6 IMPORTANT NOTE: The procedures outlined in this manual govern the administration of UUNIC paper & pencil examinations, regardless if the participating State Board Office personnel administer the examination, or the examinations are administered by a third party vendor. However, participating states which have either: (a) adopted NIC Computer Based Examination (CBT) services; or (b) out-sourced the administration of NIC practical examinations to an NIC approved examination partner; should be aware and familiar with the NIC approved partner s CBT or Practical Administration Procedures, which govern in these two situations. General Responsibilities This manual is copyrighted material which is solely owned by the National-Interstate Council of State Boards of Cosmetology, Inc. (NIC). It is intended for use by customers of NIC only. All other uses of this manual are prohibited. NIC customers may copy forms in this manual for use in the NIC Examination program. NIC assumes full responsibility for all aspects of the Examination programs it supervises. This information represents the minimum policies and procedures required by agencies or companies utilizing NIC Examinations. These policies may be used in conjunction with state, agency, or company policies and procedures. If state, agency, or company policies are less restrictive than the procedures outlined herein, this manual will take precedence. States may include pertinent information from this manual in state examinee information brochures, bulletins, or other informational documents for examinees. NIC requires all personnel who have authorized access to NIC Examinations at any time, or for any reason, to sign the appropriate Affidavit of Confidentiality and Nondisclosure and comply with the policies and procedures in this manual. Signed affidavits must be kept on file and made available to NIC upon request. To avoid conflict of interest, no one associated with the administration or review of NIC examinations may be actively involved or involved in the last three years, in courses, workshops, or tutoring activities that involve teaching or coaching examinees on aspects of any NIC examination. Examination staff or personnel may not participate in the administration of any NIC examination when immediate family members or friends are taking a NIC examination. All Examination Administration staff who have access to examination material must sign the NIC Examination Administrators, Proctors, Supervisors and Staff Affidavit of Confidentiality and Non- Disclosure (see Appendix C). States requesting to review an examination must sign the NIC Administrator, Affidavit of Confidentiality and Non-Disclosure prior to the examinations being sent for review (see Appendix D). Additionally, authorized reviewers must sign the NIC Examination Reviewer, Affidavit of Confidentiality and Non-Disclosure (see Appendix E). NIC complies with the Standards for Educational and Psychological Testing prepared by the American Educational Research Association, The American Psychological Association, and the National Council NIC Examination Administration Manual Page 5 of 72

8 on Measurement in Education. All entities using NIC examinations must comply with these standards along with the NIC policies in this manual. Security of Examination Materials Examination security is a top priority, and critical component of maintaining the validity and integrity of the assessment process. As such it is the customers and NIC s responsibility and duty to protect the integrity of the examinations and related materials. In doing so, both the customer and NIC are confident in the evaluation, and subsequent licensing of qualified and competent practitioners. The cost of creating an Examination is high and continues to increase. Whenever Examination material is lost or stolen, thousands or hundreds of thousands of dollars may be incurred. Beyond financial losses, a security breach of a NIC Examination may mean that examinees are licensed without having the prescribed level of competence. Customers using NIC Examinations must designate an authorized Examination Administrator to work directly with NIC s examination service, Schroeder Measurement Technologies, Inc. (SMT) in ordering, receiving, and returning NIC examinations intact and uncompromised. Each customer s authorized administrator is required to sign for all NIC examination materials shipped and will be ultimately held accountable if examination materials are lost or compromised between the time the examinations are received at their location, and the time SMT confirms receipt of the returned materials. The security of examination materials is critical. From the moment of delivery to the time the examination materials are shipped back to SMT, the Examination Administrator, Examination Room Supervisors, and Proctors must ensure their protection from loss, compromise, or unauthorized access by following these rules: All examination related materials including examination booklets must be stored in a secure area, which has limited or monitored access. A secure area may be a lockable file cabinet, a closet that locks, a dedicated room which locks, etc. Examination booklets and other secure materials should be placed and stored in such a secure area at all times, until the test administration, thereby protecting them from damage, theft, misplacement, and conditions that might reveal examination content. It is essential that materials for the examination be kept confidential and secure at all times. Ideally, only the exam materials to be administered for the session should be brought into the examination room. If this is not possible, the materials for all sessions may be brought into the examination room, but they must be kept segregated as much as possible to ensure only those materials meant for a particular exam session are used. All exam materials not in use must be isolated from the examinees and under constant surveillance by a proctor throughout the examination. The carton(s) containing the specific exam booklet to be administered should be opened under secure conditions, and only the number of exam booklets needed NIC Examination Administration Manual Page 6 of 72

9 should be removed. All exam booklets should be returned to secure storage after each session. Examination booklets must be used only once, and shipped to SMT within one business day following the scheduled administration. Photocopying, scanning, or any other duplication of any examination booklet is strictly prohibited and considered a breach of exam security. No one, other than the Examination Administrators, Examination Room Supervisors, Proctors, and specifically authorized staff assisting with the examination may have access to the examination booklets Examination staff (or any other personnel) are not permitted to inspect or review the contents of an exam booklet. (Exception: If an error or defect in an exam booklet is reported during the examination, an Examination Administrator may open and inspect the exam booklet.) Any other exceptions to this policy must have prior authorization from the SMT. Any suspected breach in security must be reported to SMT immediately. Each examination booklet is shipped sealed. Never break the seal on an examination booklet. Seals may only be broken by examinees after they have read and signed the Examination Rules and Security Agreement on the answer sheet, and are verbally instructed to do so. Ordering, Receiving, Accounting, and Storing Examination Materials 1. The Exam Administrator must submit a NIC Examination Materials Order Form (Appendix L) to SMT at a minimum of 33 days prior to the examination date to request required exam administration materials. The Date Order Needed By: should be at least three days prior to the date of the examination administration. The form must also indicate the number of examination booklets, answer sheets, CIBS, and Test Administration Manuals needed. 2. The examination materials will be shipped from SMT via traceable secure carrier to the authorized Exam Administrator. 3. Immediately upon receipt of the examination materials, the Examination Administrator must inspect the shipping container(s) to ascertain if their condition is satisfactory and the container seals appear to be intact. If the containers are opened or damaged, the Exam Administrator must contact the Vault Supervisor at SMT immediately at and complete and send a NIC Examination Incident Report (see Appendix H). 4. The Exam Administrator uses the enclosed SMT Packing List (see Appendix I) to verify the contents listed are actually contained within the shipping container received. Additionally, the Exam Administrator should ensure that all of the items below are present. This verification should be done immediately upon delivery of materials. The shipment will include: Examination Administration Manual(s), examination booklets, and answer sheets. NIC Examination Administration Manual Page 7 of 72

