1 8.8 UNITY TALKS: The resolution of EI on unity of teacher trade unions for stronger bargaining powers has been ongoing for the last three years. Owing to the industrial disputes that locked the teaching fraternity in 2015 with effects spilling to 2016, the agenda was not implemented as planned. Unity talk meetings with teacher unions in Kenya spearheaded by development partners and EI are set to commence early in 2017 in line with KNUT mission, To unite teachers of all grades. We ask delegates to support the agenda so that the entire teaching force remain united. Union of Education of Norway (UEN) is financing the programme. CONCLUSION: On behalf of the NEC, may I wish all the delegates to the 59 th ADC safe journey mercies back home. We equally wish all our members a very Merry Christmas and a Prosperous New Year, We remind all in the teaching service the great words of Albert Einstein while enrolling as a member of American Federation of Teachers (AFT) in 1938 while teaching at Princeton University, I find absolutely necessary for the intellectual community to come together to assert their influence in politics and protect their economic wellbeing. THE 2016 NEC REPORT TO THE 59 TH ANNUAL DELEGATES CONFERENCE (ADC) OF HE KENYA NATIONAL UNION OF TEACHERS (KNUT) AT MOI INTERNATIONAL SPORTS CENTRE, KASARANI-NAIROBI COUNTY: P R E A M B L E: The 59 th Annual Delegates Conference (ADC) is very historic in the history of the Union. It is a moment of great fulfillment for K.N.U.T. It comes at a time when K.N.U.T has achieved a major milestone of signing the Collective Bargaining Agreements (CBAs) that are registered with the courts, hence legally binding and meeting the International Labour Organization (ILO) standards and codifies gains made by the Union over the 59 years of its existence. This lays a foundation for reduced confrontations with the Teachers Service Commission (TSC) and the Government and fosters respectful engagement with the TSC and government. But, this has been paid through a price of jail conviction of the National Chairman, Brother Mudzo Nzili and myself in the year It is a price paid through strikes of 2013 (24 days), January 2015 (14 days) and September 2015 (5 weeks). It was paid through tough court contestations between January 2015 to November It has come through a price and must be defended and guarded jealously. This conference shall be graced by all former national officials of KNUT who are still alive and shall continue to do so in the future conferences to preserve the institutional memory of the union. The NEC has proceeded to extend a medical insurance cover to all those eligible within the law. 1.0 NATIONAL SECRETARIAT The union witnessed the registration of national and branch officials by the Registrar of Trade Unions following the branch and national elections held on between 3 rd February to 19 th February and on March 4, 2016 respectively. The swearing in and inauguration of all national elected officials was held on May 27, 2016 during the first NEC meeting. We welcome the newly elected officials

2 namely: Brother Hesbon Otieno in the position of Deputy Secretary General, Brother Collins Oyuu in the position of Assistant Secretary General, Brother James Ndiku in the newly created position of Deputy National Treasurer and Brother Abdi Hussein in the newly created position of the Assistant National Treasurer. The remaining officials were re-elected in their previous positions. We also welcome sixteen newly elected NEC members from the eight regions. KSSHA, KEPSHA and PWDs shall have their space in the NEC henceforth. Four union employees who are currently on terminal leave shall officially retire from the union services on December 31, We wish to thank them for their diligent services rendered to the union and wish them long and fruitful life together with their families as they continue with other issues during their retirement period. Targeted training programmes shall be rolled out in 2017 to build capacities of leadership at all levels. The NEC urges all our staff at branches and national to continue serving with dedication to enhance service delivery to members. 1.1 REPORT ON THE COLLECTIVE BARGAINING AGREEMENT (CBA) AND THE AGENCY FEE: (i) COLLECTIVE BARGAINING AGREEMENT (CBA): Delegates, as you are already aware, following the bruising legal battles the Union had with the Teachers Service Commission and the government generally and following the decisions from the Courts as well as your resolutions in the 58 th ADC held in December 2015, we did commence engagements with the government towards agreement of a new CBA. In the beginning of the year, through the intervention of his Excellency the President, we were directed to engage with a view of signing a Collective Bargaining Agreement within the financial year, It is through these negotiations that culminated in signing the first ever CBA between the Teachers and the Commission in this Country on the 20 th June, 