DEMING PUBLIC SCHOOLS 1001 SOUTH DIAMOND DEMING, NM 88030 HARVIELEE MOORE, SUPERINTENDENT PROPOSAL #15-01 SPEECH-LANGUAGE THERAPY SERVICES I. Introduction Deming Public Schools intends to acquire Speech Language Services for the 2014-2015, 2015-2016 and 2016-2017 school years and to provide such services to students with disabilities served in the district s programs for student receiving Special Education. Both the district and the vendor will have the option to continue or discontinue the contract at the conclusion of each school year. Notice of intent shall be given in writing by May 15 th of each year. The objective of these services is to provide speech and language therapy for students that have been identified as needing services. Anticipated need: three (3) English Therapists and three (3) Bilingual Therapists 5 days per week, 39 weeks, 7.0 hours per day. One (1) part time Bilingual Therapist 3 Days per week, 39 weeks, 7.0 hours per day. Actual needs may change. Vendor should indicate the number of therapists to be provided. 1. If agreed upon services are not provided district can without notice contract additional services from other contract sources. 2. Contract person or company will provide district with work history and references of all individuals providing services in the district. District will have veto option for personnel. 3. All contract service providers must have all required licenses provided to the district before initiating any services. Payment will only be made for services rendered. Therapist can only bill for related activities and cannot exceed contract days or times. All personnel will be expected to adhere to Deming District Policies and Procedures. District will supply a copy of the Policy and Procedures upon request. Failure to comply with these policies and procedures could result in termination of this agreement. Approval from the Director of Special Student services is required before any staff work beyond the 7.0 hour work day or outside the contract day. Vendors must assume the risk of the method of dispatching any communication or proposal to the District. The District assumes no responsibility for delays or delivery failures resulting from the method of dispatch. Actual or digital postmarking of a communication or proposal to the District by a specified deadline date will not substitute for the District s actual receipt of a communication or proposal. No person shall be excluded from participation in, be denied benefits of, or be otherwise subjected to discrimination in the performance of a Contract pursuant to this RFP or in the employment practices of the vendor on the grounds of disability, age, race, color, religion, sex, national origin, or any other classification protected by federal, New Mexico state constitutional, or statutory law. The vendor pursuant to this RFP shall, upon request, show proof of such nondiscrimination and shall post in conspicuous places, available to all employees and applicants, notices of nondiscrimination. 1
A proposal must not include the vendor s own contract terms and conditions. If a proposal contains such terms and conditions, the District, at its sole discretion, may determine the proposal as a nonresponsive counteroffer and reject it. A proposal must not propose alternate services (i.e., offer services different from those requested and required by this RFP). The District will consider a proposal of alternate services to be nonresponsive and reject it. The district reserves the right, at its sole discretion, to cancel and/or reissue this RFP in accordance with applicable laws and regulations. The vendor resulting from this RFP will be responsible for the completion of all services set out in this RFP or may be amended. All service is subject to inspection and evaluation by the district. The district will employ all reasonable means to ensure that service is progressing and being performed in compliance with the contract, and the vendor must cooperate with such efforts. If the Vendor fails to properly perform its obligations under this contract in a timely or proper manner, or if the vendor violates any terms of this contract, the district shall have the right to immediately terminate the contract. Notwithstanding the above, the vendor shall not be relieved of liability to the district for damages sustained by virtue of any breaks of this contract by the vendor. The vendor shall be responsible for the correct use, maintenance, and protection for all articles of nonexpendable, tangible, personal property furnished by the district for the vendor s temporary use under this contract. Upon termination of this contract, all property furnished shall be returned to district in good order and condition as when received, reasonable use and wear thereof excepted. Should the property be destroyed, lost, or stolen, the vendor shall be responsible to the district for the residual value of the property at the time of loss. II. Proposal Format The proposal should include, at minimum, the following sections: (The proposal format should correlate with the RFP format. Format and ease of reading proposal will be considered.) A. Specifications In this section vendors should describe how their proposal meets these particular requirements. 1. General Requirements a. Availability July 1 st of each year through June 30 th of the following year. Exact dates and number of days will be based on IEP requirements, including Extended School Year Plan, and district staff needs. b. Completion of Medicaid provider application. Complete Medicaid documentation accurately and monthly. c. Comply with background investigation policy, including paying background check expenses. d. Documentation of services provided. e. Work days as per school calendar for instructional staff. Vendor will be allowed a total of 35 flex hours to be worked on non-student contract days. Any required staff meeting/trainings must be attended. Services required to be done in the work day include prep time, travel time between schools, direct therapy, consultation 2
with staff and parents, in-service, participation on Eligibility Determination Team, IEP, required paperwork and staff meetings. 2. Therapy Services a. Provided in compliance with the student s evaluation and IEP. b. Participation at IEP meetings as necessary. c. Assistance to IEP committee in interpreting speech/language test results and reports, determining eligibility and developing Speech and Language goals d. Participation on Eligibility Determination Team as required and consultation with instructional staff as requested. e. Progress reporting due at the end of each grading period as required by the students IEP and end of the year summaries on students progress to be completed by the last day of the school year. f. Develop rapport with school site staff. g. Following appropriate chain of command. h. Therapists will complete articulation evaluations and may be required to complete language evaluations at their assigned schools. B. Personnel Requirements 1. Identify by name, personnel that will be contracted to provide services. 2. Copies of New Mexico Licensure must be attached for each therapist. 3. Therapists must be approved and licenses submitted before their first day of work. If therapists is not contracted within 14 days of the 1 st day of the contract the district has the options of looking at other vendors to fill this vacancy. 4. Vendor must replace any therapist within 15 days of the therapist leaving the district. Failure to do so may result in termination of contract. 5. Ability to converse fluently in English and Spanish is required for Bilingual therapists. (The district reserves the rights to verify bilingual capabilities.) C. Record of Performance This section should include references for proposed therapists. New Mexico school districts are preferred. Preference will be given to vendor with local administration and prior experience with Deming Public School District. D. Price All cost information must be in this section. Vendor should show total hourly rate which includes any additional fees such as mileage etc. If vendor intends to add gross receipts tax, it must be indicated on the proposal. If multiple prices are listed the highest price will be considered. Notice: If a proposer fails to submit a cost proposal exactly as required, the district will deem the proposal to be non-responsive and reject it. A vendor must sign and date a Cost Proposal form and must submit the Cost Proposal form to the District with the sealed proposal. (See attached Cost Proposal form.) The vendor s invoice shall be subject to reduction for amounts included in any invoice or payment theretofore made which are determined by the district, on the basis of audits conducted in 3
accordance with the terms of this contract, not to constitute proper remuneration for compensable services. Vendors may only bill 70% of the accepted hourly rate for ASL s, hours for any supervision of ASL may not be billed to the district. Vendors with SLP s will be given priority over Vendors using ASL (s). III. Evaluation Process and Timelines A. Proposals will be evaluated on a 100-point basis. The scoring will be as follows: 1. Specifications 10 points 2. Personnel Requirements- 25 points 3. Records of Performance 35 points 4. Price 30 points B. Timelines Proposals must be received by the specified deadline. Recommendations will be approved by the District Board of Education and vendors will be notified of acceptance of their proposal within 7 days of the board s decision. IV. School District Contacts A.
