Mayor Troy T. Brimage called the meeting to order at 6:00 p.m. Invocation. Wallace Shaw offered the invocation. Pledge of Allegiance. Mayor Troy T. Brimage led the Pledge of Allegiance. Attending citizens and their business There were none.

Consideration of approving the minutes for October 1, 2018 meeting On a motion by Councilman Bass, seconded by Councilman Yates, with all present voting Aye, Council unanimously approved the minutes for October 1, 2018 meeting. Consideration of a Resolution No. 2018-2558 appointing Toni M. Davis as member of the Beautification/Parks and Recreation board. Mayor Brimage stated that he knows Ms. Davis and she is an outstanding individual and he thought she d be a great addition to the board. On a motion by Councilman Bass, seconded by Councilman Green, with all present voting Aye, Council unanimously approved appointing Toni M. Davis as a member. Consideration of a Resolution No. 2018-2559 appointing Dolores A. Knox as member of the Beautification/Parks and Recreation board. Mayor Brimage stated that he knows Ms. Knox and she would also be a great addition to the board. Council unanimously approved appointing Delores Knox as a member. Consideration of adopting Resolution No. 2018-2560 adopting the 2017 Brazoria County Hazard Mitigation Plan Fire Chief Chris Motley stated that HGAC hired a contractor. Chief Motley also stated that by the city adopting this resolution it allows the city to be eligible to receive mitigation grants and helps with funding. Chief Motley stated that this is updated every five to seven years. Council unanimously approved adopting Resolution No. 2018-2560 adopting the 2017 Brazoria County Hazard Mitigation Plan. Consideration of authorizing the Mayor to sign and the City Secretary to attest an agreement with Brazoria County, Texas, to fund improvements to the Skinner Elevated Water Tower located in or adjacent to Riverside Park using CDBG funds or other CDBG assets, including program income Mayor Brimage stated that the city will use grant money to renovate the water tower. Bids will be awarded at the next meeting. On a motion by Councilman Bass, seconded by Councilman Green, with all present voting Aye, Council unanimously approved authorizing the Mayor to sign and the City Secretary to attest an agreement with Brazoria County, Texas, to fund improvements to the Skinner Elevated Water Tower located in or adjacent to Riverside Park using CDBG funds or other CDBG assets, including program income. Review and consideration of the Texas Colt LLC Pipeline Project survey authorization form Interim City Manager Bob Welch stated that Texas Colt LLC requested the City s approval for this survey to be completed. Mr. Welch stated that the survey would take place in approximately a week.

On a motion by Councilman Yates, seconded by Councilwoman Loeza, with all present voting Aye, Council unanimously approved the review and consideration of the Texas Colt LLC Pipeline Project survey authorization form Consideration of authorizing the City Secretary to advertise for bids for the sale of Lot 8, Block 8, Velasco Townsite locally known as 5 South Ave B, Freeport and set a bid date. Councilman Ken Green stated that the owners of the adjacent property on the east side recently purchased the building previously owned by Dragon Fire. Councilman Green said that they have brought the building up to code and will have a t-shirt graphics business. They hope to open on November 15, 2018. They approached the city requesting to purchase the property. The bid opening will be held on November 5, 2018. On a motion by Councilwoman Loeza, seconded by Councilman Green, with all present voting Aye, Council unanimously authorized the City Secretary to advertise for bids for the sale of Lot 8, Block 8, Velasco Townsite locally known as 5 South Ave B, Freeport and set a bid date. Consideration of retaining Baker & Lawson, Inc. to relocated the boundary line of North Avenue S adjacent to Lots 1-12, Block 813, Lots 1-12, Block 786 and portion of Wharton Street right-of-way of the Velasco Townsite, Freeport. Mayor Brimage stated, per Councilman Yates request, the city will get a survey of the property and request city attorney Wallace Shaw to prepare the deeds related to the moving the right of way line. Mayor Brimage stated that an appraisal would not be needed as it will not affect the value of the properties and that if a plat is needed it will all be passed on the same day. On a motion by Councilman Bass, seconded by Councilman Yates, with all present voting Aye, Council unanimously authorized retaining Baker & Lawson, Inc. to relocate the boundary line of North Avenue S adjacent to Lots 1-12, Block 813, Lots 1-12, Block 786 and portion of Wharton Street right-of-way of the Velasco Townsite, Freeport. Consideration of adopting Ordinance No. 2018-2559 amending the Code of Ordinances to prevent Hazardous Operation of Motor Vehicle or Watercraft on flooded streets. Billy Shoemaker presented two versions of the proposed ordinance. The alternate version will allow the ordinance to exclude first responders. Work Session: Mayor Troy T. Brimage announcements and comments. Mayor Brimage announced that Tim Kelty starts on October 23, 2018. Mayor Brimage stated that he had attended the Blue Santa golf tournament and they have a great turnout and they got to use the

