COMPLIANCE COMMITTEE CC/11/2012/3 12 October 2012 Status of submission and review of reports under the Kyoto Protocol Note by the secretariat 1. This note provides information on the status of submission and review of fifth national communications (NC5), and the annual reports submitted in 2011 and 2012 under decision 15/CMP.1, from Parties included in Annex I to the Convention (Annex I Parties) that are also Parties to the Kyoto Protocol as at 4 October 2012. 2. In accordance with decision 10/CP.13 Annex I Parties are to submit to the secretariat a fifth national communication by 1 January 2010 following the requirements of Article 12, paragraphs 1 and 2, of the Convention. In accordance with decision 8/CMP.3 Annex I Parties that are also Parties to the Kyoto Protocol are to include in the NC5s the necessary supplementary information under the guidelines established under Article 7 of the Kyoto Protocol. 3. Until 4 October, 2012, the secretariat has received 39 NC5s (see table 1). All received NC5s were reviewed in in-country reviews or in centralised reviews. In 2011, the secretariat received 41 annual inventory submissions from Annex I Parties (see table 2) under the Kyoto Protocol. Thirty-eight submissions listed in table 2, containing information under Article 7, paragraph 1, of the Kyoto Protocol, have been made by the Parties in accordance with decision 15/CMP.1 for the second year of the commitment period. 5. Belarus, which is Annex I Party to the Kyoto Protocol, indicated that its 2011 annual submission was under the Convention. In accordance with the COP conclusion (FCCC/CP/2001/13/Add.4, section V.C.) and following ratification of the Kyoto Protocol by Kazakhstan on 19 June 2009 and its entry into force on for Kazakhstan on 17 September 2009, Kazakhstan is considered an Annex I Party for the purposes of the Protocol but remains a non-annex I Party for the purposes of the Convention. Kazakhstan indicated that its 2011 annual submission is made under the Convention and the Kyoto Protocol. Turkey is Annex I Party to the Kyoto Protocol. Turkey indicated that its 2011 annual submission is made under both the Convention and the Kyoto Protocol. Since Belarus does not yet have a quantified emission limitation and reduction commitment (QELRO) for the first commitment period, - 2 -

COMPLIANCE COMMITTEE CC/11/2012/3 12 October 2012 and since both Turkey and Kazakhstan do not have a QELRO inscribed in Annex B to the Kyoto Protocol, their submissions are being treated as submissions under the Convention. 6. The secretariat coordinated reviews of 38 of the reports indicated in paragraph 4 above, following the Article 8 guidelines of the Kyoto Protocol. Nine of the individual reviews of these submissions, those of Czech Republic, Iceland, Lithuania, Luxembourg, Netherlands, Romania, Slovakia, Spain and Ukraine, were scheduled as in-country reviews and the rest were scheduled as centralized reviews. Altogether, seven centralized reviews were organised between 29 August and 24 September 2011 in Bonn, Germany. The reports from both, in-country and centralised reviews of Annex I Parties annual submissions have been published on the UNFCCC website, 1 with the exception of the report of the Russian Federation which is under preparation at this point of time. As at 4 October 2012, this amendment has not yet been ratified by enough Parties to allow its entry into force. Since Belarus does not yet have a quantified emission limitation or reduction commitment inscribed in Annex B to the Kyoto Protocol, its submission is being treated as a submission under the Convention. b In accordance with the COP conclusion (FCCC/CP/2001/13/Add.4, section V.C.) and following ratification by Kazakhstan of the Kyoto Protocol on 19 June 2009 and its entry into force on 17 September 2009, Kazakhstan is considered an Annex I Party for the purposes of the Protocol but remains a non-annex I Party for the purposes of the Convention. Kazakhstan indicated that its 2011 annual submission is made under the Convention and the Kyoto Protocol. Since Kazakhstan does not have a quantified emission limitation or reduction commitment inscribed in Annex B to the Kyoto Protocol, its 2011 annual submission is being treated as a submission under the Convention. c Turkey indicated that its 2011 annual submission is made under both the Convention and the Kyoto Protocol. However, since Turkey does not have a quantified emission limitation or reduction commitment inscribed in Annex B to the Kyoto Protocol its submission is being treated as a submission under the Convention. - 7 -

COMPLIANCE COMMITTEE CC/11/2012/3 12 October 2012 7. In 2012, the secretariat received 41 annual submissions from Annex I Parties (see table 3). Thirty-eight of these submissions, containing information under Article 7, paragraph 1, of the Kyoto Protocol, have been made by the Parties in accordance with decision 15/CMP.1 for the third year of the commitment period. As described above, Belarus does not yet have a QELRO inscribed in Annex B to the Kyoto Protocol and Kazakhstan and Turkey do not have a QELRO inscribed in Annex B to the Kyoto Protocol. The 2012 annual submissions of those Parties are being treated as submissions under the Convention. Status reports for 41 submissions had been prepared and published on the UNFCCC website. 2 These status reports were also forwarded to the Compliance Committee by September 2012, except for those of Belarus, Kazakhstan and Turkey. 8. The secretariat is coordinating 38 reviews of these reports following Article 8 guidelines of the Kyoto Protocol. Ten of the individual reviews of these submissions, those of Belgium, Croatia, Estonia, Finland, Greece, Lithuania, Norway, Portugal, Slovakia and United Kingdom, are scheduled as in-country reviews and the rest are scheduled as centralized reviews. Altogether, eight centralized reviews have been organized between 3 29 September 2012 in Bonn, Germany.
