1 Judicial Training Center (JTC) The Supreme Court of the Republic of Indonesia (In the face of challenges in the future) By A G U S S U B R O T O I. Introduction In effort to support national policy to achieve the goals of developing law sector, the Supreme Court has established a vision Excellent Judiciary. It is "THE REALIZATION OF SUPREME JUDICIAL BODIES". Basically, the vision of the Judicial bodies referring to provisions of the the Preamble of the Constitution of 1945, primarily in the second paragraph and the fourth paragraph of which is the formulation of the goals of the Republic of Indonesia. For further implementation which has been set out in the vision, further formulated mission of Judicial Bodies as follows: 1. Maintain the independence of judiciary, 2. Provide fair gives legal services to justice seekers, 3. Improve the quality of human resources (including in this sense of leadership) of the judiciary, 4. Increase the credibility and transparency of the judiciary. In conjunction with the realization of the mission as mentioned above in the third point "improving the quality of human resources of the judicial bodies", Judicial Training Center has an important and strategic role. As commonly understood, that the judge and court staffs who are under the judicial bodies are required to constantly improve and expand knowledge and skills. Increasing the capacity of the profession will lead to greater quality of the administration of judiciary and legal service to the society. It is expected to increase public trust over judicial bodies. One of the ways to achieve it is to provide education and training for judges and other technical judicial personnel in a comprehensive, integrated and synergistic with the needs of judicial bodies and the value of justice which live in the society. In addition to this, there are still other matters that should get attention is the recruitment system. 1
2 This is something that cannot be separated from education and training system connected with the management of human resources of judicial bodies. Management of human resources in a comprehensive manner is expected to manage and foster career of competent human resources with objective criteria. The realization of integrated and professional judicial personnel is one of the characteristics of supreme judicial bodies in Indonesia. In accordance with matters above, Judicial bodies have committed to produce the best graduates of judges and other technical judicial personnel in terms of expertise, professionalism, and integrity. II. Reformation of Education and Training system Recruiting competent human resources (judges and other judicial technical personnel) with objective, integrated and professional criteria, Supreme Court of the Republic of Indonesia is developing a "Education and Training System of Qualified and Respectable Judges profession and Court Personnel.The system will be realized by improving various aspects, which include : a. Institutional (institutional), b. Required facilities and infrastructure, c. Human Resources, d. Integrated and sustainable training program, e. Following up the outcomes of training, f. Training budget; and g. Other supporting activities (eg research and development activities). Re-engineering and improvement in the seven aspects are basically supporting factors to realize the improvement of the quality of education and training for judges and other technical judicial personnel. Regarding those seven aspects are basically implemented properly. In accordance with article 303 of Secretary of the Supreme Court directive Number 07 : MA / SEK / 07 / SK / III / 2006 on the Organization and Administration of the Secretariat of the Supreme Court stated that the Research and Development and Education and Training Center for Law and Judiciary has the task to support the Secretary of the Supreme Court of the Republic of Indonesia in conducting research 2
3 and development in the Law and justice, inter-institution cooperation within and outside the country as well as the education and training of technical and administration of judicial personnel in the Supreme Court and lower courts in all environment of judiciaries. In accordance with Article 304 Secretary of the Supreme Court directive Number 07 / SK / III / 2006 further formulate, that in carrying out the tasks referred to in Article 303, The Research and Development and Education and Training Center for Law and Judiciary has functions : a. Preparing the formulation research and development sector as well as law and justice, inter-institution cooperation within and outside the country as well as the education and training of technical and administrative judicial personnel in Supreme Court and the Court in all environment of judiciaries, b. Carrying out policies research and development sector as well as law and justice, and education and training of technical and administrative judicial personnel in Supreme Court and the Court in all environments, c. Implementation of administration of The Research and Development and Education and Training Center for Law and Judiciary. III. Formulation of Main Tasks and Functions In relation to Article 305 Decree of the Secretary of the Supreme Court of the Republic of Indonesia directive number 07 / SK / III / 2006 further states that The Research and Development and Education and Training Center for Law and Judiciary consists of: Secretariat of The Research and Development and Education and Training center for Law and Judiciary. The institution is tasked to provide administrative support to all elements within the Law and Justice Research and Development and Education and Training Center, by organizing functions to coordinate the preparation of plan and work programs, the implementation of human resources affairs, the implementation of financial affairs, as well as the implementation of administrative and fixtures affairs. 3