2016 in Mombasa. This CBA was for the period 1 st July, th June, KNUT RELATIONS WITH NATIONAL UNION OF TEACHERS (NUT- BRITAIN): Mr. Chairman, the programme of training the Executive Secretaries was disrupted in September 2015 when we went on strike and up to now, it has not resumed. The NEC proposes that the programme should resume without further delay from February KNUT RELATIONSHIP WITH NATIONAL EDUCATION ASSOCIATION (NEA-AMERICA): Mr. Chairman, as reported elsewhere, we have a programme running with NEA and the NEC is grateful for it. NEA is emerging as a good partner for whom we are not only getting good support from but we are also learning and borrowing good practices from them. 8.6 KNUT RELATIONSHIP WITH AUSTRALIAN EDUCATION UNION (AEU): We are indebted to the Australian Education Union (AEU) for funding the union s national campaign on the Global Response of Privatization. We shall continue strengthening our relationship. 8.7 KNUT RELATIONSHIP WITH AMERICAN FEDERATION OF TEACHERS (AFT): We have had a longstanding relationship with the American Federation of Teachers (AFT). We are currently implementing the School s Representative Conversation Project at the workplace with our members. They have financed the development and printing of the School s Organizing Manuals, POWER IN NUMBERS

3 8.2 FEDERATION OF EAST AFRICAN TEACHERS UNION (FEATU): We held our regular constitutional meeting at Grand Global Hotel in Kampala on 14 th and 15 th April, The meeting was attended by 23 persons from all the Federation of East African Teachers Union (FEATU) affiliates and DLF. We had also the handing over of the chairmanship of FEATU from UNATU to ZATU (Zanzibar Teachers Union). From 14 th to 18 th May, 2016, the Union leaders attended the EI-FEATU/DLF workshop on Global response to commercialization of education. The purpose of the workshop was to develop understanding of EI global response to growing commercialization and privatization of education with a view to developing national campaign plan aimed at ensuring the government fulfills their obligation to implement and enforce a legislative framework necessary for the achievement of Sustainable Development Goal 4. From 16 th 21 st October, 2016, the KNUT Project Coordinator attended FEATU workshop at Golden Rose Hotel in Arusha on developing communication advocacy agenda/strategy to anchor our messages to the duty bearers and right holders on education reforms founded by DLF/LO-FTF. 8.3 DANISH TEACHERS UNION (DLF): We wish to report that we had no activities with Danish Teachers Union (DLF) this year. The DLF agreed to co-fund the training of our Branch Treasurers on proper financial management. DLF is supporting small unions within the Federation of East African Teachers Union (FEATU). This initial CBA contained largely the expression of the commitment and recognitions of the benefits that our members were already enjoying. It did not contain the basic salary component. We agreed to the execution of this agreement as the entry point of negotiations on the basic salary component which it had provided for to commence by the 1 st of July, 2016 and be concluded by October, The negotiations on the CBA for 1 st July, th June, 2021 were concluded; following continuous negotiations engaged by the Commission and the Union in a very objective environment during the month of October The CBA was signed in Naivasha on 24 th October, 2016 after the approval by NEC. I wish to thank the President for his direct personal intervention and good will towards the conclusion and signing of this CBA. This will see the government spend 54 billion to implement the agreement. I also wish to thank the National Steering Committee and the members of the NEC for their input in the course of the negotiations and subsequent approval of the CBA. This CBA indeed acknowledge the value of work a teacher is engaged in and recognized the need to compensate besides classroom work, the administrative work and responsibility that goes with it. The classroom teacher, who certainly is the main feature of a pupil s life in school, needs more recognition. We appreciate that we cannot achieve everything at once; this limb of our demand is one of our working stock at this moment. We are keen on closing on the gap between the highest and lowest paid teacher. The recognition of teaching as a profession distinct from mere clerical work is appreciated. A classroom P1 Teacher is no longer in the same rank and group as clerical staff in the mainstream civil service whose qualifications are far below what a teacher attains. The grading has also enhanced competitiveness and going forward, our members shall objectively be able to rise up the ranks on performance. I urge all of you to study critically the Collective Bargaining Agreement and to fully understand for the benefit of all our members. This CBA is for the year cycle 1 st July, th June, We urge the TSC to implement the CBA in one single installment.

