3 Home to School Transport and Travel Policy 1. INTRODUCTION This policy sets out Islington Council s travel and transport arrangements for children and young people aged 5 to 18, and for young people with complex special educational needs and disabilities up to the age of 25, whilst they remain in education or training. It has been developed with regard to statutory guidance from the Department for Education: I. Home to school travel and transport guidance; July 2014 II. Post-16 transport to education and training; February 2014 It is the responsibility of parents/carers to ensure that their child attends school. In line with our duty to promote sustainable school travel Islington Council expects pupils to travel to their education provision by walking, cycling or making use of free travel available on London Transport as outlined below. Islington Council s Travel Strategy can be found on the Council s website. 2. FREE TRAVEL ON LONDON TRANSPORT London Transport for Under 5s: Children under five can travel free at any time on the Tube, Docklands Light Railway (DLR), buses, trams and London Overground as long as they are accompanied by an adult with a valid ticket. London Transport for 5 to 10-year-olds: Children aged five to ten can travel free at any time on Tube, DLR, buses, trams and London Overground as long as they travel with an adult who has a valid ticket (up to four children can travel free with one adult), or if they have a 5-10 Oyster photocard. They can travel for free, unaccompanied and without a photocard on trams and buses. Children aged 5 to 10 who are travelling unaccompanied on the Tube, DLR or London Overground will need a 5-10 Oyster photocard to travel free. London Transport for 11- to 15-year olds: Children aged 11 to 15 years can travel free on buses and trams and at child rate on Tube, DLR and London Overground services, provided they have an Oyster photocard. London Transport for year olds: Young people aged 16 or 17 can travel for free on buses and trams (if resident in a London borough), and at half adult rate on Tube, DLR, London Overground and most National Rail services in London, provided they have a 16+ Oyster photocard. London Transport for 18 year olds. Young people in full time education 1 are eligible for free bus and tram travel, provided they have a 16+ Zip Oyster photocard. Further information is available from Freedom Pass 1 Being in full-time education is defined as: At least 12 hours of guided learning per week, between 09:00-17:00, Monday to Friday At least 10 weeks on a further education course at Level 3 In a sixth form college, academy, further education college or other training provider 3

4 A Freedom Pass provides free access for people with disabilities to all Transport for London services and some national rail services. Applications are considered by Islington Social Care. Application forms for young people aged 5-19 with disabilities are available from Centre 404; contact or Adults with disabilities should use the online application form on the Council s website at 3. TRAVEL BEYOND STATUTORY WALKING DISTANCES Local authorities must provide free home to school transport for children aged between 5 and 16 years if their nearest suitable school is further away than the statutory walking distances, which are: 2 miles for pupils aged under 8 3 miles for those aged 8 and over If we cannot identify a vacant place at a suitable 2 school within these distances we will provide free transport as detailed below. Children also qualify for free transport if transport is identified in their statement of SEN or their Education, Health and Care plan, regardless of the distance they live from the school. For more details about transport for children and young people with special educational needs see Section 4 below. Please note however, that if parents choose a school which is further away than the one where a place is available and that chosen school is beyond the statutory walking distances from their home, they will be responsible for their own transport. 4. CHILDREN AND YOUNG PEOPLE WITH SPECIAL EDUCATIONAL NEEDS AND DISABILITIES (SEND) AGED a) Support with travel between home and school 3 A small number of children and young people with Special Educational Needs or Disabilities (SEND) cannot reasonably be expected to walk to school because of their mobility problems, or because of associated health and safety issues. In these cases the Council may agree to provide support to enable them to attend. 4 We will discuss this with families when carrying out their child s Education, Health and Care needs assessment. (Anyone else who wants to ask the Council to provide such support must do so using the travel assistance application form that can be downloaded from the Travel and Transport section of the Education pages of the Council s Local Offer website at In determining whether a child can reasonably be expected to walk to school the local authority will need to consider whether the child could reasonably be expected to walk if accompanied and, if so, whether the child s parent can reasonably be expected to accompany the child. When considering whether a child s parent can reasonably be expected to accompany the child on the journey to school a range of factors may need to be taken into account, such as the age 2 Suitable education is defined as efficient full-time education suitable to the child s age, ability and aptitude and to any special educational needs the child may have. 3 In this section we are using the word school to refer to an early years setting, school, college or training provider 4 This policy applies to children and young people with SEND whilst they are in school or Further Education, but not those in Higher Education. Once they have left education some young people with SEND will qualify for support to enable them to access community services from Adult Services. This is not covered in this document. 4

