PROCEEDINGS OF 265 th MEETING OF THE ERC-NCTE HELD ON 08 th 09 th JANUARY, 2019 The 265 th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 08 th 09 th January, 2019 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 265 th ERC Meeting. Momin - State Representative of Meghalaya Mr. Awadhesh Kumar Singh - State Representative of Bihar Prof. Vanlalhruaii - State Representative of Mizoram Ms. Naorem Santa Devi - State Representative of Manipur Mr. Pradeep Kumar Yadav - Regional Director (I/C), ERC & Convener As per the notice for meeting issued by this office, the 265 th meeting of ERC scheduled from 08 th 09 th January, 2019. The Chairperson, ERC is unable to attend the meeting on 08 th 09 th January, 2019 and given consent to continue the meeting in her absence. The members present in the meeting hereby unanimously decided that in absence of Chairperson ERC, Prof. Brajanath Kundu, Member, ERC shall function as Chairperson. At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Mr. Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. No. Item No. Content Confirmation of the Proceedings of 264 th ERC meeting held on 05 th 06 th ER-265.1 December, 2018 at Bhubaneswar. Confirmed. ATTENTION! 1. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. 1

ER-265.2 [Court Case] 1. 265.2.1 Usha Hiranmaye Teachers Training Institute D.El.Ed. and B.Ed., Plot No.-148, 149, 1173, 163, 164, Street No.- Hukahara, Vill. - Hukahara, PO. - Joykrishnapur, Tehsil/Taluka- Jalangi, Town/City - Jalangi, Dist - Murshidabad, West Bengal - 742305. (D.El.Ed.) (Private) (West Bengal Board of Primary Education) (ERCAPP2987) As decided in 239 th ERC Meeting, recognition to D.El.Ed. Course was refused vide order dated 02.05.2017. The institution preferred an appeal to the NCTE HQs. against the refusal order of ERC and the Appellate Authority vide order No.89-565/E-11469/2017 Appeal/19 th Meeting-2017/61368 dated 07.12.2017 rejected the appeal and the order of the ERC is confirmed. The institution preferred W.P.(C) No.2367 (w) of 2018 in the Hon ble High Court of Calcutta. The Hon ble High Court disposed of the matter on 17.12.2018 with a direction inter alia: Petitioners are interested in obtaining recognition to conduct D.El.Ed. course in their institute. Inspection was held in January, 2017 which did not result in recognition being granted. While Mr. Mallick, learned advocate appearing on behalf of the petitioners submits, inspection was held on a date when his clients were not present as earlier informed to the Council, Mr. Nandy, learned advocate appearing on behalf of the Council submits, inspection cannot be on chosen date of institute. Mr. Nandy, however, in fairness submits, if the institute complies with formalities then fresh inspection can be held for prospective grant of recognition. Mr. Mallick submits, his clients will comply with the formalities within ten days. Petitioners will comply with requisite formalities. On such compliance the Council will cause inspection and deal with the institute s claim for recognition. The Council should cause inspection so that recognition, if to be granted, can be granted for ensuing academic year. (Private) (Babasaheb Bhimrao Ambedkar Bihar University) (ERCAPP3272) As decided in 264 th ERC Meeting, recognition granted to B.Ed. course with an intake of 100 (two basic units) from the academic session 2019-2020 vide order No.58687 dated 17.12.2018. A representation vide letter Ref. No.BSCE/ERC-NCTE/2018/03 dated 02.01.2019, together with copy of letter Ref. No.Sec./ERC/BSCE/16 dated 20.03.2017 submited earlier to ERC regarding consideration of trust viz. Vaishali Foundation instead of Human Resources Empowerment Committee received from Baidyanath Shukla, Secretary of the institution and connected documents such as trust deed, notarized permanent agreement on Rs.1000/- stamp paper, abstract of resolutions dated 18.06.2016 regarding desolation of Human Resources Empowerment Committee for correction in recognition order of the aforesaid course mentioning the trust i.e. Vaishali Foundation, Jaganpura, Majhauli, Vaishali, Bihar, which is running the institution. The trust viz. Vaishali Foundation is accepted and necessary changes be incorporated in the recognition order issued earlier. 4. 265.12.2 Baidyanath Shukla College of Education, Plot Nos. 197, 64, 197, 65 & 74, Main Road, Vill.- Jaganpura, PO.- Majhauli, Tehsil/Taluka- Lalganj, Town/City- Vaishali, Dist- Vaishali, Bihar-844123 (4 year Intergrated B.A.B.Ed./B.Sc. B.Ed. Course) (Private) (Babasaheb Bhimrao Ambedkar Bihar University) (ERCAPP3295) As decided in 264 th ERC Meeting, recognition granted to 4 year Integrated B.A.B.Ed./B.Sc.B.Ed. course with an intake of 100 (two basic units) from the academic session 2019-2020 vide order No.58725 dated 18.12.2018. A representation vide letter Ref. No.BSCE/ERC-NCTE/2018/04 dated 02.01.2019, together with copy of letter Ref. No.Sec./ERC/BSCE/16 dated 20.03.2017 submited earlier to ERC regarding consideration of trust viz. ER-265.2 [Court Case] 5. 265.2.3 Y B N College for Teacher Education, Street/Road - Bara Kawali, Taluka/Mandal - Namkum, Dist. - Ranchi, Jharkhand - 834010 (B.Ed. and D.El.Ed.) (Ranchi University and Jharkhand Academic Council) (Private) (ERCAPP201646296) (ID No.10685) As decided in 263 rd ERC Meeting, Letter of Intent u/c 7(13) issued on 22.11.2018 to the institution. The institution preferred W.P.(C) No.2404 (w) of 2018 in the Hon ble High Court of Jharkhand in connection with early conduct of inspection of their institution as because previously inspection was conducted by visiting team member found fake later. Copy of order of the Hon ble High Court dated 29.10.2018 disposing of the matter received on 20.12.2018, with a direction inter alia: Accordingly, the respondent No.3-Eastern Regional Committee, National Council for Teacher Education, Bhubaneswar, is directed to take further steps with regard to grant of recognition of the petitioner-college for the applied courses expeditiously. It goes without saying that if further compliance is required from the petitioner in this regard, it shall do the same as may be asked by the respondent No.3. The Committee considered the order of the Hon ble High Court of Jharkhand along with compliance of Letter of Intent u/c 7(13) from the institution and decided as under: Formal recognition order under clause 7(16) of the NCTE Regulation, 2014 for B.Ed. programme with an intake 100 (two basic units) from the academic session 2019-2020 be issued to the institution. (ii) Formal recognition order under clause 7(16) of the NCTE Regulation, 2014 for D.El.Ed. programme with an intake 100 (two basic units) from the academic session 2019-2020 be issued to the institution. 3