4 (ii) THE AGENCY FEE: The Law, Section 49 of the Labour Relations Act, NO. 14 of 2007 (revised, 2012) entitles the Union to demand for deduction of agency fee from the wages of each unonisable teacher covered by the Collective Bargaining Agreement (CBA) who is not a member of the Union. Following the signing of the CBA on the 25 th October, 2016, we wrote to the Cabinet Secretary in the relevant ministry to gazette the agency fee in order for the Commission to commence deductions. The ministry has since written to TSC to submit a list of such unionisable teachers and not members of the Union. This is a process that we trust shall be concluded soonest. We are aimed at enabling teachers to understand and appreciate the importance of being a member of the Union. We demand that the Cabinet Secretary of Labour gazzettes the Agency Fee order with immediate effect without creating sideshows. (iii) THE UNION PARTICIPATION IN GLOBAL RESPONSE TO PRIVATIZATION AND COMMERCIALIZATION OF EDUCATION We thank the Australia Union of Education for funding the campaign goal through EI in Kenya. The highlighting of education as a stand-alone in the Sustainable Development Goals (SDGS) is a great commitment to the world in terms of delivery of quality education to All as catalyst to the achievements of the other 16 goals and a pacesetter to address the gaps identified in the Global Monitoring Report after MDGs and Education For All (EFA) Goals 2015.Governments all over the world have put in place policies and frameworks to fast track systems in the delivery of education to all with a focus on the most vulnerable and the marginalized. However, efforts to achievements of SDGs 4 is globally threatened by capitalists geared towards making profits from the very poor through edu-business under the guise of covering the education gaps in the government department. Hiding behind the model of low cost for profit schooling, multinational companies are out to make money out of the poor. The bug has spread fast especially in Principals to prudently manage public resources in the schools, enhance security and safety measures and as much as possible involve students in decision making to minimize school unrest. Principals to embrace technology and use of social media platforms as a way of disseminating information. Again Mr. Chairman, the KNUT supports them. The two associations are now co-opted into the NEC and BECs and we hope to see more consultations and harmony as we all serve teachers, children and Kenya. 8.0 INTERNATIONAL/REGIONAL PROGRAMMES: 8.1 RELATIONSHIP WITH EDUCATION INTERNATIONAL: The union has continued to follow important policies that are in line with Education International (EI) resolutions specifically the rights of workers and quality education. The union has participated in many forums organized by EI and attended by the Secretary General in his capacity as the President of EI, Africa Region. The forums among others are: The 50th Anniversary of UNESCO/ILO held in New York, USA, UN High Level Summit on Refugees and Migrants held on 19th September 2016 in New York, USA, International Conference on Education to Newly Arrived Refugees in European and Mediterranean countries held from November, 2016 in Stockholm, Sweden, 10th International Further and Higher Education and Research Conference held from November 16 to 17, 2016 in Accra, Ghana. The specific project that the union is directly partnering with EI is Breath of Learning Project and Commercialization and Privatization of Education.

5 partnering with TSC to develop relevant tools to identify the Head teacher and Teacher of the year; Promote capacity building among members through seminars, workshops and conferences on sound principles of education and administration of basic education institutions; (iv). (v). Endeavor to safeguard school land by applying for title deeds. Be at the forefront of enrolling and protecting children with disabilities and to continue working closely with the Ministry of Education to eliminate gender disparities institutions. The NEC, Mr. Chairman wishes them well and fully supports them. 7.7 KENYA SECONDARY SCHOOLS HEADS ASSOCIATION (KESSHA) The Association held its 41 st Annual National Conference 2016 at Wild Waters Centre, Mombasa between 20 th and 24 th June 2016 with the theme Rebranding the Teaching Profession. It is during this conference that teachers resolved that: The ongoing curriculum reforms should be undertaken with more emphasis put on capacity building for the implementers and supervisors. The government to ensure that cheating in national examination is eliminated and principals to be committed in the administration of these exams in order to deliver credible examinations. TSC should sensitize teachers on the newly launched management and supervision tools. The government to ensure smooth transition of the laptop programme from primary to secondary schools and that principals should support the government to progressively improve transitions from primary to secondary schools; developing nations. In Kenya the onset of low cost for profit is almost a cancer creeping quickly into the informal settlement in most of the counties. The global growth of commercialization school chains such as BIA is a threat to public education. The business venture is craftily modeled for any layman to see the bigger exploitative hidden agenda of making profit from the poor by enticing them to the one very precious commodity education. Most of the academies are in the informal settlements of our towns with an assumption that the government is not able to set up schools in such needy communities. In contrast, in the rural means they are next to public schools from which they draw the learners from unsuspecting parents. Worse still, the high level-businesses are getting funding from organizations such as World Bank, IMF, and Bill Gates Foundation among others under the humanitarian clauses. The overall goal for the MOE Kenya is to increase access to education, to achieving raise the quality and relevance of education, reduce inequality and equity as well as to exploit knowledge in Science, technology