1 Residential Life Student Housing Agreement GENERAL: Residing in housing maintained by Concordia University Texas imposes certain legal obligations and responsibilities upon the Student. This Agreement, together with the Residential Life Policies, and other policies and procedures of the University, constitutes a legally binding agreement between the University and the Student (or, if the Student is a minor, the Student s parent(s) and/or legal guardian). Therefore, the Student understands and agrees that he or she is committing to on-campus housing for the entire academic year, exclusive of any summer term. TERMS AND CONDITIONS I. AGREEMENT PERIOD AND PAYMENT: a. This Agreement, unless otherwise provided, shall be legally binding for the entire academic year. This Agreement does not include any accommodations during the summer months. b. The Student agrees to pay the University, the applicable rates for the assigned space in accordance with University requirements. Room and board (meals) rates are set per semester based on the current rates. If the Student moves to different room occupancy (i.e., triple room to a double room) during the Residential Life established deadlines for Room and Roommate Change process, the Student will be responsible to pay the established room rate of the new room occupancy. This Agreement begins on Saturday proceeding the first day of classes and ends on the last day of exams. II. ROOM RESERVATION: All 1 st year students are required to reside in campus housing and must submit a completed Housing Application form and a non-refundable $ housing deposit. Returning students interested in living on campus must renew their applications for housing each year by the established deadline(s) and submit a nonrefundable $ housing deposit. III. CANCELLATION OF AGREEMENT: a. This Agreement is legally binding throughout the academic year regardless of any delays by the University in making housing assignments and regardless of changed circumstances on the part of the Student, such as a desire to live off-campus, incompatibility with other students who live on campus, or a change in the Student s finances. 1 P a g e
2 b. Students shall reside in housing for the entire academic year. Students that withdraw from Concordia University Texas Student Housing at the end of the fall semester will be charged a $275 cancellation fee, which will be charged to the student s account. c. Students that vacate housing at any time during the semester are held liable for the entire cost of the current semester meal plan. No meal plan costs are refundable due to contractual obligations with the food service provider. Additionally, the student is held liable for room fees and any damages to the current room assignment regardless of rationale including, but not limited to the following, withdraws from the institution, financial, or personal reasons, and/or removed from housing due to disciplinary outcomes etc. d. In accordance, with the provisions outlined in the Residential Life Policies; students withdrawing from the institution must complete the Residential Life Withdrawal Form and the CTX Withdrawal Form by the last day of the fall semester (i.e., last day of Final Examinations). e. Students withdrawing from the institution must make an appointment with their Resident Assistant to check out of the residence halls. Students that have decided to withdraw after the semester break begins must contact the Office of Residential Life to make an appointment to check out of the residence halls prior to the start of the spring semester. Failure to check out of the residence halls by a member of the Office of Residential Life will result in an improper check out fee of $275. f. Students who are academically ineligible to return for the spring semester must complete the Residential Life Withdrawal Form prior to the start of the spring semester. Students must contact the Office of Residential Life to make an appointment to check out of the residence halls prior to the start of the spring semester. Academically ineligible students are not liable for the $275 cancellation fee. Failure to check out of the residence halls by a member of the Office of Residential Life will result in an improper check out fee. g. Students who graduate at the end of the fall semester and/or marital status changes must complete the Residential Life Withdrawal Form and check out of the residence halls prior to leaving for the semester break will not be charged a $275 cancellation fee. h. Students who attend CTX for a semester exchange program or attend a CTX operated semester study abroad program (i.e., Concordia Irvine, Concordia Mequon, CTX Costa Rica, etc.) must complete the Residential Life Withdrawal Form and check out of the residence halls prior to leaving for the semester break will not be charged a $275 cancellation fee. i. A student who is a service member may vacate the residence hall and avoid liability for future rent and all other sums due under this Agreement if: (1) the Student enters military service during the term of this Agreement; or (2) the Student while in the military service, receives military orders for a permanent change of station or receives military orders to deploy with the military unit for a period of 90 days or more. The Student shall provide to the Office of Residential Life a written notice of 2 P a g e