10 Written Examination Seating Chart(s) (see Appendix A); to aid in randomized seating. NIC Restroom Roster(s) (see Appendix B) for examinees to sign in and out when using the restroom. NIC Examination Administrators, Proctors, Supervisors and Staff Affidavit of Confidentiality and Non-Disclosure (see Appendix C) NIC Examination Incident Report (see Appendix H) SMT Packing List(s) (see Appendix I) -- which describes the materials sent in this particular shipment, listing an individual booklet number for each examination shipped. SMT Inventory Report(s) (see Appendix K) -- which describes the inventory that is currently in your state s possession, including the current shipment. SMT Discrepancy Form(s) (see Appendix L) -- that you will use to report any shipping or inventory discrepancies. 5. If the shipping container(s) and their contents do not show any evidence of having been tampered with, the Exam Administrator should open them and proceed to use the enclosed Packing List to verify every individual item in the container(s). Every examination booklet is individually and uniquely numbered, and must be accounted for by its unique number at the time it is received. After the Examination Administrator has verified that every booklet contained in the shipment matches the Packing List, he or she will complete and sign the Shipment Receipt Confirmation section of the of the SMT Packing List, and fax it to the SMT Vault Monitor at (see Appendix I). If a discrepancy between materials received and the Packing List is found, the Examination Administrator must complete the SMT Discrepancy Form (see Appendix L) and fax it to the SMT Vault Monitor. 6. The Exam Administrator must also review the SMT Inventory Report (see Appendix K) and be certain current inventory levels are reflected accurately. If there are any discrepancies, the Exam Administrator must complete and fax the Discrepancy Form to the SMT Vault Monitor at During unpacking, Examination Administrators, Examination Room Supervisors, Proctors, or authorized staff must never break any seals on the exam booklets. 8. After being inventoried, the examination booklets must be locked in a secure room or other secure location at all times, with controlled access. Only the Examination Administrator should have access to the secure room. All authorized people assisting with the examination must be reminded of the importance of safeguarding the confidential nature of the examination materials before, during, and after the exam administration. In the event that examination materials are lost, or compromised between the time they are received at the specified shipment location listed on the Examination Order Form, and the time SMT confirms receipt of the materials when they NIC Examination Administration Manual Page 8 of 72

11 are returned to SMT, the Examination Administrator will be held accountable. 9. Examination booklets may only be retained in the state/vendor inventory for a maximum of 6 months. It is the Exam Administrator s responsibility to verify that all booklets are accounted for at all times. Upon receipt of returned examination materials, SMT will send an updated Inventory Report to the examination administrator, indicating the examination booklets SMT s records. If a recent inventory list has not been provided, an updated inventory list can be requested by ing NIC@smttest.com. 10. The Examination Administrator must account for examination booklets several times before and during the examination administration session, immediately following the examination session, and at the time of shipment for return to SMT. At least six (6) inventory verifications of the booklets will be completed during the time the examinations are in the state or administrator s possession, which are described below: 1. Immediately upon receipt of examination materials. 2. Inventory verification upon arrival at examination site. 3. After materials have been distributed to examinees. 4. Before examinees are dismissed from the examination room. 5. At the conclusion of administration. 6. When preparing materials for return to the appropriate agency or SMT. Room Preparation for Examination Administration Only Staff that have previously executed an appropriate NIC Affidavit of Non-Disclosure (see Appendix C) on file (which must be available to NIC and/or SMT upon request), and registered examinees with appropriate identification and documentation are allowed inside the examination room. All examinations must remain sealed until the examinee has read and signed the Examination Agreement and been instructed to break the seal. It is imperative that examinees do not have access to the examination in advance. Examination site staff must not read examination content. In the event there is an actual or suspected breach in security, the Examination Administrator or Examination Room Supervisor must notify NIC and SMT immediately in writing, using the NIC Examination Incident Report (see Appendix H), and the state representative will be informed of immediate actions to be taken. All doors should be closed (but not locked in case of a fire) and only one door used for entry and exit from the examination room. Prior to admitting examinees to the room, the Examination Administrator or Examination Room Supervisor is responsible for ensuring that: Examinees are spaced so that an eight foot table has a maximum of three seated examinees, and a six foot table has a maximum of two seated examinees. 12 Examinees can locate the examination room by posting signs if necessary. The temperature of the room is comfortable and the lighting is adequate. A clock is visible to all examinees and examination room staff. There is a supply of sharpened number two pencils. The examination room is staffed with, at a minimum, one Examination Supervisor and one Proctor. The examination room should have one additional Proctor for rooms with more than 25 examinees. Proper check-in, seating, and monitoring cannot be performed without adequate staff. Examination staff must be identified by name tags. There is adequate table space to use at the room entrance, for ID checking and roster signing. There is a table or location, away from most traffic, to place prohibited items. There is a separate table or location, away from examinees, and which can be monitored by administration staff at all times to place examination materials in an orderly manner before the examination, and upon collection. The seating chart has been prepared to facilitate randomized seating. Admission and Seating of Candidates Examinee Admission For the protection and integrity of the NIC examinations all candidates will be required to produce a legal form of identification prior to being allowed access to the testing room. Once the room has been set up, admit examinees one at a time. Ask each examinee for their admission notice and valid government issued ID card with photo, valid passport, or other acceptable official photo ID. Ask the examinee to sign their name in the appropriate spot on the roster. Positive identification must then be established by following the five steps listed below: 1. Ensure that the candidate is actually presenting a state or governmental issued identification. Compare the signature on the roster to the signature on the photo ID, check the address listed on the ID against the address on the registration, etc. 2. Compare the name on the photo ID against the name on the admission notice and listed on the roster. 3. Compare the photo on the photo ID to the examinee. 4. After all of the comparisons are shown to match, return the admission notice and ID to the examinee and direct him or her to the pre-assigned seat. Do not let examinees choose their own seats. 13 5. Instruct the examinee to keep his/her admission notice on the table for double-checking seating and proper recording after the distribution of examinations. 6. Before examinees break the seal on their examinations, ask them to remove the admission notice by putting it under their desk or table. Once the administration starts, there should be nothing on the candidates table except for the examination booklet, their answer sheet, and a pencil. Admission Discrepancies Identity If there is any doubt about an examinee s identity, do not admit that examinee. Ask him or her to wait outside. If an examinee does not have an admission notice or is not on the roster, he or she must not be admitted into the examination. Each state must have procedures for meeting this responsibility and handling examinees that cannot be admitted. It is the Examination Administrator s responsibility to know these procedures and communicate them to the Examination Room Supervisor. Personal Items The Examination Administrator or designee must adhere to strict and uncompromising rules and regulations as it pertains to personal belongings in the possession of exam candidates. The strict rules are to ensure that every exam candidate has an equal opportunity to demonstrate their knowledge and at the same time protects the integrity of the test. The following security procedures must be enforced by the Examination Administrator or designee administering the exam: Instruct examinees with backpacks, briefcases, books, or other such items to put them in a designated area of the examination room, away from where the candidates are sitting. 1. Have candidate remove all jackets, sweaters, scarfs, or other bulky clothing. If candidate is wearing long sleeves have candidate pull up sleeves. 2. No cameras, notes, documents, audio or video recorders, personal digital assistants (PDA), pagers, cellular phones, calculators or other electronic devices are permitted in the testing area. Do not let the candidate merely turn the device off and keep it, all such devices must be placed in a designated location away from the candidates. 14 3. No watches or electronic time keeping devices. 4. No guests, visitors or family members are allowed in the test room. Tell examinees that if they need to take medication, they must raise their hands to explain their need to the Examination Supervisor. Examinee Seating and Use of Seating Charts Seating charts are multifaceted documents that can help the Proctor in ensuring the appropriate size and configurations of a testing room and at the same time play an important security role. Therefore, the Examination Administrator should complete the Seating Chart Form prior to the exam administration whenever practical. A recommended seating chart is attached as Appendix A. The seating chart will: 1. Assist to recreate the seating arrangement if, the exam administration is interrupted. The seating chart will help ensure the same candidates return to the same seat. 2. Assist in any investigation of a reported cheating incident to identify which seat the alleged cheating candidate was sitting along with which exam candidates were sitting nearby. The Examination Room Supervisor may assign table row identifiers for each examinee. The roster must be marked, beginning with the first examinee, with a pre-assigned seat number. The chart may be created to show the actual seating arrangements in advance of the examination. Restroom Procedures Once an examinee has been admitted to the examination room, he or she may not leave the room until they have finished the examination, except to use the restroom. If an examinee wishes to use the restroom during the examination session, they must give all examination materials to the Examination Supervisor, and sign out on the Signature Out section of the NIC Restroom Roster (see Appendix B) prior to being excused from the examination room. Only one examinee may leave the room at any one time. Positive identification must be reestablished before readmitting examinee into the examination room. The examinee must present a valid government issued photo ID, and sign the Signature In section of the Restroom Roster. The Examination Supervisor must verify that the photo ID and the Signature Out on the Restroom Roster match the Signature In. Inform examinees of these requirements ahead of time so that they take ID with them for reentry. NIC Examination Administration Manual Page 12 of 72

