1 McDONALD VILLAGE COUNCIL WEDNESDAY, NOVEMBER 5, 2014 REGULAR COUNCIL MEETING Visitors: Ken Miner, Terri Kish, and Alexandria Everhart Staff: Fire Chief Nick Kish, Police Chief Lou Ronghi, Solicitor Douglas W. Ross, Village Administrator Thomas Domitrovich, and Office Manager Char McCracken 1. The meeting of was called to order by Mayor Glenn W. Holmes at 6:17 p.m. In the absence of Mrs. DeBow, who was out of town on family business, the roll was called by Office Manager Char McCracken. Mr. O Brien present Mr. Fisher present Mr. Puckett present Mr. Harvey present Mr. Seitz present Mr. Stitt present 2. Pledge of allegiance The Lord s Prayer and a minute of silence 3. Approval of the October 15, 2014 council minutes. It was moved by Mr. Fisher, seconded by Mr. Seitz to approve the October 15, 2014 minutes as mailed: 4. Adoption of agenda: It was moved by Mr. Fisher, seconded by Mr. Seitz to accept the agenda as presented:

2 Page 2 4. Adoption of agenda cont d. 5. Mayor s report Mayor Holmes stated he will be attending Mayor s Court training on November 14, in Columbus. He is looking to reinstitute Mayor s Court next year. Mayor recognized the Boys Cross Country team placing third at the State meets, and the Girls Cross Country State Championship. The Girls won at Track and Cross Country this year and did extremely well. He asked for a motion to have the Solicitor prepare a resolution commending the Boys and Girls Cross Country team. It was moved by Mr. O Brien, seconded by Mr. Seitz to have the Solicitor prepare the necessary legislation to commend the Girls and Boys Cross County teams on their state championships. Mayor read a letter of resignation from Cory Hinderliter of the McDonald Fire Department. It was moved by Mr. Puckett, seconded by Mr. Harvey to accept the resignation of Cory Hinderliter. Discussion: Mayor Holmes thanked Mr. Hinderliter for his service to the Village. He has a child now and the fire service does take a lot of time.

3 Page 3 5. Mayor s report cont d. Mr. Stitt aye Mayor asked for confirmation on the appointment of Robert Golden as a volunteer firefighter. It was moved by Mr. Puckett, seconded by Mr. Stitt to confirm the appointment of Robert Golden. Mayor asked for confirmation on the appointment of Alexandria Everhart as an EMT. It was moved by Mr. Puckett, seconded by Mr. Stitt to confirm the appointment of Alexandria Everhart. Discussion: Chief Kish stated she will be on once she completes her schooling. Mayor thanked the voters of McDonald for approving the 1.5 mil renewal operating levy. It passed by 64%. He appreciated Council s approach to

4 Page 4 5. Mayor s report cont d. infrastructure and spending those dollars diligently. He thanked the voters for showing faith in the administration. Mayor will attend a meeting this Friday with the Solicitor, Village Administrator, and a representative from Niles regarding the sanitary upgrades. Our pro-rata share will be 10% of the upgrades. Trumbull County Sanitary District will have to pay 20% of that 10%. We are looking forward to starting those negotiations. Mayor reported the committee met on the OPWC grant for our south of Marshall Road resurfacing project. There were some lofty projects and only so much money to go around. It looks like our project is on the borderline. He will report to Council after the grants are awarded. He congratulated all the local elective officials in Trumbull County. He attended the Christmas in the Village meeting this past Monday evening. He encouraged Council to get involved. 6. Report of Village Officials: Village Administrator Thomas Domitrovich reported that he has been working to get the remodeling program started again at the Community Room. He has been working with Mike Sliwinski, Trumbull County Building Department; and Joe Steines from GPD; and contractor Ed Moody. Leaf pickup is about mid-season. It takes about a week to get through the town. There are three guys on it at least for eight hours a day. Some days they will be working late if they know there is a storm coming to get the streets safe and passable. They did all streets south of Marshall Rd. today. Mr. Domitrovich congratulated the Girls Cross Country State Champions for representing the community well. He did attend the meet and the accolades began for McDonald before the race began. The announcers talked at length about McDonald s involvement in the State program and the return to it year after year. They did announce that the Boys are the second highest State Championship Team of all divisions with the seven that we have. We are only second to another school with eight. They were very congratulatory before the race began. The VA wished good luck to the McDonald football team in the playoffs.