and innovation for global competitiveness with a view to achieving Sustainable Development Goal 4 Ensure inclusive and equitable quality education and promote lifelong learning opportunities for All The presence of the low cost for profit academies is violating the rights of the children to access Free Compulsory Basic Education encourages discrimination and is an outright exploitation of poor Kenyans for private gains. This is against the Kenyan constitution and a violation of universal declaration of education is a basic human right. KNUT together with Education International E.I) has studied the phenomena and has seen the dangers. The study in Kenya indicates a serious contradiction of the efforts to provide education for all. The sad bit is that BIA is not only making money out of the poor but also providing low quality of education to the already marginalized groups! Through use of untrained teachers an American curriculum, putting heavy levies on parents among other findings (See research findings). As a result the union has launched an advocacy campaign under the theme Learners before Profit with a call to the Government of Kenya to have all the BIA and after similar Edu business closed in Kenya. We also call on the Government to hasten provision of education facilities to all areas to avoid such potion as filling in the gaps where the Government has failed. We ask our

6 delegates today to be on the watch for any company or person exploiting poor Kenyans through provisions of poor quality schooling to alert our office. The NEC DEMANDS the immediate closure of BIA schools and unsuspecting children in these schools be integrated in public schools from January (v) EMPLOYMENT OF TEACHERS: There is a shortage of 87,489 teachers, with primary schools having a deficit of 39,913 while secondary schools have 47,576 teachers less. According to the TSC, there is a huge staffing challenge caused by the high enrolment rate, thanks to the free primary and affordable secondary education. The TSC recently launched Ksh. 16 billion Strategic Plan that acknowledges the need to address the teachers deficit. As a result of this shortage, we wish to make the following demand: The immediate employment of 100,000 teachers all at once to address the teacher shortage and also to achieve the target 4C of the Sustainable Development Goals. (vi) KNUT MEMBERSHIP The branch officials must always prioritize programmes for recruitment of new members and encourage them to join the union. The branches are to offer incentives among the top recruiting branch officials so as to enhance competition for recruiting thereby leading to the highest growth in recruitment. It has also come to our notice that some branches have tactfully kept their membership at around 900 while they have the potential to recruit well over 1000 members. We are urging branch leaders to go out of their way to ensure that all teachers are recruited to the union. 7.5 RELATIONSHIPS WITH UNIVERSITIES: In line with target 4.6 of the SDGs which states that by 2020 to substantially expand globally the number of scholarships available for developing countries particularly the least developed countries, Small Island, developing states and African countries for enrolment in higher education including vocational training, Information and Communication Technology, technical engineering and scientific programs. The union is Partnering with Kenyan universities like Masinde Muliro University, Daystar, Kenya Methodist University, Embu University, JKCUAT in providing moderate fee payment structures affordable to the teachers seeking higher education. The union has signed a Memorandum of Understanding (MOU) with several universities which are of benefit to teachers. We urge the teachers to take the opportunity of the offers to enhance their skills. 7.6 KENYA PRIMARY SCHOOL HEADS ASSOCIATION (KEPSHA) The head teachers from the different primary schools across the 47 counties convened at Sheikh Zayed Children Centre in Mombasa from 6 th to 11 th August, 2016 during their 12 th Annual Delegates Conference with the Theme: Curriculum Reforms for Child Friendly Quality Education as per the KEPSHA Constitution. During the conference, members reviewed the Associations financial and programme/activity performance over the past year, shared experiences and deliberated on management issues affecting education implementation within the primary schools context in Kenya. The 12 th KEPSHA Conference resolved to: Continue supporting the Government s efforts in curriculum reforms for quality education and integration of ICT into education through digital learning programme; Continuously advocate for the Head teachers professional growth, career development and quality management issues as well as

7 call off a legitimate industrial action, TUC-Ke moved to Court and stopped the illegal hiring of the relief teachers and the strike continued. (ii) When the National Hospital Insurance Fund (NHIF) raised membershipcontributions without consulting stakeholders, TUC-Ke moved to Court to stop the same but unfortunately, the Court declined to stay the implementation of the plan. While the matter is still pending in Court, sadly workers have continued to bear the blunt of the burden. The National Executive Council has noted with serious concerns the declining union membership in many branches due to interference by the Teachers Service Commission in its unfair validation. A quick analysis shows that in August 2015 the total KNUT membership was 197,555 and in October 2016 it was at 180,464. Total number of teachers in the country stands at 309,635. The NEC recommends that branch leadership intensifies recruitment of new members in all learning institutions to the union to meet the minimum of 70% membership in every branch. (iii) (iv) (v) (vi) In April this year, TUC-Ke put a spirited demand and in support of KNUT and its membership to demand for swift resolution to the stalemate on signing the C.B.A. then in dispute. We are happy the matter came to a good ending. Jointly with Friedrich Ebert Stiftung (FES), the Congress has started training young