15 Examination Duplication No one may duplicate, retain, or convey any portion of examination materials in any form, written, oral or by memorization. The examinee must read and sign the Examination Rules and Security Agreement section of the answer sheet prior to breaking the seal of the examination booklet. Late Examinees Late examinees should not be admitted to take the examination. After the doors are closed and the oral instructions begin, late entrants present the potential to disturb the other examinees and should not be admitted. Distribution of Examination Materials 1. After all examinees have been seated, the Examination Room Administrator will oversee the distribution of examination booklets and answer sheets. Examination materials should not be placed at any empty seat. 2. Verify the candidate has been given the examination title and language that is listed on the admission notice. 3. At the scheduled time for the examination to begin, or after everyone is checked-in, and it is past the scheduled start time, the Examination Room Administrator will begin reading the oral instructions. There will always be at least two forms of the examination. When it is time to distribute examination booklets, the examination room staff will hand one booklet to each examinee, making certain that the examination forms are alternated so that no examinees sitting next to or near each other have the same examination form. 4. If your state administers a separate State Law Examination, please follow the steps above and distribute only the state law examination booklet and answer sheets first. The state law examination administration must be completed for all candidates, and materials must be collected as outlined in the Collection of Examination Materials /Checkout Procedures of this manual prior to the distribution of the NIC national examination materials. The same distribution of materials steps will apply for the national examination, as outlined above Monitoring Examinees during the Examination 1. Throughout the examination session, the only materials allowed on the examinee s table should be the examination booklet, answer sheet, and pencils. Backpacks, electronic devices, purses, and anything that can be used as an examination aid must be placed in the designated area for storage, away from where the candidates are seated. It is recommended that the agency administering the examinations provide pencils to the examinees. NIC Examination Administration Manual Page 13 of 72

