Reference: F /2014-KVSHQ (Admin-I)/ Dated Esteemed Sir, Apropos the aforesaid subject, I hereby submit the views and suggestions of AIKVTA, the largest recognized Association of KV teachers, to you for your kind perusal and consideration and onward submission to the Ministry of HRD and Empowered committee constituted by Govt. of India With reference to the above, we take this opportunity to put forward our views and suggestions in the pay and allowances proposed by VII CPC for your intervention and favourable decision in the interest of the teaching community. Kendriya Vidyalaya Sangathan (KVS) is an autonomous organization under the Ministry of Human Resource Development, Govt., of India. It functions according to CCS and FRSR rules as applicable to the employees of Central Civil Service employees and adopts pay structure as recommended by the Central Pay Commissions. Kendriya Vidyalayas are very reputed educational institutions spread all over India which strictly adhere to the policies in the field of education as suggested by NCERT. KVS has grown to the level of institution of excellence catering to the educational needs of children belonging to different strata of the society. 1
2 OVERALL VIEW The overall view of the 7CPC recommendations is highly discouraging with special reference to the teachers Under Ministry of HRD. Very low fitment benefit and huge increase in deductions and abolition of some allowances resulted in a very less increase in the gross salary of the employees which is equal to a few increments in 6CPC scales which cannot cater the financial needs of employees for another 10 years period. 7 CPC did not consider and focus on the working conditions of the teachers having all India transfers and working in all terrains including metropolitan cities and hard and very hard stations at with defense and para-military personnel. The emoluments of state government employees of states like Rajasthan, New Delhi, Andhra Pradesh, Telangana are very high as compared to the employees of Central Civil Services. VIEWS AND SUGGESTIONS OF TEACHERS OF KENDRIYA VIDYALAYA 1. FITMENT 7cpc suggested a fitment factor of 2.57 to arrive at the new basic pay in the matrix.it is arrived 32% increase on the Pay in Pay band + Grade pay and neutralization of 125% of D.A including expected D.A as on It results in the increase of % on the gross salary, which is very less amount. As deductions are increased, hike in the net salary is approximately equals to two increments in previous scale. For example for an employee with basic pay(rs rs4600) hike in net salary is Rs 1550/-.It is a very difficult situation to manage with this hike for 10 years, facing all financial obligations and to live in cities. Some states like Andhra Pradesh, Telangana, Kerala extended nearly 43% hike in the salary of their employees within a period of 5 years. Vide annexure to chapter 4.2 the rate of Rice/Wheat is quoted as Rs whereas the market price for cereals of normal quality is nearly Rs 45/-. Hence the factor/index varies by 1.74 The rate of Dal is quoted as Rs and for the normal quality the market rate is around Rs 200/-. Here the factor/index varies by 2. The cases of essentials like cloth, vegetables, meat, fish quoted in the table are not different. Vide para 4.2.3(i) it is stated that the average consumption for a four member family is 3 consumption units. But children in the teenage need more nutritional food. Hence the consumption has to be regulated to 4 consumption units. Hence considering various factors including ILC norms, AIKVTA proposes minimum fitment factor of 3.5 to arrive at the new basic pay, so that hike in the gross salary will come around to 40%. By this increase central civil service employees can somehow manage for a spell of nearly 10 years (approximate period for their next pay revision). 2
3 2. UP GRADATION OF PAY SCALES A) We expected a proportionate hike in the pay packages of central govt.teachers. But 7 CPC expressed the view that the pay of teachers was up graded by 6CPC. In fact the up gradation was not completely implemented. Only the benefit of grade Pay was given for teachers but their pay was not fixed in the upgraded pay scales. As a result the up-gradation of pay scales was remained an eye wash. All the teachers were under the impression that their condition will be improved by 7CPC recommendations, but are left with disappointment. B) Subsequently KVS issued a circular for fixation of pay in the up graded pay scales comparing with other central government offices and it was withdrawn after some time without any reason. As a result justice is not done to teachers in true spirit. C) Prior to 3CPC Trained Graduate Teachers