leaders among its Affiliates and has in the last one year trained (10) such leaders from KNUT on critical leadership skills such as: - Grassroot mobilization, Effective Representation at workplace, Alternative Dispute Resolution mechanism, Positive activism, Organizing across borders, Process towards Collective Bargaining Agreements and on Labour Laws. This training is continuing and more others will be trained. Those that are trained have the opportunity of enrolling in Exchange University programmes across the world. TUC-Kenya annually represents us at the ILO conferences in Geneva. TUC-Kenyahas attended and will continue to attend Annual Delegates Conferences (ADC) of all affiliate members as social partners and to achieve our stated motto: Bringing Workers together. Again during those turbulent periods, the Ministry of Education, Science and Technology relationship with the union could not be described wholly as cordial. However, at times it was the only voice of reason although sounding helpless in the face of a ferocious onslaught by the TSC. Also, on its own, it has made decisions without adequate consultations with the union. Overall, we congratulate the Ministry especially for the manner and seemingly efficient way it has conducted the national examinations though we are yet to confirm that when the results are released. 7.3 KNUT RELATIONSHIP WITH THE MINISTRY OF LABOUR: The Ministry of Labour has over the period in review strived to be balanced in its approach to labour issues. As the arbiter, we expect it to continue that way. However, the NEC noted that when we declared a dispute over the performance contracting and appraisal, the Ministry dilly dallied until the issue was over taken by events. This way of working by stalling is not good for a stable labour market. The Ministry is yet to gazette the order on Agency Fee for the CBA TRADE UNIONS CONGRESS OF KENYA: Since the establishment of the Trade Unions Congress of Kenya TUC-Ke and its launch in 2014, the Labour movement in Kenya has witnessed a re-awakening and a more concerted push to achieve some of its core mandates. The Public Sector Unions who are members of the TUC-Ke have exploited every opportunity to team up and support each other in pursuit of better terms of service and favourable work environments for their members. When workers are faced with common assault by employers or Government Agencies, TUC-Ke has stood with its affiliate members. (i) When the Teachers Service Commission (TSC) decided unilaterally to hire relief teachers, deliberately intended to force striking teachers to

9 This is basically what Technical and Vocational Education and Training (TVET) does both at the national polytechnics and vocational and technical colleges. The aim of TVET is to enable learners to meet needs of employers for qualified labour or own needs related to education of goods and services. In the Kenyan constitution 2010, the fourth schedule transferred the employment and management of teachers in village polytechnics to county governments. Despite this provision, the union went ahead and included tutors in all TVET institutions in the CBA The gains made to TVET are well captured in the CBA we signed. It is in regard of these gains for teachers in TVET that the NEC, proposes for adoption of a resolution that all branch officials reach out to all the teachers in TVET institutions by involving them in branch activities, recruiting them into the union and electing college representatives in all the TVET Institutions within their jurisdiction. 7.0 RELATONSHIPS WITH OTHER BODIES: 7.1 KNUT RELATIONSHIP WITH TEACHERS SERVIC COMMISSION: Mr. Chairman, it is public knowledge that we started off very badly with the current crop of commissioners at the TSC. We had frosty and sometimes demeaning relationship with the TSC. The union was starved of cash, tormented and attempts made to drive a wedge between the union leadership within itself and the members. Validation was introduced to force and humiliate the union into silence on teacher s rights. We thank the membership, the leadership of the union and all of us in general for standing firmly united and focused. With a sigh of relief, the TSC realized that they need the teacher and the union in as much as we too need them. It is a siamese relationship in which the life of one depends on the other, thus forcing a respectable marriage. Therefore, as of now, the NEC reports that our relationship has normalized with even the commissioners paying a courtesy call to the KNUT offices and withdrawing the ill conceived concept of validation. KNUT accepts that the world has changed and the challenges posed by globalization and need for decent work for teachers have become clearer. Beyond immediate concerns, the Union has to wrestle with the question of what it is they can achieve through labour education apart from the current training programmes being undertaken by the union that include; BEC training Gender training programme Training of the Executive Secretaries The Union is also focusing on shifting training programmes that take into account the effects of globalization, demand for decent work, the fight against the spread of HIV/AIDS and discrimination, climate change and expansion of informal education as advocacy and campaign issues.. The NEC therefore proposes the adoption of the following training programmes: BEC Trainings to continue. School Representatives training to continue and include ECDE and TIVET teachers. Training Treasurers and accountants both at national and branch levels. Training of administrative staff of the union both at national and branch levels. Training the technical officers and other technical staff on ICT, information management and office administration. Training of KNUT staff on team work and team building 6.6 TECHNICAL AND VOCATIONAL EDUCATION AND TRAINING: One of the key goals of the just concluded Education for all (EFA) framework for Action Adopted in Dakar, Senegal in 2000 (UNESCO 2000) stipulated that the learning needs of all youths and adults should be met through access to appropriate learning and life skill programmes.