16 2. At all times, there should be examination room staff quietly walking around the room to guard against cheating, and to answer any questions that the examinees have with respect to the logistics of completing the examination. Examination supervisors should not attempt to answer questions relating to examination content or grading. Make sure the candidates are marking the answers on the answer sheet, and not in the booklet. Walk quietly during the examination and refrain from conversation. There should be no talking, smoking, or eating in the examination room. 3. A Proctor should check the restrooms during the exam to see if there is any study materials concealed there by a candidate. The first check should be done shortly after the exam has started. If the restrooms are located in non-secure areas where non-test takers have access, more frequent checks need to be made to ensure materials to assist with the exam are not planted after the exam starts by unauthorized individuals. 4. The Examination Administrator or Proctors should NOT directly confront a candidate who is cheating, or suspected of cheating. If the cheating involves a cheat sheet or other piece of extraneous material, the Examination Administrator or Proctor must tell the candidate the item is not allowed in the room and collect the item. If the candidate refuses, do not pursue the matter. The Examination Administrator should quietly collect the candidates test material and instruct the candidate to collect their personal items and exit the testing room. It is preferred that the Examination Administrator or Proctors quietly observe the behavior and notify exam security (ESS) immediately. Additional witnesses to a cheating incident are advisable and will help with preparing reports of the incident to SMT. Document the details on a NIC Examination Incident Report Form (see Appendix H) and submit it SMT as soon as possible. NIC will then provide the information to the state for appropriate action (invalidation of examination scores, etc.) The following behavior is considered cheating and constitutes a violation of security policy: Talking, whispering or sign language to another person other than authorized examination staff during the examination. Bringing an electronic device such as a telephone/camera into the testing room. Looking at another examinee s examination materials. Allowing someone to copy from their examination materials. Writing after time is called. Taking, or attempting to take, any secure materials or information from the examination room by any means (electronic, copying, recording, etc.). 17 Possessing or looking at any object containing answers or what appears to be a code for answers. Writing on any material other than the answer sheet, examination booklet, or comment sheet. Each agency should develop a comprehensive plan and provide training to their administration staff regarding such matters. Quietly observe the behavior and, if possible, get a second person (i.e. a Proctor or the Examination Administrator) to also observe the behavior before confronting the examinee(s). Documenting Irregular Incidents If necessary, the Examination Administrator, or Examination Room Supervisor will also record on an NIC Examination Incident Report (see Appendix H) the details relating to any of the following types of events that may occur during examination: Defective Examination Booklets If a defective examination booklet is reported, the Examination Supervisor should take the booklet from the examinee and replace it with a new booklet of the same form with no defects. The examinee should write the new booklet number on the answer sheet directly next to the first number. The examinee should continue recording answers on the original answer sheet. The supervisor should attach the defective booklet to the NIC Examination Incident Report (see Appendix H) and return with the other examination materials to SMT. Defective Answer Sheets If a defective answer sheet is reported, the Examination Room Supervisor should give the examinee a new answer sheet, direct the examinee to indicate his/her name, Examination Form, Test Code and Candidate ID # on the new answer sheet, and have the examinee continue recording answers on the new sheet. The supervisor should attach both answer sheets to the Incident Report with a paper clip and return with the other examination materials to SMT. Potential Problems with Examinee Answer Sheets Examples are improper gridding in any of the fields, poor erasures, and stray marks. If possible, the improper marks should be corrected immediately by the examinee. Examinee Permanent Withdrawal from the Examination If an examinee must withdraw permanently from the examination, the examinee's exam materials NIC Examination Administration Manual Page 15 of 72

18 are to be collected and an incident report must be completed. The examinee's exam materials and incident report must be returned to SMT with the used exam materials. The Examination Supervisor should note on the Incident Report the name, examination booklet number, reason, and time of withdrawal for any examinee who requests to terminate/abandon their examination prior to completing. Early Dismissal Unless special instructions are provided, examinees that finish early are permitted to leave the examination room one at a time until the last thirty minutes of the examination session. An exam booklet and answer sheet must be collected from each examinee that leaves early. It is also imperative that the answer sheet and exam booklet are inspected to ensure they were completed accurately and entirely. Also inspect each exam booklet prior to the candidate leaving to ensure no pages are missing or tampered with. If these discrepancies are not noted prior to the departure of the candidate there will be no way to prove that the candidate is the one who removed a page from the exam booklet. If a credential ID/badge system is being used collect the badge. Examinees that leave early should be reminded to be considerate of those who are still working and to refrain from making noise outside the testing room. No one is permitted to leave the examination room after the announcement of the thirty-minute warning. As examinees complete the examination and begin to leave the testing room, a proctor should be stationed at each exit to ensure that exam materials are not carried from the room. Exam materials should not be left near exits used by examinees. Group Mistiming If a delay or interruption of five minutes or more occurs at any time during the timed portion of the examination administration, the lost time must be added to the closing time of the examination session. Group miss-timings should be noted on an Incident Report Form. Tampering with Examination Booklets All booklets should be checked for missing staples, missing pages, writing in the booklet upon receipt from examinee as part of the check-out procedures and any occurrence should be noted on an NIC Examination Incident Report Form (Appendix H). Irregular Incidents and Events The Examination Administrator and or designee have the authority and responsibility to ensure that the examination is conducted under standardized conditions for all examinees. The Examination Administrator and or designee are expected to handle all incidents that disturb or deviate from these conditions and document the incident(s) in a written report. SMT may be contacted during the examination if assistance is needed in handling any such situation. Observe NIC Examination Administration Manual Page 16 of 72

19 the following procedures for disruptive, irregular behavior, or emergency situations. incidents must be documented in an incident report. (See Appendix H). All Disruptive Behavior If the conduct of an examinee interferes with the testing conditions of other examinees and the examinee fails to respond to a warning, collect the exam booklet and answer sheet and escort the examinee from the examination room with the least amount of disturbance to the other examinees. Irregular Behavior Irregular behavior that occurs during an examination includes the following: 1. Copying answers from another examinee, permitting answers to be copied, or in any way providing or receiving unauthorized information about the content of the examination. 2. Continuing to mark answers or erase on the answer sheet after the STOP announcement. 3. Possessing notes or making notes on anything other than the test book or answer sheet. 4. Copying, Giving, or Receiving Information. If a proctor observes and/or is made aware of behavior that indicates that an examinee is copying answers from another examinee, permitting his/her answers to be copied, or providing or receiving unauthorized information about the content of the examination, the following actions should be taken: 1. Have another member of the exam administration staff monitor the candidate as well. 2. Contact exam security immediately (ESS) 3. Allow the examinee to continue the examination session 4. Confirm the observation with at least one other proctor 5. Call SMT/ESS if consultation is needed 6. If it is determined or believed that the security of the examination content is or suspected to be in jeopardy, advise the candidate that you need to talk with them outside the room, secure the candidate s examination materials, obtain any other documents or devices used by the candidate and do not let them continue to have access to any examination materials. 7. Quietly and discreetly collect the test candidate(s) exam material and ask them to collect their personal belongings and leave the examination room. If the examinee questions the reason NIC Examination Administration Manual Page 17 of 72

