and Olivia Oppenheim as Activities Director of the East Fishkill Town Camp; and WHEREAS, the Director of Recreation has also requested the hire of Joseph Zarrella and Kerri Tracy as Co-Directors of Red Wing Park; and WHEREAS, it is the desire of the Town Board to authorize these employees for the summertime period; and BE IT FURTHER RESOLVED, that said employment shall only be for summertime employment and that upon completion of their task, they shall be removed from the payroll, unless further ordered by the Town Board. Motion to appoint Camp and Red Wing Directors: Board Member Marinaro. Seconded: Board Member Franco. All voted in favor. Motion carried. 4. Authorize Sons of Italy Request for use of the Recreation Fields on May 26, 27, 28 and 29

Town of East Fishkill Board Meeting Minutes February 23, 2017 4 (AUTHORIZING THE CLOSURE OF THE HOPEWELL RECREATION FIELDS) WHEREAS, the Sons of Italy conduct their annual event to provide entertainment to the community and to raise funds for charitable purposes; and WHEREAS, the Town has traditionally allowed them the use of the Hopewell Recreation Field for this purpose; and WHEREAS, a written request has been received by the Town for 2017; and THEREFORE, BE IT RESOLVED, that the Sons of Italy annual event to be held on May 26, 2017 thru May 28, 2017 at the Hopewell Recreation Field be and hereby is authorized; and NOW, THEREFORE BE IT RESOLVED, that May 29, 2017 would be available to the Sons of Italy in the event they lose a day due to inclement weather; and BE IT FURTHER RESOLVED, that the Town Police, Town Recreation Department and all other agencies of the Town are authorized and directed to allow the use of the Hopewell Recreation Field by the Sons of Italy on those days; and BE IT FURTHER RESOLVED, that this consent is subject to the receipt of a Certificate of Insurance from the Sons of Italy indemnifying the Town for any liability arising out of their use of the fields. Motion to authorize the Sons of Italy request for use of the Recreation Fields on May 26 29, 2017: Board Member D Alessandro. Seconded: Board Member Franco. Supervisor Hickman recused himself from this vote. All others voted in favor. Motion carried. 5. Approve Memorandum of Agreement with the Federation of Police for 2016-17-18 and 19 (APPROVING MEMORANDUM OF AGREEMENT WITH THE FEDERATION OF POLICE) WHEREAS, the Collective Bargaining Agreement with the Town Police expired on December 31, 2015; and WHEREAS, a proposed settlement has been reached with the assistance of a mediator appointed by the Public Employment Relations Board; and

Town of East Fishkill Board Meeting Minutes February 23, 2017 5 WHEREAS, the Town Board Members have been given a copy of the proposal to review; NOW, THEREFORE, BE IT RESOLVED, that the annexed Memorandum of Agreement with respect to the Collective Bargaining Agreement with the Federation of Police for 2016, 2017, 2018 and 2019 be and hereby is approved; and BE IT FURTHER RESOLVED, that the Supervisor is authorized to execute an agreement as prepared by the Town Attorney reflecting the changes approved herein; and BE IT FURTHER RESOLVED, that the Comptroller be and hereby is authorized to pay any amounts due and owing the employees entitled thereto within 30 days. Motion to approve the Memorandum of Agreement with the Federation of Police for 2016-19: Board Member Marinaro. Seconded: Board Member D'Alessandro. All voted in favor. Motion carried. 6. Set new fees for Peddlers Permits (SETTING PEDDLER S PERMIT FEES) WHEREAS, the East Fishkill Town Clerk issues peddler permits; and WHEREAS, currently there is a $50.00 charge for each permit; and WHEREAS, the cost to the Town for background checks, administration, etc. have increased; and WHEREAS, the Town Clerk has reviewed neighboring Town fees and has requested that the Town Board increase the Peddler s Permit fee to $300.00; and NOW, THEREFORE, BE IT RESOLVED, that the fee to be charged for all Peddler s Permits in 2017 shall be $300.00. NOW, THEREFORE, BE IT FURTHER RESOLVED, that these fees shall take effect February 24, 2017. Motion to set new fees for Peddler s Permits: Board Member D Alessandro. Seconded: Board Member Franco. All voted in favor. Motion carried.

Town of East Fishkill Board Meeting Minutes February 23, 2017 6 Supervisor Hickman stated they are working on the sign law. The Planner will be making a presentation at the next workshop. Budget Transfers: Supervisor Hickman stated there were no transactions requested at this time. Take Public Comments on General Town Issues: Supervisor Hickman asked if there was anybody in the audience who would like to speak on general Town issues. Marty spoke about the sign ordinance. Mr. Wahlers spoke on National Pi Day. Robert Grasso spoke about Hillside Lake. Comments from Town Board Members: Board Member Franco spoke about the possible installation of banners for our "hometown heroes". They made a committee and decided this was something they would like to do and they will be making 3 x 5 cloth banners. If you know of any veterans please contact either Board Member Franco or Board Member D'Alessandro. This project will be coordinated with the East Fishkill Rotary, the Town, and the American Legion Manny Bacon Post. Board Member D'Alessandro stated they are trying to get some of the youth involved also. They met with Don Burns and Kevin Hawthorne as well as some students from John Jay. They may have students from the high school come to the Town Board meeting in May around Veterans Day and do a presentation on one of the "hometown heroes". The students may be able to do interviews with veterans and it could be aired on Channel 22. These are also ways for students to get community service hours. This is one way to keep the veterans stories from getting lost. A lot of families of veterans have come forward stating they would like to sponsor their family member s banners. There are businesses that have also expressed interest. It would be nice if the Town could contribute also. Board Member Franco reiterated if anyone in the public knows a veteran to please contact a Board member so they can all be recognized. Supervisor Hickman thanked Julie Newman for sharing this idea with Board Member Franco. Board Member Marinaro stated he attended a meeting of the Association of Towns. They addressed the lack of funds coming into the towns. The other major

Town of East Fishkill Board Meeting Minutes February 23, 2017 7 discussion was regarding the amount of money collected for the schools with no accountability to the taxpayers. There is a statewide movement toward town officials to contact State Legislators and Senators. He encouraged all taxpayers to attend meetings of the School Boards during their budget discussions. He also wanted to thank the local PBA, the Town Attorney, and the Town Comptroller for their efforts in assisting with the formation of a good Police Contract. He also thanked the Town Board and the Attorney for working together and working towards the wishes of the community at Hillside Lake. He also asked the Town Comptroller if it was possible to not need to purchase additional Highway salt for next year as this winter has been so mild. There is a possible $1 million savings that he believes should be put towards paving. Supervisor Hickman thanked the Board members and Town Professionals that attended the conference. Supervisor Hickman stated there is still a $400,000 outstanding balance due on the BAN for the salt. Comptroller Pozniak suggested waiting until the entire winter is over. He is unsure the amount left over will be close to $1 million but they can check those numbers at that time. Supervisor Hickman stated he is in agreement that any extra funds could be put towards the paving contract.