4 Research and Development Center of Law and Judiciary It has the task of undertaking research and development of law and justice, inter-institution cooperation within and outside the country, to perform the functions of the implementation of programmatic research and development, evaluation and reporting activities of research and development, and implementation of cooperation and publications of research and development sector. The Education and Training Center for Law and Judiciary The task given to this institution is to implement, coordinate foster education and technical training to technical personnel of judicial and administration of justice, to perform the functions of the implementation of the development, preparation of guidelines for education and training of technical personnel and the judicial administration of justice, the implementation of programming, curriculum and syllabus and methods and standardization of judicial education and technical training and implementation of administrative affairs. So, task and responsibility of Judicial Training center: plan, organize and evaluate training and education for judges and technical staff on technical judiciary matters. Education and Training Center for Management and Leadership This unit has a duty to implement, coordinate and develop education and training in management and leadership to the technical personnel of the judicial and administrative judiciary related to hierarchy ranks and positions, by organizing the function implementation guidance, Developing guidelines of education and training of management and leadership for technical and administrative judicial personnel, carrying out the preparation of program, curriculum, syllabus and methods of standardization of education and training of management and leadership as well as the administration of court, as well as the implementation of administrative affairs. 4
5 IV. Technical Judicial Education and Training activities Vision and mission Vision As the supporting unit for various activities of the Supreme Court, The Research and Development and Education and Training Center for Law and Judiciary formulates the vision of "To become qualified and respectable judicial profession education training center. Mision In conjunction with efforts to realize this vision, the judicial education and training center also formulates mission, it is "Improving the qualified professionalism of judicial and technical human resources". What has been formulated on the vision and the mission is basically aimed at directing clear direction to provide education and training about technical judiciary. In accordance with regulation, Supreme Court of the Republic of Indonesia directive number 140/ 2008 on guideline about carrying out Education and Training. It is widely understood that the success of an institution in carrying out their duties and functions lies in the quality of human resources. Under these conditions, the increasing of the quality and quantity of the court s personnel is determined of how this institution preparing its staffs with adequate training and education. On the other hand, the development of institutional capacity is also strongly influenced by the outcomes of adequate research to improve the ability to serve the public. Therefore, improving the quality of education and training of court personnel supported by adequate research is expected to produce a strong judiciary and authoritative. In conjunction with the delivery of education and training activities of the Technical Judicial concepts built and organized for this is the pattern of continuing judicial education (Continuing Judicial Education / CJE) and Continuing Registraat Training (CRT). It means that the education and training provided to the (candidate) judges and court staff is a continuation of previous formal education they get. Its development will then adjust to the development of their respective 5
6 professions (live) throughout their career in the court. In relation to this, it means that the Supreme Court requires judges and other judicial technical personnel to attend continuing education and ongoing training in order to support day-to-day tasks. Based on Training Needs Analysis (PPA) carried out jointly by the National Research and Development and Education and Training Law and Justice of the Supreme Court of the Republic of Indonesia with the Faculty of Psychology of University of Indonesia, Jakarta formulated that Education and Training is one of the useful efforts to create and develop the technical apparatus of judiciary. In conjunction with the implementation of Continuing Judicial Education, there are some principles that need attention, namely: 1. Characteristically comprehensive, integrated and synergistic to help judges and other judicial technical personnel to meet the expectations of society; 2. It is characteristically specific. It is part of the continuing education. It focuses on the needs of the development of technical competence of judges and other court personnel. In implementing the concept of Continuing Judicial Education, Education and Training Center on Law and Justice of the Supreme Court of the Republic of Indonesia fully implements the method of adult learning (adult learning). The application of this method in turn will improve the basics of the system and culture in the implementation of knowledge-based organization design (knowledge-based organization). Judges and other judicial technical personnel will always be learning from the outcomes of the training produced by graduates. V. Types of Provided Education and Training Based on continuing judicial education pattern, technical judicial Education and Training center has organized education and training programs as follows: 1. Education and Training of Integrated Candidate Judge. The program is organized to educate candidate judges of the Public Courts, Religious Courts, administrative Courts, and Military court. Period of Education and Training Candidates Integrated Judges is two years; The program in details is as follows of Apprenticeship Education I, to internalize administration affairs, Education and Internship II to train them as Substitute Registrar, and Education and Internship III to educate them as judge s assistant. 6