were getting more emoluments than Junior Lecturers in state government (AP).So many teachers preferred to join KVS leaving state government services. Gradually the teachers of KVS are ignored and degraded and their pay was equalized to UDCs and Assistants. D) The 6 th CPC in its report from para to has recommended in order to attract better Teachers and to retain them in the Government, the commission has recommended a higher start for Primary School Teachers. Hence, all school cadre teachers were given two pay scale up-gradation by GoI based on the 6 th CPC recommendations. Accordingly the primary teachers were up-graded from pre-revised pay scale to as on corresponding to the grade pay of 4200/-. Further 6 th CPC has recommended the merger of three pay scales i.e , and in identical grade 4200/-. Same was implemented and primary teachers similarly placed other central government employees including KVS employees in the pay scale of were granted grade pay Rs. 4200/- but later on based on the representation from various departments/ ministries the GoI, MoF, has issued a notification vide OM. No. F.1/1/2008-IC dated for granting/ revising the grade pay of 4600/ for those posts which are placed in the pay scale of as on After receipts of this letter from MoF, all the ministries and departments of GoI including KVS has revised the grade pay of the posts having pay scale by granting GP 4600/- but due to wrong interpretation and implementation the same benefits of 4600/- grade pay has not been extended to primary teachers which is contradictory to the recommendations of the 6 th CPC and discrimination to PRTs resulting in downgrading, demoralizing and depriving the rightful 3
4 entitlement to this back bone cadre of school teachers. By not granting the grade pay of 4600/- the KVS has totally violated the 6 th CPC recommendation which has granted two pay scale up-gradations to all teachers. Whereas primary teachers are presently drawing the grade pay of 4200/- which is corresponding to the pay scale of Hence, got benefit off one pay scale upgradation. Whereas all other teaching posts from TGT to Principal are granted benefits/ corresponding grade pay of two pay scale up-gradation. The above wrong interpretation and implementation contradictory to MOF, GOI OM. No. F.1/1/2008-IC dated and has increased the proportionate difference between three cadres of school teachers beyond any logic. The proportionate difference shown in the following table clearly shows the impact of wrong implementation regarding Primary Teachers pay fixation have increased the gap between PRTs/TGTs/PGTs which has never happened in the past. E) The state governments of Utter Pradesh adopted central pay scales and granted Rs.4800/- Grade Pay to their Primary teachers. F) Hence it will be justified if teachers in the central government schools are placed with an entry level as proposed below for a balanced fixation. 5 G) On the occasion of teachers day the young mass appealed to our Honorable Prime Minister Sri Narendra Modiji to attract talented people to the teaching profession. Hence a decent perks to be offered to the teaching community. 3. GRANT OF MACP (Modified Assured Career Progression) A. The Ministry of DOPT vide OM No /1/97-Estt(D) dated recommended ACP( Assured Career Progression) as mooted by V CPC to deal with the problem of genuine stagnation and hardship face by the employees due to lack of adequate promotional avenues. Under ACP scheme two financial up-gradations for Group B, C and D employees on completion of 12 years and 24 years was proposed and implemented. The V CPC also recommended two financial up gradations on completion of 12 years and 24 years to the teachers of various Central Govt. Departments/ Organizations under the nomenclature Entry Scale, Senior Scale and Selection Grade with many riders as recommended by the IV CPC. The VI CPC recommended financial up-gradation under the MACPS (Modified Assured Career Progression) counted from the direct entry grade on completion of 10, 20 and 30 years of service respectively with ten years of continuous service in each stage. The teachers of Kendriya Vidyalaya Sangathan alone were deprived of this scheme stating that it is a modified version of ACP. Whereas the entire group A (including those who didn t have ACP scheme also), B, C and D employees of Kendriya Vidyalaya Sangathan have been granted MACP. Hence the teachers of Kendriya Vidyalaya met with grave injustice. a) Vide OM. No. DE-3(4)/ACP CELL/09// dated the teachers and other categories of staff of NCT (National Capital Territory) of Delhi granted MACP. b) Vide OM. No. DE/15/ACT/2009/589 dated MACP is granted to the teachers of Aided School under NCT (National Capital Territory) of Delhi. c) Vide OM. No.1402/07/2011-Delhi- Ministry Of Home Affairs dated MACP is granted to the Principals and Education Officers of NCT (National Capital Territory) of Delhi. d) Vide OM. No. A-32014/2/2009-KHPS/631, Ministry Of Home Affairs, Central Hindi Training Institute dated MACP is granted to the staff of Department of official Language. 5