5 Page 5 6. Report of Village Officials cont d. Police Chief Lou Ronghi stated his men attended the drug free workplace training. They also received a portable breathalyzer from the Ohio Department of Public Safety to utilize on the roads. The Chief and Mayor attended a Board of Education meeting on October 20 regarding the lockdown drills, A.L.I.C.E. training, school campus two-way radio system, security cameras, and the new sidewalks around the school. He also assisted both schools with the lockdowns. His department purchased seven new Glock handguns for the full-time officers. We were able to fund them out of this year s budget. These will replace their current handguns that were purchased in Fire Chief Nick Kish thanked Mayor and Council for the appointments to his department. His department will be applying for grants through FEMA equipment. Trick or Treat went well. There were no incidents. Solicitor Douglas W. Ross no report. 7. Committee reports: President Pro Tem Mr. O Brien reported on tonight s Caucus where the following items were discussed: agenda, Fiscal Officer s report, Council minutes, legislation, Fire appointments and a resignation, and a splash pad for the park. Mayor Holmes stated we discussed briefly the stick pick up during the winter will be on a as needed basis. The Village Administrator will use his discretion as to when that truck needs to roll. He is looking at fuel costs. Mr. Domitrovich encouraged the residents to call if they have to put branches out during the winter season. This will help with the fuel costs of running the machine and truck that is pulling it. We have an increased cost of salt, gas, and electric and if we could garage the equipment, it will put more money into the budget for other things. Park & Buildings Mr. Stitt reported Park and Buildings met last evening and discussed the Community Room and the work that can be done during the winter months. They also discussed Christmas in the Village which is scheduled for November 29, at 6:30 p.m. The Girls Cross Country Team will light the tree this year. They also talked about what they can do with the wading pool.

6 Page 6 7. Committee reports cont d. Safety Committee Mr. Puckett no report. Finance & Capital Improvement Mr. Seitz stated we are coming to the end of the year and asked the departments to watch their spending and stay within their budget. They discussed the contract with Infinisource for Cobra Compliance. There is a first reading tonight and they it will have to be passed as an emergency at the next council meeting to meet the time constraints. They also discussed future projects. Service Committee Mr. Harvey stated they met last evening with a full committee and discussed the Cobra Compliance, Public Defender s contract, and the slag/salt issues for this winter. Planning Commission Mr. Fisher stated Planning will meeting November 12 at 7:00 p.m. He also stated there are two pieces of legislation on the agenda this evening dealing with rental inspections and asked for support of those. Mr. Fisher also stated as an alumni member of the Cross Country program he congratulated them on their performance. He can t say enough about the coaching staff they are incredible. He wished the football team well and hopefully we can finally beat Mogadore. Community Chest Mr. O Brien no report. 8. Remarks from persons or groups present: none 9. Old Business: none 10. Legislation: A Second reading of a Resolution Authorizing The Mayor And Fiscal Officer To Extend The Agreement With The Trumbull County Public Defender s Office, For The Benefit Of The Village, Providing For Services To Be Rendered By Trumbull County, Acting Through Its Board Of Commissioners, At A Pro- Rata Share Of Five Hundred Dollars ($500) For A One (1) Year Extension Commencing January 1, 2015 And Ending December 31, 2015.

B Second reading of an Ordinance For The Purpose Of Amending A Certain Section Of Chapter 1359 Of The Codified Ordinances Of The Village Of McDonald, Ohio, Entitled Rental Property, And Specifically Section (e). It was moved by Mr. Fisher, seconded by Mr. Seitz that the resolution pass second reading as read. C Second reading of an Ordinance For The Purpose Of Amending Previous Village Ordinance No For The Purpose Of Adopting The Previously Established Fee Schedule For Building And Zoning Permits; And For The Purpose Of Adding Fees For Re-Inspections Of Rental Property. It was moved by Mr. Fisher, seconded by Mr. Puckett that the resolution pass second reading as read.

8 Page Legislation cont d. D First reading of a Resolution Authorizing The Mayor And Fiscal Officer To Renew The Agreement With Infinisource Cobra Compliance Systems, Inc., 15 E. Washington St., P.O. Box 889, Coldwater, MI , Which Agreement Will Commence December 1, 2014 And End November 30, 2015, For The Purpose Of Handling All Cobra Claims As Required By The Federal Government. Discussion: Mr. Seitz stated that Council deems it prudent to have a specially trained company handle all cobra claims for the Village. It was moved by Mr. Seitz, seconded by Mr. Harvey that the resolution pass first reading as read. 12. Fiscal Officer s report: Mr. Seitz reported that the bills for the Fiscal Officer s report total $41, I, Scott Seitz, Chairman of the Finance and Capital Improvement Committee of the Village of McDonald, Ohio do hereby declare that the bills are true and correct. It was moved by Mr. Harvey, seconded by Mr. O Brien to accept the Fiscal Officer s report and pay all bills.

9 Page Miscellaneous: Mayor Holmes stated he neglected to read the monthly Mayor s Court report under his record. Mayor Holmes gave the monthly court report as follows: For the month of October we collected Niles Municipal Court fines $ , reports $10.00, law enforcement fund $783, and drug fund $150 for a grand total to the Village of $ Mr. Harvey stated Mathias Tayala is a NCAA Champion. Not many communities can say they have a resident that has reached that height and will continue his quest. We are very fortunate to have him as a student and athlete. His career is really flourishing at the college level. I congratulate him also. 14.
