52 TAMIL NADU GOVERNMENT GAZETTE NOTIFICATIONS BY GOVERNMENT [ Part III Sec. 1(a) HOME DEPARTMENT Amendments to Tamil Nadu Home Guard Rules, 1963. [G.O. Ms. No. 398, Home (Police XIV), 18th May 2009.] No. SRO A-14/2009. In exercise of the powers conferred by Section 15 of the Tamil Nadu Home Guard Act, 1963 (Tamil Nadu Act 3 of 1963), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Home Guard Rules, 1963: In the said Rules, AMENDMENTS (1) in rule 3, in sub-rule (i), for clause (a), the following clause shall be substituted, namely : (a) has completed age of 18 years and has not completed age of 50 years; (2) in rule 9, in sub-rule (2), (a) for clause (i), the following clause shall be substituted, namely: (i) one or more Assistant Commandant Generals who shall be appointed, from among the Area Commanders on the basis of performance, efficiency and devotion to duty in the organization by the Commandant General on the recommendation of the Deputy Commandant General. Eminent personalities in public life or specialised personnel in different walks of life with interest in voluntary service may also be considered and appointed by the Commandant General based on the recommendation of Superintendent of Police in the district and Commissioner of Police in the City of Chennai and upon the recommendation of the Deputy Commandant General. They shall be assigned the rank of Deputy Commissioner of Police in the City of Chennai and the Superintendent of Police in the district. They shall assist ex-officio Commandant General and the Deputy Commandant General. Their functions shall be only of advisory in nature. The regionwise jurisdiction of the Assistant Commandant General shall be confined within the limits of City in respect of Chennai City and in Districts within Police ranges in mofussil. The upper age limit of the Assistant Commandant General shall be 65 years. (b) for clause (i-a), the following clause shall be substituted namely: (i-a) An Area Commander who shall be selected and appointed by the Superintendent of Police in a district and by the Commissioner of Police in the City of Chennai subject to the approval of the Deputy Commandant General. The Area Commander shall be assigned the rank of Additional Deputy Commissioner of Police in the City of Chennai and the rank of Additional Superintendent of Police in districts. ; (c) for clause (i-b), the following clause shall be substituted namely: (i-b) A Deputy Area Commander (for Women s Wing only), who shall be selected and appointed by the Commissioner of Police in the City of Chennai and the Superintendent of Police in districts subject to the approval of the Deputy Commandant General. The Deputy Area Commander shall be assigned the rank of Additional Deputy Commissioner of Police in the City of Chennai and the rank of Additional Superintendent of Police in districts. ; (d) for clause (iii), the following clauses shall be substituted, namely: (iii) Divisional Commander for each group consisting of not more than five Companies and not less than three Companies, Company Commander, Platoon Commander, Assistant Platoon Commander, Section leader and Assistant Section leader who shall be appointed by the Commissioner of Police in the City of Chennai and by the Superintendent of Police in districts based on the recommendations of the promotion Board duly constituted by the Commissioner of Police in the City of Chennai and by the Superintendent of Police in districts, following the norms fixed by the Deputy Commandant General.. (iv) Home Guards shall be appointed by the Commissioner of Police in the City of Chennai and by the Superintendent of Police in districts. ;

June 3, 2009] TAMIL NADU GOVERNMENT GAZETTE 53 (3) after rule 9, the following rule shall be inserted, namely: 9-A Selection by Promotion Board. (a) The promotion to Assistant Section leader, Section Leader, Assistant Platoon Commander, Platoon Commander, Company Commander and Divisional Commander shall be made on the recommendation of the Promotion Board constituted by the Commissioner of Police in the City of Chennai and by the Superintendent of Police in the districts. (b) The duly constituted promotion Board in Chennai City, (i) for promotion to Assistant Section leader from Home Guard, to Section leader from Assistant Section leader and to Assistant Platoon Commander from Section leader, shall consist of following persons: (1) Area Commander; (2) Assistant Commissioner of Police; (3) Divisional Commander. (ii) for promotion to Platoon Commander from Assistant Platoon Commander, to Company Commander from Platoon Commander and to Divisional Commander from Company Commander, shall consist of the following persons: (1) Area Commander; (2) Assistant Commissioner of Police; (3) Deputy Commissioner of Police, Head Quarters. (c) The duly constituted Promotion Board in districts for promotion to Assistant Section leader from Home Guard, to section leader from Assistant Section leader, to Assistant Platoon Commander from Section leader, to Platoon Commander from Assistant Platoon Commander and to Company Commander from Platoon Commander, shall consist of following persons: (1) Area Commander; (2) Deputy Superintendent of Police; (3) Additional Superintendent of Police. (d) A list of qualified Home Guards suitable for promotion on unitwise basis in respect of each rank shall be prepared in each district by the respective Area Commander and Deputy Superintendent of Police, in charge of Home Guards and by the respective Area Commander and Assistant Commissioner of Police in charge of Home Guards in the City of Chennai on the basis of personal observation and award of 25 marks for each item mentioned below: (1) Seniority and regularity in attendance as adjudged from records; (2) Efficiency, rewards and appreciation; (3) Training undergone at National Civil Defence College at Nagpur, Tamil Nadu Home Guards Civil Defence Training Institute at Ooty and Civil Defence Training Institute at Bangalore; (4) Activities as per records such as performance during parade, traffic regulation, crime prevention, bandobust duty and knowledge of Organization: Provided that for the promotion from Home Guard to Assistant Section leader, the Home Guard shall render minimum five years of continuous service without any adverse remarks. (e) Such list as prepared shall be submitted to the respective promotion Board.