Education and continuing Judicial Training In principle, we adopt international practice of Continuing Judicial Education (CJE) for judges and court staff ensuring that they will receive continous and update training throughout their career in the judiciary, likely: a. Continuing judicial Education and Training I (CJE I), the Public Court, Religious court, administrative court and Military court Judges by the terms of work period of 1-5 years, b. Continuing judicial Education and Training Judge II (CJE II), the Public Court, Religious court, administrative court and Military court Judges by the term of work period of terms of 6-10 years. c. Certified Education and Training: including certified Islamic Economics Judge, Certified Mediator Judges, certified industrial relation Judge (Industrial Relations Court), Certified Fisheries Judge, Certified Commerce Judge (Commercial Court), certified corruption Judge (Anti-Corruption Court), certified environment Judge. d. Judicial Education and Certification Training for Judges who handle cases of juvenile case (Juvenile Court). 3. Judicial Education and Training for Senior Judges or Court s leaders a. Functional Technical Training Military court Judge, b. Judicial Training for those who deal with cases local elections for a head of government and legislative Election. They are administrative court Judges, c. Judicial Training for those who deal with domestic violence cases. They are Public Court Judges, d. Judicial Training for those who deal with Freedom of access to Public Information cases. They are Public Courts Judges and administrative court Judges, e. Judicial supervising Training for deputy chief of the appellate court Judges in four judicial bodies. 4. Judicial education and Training for Substitute Clerk and the bailiff a. Technical functional training for Clerk / substitute clerk of the Public Courts, Religious Courts, administrative Courts and Military court), b. Functional Technical Training for the bailiff to the Public Courts, and Religious Courts, Administrative court. 7
8 VI. Cooperation with third parties Beside the implementation of the activities carried out by the Judicial Technical Training and Education Center, some integrated trainings in the other forms of cooperation facilitated by several donors as well ministry / Institute have been held, they are including : 1. Revised Workshop of continuing Education and Training Substitute clerks, for those who have working period of 0-1 years, teaching materials endorsement Plenary Meeting of Education and Continuing Training of Substitute Clerk, Training of Trainers for Substitute Clerk ; This activity is organized in cooperation with the Technical Education Center for Justice at the United States Agency for International Development (US AID) - Changes for Justices (C4J). 2. Continuing Judge Training of trainers II (CJE-II) as well as the implementation of CJE-II for the judge who have working period 6-10 years with chronological Case Flow Management material, Quality of Verdicts as well as the Code of Ethics and Code of Conduct of Judges. This activity is organized in cooperation between the Technical Judicial Training Center with USAID-C4J. 3. Gathering of Education and Training for Law Enforcement agencies, they are Judges and prosecutors who handle cases of Crimes against Women and Children, held in cooperation between the Judicial Technical Training Center of Supreme Court - Training Center of Public Attorney and the Jakarta Centre for Law Enforcement Cooperation (JCLEC), 4. Cooperation between the Supreme Court and Bank Indonesia and the Financial Services Authority held a workshop on the legal aspects of banking, 5. Cooperation between the Supreme Court with the Ministry of Law and Human Rights, organized a Technical Training Integrated Treatment of Children in conflict with the law (Juvenile Court system), 6. Cooperation between the Supreme Court with the Ministry of Environment and the International Center for Environmental Law (ICEL) in the implementation of education and training of Certification of Environmental Judges, 7. Cooperation between Supreme Court of the Republic of Indonesia with the United Nations On Drug and Crime (UNODC) in the implementation of Computer Forensics Training for Environmental Public Judges. 8
9 VII. Development of E-Learning Indonesia is a very wide area, and the Supreme Court has more than 840 work units. Therefore, Judicial Technical Training Center annual budget can only provide education and training is not more than 15% of the total number of existing human resources, due to limited budget. To overcome this problem, the model of distance learning (e-learning) is conducted as the best choice for the Supreme Court. E- Learning model has been implemented for some training, including on the Code of Ethics and Code of Conduct of Judges. VIII. Challenges in the future 2015 is a milestone for countries which are members of ASEAN along with the implementation of the ASEAN Economic Community (AEC). AEC is the concept of the in-out way of goods, services and labor freely among countries in the Southeast Asia region. Facing this era, preparing quality of human resources is a tough thing which isn t negotiable (conditio sine quo non). Including in this sense, the human resources of "judiciary", both judges and other judicial technical personnel to face of the possibility of a case relating to the ratification of ASEAN Economic Community (AEC). That s why it needs to prepare training model of transferring knowledge about the Asian Economic Community. Besides, along with the rapid progress of Information and Technology, models of distance learning (e-learning) among judges and legal experts of ALA member need to be concerned to be developed in the future. By distance learning (e-learning) is expected to legal experts in their respective fields among ALA members provide course materials to the countries who are conducting training; therefore no longer distances to gain the progress of technology and information among ALA members. 9

C o n c l u t i o n Education and Training Center is an institution that has an important and strategic role in improving the capacity of human resources, especially Judicial human resources consist of judges and other judicial technical personnel. By following the continuing education program, it is expected that capacity of human resources is increasing. So, it will support to carry out the daily tasks. Along with the progress of technology of information, the learning process has no longer to apply face-to-face method between Tutor and Participants. The learning process can be carried out with the model of E-Learning. By E-Learning model, the distance between student and tutor is not a crucial issue again. Related to this matter, It needs to find out the way of developing possibilities of distance learning process (e-learning) among the ALA members Thank you