5 of the child and whether one would ordinarily expect a child of that age to be accompanied. The general expectation is that a child will be accompanied by a parent where necessary, unless there is a good reason why it is not reasonable to expect the parent to do so. In deciding whether a child / young person is entitled to this support we look at the particular circumstances of the child/young person and their parents/carers. We take into account: the child s special educational needs and/or disabilities the distance from home to school any difficulties in travelling by public transport family circumstances, such as other caring responsibilities and parent/carer disability whether the child s needs can be meet at a more local school If we do agree to provide travel assistance this can take the form of: A Personal Travel Budget, which means that the Council provides the family with a sum of money to enable them to make their own travel arrangements A vehicle provided by the Council s Accessible Community Transport service, with an escort if required 5 A Travel Buddy, who will travel with a child/young person on foot or by public transport. Wherever possible the Travel Buddy will provide Travel Training so that the child/young person develops the ability to travel independently. We will discuss these options with the family, and agree the most appropriate arrangements. 4b) Reviewing support for travel Some children and young people will require home to school travel support throughout their time in education. For others, increased independence and improved skills will mean that this provision is no longer necessary. The provision of home to school travel support will therefore be reviewed at least annually, usually through the child/young persons Annual Review. If the Council believes it is no longer required we may decide to withdraw our offer of support. If a child or young person is receiving travel support moves from one school to another, or if the family moves home, the Council will have to reassess the need for travel support. It will not be agreed without a reassessment. Families should therefore advise the Council well in advance of any such move. 4c) Independent Travel Training As they reach secondary school age most young people with SEND will want to start to travel independently whenever possible. For some young people with SEND this may not be possible until they are older, whilst a very small number may never be able to do so. Where the Council has agreed to provide travel assistance it will expect secondary schools and colleges to provide independent travel training wherever possible. If appropriate the Council may provide travel training directly, or through a third party. 4d) Parental preference If a parent would like their child to go to a setting/school/college that is further away from home than another provider which is able to meet their special educational needs the Council may agree to a placement at the parents preferred school only on condition that the parents agree to meet any additional transport costs. 5 Transport may include travel by coach, minibus or taxi. Any transport arranged will enable the pupil to travel in safety and reasonable comfort and without undue stress, strain or difficulty 5

6 5. TRAVEL TO ALTERNATIVE PROVISION Students who have been placed in alternative provision are expected to make use of free travel on London Transport. Students placed by their school Students can apply to their school to cover the costs of travel on London Underground or Overground network if a journey by bus will: necessitate taking more than two buses. take longer than an hour during peak hours as calculated using Transport for London s Journey Planner ( Each school will have its own policy/criteria and therefore you will need to contact the school directly. Students placed by Islington Local Authority Students can apply to Islington Council (using the Transport Assistance Request form on the Council s website) to cover the costs of travel on London Underground or Overground network if a journey by bus will: necessitate taking more than two buses. take longer than an hour during peak hours as calculated using Transport for London s Journey Planner ( 6. YOUNG PEOPLE AGED Young people aged who are over the compulsory school age (i.e. who have completed the school year in which they turned 16) are still required to participate in some form of education or training. This may be in a 6th form at school, a Further Education College, or in an apprenticeship and trainee scheme. Young people aged in Islington should be able to travel to their education or training on foot or by public transport. Information about access to free and subsidised travel on London Transport for young people aged is set out in Section 2 of this policy. The Council is committed to ensuring that no young person is prevented from participating in education or training because of difficulties with their travel arrangements, and will provide financial support where necessary. In considering any requests for travel support the Council will take into account the distance and travel time from home to the provider, the cost of the journey, and the young person (and their family s) income. The Council will consider covering the costs of travel on London Underground or Overground network if a journey by bus will: necessitate taking more than two buses. take longer than an hour during peak hours as calculated using Transport for London s Journey Planner ( Any financial support will be targeted particularly at young people on low incomes. Young parents who are under the age of 20 when they start their course may be able to get financial support for childcare and travel costs via Care to Learn (C2L). Further details are available at 6