Quite a number of the branches have challenge in accessing digital communication due to lack of Information Communication Infrastructure in the office, hence seek services from Cyber Cafe. The NEC proposes that all branches MUST acquire the ICT as a matter of urgency. (c) Accessing downloads from our KNUT website: The national office posts circulars and other important documents that can be downloaded from our website under section of Downloads. We have continue also to use bulk sms to send specific quick messages to our leadership and hope to encompass our entire membership. The national office has also commenced the initiative at the Head Office and this will eventually be rolled down to all the branches. 6.4 INFORMATION COMMUNICATION TECHNOLOGY: Information and Communications Technology (ICT) has an important role in the world since we are now in the information age era. It is also very important in our daily lives. Lack of appropriate information at the right time will result in low productivity, quality research work, and waste of time. Digital computer and networking has changed our economic concept to the economy with no boundary in time and space because of ICT. It brings a lot of advantages for economic development enabling millions of transactions to happen in an easy and fast. ICT has become an integral part of everyday life for many

The union embarked on membership training and sensitization. This year however, owing to the financial challenges, most of the earmarked gender trainings were not done. 6.3 SCHOOL RELATED GENDER BASED VIOLENCE (SRGBV): This is a KNUT and National Education Association (NEA) of USA/UNGEI partnership project that aims at contributing in minimizing incidences of gender based violence both at school and at the work place. 14 PROFESSIONAL MATTERS: 2.2 DIGITAL LITERACY PROGRAMME STATUS AT QTR-2, 2016/2017 (a) Introduction: The ICT Authority is leading the implementation of the Digital Literacy Programme (DLP) as mandated by a cabinet directive in April DLP is being implemented by the Ministry of Education, Science and Technology (MOEST), the Ministry of Information, Communication and Technology, the Ministry of Industrialization and Enterprise Development, the Kenya Institute of Curriculum Development (KICD), the Kenya Institute of Special Education, the Teachers Service Commission and The National Treasury. The union is fully represented by two officers in the ICT Authority. The following is the progress status of the programme:- (b) Content Development: The following are the developments in the area of digital content:- (c) The development of digital content for class 3 is under pilot testing and is expected to be rolled-out in January 2017 The approval of online digital content commenced in September 2016 following the adoption of standards for online content development. Submission of content by publishers and creators is now open at cms.kec.ac.ke Deliberations for development of a digital content market continued with meetings between the KICD, the ICT Authority, The Ministry of Education, publishers and the Digital Content Creators Alliance as part of the curriculum reforms and the union was represented. Implementation Schedule: E-Readiness Assessments: In terms of e-readiness Assessments the total number of schools assessed for e- readiness is 12,035 out of the current target of 21,731, representing a coverage of 55 per cent (55 %). Out of the schools assessed 1,338 schools did not have power hence not ready while the balance 10, 697 schools are ready. 3. Quality of teaching and standards will be supervised by TSC. 4. TSC will set guidelines on how ECDE teachers will enter service, grades and how they will progress through the ladder. 5. ECDE teachers already in employment will continue serving but TSC has to move with speed and regularize their employment. We urge the TSC to urgently develop a scheme of service for ECDE teachers, and register of qualified teachers as directed by the High Court. 6.0 CAPACITY BUILDING: RESEARCH ACTIVITIES: The Research Department has continued to explore areas of concern in education to enable the union to achieve her objectives from an informed position. Research on Privatization and Commercialization of education in Kenya with main focus on Bridge International Academies (BIA). The findings indicate that there are gaps in the provision of public education especially in informal settlements, rendering the inhabitants vulnerable to exploitation by education business corporations under the guise of low fee for profit academies. The union has consequently launched an advocacy campaign to have the BIA closed and call for the government to enhance service delivery to all Kenyans through the Free Primary Education (FPE). All children attending Bridge International schools should be transitted to public schools by January A second study Breadth of Learning in Kenyan Secondary Schools which is a collaboration venture between the union, EI and Centre for Universal Education (Brookings Institute) is ongoing. The study focuses on the skills for learning for a changing world with focus on breadth of skills across ages, the learning opportunities and the support systems amongst the teachers as drivers of change. The study is ongoing in 10 branches of the union and will soon be concluded. The digitalization of the KNUT library is still ongoing and will be