6. 265.2.4 Utkal university, Vill.- Bhubaneswar, Street/Road-Vani Vihar, Taluka/Mandal- Bhubaneswar, Town/City-Bhubaneswar, Dist.-Khurda, Orissa-751004 [B.Ed., M.Ed. and 4 year Integrated B.A.B.Ed./B.Sc. B.Ed. course] (Government) (Itself affiliating body) (ID No.7162) As decided in 257 th ERC Meeting, recognition granted to B.Ed., M.Ed. and 4 year Integrated B.A.B.Ed./B.Sc. B.Ed. courses respectively from the academic session 2019-2020 vide orders dated 12.07.2018 with approved intake mentioned therein for each course. The institution filed W.P. (C) No.14089 of 2018 in the Hon ble High Court of Orissa. The Hon ble High Court disposed of the matter on 19.11.2018 with a direction inter alia: Considering the limited grievance of the petitioner, without expressing any opinion on the merits of the case, this Court disposes of the writ petition directing opposite party no.2 to take a decision on the representation filed by the petitioner vide Annexure-6 and pass appropriate order in accordance with law within a period of two months from the date of production of certified copy of this order. The Committee considered the order of the Hon ble High Court of Orissa and observed as under: It is needless to mention here that Hon ble Supreme Court of India in its order dated 13.12.2012 passed in W.P.(C) No.276 of 2012 titled as Maa Vaishno Devi Mahila Mahavidyalaya Vs. State of UP & Ors, the Hon ble Court had fixed up a schedule for recognition and affiliation of Teacher Training Institutions by fixing the cut off date as 3 rd March of each year and hence, the NCTE is bound to follow the time schedule provided by the Hon ble Court for the said purpose. Formal recognition granted to B.Ed., M.Ed. and 4 year Integrated B.A.B.Ed./B.Sc. B.Ed. courses respectively from the academic session 2019-2020 by ERC remains unchanged. A reasoned order be issued to the institution in this regard. Course) (Government) (Tilka Manjhi Bhagalpur University) (Application No.- ERCAPP201646150) (ID No.-7585) Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and decided as under: Formal permission order under clause 7(16) of the NCTE Regulation, 2014 for M.Ed. programme with an intake 50 (one basic unit) from the academic session 2019-2020 be issued to the institution. 4

Original FDRs required to be submitted. Show Cause Notice be issued to the institution as to why the application for recognition be not refused on the above point. The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide order No.89-360/E-75551/2018 Appeal/14 th Mtg.-2018/30 th & 31 st July, 2018 dated 12.09.2018 remanded back the case to ERC with a direction to consider these documents to be submitted to them by the appellant and take further action as per the NCTE Regulations, 2014. The appellant is directed to forward to the ERC the documents submitted in the appeal within 15 days of receipt of the orders on the appeal. In 2016, the institution applied online for D.El.Ed.- Basic mentioning one unit under ID No.10146 and submitted representation dated 30.07.2016 for one unit of D.El.Ed.-additional intake and another representation dated 03.02.2108 ref. letter No.21/2018 mentioning D.El.Ed. additional course, which is contradictory.