7 Where there are reasons relating to a child or young person s health or social needs (as supported by documentary evidence) which Islington Council deem as exceptional, travel costs or transport arrangements can be considered. Each case will be considered on an individual basis bearing in mind the individual circumstances of each particular case. Information, guidance and support on this and other matters can be provided to young people and families from Islington s SEND Community Support Service, contact details of which can be found at Islington s Local Offer webpage: 7. IF TRAVEL SUPPORT IS AGREED, WHAT HELP WILL BE PROVIDED? The type of transport arrangements we will make will depend on the individual pupil s needs. (For children and young people with SEND see Section 4.) Wherever possible we will pay for the cost of a travel pass for rail travel for the most appropriate and cost effective route available. Where such arrangements are not appropriate we will make what we consider suitable alternative arrangements. Some parents may wish to transport their child to school by car. Where we agree to this arrangement, the parent will be reimbursed their reasonable travel expenses. 8. IF MY CHILD QUALIFIES FOR FREE SCHOOL TRAVEL, HOW LONG WILL THIS PROVISION CONTINUE? If your child meets the criteria set out above and is awarded free school travel, this will continue until: Your child leaves their current school and transfers to another school; Your child changes address either temporarily or permanently; Your child ceases to be a registered pupil at the school; Your child reaches school leaving age; Following a review, if it is decided that they do not continue to meet the criteria. 9. ASSISTANCE WITH HOME TO SCHOOL TRANSPORT Section 509(3) of the Education act 1996 provides Islington Local Authority with discretionary powers to pay the whole or part of the reasonable travel expenses of pupils who do not qualify for free transport in exceptional circumstances. When deciding whether to make a contribution to pupils travelling expenses we will consider the individual circumstances of the pupil including parental income. 10. HOW TO APPLY If your child has a special educational need or disability please use the application form that can be downloaded from the Travel and Transport section of the Education pages on the Council s Local Offer website ( For all other children and young people please complete the application form that can be downloaded from the Travel section of the Schools and Learning pages on the Council s Local Offer website. 7

8 11. APPEALS If you wish to appeal against the decision not to award free or subsidised travel, you should use an appeal form which can be downloaded from Islington s Local Offer website. Stage one: Review by a senior officer A parent has 20 working days from receipt of the local authority s home to school transport decision to make a written request asking for a review of the decision. The written request should detail why the parent believes the decision should be reviewed and give details of any personal and/or family circumstances the parent believes should be considered when the decision is reviewed. Within 20 working days of receipt of the parents written request a senior officer reviews the original decision and sends the parent a detailed written notification of the outcome of their review, setting out: The nature of the decision reached How the review was conducted Information about other departments and/or agencies that were consulted as part of the process What factors were considered The rationale for the decision reached Information about how the parent can escalate their case to stage two (if appropriate) Stage two: Review by an independent appeal panel A parent has 20 working days from receipt of the local authority s stage one written decision notification to make a written request to escalate the matter to stage two. Within 40 working days of receipt of the parents request an independent appeal panel considers written and verbal representations from both the parent and officers involved in the case and gives a detailed written notification of the outcome (within 5 working days), setting out: The nature of the decision reached How the review was conducted (including the standard followed e.g. Road Safety GB) Information about other departments and/or agencies that were consulted as part of the process What factors were considered The rationale for the decision reached Information about the parent s right to put the matter to the Local Government Ombudsman The independent appeal panel members should be independent of the original decision making process (but are not required to be independent of the local authority) and suitably experienced (at the discretion of the local authority), to ensure a balance is achieved between meeting the needs of the parents and the local authority, and that road safety requirements are complied with and no child is placed at unnecessary risk. 8