20 for the move, ask them to leave the testing room first then speak to the candidate about your observations and the rules and regulations dictating the Proctors actions. Let the candidate know they can appeal your decision with ESS/SMT directly, but that a report by the Proctors and any witnesses will be forwarded to SMT for action deemed appropriate. 8. Prepare an incident report and return it to SMT. Include the following information: a. Time and duration of the incident; b. Page and/or item number that the examinees involved were working on at the time of the observation (if possible); Identity of all involved examinees by name and candidate identification number (indicate whether all involved examinees were aware of the incident); c. A diagram of the precise seating arrangements and spacing among those involved; d. Signatures of the proctors making the observation. Writing After the Stop Announcement If an examinee is observed marking answers or erasing on the answer sheet after the STOP announcement, it is a direct violation of the timing regulations for the examination. The Examination Administrator or Administrator Assistant should: Immediately approach the examinee and warn him/her that the announcement has been made to stop, signaling the end of the examination. Prepare a report and include the examinee s name and Candidate ID number, the length of time for which the examinee continued to write, and the approximate number of items answered by the examinee after the STOP announcement. Possessing Notes or Making Notes If an examinee possesses notes or is observed making notes on anything other than the exam booklet or answer sheet, describe the incident in an incident report and return the signed report to SMT along with any materials/notes confiscated from the examinee. The report and data obtained from the examination materials will be studied and appropriate action will be taken upon approval/request of NIC officials. If clarification of the report or further information is needed, the Examination Administrator will be contacted by SMT. It is important that reports of irregular incidents be thorough, but concise, and contains an unbiased account of the proctors' actual observations. 21 Disruptions and Interruptions External disruptions such as construction noise, fire alarm, activity in adjoining room, hallway/corridor noise and internal disruptions such as room temperature, defective lighting, and examinee noise may cause distress and distraction to examinees during the administration of the examination as well as interruption of the examination. Disruptions should be handled as quickly as possible with minimal disturbance to examinees: 1. Relocate the testing room if necessary (e.g., if construction noise cannot be stopped). 2. Send a proctor out to disperse hallway/corridor noisemakers. 3. Request that adjoining room activity be relocated. 4. Contact building administration if fire alarm noise is prolonged, provided the alarm is not signaling a real emergency. 5. If the disruption is causing anxiety to the entire group and is prolonged, testing time should be extended to accommodate the duration of the disruption. 6. Report any disruptive situation that occurs, especially if it involves interruption of the examination. Prohibited Actions and/or Activities The security of the examination and certification process is of paramount concern, therefore action, actions, activities, occurrences, etc. which in any jeopardizes the integrity of the examination is considered a violation of exam security. 1. Possession of any items which are not specifically authorized, or any actions which are prohibited within the Candidate Admission Letter, is a breach of exam security. 2. Violate exam security rules adopted by NIC and the Board of Licensing, or, with respect to any such exams, knowingly and willfully to: a. Give examinees access to exam questions prior to testing; b. Copy, reproduce, or use in any manner inconsistent with exam security rules all or any portion of any secure exam booklet; 3. Coach examinees during testing or alter or interfere with examinees responses in any way; a. Make answer keys available to examinees; b. Fail to follow security rules for distribution and return of secure exam materials as directed, or fail to account for all secure exam materials before, during, and after testing; c. Fail to follow exam administration directions specified in the exam administration manuals; or NIC Examination Administration Manual Page 19 of 72

22 d. Participate in, direct, aid, counsel, assist in, or encourage any of the acts prohibited in this section. Emergency Evacuation The Examination Administrator should establish a plan for evacuating the examination room in the event of an emergency (e.g., fire, prolonged power failure). The plan should include collecting and securing the exam materials, and providing instructions to the examinees and proctors regarding exiting from and returning to the exam room. To ensure the security of the exam materials, the proctor should be the last to exit and the first to return to the testing room. If possible, the room should be locked during the evacuation. To maintain the integrity of the examination, proctors should monitor the examinees during the evacuation to minimize communication among the group. If the room cannot be locked, and it is deemed safe to do so, the Examination Administrator should collect the exam material in the following order of priority and exit the room with them; booklet, answer sheet, scratch paper. If this cannot take place, the Examination Administrator must be the first person to return to the testing room and conduct a complete inventory of the exam material before allowing exam candidates back into the room to resume the examination. If the Examination Administrator or designee has a camera it is recommended that they photograph the testing room as it was left and photograph it again upon return to see if anything was disturbed during the time when the room was left unsecured. Any signs of tampering or theft should be immediately reported. The proctor should note the time of the exam interruption and the time all of the exam candidates returned to the testing room to begin testing again. The time the exam candidates were not able to test MUST be added to the overall time. Written Examination Administration Verbal Instructions Adhering to precise verbal instructions is very important to a fair examination administration. The Examination Room Supervisor must ensure that all verbal instructions are carefully and clearly read, and that all examinees are able to hear them. In this section, procedures or comments for the Examination Administrator or Examination Room Supervisor are in normal text, as in this sentence. Verbal instructions and announcements to the examinees are shown in bold, italic text. Instruct the Proctor(s) to distribute the examination booklets to the examinees making sure that the forms are alternated so that no examinees sitting next to each other have the same Examination Test Form number. The Test Form number is located on the front cover of the booklet. Always try to use written examination booklets in numerical order from the smallest number to the largest number. 28 NIC National Examination Written Verbal Instructions The NIC National Examination booklets are now being produced with two adjoined pre-coded answer sheets, one located at the front of the booklet and a second on the last page of the booklet. Please note, the transition to the adjoined booklets will be a gradual process; therefore some of the candidates will be using the prior booklet format. In these cases, the candidate will need to be provided a separate answer sheet and the adjoined booklet specific instructions will not apply. If the candidate exam booklet contains an adjoined answer sheet, please be cognizant of the following: The adjoined answer sheets contained within these booklets are printed on perforated paper. The candidates will be able to easily separate the coded answer sheet from the examination booklet. The examination content (questions) is sealed within the booklet, and should not be opened by the candidate until the verbal instructions are read and the candidate is directed to do so. Candidates will be required to complete and bubble in the all of the information as on the answer sheet, including the Test Code and Test Form. Failure to follow these procedures will result in improper or delayed scoring. It is imperative that the candidates only use the answer sheet contained within the specific booklet assigned to the candidate. Answer sheets must never be shared. This is a crucial measure as the information contained on the answer sheet directly coincides with the examination booklet it was contained within. 32 You will have 90 minutes to complete the written examination. At the beginning of the last hour of this examination and every fifteen minutes thereafter, I will make an announcement of the time remaining. When you have finished your examination, raise your hand. The Examination Supervisor will indicate for you to bring your examination booklet and your answer sheet to the supervisor s table and you will be excused from the examination. Are there any final questions? The time is now. Your examination will end at. Record the starting time of the examination and the number of candidates in the room on the seating chart. You may break the seal on your examination booklet, and begin the examination. Should examinees complete the examination in less than the time allotted, they may use the time to review their responses. If they choose to leave the room, they must turn in all materials and leave the room, quietly and will not be permitted to return. When there is fifteen minutes left, no other examinees are allowed to leave. Always record the start time of the examination using a clock visible to the examinees. Examination Administration Staff must record the time the first examinee completes the examination and exits the examination site. Make an announcement when one hour remains, then every fifteen minutes afterward. At each announcement of the time remaining, record the time and the number of candidates still testing and when five minutes is left, record the number of examinees remaining. At the end of the examination time limit, make a clear and understandable STOP announcement. Make sure all examinees actually stop. If all examinees finish the examination before the time limit, record the time the last examinee finishes the examination. As examinees complete the examination and their materials are collected and recorded, a Proctor or Administration Staff should be stationed at the exit to ensure examination materials are not carried from the room. Collection of Examination Materials/Checkout Procedures When an examinee finishes the examination and wishes to be dismissed, he or she must raise a hand to alert the Examination Supervisor. Follow these procedures to check examinees out: It is imperative that the Examination Administrator or Assistant Proctor examine each answer sheet when it is turned in by the candidate after the examination. 33 will interfere with scoring and may result in the delay or impede the provision of candidate score results. Release one examinee at a time. Inspect each booklet to make sure no pages have been removed, staples are intact, no writing inside the booklet etc. Verify that the examination code, examination form, and candidate ID # fields have been transcribed from the examination booklet and bubbled in correctly on the examinee s answer sheet, and that the examination agreement has been signed. Compare the signature on answer sheet with the signature on the photo ID or on the roster. Secure examinees examination booklets and answer sheets. Do not open the booklet again after this time. No examination staff may read the examination content. Verify that all secure materials for each examinee are accounted for and secure before releasing him or her. DO NOT ALLOW THE CANDIDATE TO LEAVE UNTIL THE ANSWER SHEET HAS BEEN EXAMINED AND COMPLETED ACCURATELY AND COMPLETELY. IF YOU FIND ERRORS AND/OR OMISSIONS MAKE THE CORRECTIONS/CHANGES BEFORE THE CANDIDATE LEAVES. Once the examinee s examination materials have been collected, accounted for, and verified, the examinee must sign out on the roster prior to leaving the examination room, and their name must be checked off. At the close of the examination session, the examination materials should be collected in the following manner: The Examination Supervisor will ensure that all examination booklets are arranged in serial number order, inserting appropriately the booklets of examinees who left early. The answer sheets should be grouped together separately. The Examination Supervisor will reconcile and ensure that one answer sheet has been collected for each examinee that tested. All used and unused examination materials must be inventoried and locked in a secure location at all times, until the materials are returned to SMT (within 1 business day). Only the Examination Administrator should have access to the secure room/location. Examination Administrators, Examination Room Supervisors, Proctors, or any other staff members must not read examination content. In the event examination materials are lost or compromised between the time the examinations are received at the shipment location on the Examination Order Form, and the time SMT confirms receipt of the returned materials, the Examination Administrator will be held NIC Examination Administration Manual Page 31 of 72