6 e) Vide OM. A /12/2011 dated MACP is granted to the teachers of Department of Space. f) Vide OM.F. No.34 (12)/13/D (SSC) dated MACP is granted to the teachers of Sainik School Society under ministry of Defense, Govt. of India. g) Vide OM. No /03/2008-Estt (D) dated MACP is granted to the staff car drivers of central Govt. h) Vide OM.F.No.17-8/2009/-TS.1 dated the group B, C and D employees of IITs were granted MACP. It is a known factor that many of these categories of staff didn t have ACP. Hence in this exercise of granting MACP, the teachers Kendriya Vidyalaya Sangathan alone left out. It is a violation of Natural Justice and the series of events totally demoralized and marginalized the teaching fraternity. The scheme of ACP and MACP is introduced to deal with the problem of genuine stagnation and hardship face by the employees due to lack of adequate promotional avenues. Majority of the teachers of Kendriya Vidyalaya Sangathan retire after 30 years of service with one financial up-gradation since the second up-gradation after 24 years is a dream only for the teachers due to its riders and non-conduct of the DPCs in a specified interval. Many teachers who posses Graduation and Post-Graduation from recognized Universities are deprived of the Promotion and grant of Selection Scale (financial up-gradation alter 24 years stating that they don t posses the requisite subject combination. In effect an absolute minority only get promotion through LDE (Limited Departmental Examination) or financial up-gradation through Selection Grade.Finally the career of majority teachers ends up with one financial up-gradation. Where as there counterparts in departments enjoy three financial up-gradations in the form of MACP. VI CPC proposed three stages for teachers viz. Grade I, Grade II and Grade III without any riders which has not been implemented by KVS. The Entry Scale, Senior Scale and Selection Grade are the recommendations of IV & V CPCs. The recommendations of VI CPC for teachers have not been not been fully implemented. Hence in the case of teachers, KVS is fishing in muddy water. Further a handsome number of teachers of all categories are deprived of promotions due to the recruitment and promotion policies recently adopted by KVS. The co-scholastic and scholastic teachers like TGT (WE), TGT (PHE), TGT (ART), PRT (Music), Librarian, HM etc., do not have any feeder posts or promotional avenues. Hence the demand of MACP is a legitimate and long pending claim of the teachers of KVS. 6
7 Financial up gradation followed by KVS for the teachers after completion of 12 years and 24 years of service in the same cadre without the benefit of any increment [Fixation as per FR 22 (i)(a)(ii)]. In majority of cases the first promotion is offered after completion of 25 to 28 years i.e. after granting selection grade scale (on completion of 24 years).if an employee gets functional promotion after grating selection scale his/her pay is again fixed as per FR 22 (i) (a ) (ii) without granting an increment for taking up of higher responsibilities (Rules of ACP applied here). As a result, the pay of the employee is reduced on granting financial up-gradation.). Even Swami s publishers could not give any clarification as KVS follows different rules in this regard as KVS is autonomous body. Autonomy in majority situations is being used for penalizing and putting the employees in disadvantage position. Some of the employees are denied financial upgradation for not having qualification for promotion basing on the rules of ACP (Here the rules of ACP are applied). Hence I appeal to the esteemed Empower Committee to consider our genuine plea for three financial up-gradations in the form of MACP or any other form to the teachers of KVS, since fifty lakhs Central Civil Service Employees and corresponding pensioners are enjoying the benefit of MACP. B. 7 CPC recommended that MACPS is performance based. On many occasions APAR grading was used as a tool to target teachers. Hence MACPS to be granted to all the employees by de- linking to the performance index. C. Dynamic assured progression scheme for teachers: Keeping in view the nature of service of teaching profession, teachers are not only presumed but in reality also are the national reformers. 6 th CPC has recommended the pay scales of teachers in part B of the Gazette of India (page 44) as special category along with scientific staff, nursing and Para medical staff etc. The Govt. of India has given the benefit of DACP (Dynamic Assured Progression Scheme i.e. four time bound progression in grade pay) to the medical staff, which has now been extended to the AMC staff also. AIKVTA request that teachers may also be considered for extending the benefits of DACPS considering their service and commitment to the society. A case study on the work load of teachers will substantiate our genuine demand for DACPS. 7

