1 BYU-Hawaii Housing Contract Residence Halls Room & Board Spring 2017 This contract is effective for the following period: February 28, 2017 June 8, 2017 Note: It is the responsibility of the student to familiarize him/herself with all pertinent information before completing this contract. Signing this contract is an acknowledgement and acceptance of this responsibility as well as an agreement to the terms and conditions, and financial commitment of the contract. The Residence Hall Handbook is also incorporated by reference, as a part of this contract. If a resident requests to cancel their contract, but the contract cannot be replaced by another student, the resident will remain financially responsible to pay the full amount of room and meals, even if he/she might not reside there or use the meals. Because of this we recommend that students request to cancel their contracts at least one month in advance to avoid this financial obligation. Contract Terms and Conditions Security Deposit A security deposit of $150 is required of all students living in the Residence Halls. Payment in full is required prior to booking a room for the upcoming semester. The security deposit may be used as payment for damages to property (not including normal wear and tear), or to cover any overdue balances and fees. If there are no contract violations, the $150 security deposit will be fully refundable upon a student s successful and timely check-out at the end of the contract period. All outstanding balances due to the university must be paid in full before a refund can be issued to the student. Requests to recover all or a portion of the security deposit must be made within one year of the termination of the contract. Check-In Students may check-in to the Residence Halls by reporting to the RA office of their respective Hale upon arrival. There are pre-set check-in dates prior to the beginning of each semester, which is usually a three-day check-in period, one week before the first day of class for domestic students, and typically earlier for international students. More arrival information can be found on the Housing website. Students are not permitted to enter their assigned room without having first checked-in with their RA. Those who enter, without first checking-in and the roommate(s) who allowed this illegal entry will be charged the $100/day illegal check-in fee. Students who have not checked in by the end of the check-in period will be considered to have quit before tenancy (Please see quit before tenancy ), and the university will attempt to replace the contract by posting the room online for another student to book. If the contract can be replaced by another student, the contract will be cancelled and the student will forfeit the $150 security deposit and charged the cancellation fee. Please see Cancellation Fee for the amount. If the contract cannot be replaced, the student will remain financially responsible for the full terms of the contract. The student will be responsible to pay the full amount for the room and meals even if he/she may not physically reside there or use the meals. In rare cases, a late check-in may occur when prior arrangements have been made and approved by the Housing Office. In these rare cases, a room will be held until the prearranged late check-in date, but the actual room assignment may be changed according to availability. Check-out It is the resident s responsibility to schedule a check-out time with the RA staff prior to their check-out date. Residents are required to be physically present for their scheduled check-out. Students who leave without properly checking out with

2 their RA or HC will be assessed a $100 improper check-out fee. They will also experience a delay in receiving their security deposit refund. Graduates are allowed to check-out of the Residence Halls the morning after graduation, but will be charged the daily rate for each additional day they reside in the Hales after the contract end date, up to the morning after graduation. Any belongings left in the room after the official check-out date and times have past will be considered abandoned and will be removed and disposed of or given to the Give and Take. Residents will be charged a $35 flat rate and an additional $35/hour after the first hour, for any work that needs to be done by the Housing staff to bring it up to check-out standards. Occupancy This contract covers only the length of occupancy stated and begins on the first day of new student check-ins and ends on the check-out date. Residents must be enrolled as full-time students, with a minimum of 12 credits each semester by the specified deadlines, to be eligible for on-campus housing. Exceptions are given to students on university approved reduced course loads and on-island university approved internships. Post course work experience students such as AT and OPT students are ineligible for on-campus housing. Students who have signed a contract but become ineligible, by discontinuing from school, registering for less than the required 12 credits or by violating parts of the contract and/or handbook are considered to have abandoned their contract and will be required to pay for the entire amount of the contract. See Abandonment and Abandonment Due to Non-Compliance/Breach of Contract. Students continuing in the Residence Halls from one consecutive semester to another may reside and leave their belongings in their rooms at no charge during the 1 week break. They may also continue to have meals in the cafeteria during the 1 week breaks. These privileges are non-transferable. Students who cancel during the break for the next consecutive semester and who are able to replace their contract, will be charged the daily rate for room and meals during the break. Students are required to notify their Hale Coordinator of any extended absence from the premises. During an extended absence, such as a school trip, internship or vacation, authorized university personnel may enter the unit as may be reasonably necessary for safekeeping, inspection, and maintenance. If the Hale Coordinator is not notified of an extended absence, the student will be considered to have abandoned their contract. See Abandonment. Renew Contract Based on availability, students may be allowed to renew their contract for the following semester, by logging into the Housing Portal during the Renew Contract period, which is typically the first two weeks of each semester. Change Room A student may change his/her room for the following semester after having renewed their contract, by logging into the Housing Portal during the Room Change period, which is typically the third week of the semester. A $50 transfer fee will be applied to all room transfers. Current semester room changes are not permitted. Liability Students may not use the dwelling unit for any purpose other than as the tenant s residence or home. It is the responsibility of residents to take necessary precautions to protect personal belongings and valuables. The University and its representatives are not responsible for loss of or damage to clothing, valuables, or other personal property, including money and jewelry. Students are advised to purchase personal rental insurance.