34 responsible. Return Shipment of Examination Materials All used examination materials should be returned to SMT no later than the first business day after the administration of the examination. Examination answer sheets and booklets must be returned in two separate shipments, as described below: Please note: Use containers strong enough to hold examination materials that will not break open to prevent examinations from being compromised. Shipment One: Answer Sheets, Examination Rosters and Seating Charts This shipment must be sent by traceable means, such as UPS, Federal Express, etc. U.S. First Class Mail is NOT acceptable, as this provides no means to track packages. The service you select will determine processing and reporting response times. For faster score report processing, we recommend using express or overnight services. Answer sheets should be arranged and sorted by examination type. A copy of the examination roster and seating chart is placed on top of the appropriate answer sheets. If more than one category of written examinations were administered at the same time, only one roster is required. Separate administrations require a copy of the administration roster with the answer sheets attached for each administration. These examination rosters are very important. If examinees incorrectly bubble their answer sheet, the roster will enable processing personnel to correct the problem and provide accurate scoring information. 35 After the materials are verified, the Examination Administrator must complete a packing list or detailed inventory of the examination booklets being shipped. This inventory should at a minimum include all return shipment inventory booklet numbers, to be included with the examination booklets. Once SMT receives the booklet shipment and verifies the return shipment, an updated Inventory Report will be sent to the examination administrator and/or state, indicating the examination booklets SMT s records reflect are currently in the states inventory. Records to be Maintained Each customer is responsible for the creation and maintenance of an effective and auditable inventory control system, which documents the receipt, access, use and return of all examinations, or other examination related materials. Additionally the client should maintain records relating to: 1. Copy of roster and seating chart with each examinee checked off or shown as a no-show, including any changes. (All records must be retained for twelve months after examination date and furnished to a NIC or SMT representative upon request.) 2. Copy of any Incident Report(s). (Retain perpetually.) 3. Insurance and shipping records/receipts from the shipment containers. (Retain until you receive an updated Inventory Report from SMT, verifying return of materials.) Examination Reviews NIC does not permit examinees to review NIC examinations or examination content. If the law in your state requires that examination reviews be conducted, the Board or Regulatory Agency should contact NIC to discuss the local requirements. Practical Examinations NIC offers National Practical Examinations for Cosmetologists, Manicurists/Nail technology, Electrology, Estheticians, Instructors, Natural Hair Styling, Wax Technology, and Barbers. Practical examinations, unlike written examinations, are rated by NIC certified examiners. The National Interstate Council of State Boards of Cosmetology conducts examiner training annually for all examiners to insure that examinees are examined equally. The same security measures apply with the National practical examinations that apply with the National written examinations. 1. All examination materials should be stored in a locked room or other secure location. Only the Examination Administrator should have access to the examination materials. 2. Examiners must be identified by name tags. 3. Observers are only allowed if permission is granted by the state with advance notice to observe NIC Examination Administration Manual Page 33 of 72