3 termination and a copy of an appropriate government document providing evidence of the Student s entrance into the military service or of the Student s military orders. The University shall refund all rental amounts paid in advance within 30 days of the termination. This provision does not affect the Student s liability for delinquent, unpaid rent, or other sums owed to the University before termination of the Agreement. IV. ROOM ASSIGNMENTS AND CHANGES : a. Space is limited in the residence halls. Assignments are thus made with priority to (1) first-year students and (2) returning students. b. Room assignments are made without regard to race, religion, disability, sexual orientation, veteran s status, or national origin. c. The University will inform the Student of his or her designated residence hall and room assignment as soon as practical. A reasonable effort will be made by the Office of Residential Life to honor room and roommate preference requests; however, room selection and roommate in any University residence hall are within the sole discretion of the Office of Residential Life. No specific room assignment based solely on the Student s request or preference is guaranteed or implied. d. The University will make reasonable efforts to consider the compatibility of students when assigning roommates. Students are expected to share space with roommates(s) unless reasonable ground for an accommodation is made in writing in advance of housing assignments. Any student who requires a single room will be assigned and charged for a single-occupancy room only if a single room is available and if grounds for a reasonable accommodation are made in writing before housing assignments. If no single room is available the student will be placed at the bottom of the current wait list. Students may not refuse a roommate if one is available. e. The University in its sole discretion may make room changes, reassignments, or roommate changes during the term of this Agreement. Reassignments may be necessary to ensure optimum use of available housing or for other reasons in the sole discretion of the University. The Student agrees to comply with any changes in room assignments made by the University. To the extent reasonably possible, the University will minimize inconvenience to the Student as a result of or in conjunction with a reassignment. f. Room and Roommate Changes occur during the established deadlines and requirements, which are found within the Residential Life Policies (i.e., spring semester). If the Student wishes to move prior to room and roommate changes, occurring during the spring semester, the Student must go through the mediation processes with a member of the Residential Life Staff (i.e., Resident Assistant) and his or her roommate(s) during the fall semester. Mediation must be conducted before a Student is granted approval and an exemption to move rooms and roommates prior to the established deadlines and requirements, which occurs during the spring semester. 3 P a g e

Room and roommate changes occur when the paperwork is completed, submitted, and approved by the Office of Residential Life; by the established deadlines and requirements, which are found within the Residential Life Policies. The exchange of rooms or substitution of one resident for another without the written authorization of the University is prohibited and will result in a $275 charge placed on to the Student s Account. Subletting of any room is prohibited. h. If a vacancy occurs in a room, the University may require the remaining student to accept another roommate as assigned by the University, to move into another room as assigned by the University, or to pay additional charges for a single-occupancy room. Additionally, if a vacancy occurs in a room the remaining student(s) agree to maintain the room in a manner that will allow another student to move in immediately. V. UTILITIES: The University cannot guarantee against temporary failures of utility systems or defects caused by ordinary wear and tear. The sums due under this Agreement shall be paid regardless of any failure of utility system. VI. GENERAL CONDUCT: a. The Student is responsible for conducting himself or herself and maintaining his or her residence in such a manner so as not to create a hazard or nuisance or to infringe upon the rights, health, and safety of others. The student must comply with all applicable laws, University policies and procedures, policies of Residential Life and University rules and regulations of this Agreement and failure to do so may result in the Student s removal from