Dated 14.09.2013 to reimburse the refunded amount i.e. Rs.83,989/-on sympathetic ground. The Committee considered the appeal made by Shakeel Ahmad, a student of ph.d., Sir Sulaiman Hall, and viewed that since it was a malicious intention to withdraw advance money to attend the conference at Tunisia, and the student has committed acts of gross misconduct and indiscipline as provided under Part-II Rule-4 (x),(xx),(xxii) of AMU Student s conduct and Discipline Rules, 1985, therefore there is no ground for giving any sympathetic consideration to his request. ------------------------------------------------------------------------------------------------------------------------ Item no. 8: Considered and approved the recommendations of the Standing Establishment-cum-Grievance Committee made at its meeting held on 19.8.2014 Item No. 3 :To consider the appeal preferred by Prof. Anis Ahmad Ansari [Retd] Department of Kulliyat, Faculty of Unani Medicine for protection of his pay for the deputation period in the Department of Ayush, Ministry of Health and Family Welfare, Government of India, New Delhi from 1.12.2001 to 2.12.2006. To examine the appeal preferred by Prof. Anis Ahmad Ansari [Retd] Department of Kulliyat thoroughly, the concerned AFO (Pay Revision Cell) was asked to explain his case before the Committee by the Chairman of the Committee. The AFO (P.R.Cell) explained the entire case in detail. After listening to the AFO (Pay Revision Cell), the Committee has observed that the request of Prof. Anis Ahmad Ansari for securing / protection of his last basic pay which he had drawn during the period of his deputation in the Department of Ayush, Ministry of Health and Family Welfare, Govt. of India is not covered under E.C. Resolution no. 7 dated 6.3.1972. Since the same is not within the rules, he is not entitled for the same. Secondly, Prof. Ansari has also been allowed all annual increments during the period of deputation while making fixation of his pay on account of revision of pay under VI pay Commission effective from 1.1.2006. The arrears of his pay on account of revision of pay under VI pay Commission, have also been paid to Prof. Ansari as per above fixation which has included the annual increments for the whole period of deputation. Zeeshan Azam under Section 36[B] of AMU Act XL 1920 against office Memo LD.Nos.1560/Proc. and 2950/Proc. Dated 24.04.2013 and 4.11.2014 with the request to review the restoration of his residential status. The Committee considered the above appeal filed by Md. Zeeshan Azam, student of B.A.(F) regarding his residential status and observed that since on the basis of facts and circumstances it was prima facie established that Md. Zeeshan Azam had committed different acts of gross misconduct and indiscipline, punishable under Part II Rule 4 clause (iii) and x of AMU Students conduct and Discipline Rules 1985, hence he is not entitled for any sympathetic consideration. The decision of the disciplinary Committee as communicated to him vide letter no. 1560/Proc. The Committee considered the appeal of Mr. Waqas Wasiq Warsi to review the restoration of his residential status and observed that Since Mr. Waqas Wasiq Warsi was made NRSC for the current academic session i.e. 2013-14 vide office Memo LD No. 4105/Proc. Vice -Chancellor, Muslim University, and others) The Committee considered the appeal of Mr. Ayyub Khan, Ex-Teacher of ABK Union High School and after having a detailed discussion it was decided that since he was involved in a politics raised by his relatives because of which he was imprisoned and later on acquitted from all the charges leveled against him by the order dated 4.3.2014 passed by the Additional Session Judge court no II, he should be given re-appointment as early as possible in any School of the University preferably in the ABK Union School. Further, since he is M.Sc. B.Ed., the Committee recommended that he should be absorbed in the first slot of vacancy that occurs in any school of the University. In the meantime the legal opinion may be obtained with regards to his reappointment so that no legal implications may affect the matter at a later stage. Condonation of break in service for the purpose of giving continuity in service where such break commenced on or after 18.6.1988. From March 2008 onwards the same clause is reading as under: 23. Condonation of break in service for the purpose of giving continuity in service where such break commenced on or after 18.6.1998. In this regard it is to inform you that the date 1988 and 1998 are confusing a lot and a lot of applicants are being deprived of from condonation due to the date of break commencing on 1998.(copies enclosed) In views of above you are requested kindly to confirm this office of the correct position, so that necessary action may be taken accordingly. It is further requested that amendment if any, in the referred Ordinances may kindly be intimated.
