1 Harassment, Intimidation, and Bullying (H.I.B.) Overview and Procedures

2 Harassment, Intimidation & Bullying (HIB) Policy Legislation required each school to adopt an H.I.B. policy in 2002 The policy was amended in October 2010 and signed into law on January 5, 2011 The law is known as the Anti-Bullying Bill of Rights Act (ABR)

3 Anti-Bullying Bill of Rights Act This law was established to enhance the standards and procedures involving the: Prevention of student incidents of H.I.B. Reporting of student incidents of H.I.B. Investigation of student incidents of H.I.B. Overall response to student incidents of H.I.B.

4 H.I.B. Definition H.I.B. means any gesture, any written, verbal or physical act, or any electronic communication, whether it be a single incident or a series of incidents, that: Is reasonably perceived as being motivated either by an actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability, or by any other distinguishing characteristic; and Takes place on school property, at any school-sponsored function, or on a school bus; or off school grounds, as provided for in N.J.S.A. 18A: , and Substantially disrupts or interferes with the orderly operation of the school or the rights of other students; and that

Definition (cont) A reasonable person should know, under the circumstances, will have the effect of physically or emotionally harming a student or damaging the student s property, or placing a student in reasonable fear of physical or emotional harm to his person or damage to his property; or Has the effect of insulting or demeaning any student or group of students; or Creates a hostile educational environment for the student by interfering with a student s education or by severely or pervasively causing physical or emotional harm to the student.

6 Characteristics/Types of Bullying Behaviors Verbal Includes taunting, name calling, malicious teasing or making threats (U.S. Department of Justice, 2001); Psychological Includes spreading rumors, purposefully excluding people from activities, breaking up friendships (U.S. Department of Justice, 2001); Physical Includes hitting, punching, shoving, spitting or taking personal belongings (U.S. Department of Justice, 2001); and Cyber bullying Includes using the Internet, mobile phone or other digital technologies

7 Conflict vs. Bullying Bullying is not a phase young people must endure or outgrow. Bullying is not a conflict between students or among groups of students. CONFLICT is a mutually competitive or opposing action or engagement, including a disagreement, an argument or a fight which is a normal part of human development. Conflicts can be mediated and all parties want to solve the disagreement. BULLYING is one-sided, where one or more students are victims of one or more person s aggression, which is intended to physically or emotionally hurt the victim(s).

10 Potential Signs of H.I.B. Victimization Source: Kidscape.org Feels ill in the mornings Becomes truant Decline in school work Goes home regularly with clothes or books destroyed Goes home starving (bully taking money) Becomes withdrawn and loses confidence Becomes distressed and anxious, may stop eating Attempts or threatens suicide Cries himself/herself to sleep, has nightmares Has his/her possessions go missing Refuses to talk about what is wrong Has unexplained bruises, cuts, or scratches Becomes aggressive and unreasonable Gives improbable excuses for any of the above

11 Elements of Effective Anti Bullying Programs A school-wide commitment to sharing the responsibility for H.I.B prevention Policies for HIB behavior are enforced and training on the H.I.B policy is provided for ALL staff (including bus drivers, aftercare, etc) Adult supervision exists in areas identified as Hot Spots. When H.I.B behavior is observed, consistent and appropriate actions are taken in support of school-wide efforts. Classroom time includes messages and lessons that will help prevent H.I.B. and are sustained over a long period of time.

12 SETTING SCHOOL WIDE EXPECTATIONS. Policies prohibiting H.I.B. that are publicized and posted school-wide and consistent enforcement of policies Week of Respect: First Monday in October The purpose of the week is to recognize the importance of character education by providing age-appropriate instruction focusing on the prevention of HIB. A "buddy system" that pairs students with a particular friend and is available if help is needed Classroom and school-wide activities designed to build self-esteem by spotlighting special talents, hobbies, interests, and abilities of all students Cross-age teaching about H.I.B. and prosocial behavior Students performing leadership roles

13 HELP CREATE UPSTANDERS IN YOUR CLASSROOM!! Send the message that bullying is a serious matter and will not be tolerated. Discuss possible scenarios involving bullying to recognize some positive ways to respond or for ways to reach out to isolated peers. Assure students that reporting is safe and names will be protected. Be approachable and open without confusing reporting with tattling. Use encouraging statements when a bystander reports bullying. Respond to bullying quickly and consistently when it is reported. Never ignore bullying and don t expect kids to work it out.