3 Inspection and Repair In general, the University will provide notice, two days in advance, before entering living quarters for the purpose of routine inspections, checking of standards, repairs, custodial and/or other maintenance work, however, there may be rare instances when they will need to enter with shorter notice. Submission of a work order is an acknowledgement that housing personnel will enter the room or unit to inspect and make the necessary repairs. In the case of emergencies, such as a fire or natural disasters, we reserve the right to enter immediately to remedy any damage to life or property. We also reserve the right to enter immediately to perform random bed checks, to ensure compliance with the Code of Honor and to ensure the safety of our residents. University personnel will knock a minimum of 3 times, stating themselves, at all times before entering. Residents are expected to respond if more time is needed before university personnel enters the room. If no response is given, personnel will enter promptly. University personnel will leave all exit doors open and accessible while in the student s living quarters. All maintenance personnel will have ID cards for identification while working in any housing facility. Consolidation If at any time a resident is left without a roommate, he/she is responsible for the entire cost of the room. To avoid this, we recommend that all residents notify Housing immediately, if their roommate unexpectedly leaves. An exception will be given to a student when a consolidation cannot be made due to the number of students in the dorms, or the availability of rooms. The University reserves the right to transfer or consolidate students to other than the originally assigned rooms. Major reassigning of residents will take place during the Spring Semester or Summer Break, to accommodate university visitors, renovations, and custodial or maintenance work. Students will be notified in advance of any reassignments. Room Key Cards The room key card is intended for the resident only. Residents must not give out their room key card to anyone. Residents who are found giving their keycard to anyone will be fined, may be referred to the Office of Honor, and may risk losing their housing contract. There will be a $5 charge for all lost key cards. Meal Program Students with contracts in dormitory style rooms in the residence halls must participate in a dining program and are required to select the Gold Meal Plan or the Silver Meal Plan. If a meal plan is not selected by the student, they will automatically be enrolled in the Gold Meal Plan. It is optional for students in apartment style rooms to participate in a dining meal plan, as each apartment is furnished with a fully functional kitchen. They have the option of participating in a meal plan if they choose and may select one of the following plans: Gold Meal Plan, Silver Meal Plan, 100 Block Plan, 75 Block Plan, 50 Block Plan, and 25 Block Plan. ***IWORK and other university sponsored students living in dormitory style rooms in the residence halls are required to select the Gold Meal Plan. IWORK and other university sponsored students living in apartment style rooms are required to select the IWORK Block Plan. Before the first day of check-in students can change their meal plan by contacting the Housing Office. After the first day of check-in and up to the first day of class, changes can be made by contacting Food Services. Beginning the first day of class, students can upgrade their meal plans by contacting Food Services, but not downgrade or delete a meal plan. At any time if a student would like to purchase an additional meal plan they may do so by contacting Food Services. Meals will be served beginning with lunch on the first day of check-in and ending with lunch on the day of check-out. Meals are non-transferrable and refunds will not be issued for meals missed during the length of this contract. More detailed information about our dining programs can be found at or by visiting the Food Services Department.

4 Tenant Quits Before Occupancy Students are considered to have Quit Before Occupancy if the student changes his or her mind about taking the unit before moving in. If the contract can be replaced by another student, the contract will be cancelled and the student will forfeit the security deposit and charged the cancellation fee. Please see Cancellation Fee for the amount. If the contract cannot be replaced, the student will remain financially responsible for the full terms of the contract. The student will be responsible to pay the full amount for the room and meals even if he/she may not physically reside there or use the meals. Abandonment In the following instance students are considered to have abandoned their contract: a) vacates the unit wrongfully with no intention to resume tenancy. If the contract can be replaced by another student, the contract will be cancelled and the student will forfeit the security deposit and charged the cancellation fee. Please see Cancellation Fee for the amount. Abandonment due to Non-compliance / Breach of Contract Failure to comply with the terms of this contract may result in the disciplinary action and/or abandonment of this contract due to non-compliance. In any of the following instances BYU-Hawaii may declare Abandonment due to Noncompliance/breach of contract and elect to remove the student from the Residence Halls: a) Failure to make payments on time, c) failure to comply with the terms of this contract and/or abide by the published Residence Halls Handbook which is incorporated, by reference, as part of this contract, b) failure to conduct themselves in accordance with BYU-Hawaii policies, including the BYU-Hawaii Code of Honor and d) failure to abide by state and federal laws. Students who abandon their contract due to non-compliance will be removed from the residence halls, and will be charged the $100 breach of contract fee. If the contract can be replaced by another student, the contract will be cancelled and the student will forfeit the security deposit and charged the cancellation fee. Replacement When a student requests to cancel their contract, their room assignment will be released so that it becomes available online for another student to book. Because students are free to choose any room in any building online, replacement of a contract is not specific to any particular room assignment, rather replacement is handled on a first-requested-first replaced basis. If all rooms in the residence halls were filled except one, the student who cancelled last will not have their contract replaced. Contracts are gender specific. The student should expect to check-out if he/she will not reside there, as it will terminate his/her responsibility for the physical condition of the room for the duration of the contract.

5 Cancellation Fee If a student finds himself/herself in one of the following cases: Quit before Tenancy, Abandonment, or Abandonment due to Non-compliance/Breach of Contract and the contract can be replaced by another student, the contract will be cancelled and the student will forfeit the security deposit and charged the cancellation fee. Acknowledgement I hereby acknowledge that I have read, understand and agree to the terms and conditions of this contract and the Residential Hall Handbook, which is incorporated, by reference, as part of this contract. In the event that I wish to cancel my contract but the contract cannot be replaced by another student, I understand that I will be financially responsible to pay the full amount for the room and meals even if I do not physically reside in the Residence Halls or use the meals.