36 once a year. Observer must sign a confidentiality non-disclosure statement and provide government issued photo I.D. Observer is not permitted to take any items into examination room, which include (but not limited to) purses, briefcases, electronic devices, or any writing material. Observers are not permitted to walk around the examination room, and must stay in one position during the entire examination 4. States that require live models: Models are required to provide a government issued photo I.D. and meet the state guidelines for live models. Models must be at least 15 years of age and cannot be licensed or a student studying in this field. The model must also sign a Practical Examination Affidavit of Non-Disclosure and Non-Licensed or Non-Schooled Statement. Models must be present with the candidate at the beginning of the practical examination. The model must be appropriate for examination purposes and must agree to submit to all services in the practical examination. Models may not participate in any way during the examination. Models are not permitted to talk to the candidate or examiners at any time during the examination. 5. Examiners should use clip boards and keep all examination materials with them during the examination. Rating forms should not be put down or left where examinees can read them. Examiners should not allow examinees to read the rating forms over their shoulder. 6. Examiners must fill in the oval for either Y to indicate YES, or N to indicate NO for every task that comprises that procedure, using a number 2 pencil. If a candidate does not complete a task or section, the unfinished task lines should all be marked N. Sections skipped or not completed cannot be scored, and will be returned. 7. Examiners should be in the examination area during all phases of the examination. Examinees should not be left unattended at any time during the examination. 8. Examinees must sign out to go to the restroom. Only one person may be absent from the examination room at any time. 9. Cellular phones, pagers, any electronic device, printed materials, and handwritten notes are NOT permitted in the examination room. Talking to other candidates or any examiner is strictly prohibited. Failure to comply with any of these conditions will result in candidates being dismissed immediately, and their actions reported on a NIC Incident Report. Examiner must not answer any questions concerning the practical examination. This ensures equal opportunity for all candidates and standardization in testing for the National Practical Examination. 10. Examiners must inventory all examination materials. 11. If you suspect an examinee of cheating, ask another examiner to verify the suspicion. If verification is made, note the conditions on the incident report, and have it countersigned. 12. Examiners should be vigilant for examinees with unauthorized materials, especially written NIC Examination Administration Manual Page 34 of 72

37 materials. 13. The verbal instructions, provided to each Regulatory Authority participating in the practical examination program, should be read verbatim for every examination administration and should be read to the entire group of examinees at the same time. Special Administrations Special Accommodations for Examinees with Disabilities The proper adherence to Americans with Disabilities Act (ADA) standards is the responsibility of each entity providing examination services. The following section is provided only as a guide to Examination Site Administrators and Examination Room Supervisors. This does not substitute for the full and proper training in ADA standards and requirements of personnel involved in the Examination process. Refer to the latest ADA publication for full compliance. In addition, please refer to the Standard for Educational and Psychological Testing, Part III, Standard 14, for additional guidance on providing examinations for people with disabilities. Title II of the 1990 Americans with Disabilities Act (ADA) prohibits discrimination in the offering of benefits, programs, or services by state and local governments: Title II, Section 202. Subject to the provisions of this title, no qualified individual with a disability shall, by reason of such disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to discrimination by any such entity. Thus, any examination process carried out by state or local government entities must be offered with appropriate accommodations to preclude discrimination on the basis of disability. Title III of the ADA prohibits discrimination in the offering of public accommodations and services: Title III, Section 309. Any person that offers examinations or courses related to applications, licensing, certification, or credentialing for secondary or post-secondary education, professional or trade purposes shall offer such examinations or courses in a place and manner accessible to persons with disabilities or offer alternative accessible arrangements for such individuals. Examinees who require special accommodations due to an accident or permanent disability must notify SMT (not NIC) at least two weeks in advance if special examinee consideration is requested. Examinees who request special accommodations should be considered on an individual basis by the proper authorities within your state. NIC requires its customers to comply with all standards and requirements of the ADA as well as federal standards. Deaf and Hearing Impaired NIC Examination Administration Manual Page 35 of 72

38 An examinee who is deaf or has a hearing impairment is assigned a seat as close to the Examination Room Supervisor as possible. It is beneficial to seat the examinee close to the Examination Room Supervisor to facilitate lip reading of the instructions. The examinee may be given written instructions in place of, or in addition to verbal instructions. The Examination Room Supervisor should signal the examinee to indicate starting and ending times, and ensure they understand. An examinee with a hearing impairment may request an interpreter to sign the preliminary instructions. The use of a signer is at the discretion of the agency providing the license. Each signer is required to have a government-issued photo ID. All signers are required to leave the examination room prior to the actual examination administration. Visually Impaired An examinee who has a visual impairment may request a reader to read the examination questions and/or a person to act as a scribe to record the answers on the answer sheet(s). Readers must be approved by the proper authorities, and will be required to have a photo ID for admission to the examination. They will also be required to sign the NIC Examination Administrators, Proctors, Supervisors and Staff Affidavit of Confidentiality and Non-Disclosure Form prior to beginning the examination (see Appendix C). If a reader is needed, the examination must be given in a separate room where the examinee and reader will not disrupt other examinees. A reader may not assist the examinee in answering or interpreting a question. The reader may read the examination question and/or examination materials as many times as requested by the examinee. The reader may read the questions only in the language of the examination booklet. For example, if the examination booklet is in English, the questions must be read in English; if the examination booklet is in Spanish, the questions must be read in Spanish, etc. The reader cannot translate the examination questions into any other language. The entire session should be recorded and the Examination Administrators should pay particular attention to any touching or signaling that may occur. Learning Impaired An examinee that has a learning disability may have impairments such as nominal brain damage, brain dysfunction, dyslexia, perceptual disorders, or language disorders. An examinee who has a learning disability may request additional time to take an examination, may have a reader, or require a person to act as a scribe to record the answers on the answer sheet. Special accommodations for an examinee that has a learning disability must be approved by the proper authorities. Physically Impaired An examinee that has a physical disability may be in a wheelchair, wear braces, or use crutches, and may need assistance to move about the examination site. 39 An examinee that has a physical disability may need extra examination time, additional rest periods, a separate room or a larger work area. An examinee that has poor dexterity may require a Room Supervisor to act as a scribe to record the answers on the answer sheet. In this case, the examinee is required to sign a statement indicating that the Examination Room Supervisor is performing this service at the examinee's request. NIC Policy on the Use of Readers, Translators, and Foreign Language Dictionaries NIC does not permit examinees to use readers, translators, or foreign language dictionaries, and any such use is deemed to be a breach of security. These terms are described as follows: Readers are individuals who simply read the examination questions, in the language they are written, to examinees. This language is assumed to be the first language of the examinee. Readers are used because the examinee has some degree of inability to read the examination. Translators are individuals who read aloud their interpretation of the meaning of an examination to examinees that have some degree of inability to read the examination in the language it is written. For example, an examinee whose native language is Russian and has little command of written English, may need a translator. The translator would read the examination, as printed, in English, and provide the examinee with their interpretation of how the questions would be written in Russian. Foreign language dictionaries are references that provide an equivalent between English words and words in another language. Foreign language dictionaries do not provide word definitions. Reason for the Policy The potential for a breach of security occurring as a result of the reading or translation is great. An examinee with a concealed audio recorder or transmitter can easily steal the entire examination with little possibility of detection. In addition, all credentialing examination programs share a set of goals. These include, but are not limited, to the following: Recognition of competency -- That is, decisions to offer a license or certificate should be based upon the competency of the examinee alone. Standardization of the examination process -- That is, the process of examinee evaluation should be the same from location to location and from administration to administration. Fairness to examinees -- That is, no examinee or group of examinees should be disadvantaged or advantaged by the examination process. 40 the same access to the same information as all other examinees. Security of the examination process -- That is, no examinee should have advance knowledge of the examination content. Allowing examinees to use readers, translators, or foreign language dictionaries creates problems in meeting credentialing examination goals for the following reasons: The profession of cosmetology and related fields require that the licensee be capable of reading instructions, particularly in connection with the use of chemicals. The licensing of cosmetologists and related professionals is based on the need to protect the public from unsafe practice. The ability to read and understand information relevant to public protection is essential. The use of readers, translators, or foreign language dictionaries may help people get licensed who do not have these skills. NIC does offer some examinations in other languages, however, these are also administered without readers, translators, or foreign language dictionaries. Standardization can be harmed because a translator necessarily provides examinees with their interpretation of each question s meaning if written in another language. Also, readers often change the way a question is written, based on their own interpretation, so that it s easier to understand. Such interpretations may fundamentally change what is being examined because the intent of the question may change due to the subjective nature of any kind of translation. When foreign language dictionaries are permitted, a mechanism is created through which information about the examination can be brought into the examination room, and removed from the examination room. Permitting foreign language dictionaries is almost always associated with security breaches. Readers or translators may provide verbal or non-verbal cues to help the examinee find the correct answer. Exceptions to this Policy NIC recognizes that exceptions to this policy may be necessary for the following reasons: Accommodations under the Americans with Disabilities Act (ADA) may include the use of readers. However, it is important to understand that the ADA does not recognize an examinee s inability to read and understand English, because of illiteracy or the fact the examination language is not the same as the examinee s first language, as a disability. A reader then, would not be provided in such a situation. It is possible that a state s laws or regulations may require that a reader, translator, or foreign language dictionary be provided in the event of illiteracy or because English is not the examinee s first language. When exceptions to this policy are necessary, the following guidelines should be NIC Examination Administration Manual Page 38 of 72