Value Education / Guidance and Counseling Education etc. Based on the work load, commitment and social obligation the teachers of KVS are fully eligible for Dynamic Assured Progression Scheme (i.e. four time bound progression in grade after completion of 8, 16, 24,and 32 years) as it is implemented by many state governments. 4. ANNUAL INCREMENT The slab/differential increment system will lead to non-uniformity among various cadres. As the deductions are increased AIKVTA proposes an annual increment 5% of the basic pay to extend financial support to the employees 5. Grant of pay scale corresponding to the grade pay of Rs.6600/- to the PGTs at the time of promotion to the post of Vice Principal. The next higher post of Vice Principal (VP) is the post of Principal. The present grade pay of principal is Rs.7600 whereas the VP is granted Rs The rationale behind maintaining the difference of two grades between the post of VP and Principal is not progressive. Hence, the PGTs at the time of promotion should be placed in the corresponding pay scale of Rs.6600/- by 7 th CPC which is one scale/grade pay prior to the grade pay of Rs.7600/
11 6. Enhancement of retirement age to 65 years: With an aim of utilization of the vast teaching experience, the superannuation age of KV teachers may please the recommended to be enhancing from 60 years to 65 years as implemented in many Universities and Institutions of Higher Learning. This step will be in the larger national interest especially in the field of education because nothing can replace the Experience of a teacher and is to be regarded and rewarded. 7. Teaching allowance/ professional allowance to be restored: The teachers were granted Rs.100/- as teaching allowance in the form of special pay by the 4 th CPC but the 5 th CPC withdraw the teaching allowance and also the 6 th CPC had preferred to be silent on teaching allowance. AIKVTA propose that teaching allowance or professional allowance as granted to the doctor as NPA in the form of special pay should be restored and it should be revised to Rs.2500/- or 20% of basic pay whichever is maximum. 8. Higher qualification allowance: Majority of the teacher in KVS have higher qualification then the minimum required for the post highly talented lot of teachers of KVS is highly qualified. Additional benefit of increments may be granted to the teachers for having the higher qualifications. 9. Full earned leave for the duty performed in vacation: Teachers have been extended the benefit of Earned Leave under the provision of rule 28 of Leave rules, for the duration in which such staff/ teachers have been utilized for school works/ activities during vacation OM dated But only 3/5 of the period of the duties spent during vacation has been granted as Earned Leave. Instead of 3/5, full compensation should be given. Normally many compulsory in service courses and other activities are being assigned during the vacation. Therefore full compensation should be given and E.L. to be credited in the Leave account of the employee. There should be a provision of encashment after every five years. 10. HPL( Half Pay Leave) The VI CPC recommended HPL in lieu of EL (Earned leave). The demand of the teachers were the grant of HPL along with EL since we don t have medical leave/sick leave or any other leaves of that kind except 8 CL. Hence we demand 10 EL along with 20 HPL. 11. Child Care Leave Child Care Leave may also be considered at par with maternity leave for drawing vacation salary. The child care leave to be granted to both the parents since the duties and responsibilities of parents shall not be discriminated on gender basis. 12. ALLOWANCES A) Transport allowance: Transport allowance is projected with higher figures by simply adding the D.A on the previous rates. In urban areas even public transport rates are very high. Hence it needs revision with a minimum of Rs. 3000/- per month. 11
