1 It s Raining Quotas Centre and states have forgotten the 50% cap. It is time Supreme Court served a reminder TOI Editorials Bowing to Gujjar protests, Rajasthan assembly has passed a bill granting 5% reservation to five communities, ncluding Gujjars. Last week, Andhra Pradesh assembly had enacted 5% quota for Kapus. The Gujjar quota had failed to pass muster in the Rajasthan high court on earlier occasions. But Centre s flouting of Supreme Court s Indra Sawhney judgment capping restrictions at 50% has emboldened the states to follow suit. The constitutional amendment creating a 10% quota for economically weaker sections has, as expected, opened a Pandora s box. Central reservations now stand at 59%, in some states quotas have crossed 60%, and there is Maharashtra and Tamil Nadu where they are within reach of 80%. The ideas of merit and equality are being squeezed out, society is being forced into a caste frame. Jumping on the bandwagon, socialist politicians like Tejashwi Yadav and Nitish Kumar have begun clamouring for a higher OBC quota. In Indra Sawhney, SC rationalised the 50% cap terming reservation an extreme form of protective measure or affirmative action to be confined to a minority of seats. Now with 10% EWS quota reservation is the norm and not qualifying is the exception. Note how Haryana is implementing it: those with homesteadss valued up to Rs 1 crore, or virtually the entire populace, can boast a quota. SC must take forward the petitions challenging EWS quota and reiterate the 50% cap. Undermining the cap s sanctity is a sure recipe for politicians to promise more quotas, come election time. There is no turning back the clock because in India, a quota is forever. Given the difficulties in accessing higher education and government jobs no community will spurn it. The argument that Constitution s basic structure and judgments, which include the fundamental right to equality, have to be changed to reflect current socioeconomic realities holds no water. SC must end this charade. For Delhi, Statehood, Puducherry, Merger UTs' troubles call for a democratic solution Editorial Two Union territories are in the news for institutional tussles between the central government and the elected legislature, Delhi and Puducherry. A Supreme Court bench has been unable to agree on the limits

2 of the Delhi government s powers and the Lt Governor of Puducherry and the head of its elected legislature see eye-to-eye rarely, leading to a virtual blockade of the Lt Governor s place by the so-called chief minister and his supporters. This situation calls for an institutional solution. In the case of Delhi, an area comprising the regions governed by the New Delhi Municipal Council (NDMC), must be carved out and placed under the direct rule of the Centre, administered through a divisional magistrate. The rest of Delhi must gain the status of a full-fledged state. Puducherry should be dissolved, and its constituent districts merged in the different states in which they are located. Delhi s population is some 16.4 million. That makes it bigger than as many as 164 nations, bigger than Zimbabwe or Senegal in Africa, Cambodia or Azerbaijan in Asia, Portugal or Hungary in Europe and Cuba or Haiti in Latin America. Why should so many people be deprived of the full rights of representative government, in which their elected political executive can be held to account for law and order, any branch of administration and public service? The Centre needs to directly control only the patch around the seat of the central government. The NDMC area comprises some 47 sq km out of Delhi s 1,480 sq km. Puducherry continues as a Union territory because of its French colonial past. Its 12 lakh residents deserve a democratic government, not the whims of a Lt Governor. Its constituent regions Mahé, located in Kerala, Yanam in Andhra Pradesh, Puducherry and Karaikal, in Tamil Nadu could be merged with the surrounding states, after consulting the residents wishes. The people can, of course, continue with French language and culinary traditions. If the French so much as mutter an objection, the treaty of cession, a remnant of colonialism, should be rescinded, unilaterally. Surprising Trends in Child Marriages Editorial The 2015-16 edition of the National Family Health Survey (NFHS), one of the world s most comprehensive collections of data related to health, well-being, marital status, childbirth and many other parameters relevant to sensible policymaking, provides surprising insights into the practice of child marriage girls between 15 and 18 who are married off by families. With the exception of Himachal Pradesh and Manipur, every state has reported a fall in the number of child brides from the 2005-06 survey, a pan-india drop from 29% to 11.9%. This is welcome: the later a child marries, the lower the probability of teenage pregnancy, and higher the chances of continued education, and social and economic empowerment. By and large, most logical factors related to the incidence of child marriage tally with the NFHS data: kids from poorer families tend to get married off earlier, urbanindia fares better than villages, and the higher the level of education, the lower the incidence of child marriage. The devil in the detail is this: while some states like Bihar, Uttar Pradesh, Rajasthan and Haryana with low social indicators have managed to

3 reduce the incidence of child marriage by substantial levels in 10 years, others like Gujarat, Maharashtra, Manipur and West Bengal have progressed slower than one would expect. The reason for this divergence across states is unclear: Manipur and West Bengal have far better sexratios (the number of women per 1,000 men and a pointer to gender equality) than Maharashtra, Gujarat, Bihar, UP and Haryana. This should imply lower, not higher, incidence of child marriage.