54 TAMIL NADU GOVERNMENT GAZETTE [ Part III Sec. 1(a) (f) The recommendation of the Promotion Board for promotion shall be approved by the Commissioner of Police in the City of Chennai and Superintendent of Police in districts. (g) All Companies in a Division in the Chennai City and all Companies in a single location in districts shall be treated as one unit for the purpose of promotion where the unit strength is less than a Company, geographically close units shall be grouped and treated as a Company. ; (4) in Rule 12 for sub-rule(4), the following sub-rule shall be substituted, namely: (4) All cases of indiscipline shall be brought before an Orderly Room consisting of the Adjutant, an Area commander and a Divisional Commander or Company Commander. After charges are framed, the Home Guard against whom charges have been framed shall be given an opportunity to explain the charges against him. The findings of the Orderly Room and its recommendation shall be forwarded to the Commissioner of Police in the City of Chennai and to the Superintendent of Police in a district who shall decide further course of action to be taken in the matter. Ms. No. 65, School Education (VE), 24th February 2009.] No. SRO A-15/2009. In exercise of the powers conferred by Section 56 of the Tamil Nadu Recognised Private Schools (Regulation) Act, 1973 (Tamil Nadu Act 29 of 1974), the Governor of Tamil Nadu hereby makes the following amendments to the Tamil Nadu Recognised Private School (Regulation) Rules, 1974: 2. The amendments, hereby made shall come into force on 24th February 2009. AMENDMENTS In the said Rules, (1) In Rule 15-(1) in sub-rule (4), in clause (ii)-(a) for sub-clause (i), the following sub-clauses shall be substituted, namely: (i) Promotion from among the qualified teachers in that school; or (ii) Promotion from among the qualified Vocational Instructors in that school ; (b) sub clause (ii) shall be renumbered as sub-clause (iii). ; (2) after sub-rule (6-A), the following sub-rules shall be inserted, namely: (6-B) No person shall be eligible for appointment to the post of Vocational Instructor in a Recognised Private Higher Secondary School unless he possesses the qualifications specified in Annexure V-B. (6-C) No person shall be eligible for appointment to the post of Vocational Instructor (Computer Science) in a Recognised Private Higher Secondary School unless he possesses the qualifications specified in Annexure V-C. ; 2. After Annexure V-A the following annexures shall be inserted, namely:

VOCATIONAL INSTRUCTORS FOR HOME SCIENCE : (1) Food Preservation (a) Degree in the relevant subject from a recognized University in the State or a degree of equivalent standard in the Vocational subject under Home Science area; (or) Diploma in the relevant Vocational subject awarded by the State Board of Technical Education or any other recognised Board or Institution or B.Sc. (Home Science) from a equivalent standard and (2) Baking and Confectionery (a) Degree in the relevant subject from a recognised University Vocational subject under Home Science area (or) Diploma Board or Institution or B.Sc. (Home Science) from a equivalent standard and (3) Catering (a) Degree in the relevant subject from a recognized University Vocational subject under Home Science area (or) Diploma Board or Institution or B.Sc. (Home Science) from a (4) Dietetics, Nutrition and Food Preparation (a) Degree in the relevant subject from a recognized University in the State or a degree of equivalent standard in the Vocational subject under Home Science area (or) Diploma in the relevant Vocational subject awarded by the State Board of Technical Education or any other recognized Board or Institution or B.Sc. (Home Science) from a year in the relevant field