new golf carts. He also said that he, along with Councilman Yates attended the Senior Citizen s luncheon and there were over 200 attendees. He announced that he had attended Mr. Hickey s 95 th birthday party and the museum looked awesome. Councilman Green Ward A announcements and comments Councilman Green asked about the correct way to obey the law concerning the blinking red lights at the crosswalk between Brazosport High School and Hopper Field. Police Chief Ray Garivey said that a blinking red light means stop then proceed with caution. Councilman Green questioned whether the beach had been closed. It had been closed for the high water. Councilman Bass Ward B announcements and comments Councilman Bass had nothing. Councilwoman Loeza Ward C announcements and comments Councilwoman Loeza questioned the food truck located at Yellowstone & Brazosport Boulevard. Billy Shoemaker said that they had permission to be there by the owner and had their food permits. Councilwoman Loeza said that she had been questioned regarding the ordinance regarding chickens. Mayor Brimage said that anyone needing answers regarding chickens should contact Billy Shoemaker. Councilman Yates Ward D announcements and comments Councilman Yates said that he had attended the Seniors luncheon and everyone had done a very good job. Councilman Yates asked about the status of the fishing pier near the community house. Mayor Brimage said it would take $49,000 to fix it as that was their cheapest bid. Councilman Yates stated that he has not seen the final version of the Museum audit. He stated that he believes that there were numbers that were wrong and not everything was listed. Councilman Yates asked about the scheduling of an executive session to discuss the property owned by Clinton Wong Councilman Bass stated that he contacted the City s attorney and the attorney was preparing a report. Councilman Bass added that the attorney is available via skype or phone at $185.00 per hour. Councilman Bass said that the 380-agreement called for a MUD district and the city sought legal help because there could be consequences depending on how we proceed. Councilman Bass stated that this MUD district could cost the city $13 million dollars. Councilman Bass stated that this needs to be discussed in executive session. Updates on current infrastructure.

There were none. Update on reports / concerns from Department heads. Kim Townsend Parks Department Ms. Townsend stated that there had been a group from Katy that had come to volunteer to do beach cleanup. She stated that they felt that Bryan Beach was a hidden jewel On October 24 th, we will be having our Fall Festival at RiverPlace. Jennifer Hawkins Economic Development Corporation Ms. Hawkins announced that there is an opening on the EDC Board. Jason Travis has resigned. It will be on council s next agenda. Kenny Collins Street Department Mr. Collins advised that Brazoria County crews will begin working on Ave. D Billy Shoemaker Building Department Mr. Shoemaker stated that Citywide Cleanup was recently held. 77 tires were picked up on the Velasco side of town. Chief Chris Motley Fire Department Chief Motley showed pictures of a recent wreck on Hwy 332. Pictures were also shown of the new Fire Truck that is being assembled and should be completed by the end of December or first of January. Chief Ray Garivey Police Department Chief Garivey had nothing. Adjourn Mayor Brimage adjourned the meeting at 6:36 PM. Mayor, Troy T.