12 The higher rate of transport allowance may be granted to all cities falling in the NCT Delhi such as Gurgaon, Faridabad, Noida etc. as higher rate of HRA is admissible to these cities similarly higher rate of TPT must be considered for these cities. B) CCA: The Government is trying to develop many cities as smart cities which involve very high expenditure in the years to come. Under the tag of smart cities many taxes and user charges are being levied on consumers in all the urban areas. Coming decade is a decade of transformation and development involving people s participation which ultimately increases the financial burden on consumers. In the forthcoming GST tax system also, the financial burden on consumers will be further increased. So restoration of CCA in the prevailing situation becomes need of the hour to support the employees. Hence It suggested that CCA must be restored with reasonable rates of minimum of Rs 3000/-per month. 13. MEDICAL FACILITY Medical facilities such as health insurance or health schemes like CGHS are to be extended to all the employees and where there are no CGHS fixed amount is to be paid as medical allowance or Medical cards are to be provided to the KVS employees and retired staff for treatment in notified corporate hospitals as inpatients and out patients as it is done to the government employees by Andhra Pradesh government. 14. CPF( Cumulative provident Fund) The employees of Central Civil service may be give one time option to change from CPF to GPF since only a very few are employees are left in the service with the scheme of CPF. The employees who retired from service with CPF scheme are at a heavy financial loss. 15. AUTONOMOUS ORGANISATIONS In many situations the word autonomy is misused by the so called autonomous organizations. It is used an instrument to exploit the employees and separate the employees from the common pool of central government employees. In majority of situations the employees are put to disadvantage by not applying the rules of central government in Toto. (i) Prior to 3CPC Trained Graduate Teachers were getting more emoluments than Junior Lecturers working in the state government (AP). So many teachers preferred to join KVS leaving state government services. Gradually the teachers of KVS are ignored and degraded. After adopting 3CPC pay scales, teachers were granted one step less than the pay scales they were getting earlier. (ii) All the central government departments follow ACP with an increment at the time of pay fixation whereas KVS granted financial up-gradation without granting an increment at the time of pay fixation. 12
13 Hence it is an appeal to the government to make it mandatory to the autonomous bodies to implement the recommendations of pay commission or government bodies without any deviation or modification. It is to bring uniformity in functioning of the autonomous organizations and government sectors. 16. COMPARISON WITH STATE GOVERNMENT EMPLOEES Service conditions of state and central staff are compared and are entirely different. a. Work places of most of the state employees are in villages or small towns. Whereas work places of central staff are in cities towns. b. State staff is transferable within a mandal or district. Whereas central staff are transferable anywhere in India. c. State staff can protect their nativity. Whereas central staff cannot protect their nativity.if they want to protect nativity they have to live away from their families d. Average financial requirement is less when compared to central staff. e. Pay of state staff is revised once in five years and for central staff it is ten years. f. 33% rise in gross salary of sate staff in Andhra Pradesh and Telangana. Whereas 14.8% rise in gross salary of central staff g. The employees of state government are granted 22 casual leaves whereas central government employees are restricted to 08 only. h. The pay of employees of state government was approximately equal to central staff in previous pay revisions and now they get more pay than central staff of same cadre and the same service. As an example a primary teacher in state government with 30 years of service is getting Rs 93000/- as salary (It is given in newspapers) whereas a primary teacher with 33 years of service is not getting Rs 70000/- per month as salary after 7 CPC recommendations. 17. GOOD FEATURES OF 7CPC RECOMMENDATIONS. A) Pay bands and grade pay are removed and running scales in the form of matrix is provided for clarity. B) A method of fixation of pay to arrive at new basic pay is very clear without any ambiguity. C) It is highly appreciated for granting EL to central government teachers D) It is a very positive move by 7CPC to increase gratuity from 10 lakhs to 20 Lakhs. It is hailed by one and all. E) Child care leave is extended to father where in specific situations. F) Restoring EL and conversion of HPL to El. 13