15 5.4 EARLY CHILDHOOD DEVELOPMENT EDUCATION(ECDE): It is important to note that out of a total of 300,000 teachers employed by the Teachers Service Commission on behalf of government, to work in all public schools and colleges in Kenya, the KNUT membership is only 203,000 by August This accounted for about 67% of the total teacher population before the validation process introduced by TSC. The remaining 33% of non members of the union, 35,000 (12%) belonged to a rival union. The rest of the remaining 67,000 teachers (22%) had chosen not to belong to any union and have continued to joyride as they benefit freely from packages negotiated by the union and this shall be. by Agency fee as reported elsewhere in this report. The great concern also was the fact that there are over 110,000 ECDE teachers currently employed by county governments, churches, NGO s and private individuals all of whom are not members of KNUT. This situation continues to erode the bargaining power for the union and pose a serious threat to KNUT in carrying out its overall mandate to secure, protect, and enhance the welfare of their members and to advocate for education professionalism and development in the Country. The NEC has developed an analysis tool that summarizes the challenges the union faces and how it proposes to tackle these challenges by having the ECDE teachers into the KNUT. All along, we have continuously petitioned the government to employ those teachers even before the new constitution was promulgated. As directed by the High Court, we are happy to report that the TSC is under duty to develop a scheme of service for E.C.D teachers and below are the highlights of the judgment in regard to the employment of ECD teachers: 1. County Governments to recruit and employ ECDE teachers but they must have been registered by TSC. 2. Though ECDE teachers will be remunerated by County Governments, they will be regulated by TSC. Assessments in the remaining schools is on-going and is expected to be completed in November We therefore urge the government to finish off power connections for us to realise equity in this programme. (d) Installation in Schools: The total number of schools installed to date is only 886, representing a national average of 4% of the total contract which is way below with a total number of LDDs installed to date is 67,068, and total number of TDDs is 1,772 as follows; Moi University/JP SA Couto (covering 26 counties) installation done in 693 schools and JKUAT/POSITIVO BGH (covering 21 counties) installation done in 193 schools. (e) Monitoring and Evaluation/ Sensitization of Stakeholders: A baseline survey was conducted in September 2016 as planned. Data was collected as follows: 151 schools were visited. In each school, 1-2 teachers in class 1 or 2; and the headteacher responded. 49 lessons were observed. Checklist for infrastructure was carried out in all the schools visited and revealed glaring disparities. Other respondents categorized as critical informants included parents, Education officers, Board of Management members and support staff. The Data Analysis, both qualitative and quantitative, is on-going and the team will finalize their report by mid November (f) Teacher and administration capacity: The capacity building exercise targets to train all teachers in public primary schools. Due to global technological changes and the dynamic environment in which teachers work, professional teacher development is a prerequisite for effective teaching and learning in the classroom. Therefore Continuous capacity building for teachers will be key. To ensure effectiveness in the delivery, the training has been divided into various phases. Phase 1 will target all class one (1)

16 teachers, Phase 2 will target master trainers and TOTs and Phase 3 will target all the remaining teachers and other stakeholders working with teachers on different curricula s. In conclusion Mr. Chairman, the NEC recommends that the trained teachers be appropriately remunerated. 2.3 KNUT/BUPL/EIRAF PARTNERSHIP ON ECDE PROGRAMME: Education International Africa Region (EIRAF) in partnership with BUPL of Denmark confirmed Kenya as the third country in Africa and the only one in East African country to implement the ECDE project as the union assumes the National coordination title for a period of 2 years. KNUT is working closely with the county governments to ensure that parliament enacts the County Early Childhood Education Bill, and Senate Bill 2014 which has currently stalled at the second reading. The Bill gives the TSC mandate to employ ECDE teachers. The NEC therefore proposes for adoption of the following:- The Mobilization and recruitment of ECDE teachers into the union. The election of ECDE and the involvement of ECDE teachers in all union activities at the branches as per Article X(3) of the KNUT constitution. Development of KNUT ECDE policy guidelines. 2.4 KENYA NATIONAL EXAMINATIONS COUNCIL (KNEC): The Union has supported the KNEC commitment in ensuring that there is objectivity and fairness in the conduct of the national examinations this year; and commends the Ministry of Education and KNEC efforts in curbing cheating in national examinations. Indeed, we applaud and appreciate the role of headteachers and principals in schools for promoting academic excellence, instilling discipline in learners and monitoring teachers. 