41 observed: The potential of a breach of security because of the use of readers or translators is great. An examinee s concealed audio recorder or transmitter can easily steal the entire examination with little possibility of detection. Every precaution should be taken to preclude such an event. For example, examinees should have no personal possessions such as purses, briefcases, or backpacks near them during the Examination since a recording or transmitting device can be concealed in these items. Further, the Examination should be proctored just like any other Examination. That is, the reader or translator cannot also serve as Proctor and the Proctor must be constantly vigilant for clues of the presence of such a device. One clue would be the examinee frequently reaching into their pocket as if to manipulate a device. The reader or translator should be selected and paid by the licensing board. In no case should an examinee be allowed to select the reader or translator. Any foreign language dictionary permitted during examining must be provided by the licensing board. No examinees may bring their own dictionary into the examination room. The reader or translator must not be an expert in, or be knowledgeable in the field of cosmetology or related professional areas being examined. (NIC) and, (Receiving Party), for the purpose of preventing the unauthorized disclosure of Confidential Information as defined below. The parties agree to enter into a confidential relationship with respect to the disclosure of certain proprietary and confidential information, specifically: NIC examination materials being provided are identified below: Test Code Test Form Booklet Number Description 1. Definition of Confidential Information. For purposes of this Agreement, Confidential Information shall include any and all information or material that has or could have commercial value or other utility in the business in which NIC is engaged. If Confidential Information is in written form, NIC shall label or stamp the materials with the word Confidential or some similar warning. If Confidential Information is transmitted orally, NIC shall promptly provide in writing indicating that such oral communication constituted Confidential Information. 2. Exclusions from Confidential Information. Receiving Party s obligations under this Agreement do not extend to information that is: (a) publicly known at the time of disclosure or subsequently becomes publicly known through no fault of the Receiving Party; (b) discovered or created by the Receiving Party before disclosure by NIC; (c) learned by the Receiving Party through legitimate means other than from the NIC or NIC s representatives; or (d) is disclosed by Receiving Party with NIC s prior written approval. Receiving Party shall hold and maintain the Confidential Information in strictest confidence for the sole and exclusive benefit of NIC. Receiving Party shall carefully restrict access to Confidential Information to employees, contractors and third parties as is reasonably required and shall require those persons to sign nondisclosure restrictions at least as protective as those in this Agreement. Receiving Party shall not, without prior written approval of NIC, use for Receiving Party s own benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of NIC, any Confidential Information. Receiving Party shall return to NIC any and all records, notes, and other written, printed, or tangible materials in its possession pertaining to Confidential Information immediately if NIC requests it in writing. The Receiving Party will also, and agrees to store any and all Confidential Information in a locked and secure area at all times when such materials are not within the immediate, direct and exclusive control of the Receiving Party. 4. Time Periods. The nondisclosure provisions of this Agreement shall survive the termination of this Agreement and Receiving Party s duty to hold Confidential Information in confidence shall remain in effect until the Confidential Information no longer qualifies as a trade secret or until NIC sends Receiving Party written notice releasing Receiving Party from this Agreement, whichever occurs first. 5. Relationships. Nothing contained in this Agreement shall be deemed to constitute either party as partner, joint venture or employee of the other party for any purpose. 6. Severability. If a court finds any provision of this Agreement invalid or unenforceable, the remainder of this Agreement shall be interpreted so as best to affect the intent of the parties. 7. Integration. This Agreement expresses the complete understanding of the parties with respect to the subject matter and supersedes all prior proposals, agreements, representations and understandings. This Agreement may not be amended except in a writing signed by both parties. 8. Waiver. The failure to exercise any right provided in this Agreement shall not be a waiver of prior or subsequent rights. This Agreement and each party s obligations shall be binding on the representatives, assigns and successors of such party. Each party has signed this Agreement through its authorized representative.
