No. 52, SEC-III, Salt Lake City, Kolkata Subject: First Appeal dated and dated Nil (received on ) under RTI Act, 2005 Madam, This has reference to your Appeal submitted twice separately datedd and dated Nil (received in this office on ) in connection with your RTI Application dated No specific point of dissatisfaction has been expressed in your appeal dated while in your subsequent appeal dated Nil (received in this office on ) it has been mentioned that basic facilities.. included in Question No. 8 has not been touched upon in CPIO s reply. However, your Appeals vis-a-vis the replies given by the CPIO vide this office letters of even numbers dated and have been considered carefully and found that the CPIO has furnished information based on your query as per available information. Replies given by the CPIO are upheld. However, you are also informed the following in this regard: 1) Under Point No.3 in your RTI Application dated , you have sought Minutes of reverting committee from UDC (ad-hoc) to LDC. In this connection it is mentioned that consequent upon imposition of penalty on Shri Raju Kumar under Rule 16 of CCS (CCA) Rules, 1965 he was not clear from vigilance angle and accordingly no order extending his ad-hoc appointment as UDC was received in this office from Department of Personnel and Training. Therefore, his ad-hoc appointment as UDC came to an end as per extant instructions of Govt. of India on the subject viz. If the Govt. Servant is not fully exonerated in the departmental proceeding the ad-hoc promotion granted to him should be brought to an end which instructions are available in public domain. e.g. in the website of Department of Personnel and Training; 2) Under Point No.7 in your RTI Application dated , you have sought valuation of work done by Shri Raju Kumar as UDC. In this connection it is mentioned that there is a due procedure for evaluation of performance of an employee. SSC (HQ) and/or Department of Personnel and Training is the custodian of information on such matters; 3) Under Point No.8 in your RTI Application dated , you have inter alia sought information on alleged less salary getting by Shri Raju Kumar for January, In this connection it is mentioned that Shri Raju Kumar absented himself unauthorizedly on 26 th and 27 th December, 2013 for which salary was not paid to him as per rules, and necessary recovery was effected from the salary of January, As regards, providing basic facilities/needs like table/chair, it is for your information that such facilities are provided to the employees considering their status as well as resources available in this office and Shri Raju Kumar is being provided such facilities in common with other employees of the comparable rank;
