PROCEEDINGS OF 252 nd MEETING OF THE ERC-NCTE HELD ON 28 th February to 3 rd March, 2018 Part-2 The 252 nd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) has been scheduled from 28 th February to 3 rd March, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 252 nd ERC Meeting. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. No. Item No. Content ATTENTION! 1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. 8. The cut-off date for granting/refusal of recognition for the session 2018-19 is 3 rd March, 2018; hence, the institution may submit the compliance on the basis of proceedings uploaded in the ERC NCTE website. 1

ER-252.2 2. 252.2.6 [Court Case] Matri Prem College of Education, Plot No. 1243, 1244, Vill:- Chilhari, PO.- PuranaBhojpur, Tehsil/Taluka- Dumraon, Town/City-Buxar, Dist: Buxar, Bihar-802133. (B.Ed.-Addl. Intake) (Private) (Veer Kunwar Singh University) (Code ERCAPP3459) The permission to B.Ed.(Additional Intake) Course was refused vide ERC Order No. 46639 dated 02.05.2016 as per decision of 209 th ERC Meeting. Thereafter, the institution preferred an appeal to NCTE HQs. and the Appellate Authority vide Order No. 89-402/2016-Appeal/3 rd Meeting-2017/52004 dated 28.03.2017 rejected the appeal and the order of the ERC is confirmed. The institution filed W.P.(C) No. 10445 of 2017 in the Hon ble High Court of Delhi. The Hon ble High Court disposed of the matter on 21.02.2018 with a direction inter alia: The petition is, accordingly, disposed of with liberty to the petitioner to submit a representation to the respondents within two days seeking recognition for the year 2018-2019 which would be decided by the respondents within a period of one week thereafter. It is made clear that while deciding the representation, the respondents will duly consider the NOC dated 17 th October, 2017 granted to the petitioner by the affiliating University as also the order dated 4 th December, 2017 passed by this Court in LPA No 771/2017. The Committee considered the order dated 21.02.2018 of the Hon ble High Court of Delhi and observed as under: (i) (ii) (iii) As per submitted building plan, the institution having only 3600 Sq. Mts. built up area whereas the institution is already recognized for B.Ed. (100 intake) and D.El.Ed. (100 intake). For another 100 additional intake of B.Ed. course, it requires 5000 Sq. Mts. built up area, which is less than the required as per Regulations, 2014. Submitted building plan is not approved by the Govt. Engineer/Authority. Building completion certificate is not submitted. In view the above, the committee Show Cause Notice be issued to the institution as to why the application applied for permission be not refused on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. 2
ER-252.4 3. 252.4.9 [Appeal Case] Bagnan Teachers Training College, Plot No. 2730, 2731 & 3014, Vill/P.O. - Mugkalyan, Tehsil/ Taluka - Bagnan - II, Town/City - Bagnan, Dist - Howrah, West Bengal - 711312. (D.El.Ed.-Addl. Course) (Private) (West Bengal Board of Primary Education) (ERCAPP3838) As per decision of 218 th ERC Meeting, permission to D.El.Ed. Course was refused vide ERC Order No. 48606 dated 29.07.2016. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-99/2017-Appeal/21 st Mtg.-2017/14 th & 15 th Dec., 2017/62830 dated 13.02.2018 remanded back the case to ERC with a direction to conduct a re-inspection of the institution, on payment of the prescribed fee by the appellant, and take further action as per the NCTE Regulations, 2014. The appellant is directed to forward to the ERC, within 15 days of receipt of the order on appeal, (i) the building completion certificate signed by a Govt. Engineer, which was submitted in appeal, indicating therein the year of construction against item No 12, which was not mentioned; (ii) other documents relating to library and laboratories submitted in appeal, and (iii) a written request to allow withdrawal of their application for grant of recognition for M.Ed. course. The ERC re-viewed the matter in accordance with the appeal order and Re-inspection of the institution be conducted on payment of fee of Rs. 1,50,000/-. ER-252.2 4. 252.2.7 [Court Case] Rajeev Gandhi Memorial Teachers Training College, Plot No. 516, Street No-36, Vill:- Nunudih, PO.- Patherdih, Tehsil/Taluka-Jharia, Town/City- Dhanbad, Jharkhand- 828119. (D.El.Ed.-Addl. Intake) (Private) (Jharkhand Academic Council) (ERCAPP3846) The permission to D.El.Ed.(Additional Intake) Course was refused vide ERC Order No. 35535 dated 14.04.2016 as per decision of 209 th ERC Meeting. The institution filed W.P.(C) No. 3809 of 2017 in the Hon ble High Court of Delhi. The Hon ble High Court disposed of the matter on 23.02.2018 with a direction inter alia: In view of this, the writ petition is allowed. The order dated 09.08.2016 passed by the respondent No,1 and the minutes of meeting 04/06.02.2018 of respondent No.2 in respect of the petitioner/institute are quashed. The respondents are directed to consider the application of the petitioner expeditiously by taking into consideration the NOC supplied by him on 09.07.2015 and keeping in view the cut-off date for recognition is 03.03.2018. The respondents are directed to consider the application of the plaintiff as expeditiously as possible subject to the meeting all criteria on or before 03.03.2018. The Committee considered the order dated 23.02.2018 of the Hon ble High Court of Delhi and observed as under: (i) In the year 2015, the institution submitted two applications simultaneously for D.El.Ed. (ERCAPP3209) and D.El.Ed.-Additional Intake (ERCAPP3846). As the application for recognition to D.El.Ed. course is under process, hence, the application for grant of permission to D.El.Ed.(Additional Intake) course (ERCAPP3846) cannot be considered as per Regulations, 2014. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No. 89-172/2017-Appeal/21 st Mtg.-2017/14 th & 15 th Dec., 2017/62858 dated 13.02.2018 acceded to the request of the appellant for withdrawal of their appeal against the order refusing recognition for M.Ed. Course. The appellant is directed to write to the ERC also to allow withdrawal of their application for grant of recognition for M.Ed. course.