14 What the Upstander Can Do... Look confident (assertive body language) by standing tall, with your shoulders back Move beside the victim, give the bully non-threatening eye contact, and keep your facial expressions neutral Make your stand then leave the situation Make assertive statements for the victim: With a serious face and a strong but calm voice say, "Stop it!" Refuse to spread the lies and/or rumors Use a sense of humor Make an asset of the characteristic used to tease someone

15 PEER MEDIATION IS NOT THE ANSWER! While well-intentioned, peer mediation is an inappropriate strategy for addressing victimization, because mediation is designed to help resolve conflict. Victims of HIB need adult intervention to stop the victimization. Mediation only serves to further victimize the target of the HIB, rather than provide relief from HIB for the victim, and increases the chances and severity of repeated HIB.

16 Obligation to Report All school employees observing or having direct knowledge from a participant or a victim of an act of violence, including H.I.B., must file a report describing the incident the day it occurs to the school principal! Any school employee who promptly reports H.I.B. in compliance with the District s policy is immune from any action for damages resulting from any failure to remedy the reported incident.

17 Obligation to Report (continued) The same standard for reporting child abuse and/or neglect also applies to reporting incidents of H.I.B.. All school employees are mandated reporters!

18 Important Notes about the H.I.B. Investigation Process The Principal is responsible for the initiation of the investigation process. The Anti-Bullying Specialist conducts the investigations by interviewing all students delineated in the H.I.B. Reports, including the alleged victim(s), alleged witness(es), and alleged offender(s). Mrs. Gina Infante for Grades pk-8 Any school employee with a counseling background, such as a school psychologist or a school social worker, can be appointed to assist the ABS with the H.I.B. investigations.

19 Important Notes about the H.I.B. Investigation Process (continued) Each student has a right to confidentiality regarding his or her role in the H.I.B. investigation process. If a student is participating in an H.I.B. interview, school employees must respect the student s privacy and not question him or her in relation to his or her involvement in it.

20 Anonymous Reports The school must permit anonymous reports Cannot take formal disciplinary action on basis of anonymous report alone Has to be corroborated with other information

21 Possible Responses When An H.I.B. Report is Substantiated The ABR requires a range of responses that are implemented by the principal, in conjunction with the school anti-bullying specialist. The responses must include: Both remedial actions and consequences imposed Severity of the offenses (discipline code) Developmental ages of the offenders Students histories of problem behaviors and performance. The responses must include an appropriate combination of counseling, support services, intervention services and other programs.

22 School Safety Team A collaboration of school, home, and community designed to develop, foster, and maintain a positive school climate, including H.I.B. issues Meets at least 2 times per school year Consists of the principal (or designee, preferably a senior administrator) and principal appointees a teacher in the school, the school anti-bullying specialist, a parent (as defined in N.J.A.C. 6A:16-1.3) of a student in the school, and other members determined by the principal

23 Purpose of School Safety Team Receive any H.I.B. complaints reported to principal* Receive copies of any H.I.B. investigation reports* Identify and address patterns of H.I.B. in the school* Review and strengthen school climate and policies in order to prevent and address H.I.B. Educate the community in bullying prevention *Parent team members may only participate in activities that do not compromise student confidentiality.

24 H.I.B. Reporting Timeline (School Day 1) Within 1 School Day of Verbal Report (School Day 2) Within 2 School Days of H.I.B. Incident (School Day 3) Within 10 School Days of Written Report (School Day 13) Within 2 School days of Completing Investigation (School Day 15) Within 5 School Days after Investigation Results are given to the Board - H.I.B. occurs and/or employee learns of H.I.B.. -Verbal report to Principal/ABS. -Principal informs parents or guardians. -Principal decides to initiate investigation by ABS; others may be appointed to assist. -Written report provided to Principal by staff member, student or volunteer who witnessed or received reliable information that a student experienced H.I.B. -H.I.B. Investigation complete and results reported to Principal -Principal decide actions to take (intervention services, training, discipline) -Principal reports investigation findings to the Board at the next Board Meeting -Principal provides information to parents of alleged bully and victim(s) about investigation findings.

25 Parents Right to Appeal Within 5 School Days after Investigation Results are given to the Board Parent can request Board Hearing for H.I.B. Parent can request Due Process Hearing for H.I.B. -Principal provides information to parents of alleged bully, alleged witness(es), and alleged victim(s) about investigation findings. -Board Hearing must occur within 10 days of parent request. Must have within 30 days of suspension Next Board Meeting 90 days after Board s determination 180 days after Board s determination -Principal must report H.I.B. and/or Due process results -Parents may appeal to the Commissioner of Education - Parents may appeal to the Office of Civil Rights