5.2 SCHOOL REPRESENTATIVE TRAINING PROGRAMMES: The American Federation of Teachers (AFT) supported a training for The KNUT National executive council members to share with them on the new knowledge and skills acquired. The School Representative Organizing Manual was developed from this training. To date, AFT has supported the printing of 30,000 copies of the manual. The AFT is willing to renew partnership in the training of strong recruitment team consisting of both elected and technical officers who shall form a standing committee for recruitment and sustainability of membership. The NEC proposes that this program be supported and intensified in all the branches and should include ECDE and TIVET representatives. 5.3 TRAINING OF THE BRANCH EXECUTIVE COMMITTEES (BEC): Mr. Chairman, following our February/March 2016 KNUT general elections, it has been observed that there is great need to train our entire Branch Executive Committees (BECs) across the country on their roles and general expectations from them as KNUT leaders. Some BECs have even held the branches hostage financially akin to what is happening in some counties. This may be due to lack of knowledge on union functions, roles, expectations and guidelines from the NEC. The NEC strongly proposes a vigorous training programme as per curriculum and content designed from the technical wing of the union with input from experts to commence from January Each branch should strive to have its BEC properly trained prior to having their AGMs so as to reduce/eliminate any possible disharmony. The work done by principals and heads of schools is far above that of supervisors and should be compensated more than any contracted professionals.

17 Keeping and reviewing data on School Representatives in all public institutions countrywide; Management of Union membership through charting and mapping of both members and non members across the country. This has been implemented in 5 branches namely: Nakuru, Muranga South, Kwale and Kinango. Developing tools for proper organization, conversation and feed-back from member. In this regard, the office has worked closely with a media consultant to develop the union brochure which acts as a one stop shop for information on KNUT. Carrying out a baseline survey on the status and employment of ECDE teachers; Pursuing possibilities of organizing teachers in the early childhood education sector through mobilization and recruitment meetings in Bungoma County, Kisumu county, Kisii south,bomet, and Kilindini Branches on a pilot basis and reviewing of the Knut Brochure with current activities and affairs of the union. There is need for well crafted campaign and marketing strategy in order to sell the union as a popular brand especially with the onset of arm twisting by the employer as shown by the recent infamous validation and poaching of members to rival unions. Retaining the already recruited members shall take the full engagement of union leadership whose strong pillar shall be an informed, active and committed School Representative programme especially among ECDE, TIVET and other postprimary institutions. The NEC recommends a routine periodic meetings with the School Representatives at the lowest level (Zonal) to ensure quality feedback and programming beginning January The BECs and SRs have to continue with the recruitment programme after the technical team from the national office departs. The programme will be monitored by the Steering Committee in conjunction with recruitment committee on regular basis. However, we demand for increase in the allowances paid to contracted professionals and increase in the distribution centres; especially in the hardship areas. The KNEC nominated thirty officials from our union to take part in the monitoring of national examinations this year. The union s position is that malpractices should not be tolerated at all to bring back sanity to examinations. 2.5 KNUT AND THE SUSTAINABLE DEVELOPMENT GOALS (SDGs) AGENDA: The earmarking of education as a standalone goal by the United Nations under Goal No. 4 Ensure inclusive and equitable quality education and opportunities for all was a great landmark and achievement for teacher unions across the globe. Consequently, the union has been involved in campaigns, lobbying and advocating for implementation of the SDGs in the country. Specifically, the union has been liaising with the Ministry of Education and the Teachers Service Commission to ensure that the targets under goal No. 4 are fast tracked. Under this agenda, the union is lobbying for continued employment of teachers to curb the teacher shortages in line with target No. 4 C. The union is involved in the ongoing curriculum reforms as a means of ensuring that the children of Kenya receive the right skills to enable them to participate in the development agenda with ease. There is need for all our members to understand all the seventeen goals (17) in the SDG agenda. There is need for our members as well to understand the seven targets under goal No. 4 (four): Targets and indicative strategies: Target 4.1: By 2030, ensure that all girls and boys complete free, equitable and quality primary and secondary education leading to relevant and effective learning outcomes. Refugee children have a right to quality education and access to teachers as soon as they arrive in the country and must be integrated in our schools near the camps.