campus housing, referral for disciplinary outcomes, and/or assessment of monetary charges. b. Student represents to the University that he or she has read and is familiar with the University Catalog and Residential Life Policies and the requirements pertaining to his or her use or conduct in the assigned residence hall room and the common areas of the residence hall. Further, Student and University agree that the applicable University Catalog and Residential Life Policies, as they may be changed or amended in the future, are incorporated into this Agreement for all purposes. Any breach or violation of University policies, procedures, or regulations or of this Agreement may result in the Student s removal from campus housing, referral for disciplinary outcome, forfeiture of any housing or meal plan refunds and/or assessment of monetary charges. c. All current Residential Life Policies are reflected at d. The Student agrees that, in the event of the Student s removal from campus housing, referral for disciplinary outcome, and/or monetary charges, the University, in its sole discretion, may notify the Student s parents or legal guardian of the action taken. 4 P a g e
5 VII. RESIDENT LIABILITY & INSURANCE: a. THE STUDENT AGREES TO BE PERSONALLY LIABLE FOR LOSS OR DAMAGE TO THE RESIDENCE, ITS FURNISHINGS, AND THE AREAS OUTSIDE THE RESIDENCE. STUDENTS LIVING TOGETHER SHALL BE HELD JOINTLY AND SEVERALLY LIABLE FOR THE COSTS OF DAMAGES OWED TO CONCORDIA. b. THE STUDENT AGREES TO HOLD HARMLESS AND INDEMNIFY CONCORDIA FOR ALL LOSS OR DAMAGE CAUSED BY THE STUDENT AND/OR ITS GUESTS TO THE RESIDENCE, CONCORDIA PROPERTY, AND THE PROPERTY OF OTHER RESIDENTS. c. CONCORDIA DOES NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS FOR DAMAGES OR PERSONAL INJURY SUSTAINED BY THE STUDENT, OR ITS GUESTS, OR OTHERS IN THE RESIDENCE AS A RESULT OF: A. THE ACTS OF OMISSIONS OF THE STUDENT AND/OR ITS GUESTS; B. THE ALTERATION OR MODIFICATION OF FURNITURE OR FIXTURES PROVIDED BY CONCORDIA, OR THE CONSTRUCTION OR INCLUSION OF FURNITURE NOT PROVIDED BY CONCORDIA. d. CONCORDIA IS NOT RESPONSIBLE FOR DAMAGED, LOST, OR STOLEN PROPERTY BELONGING TO THE STUDENT OR ITS GUESTS REGARDLESS OF WHERE THE LOSS, THEFT, OR DAMAGE OCCURRED. e. CONCORDIA STRONGLY RECOMMENDS THE STUDENT HAVE RENTERS INSURANCE. Renters Insurance provides valuable protection for personal belongings that are stolen or damaged and also provides financial protection for unintentional damage to a Residence or bodily injury for which STUDENT is liable. Renters Insurance information is available at: VIII. TERMINATION OF AGREEMENT: a. The University may terminate the Agreement for the breach or violation of any term of this Agreement or for breach or violation of any applicable University rule, regulation, policy, or catalog. b. The University may remove the Student from campus housing and terminate this Agreement if the presence or continued presence of the Student in the residence hall poses a risk to the health and safety of the student or others. c. The University may terminate this Agreement if the Student fails to register for classes, fails to pay sums owed under this Agreement, or fails to pay required University charges and/or room fees. The University may terminate this Agreement if the Student, for any reason, ceases to be enrolled at the University. 5 P a g e
6 d. The University may terminate this Agreement in the event that the Student is disciplined, suspended, or expelled. IX. NO ASSIGNMENT OR WAIVER: a. This Agreement may not be assigned or sublet, in whole or in part. Additionally, this Agreement may not be amended or modified, except in writing and approved by the Director of Residential Life or the Dean of Students. b. This Agreement may not be waived, in whole or in part, by delay in enforcement or otherwise, except, in each instance, as approved in writing by the Director of Residential Life or the Dean of Students. X. GOVERNING LAW AND NOTICE: a. This Agreement shall be governed by the laws of the State of Texas, without regard to its conflicts and choice of law principles. b. Any notice or demand required by this Agreement shall be served either through hand delivery or U.S. mail as follows: (i) notice to the University shall be given to the Director of Residential Life and (ii) notice to the Student shall be given to the Student or to his or her parent or legal guardian at the last known home address on file with the University. In addition, to providing notice via hand delivery or U.S. mail, notice also shall be provided to the recipient s University assigned account or other address on file with the University. By signing and returning this Agreement, you represent that you have read this Agreement, and that you have agreed to abide by all the terms and conditions set forth in this Housing Agreement. Additionally, you agree to comply with all the University policies, regulations, terms, as contained in the Residential Life Policies and University Catalog.
