According to Dear Colleague GEN-92-21, Part IV, Provisions Effective July 1, 1993, Section B,... As previously noted, effective on enactment of the Amendments, for purposes of an in-school deferment, an eligible institution is defined as including any institution, whether it is participating in any Title IV program or has lost its eligibility to participate in the FFEL program because of a high default rate. If an institution has never participated in the Title IV programs previously, the institution must request a determination from the Secretary that it satisfies the definition of an eligible institution prior to certifying borrower deferment forms. Lenders are instructed to check with OSFA if students wish to obtain a loan for attending these schools.
