1 RECRUITMENT EMPLOYMENT PREFERENCE FOR VETERANS APPLICATION OF THE PREFERENCE The Chancellor shall prescribe procedures for the recruitment of all personnel employed by the College District, consistent with applicable laws and regulations. These procedures shall advance the Board s commitment to equal opportunity employment. Current College District employees are eligible to apply for any vacancy. The faculty is encouraged to participate with appropriate administrative personnel of the College District in the recruitment of superior instructors. Faculty recommendations may be solicited concerning the kinds of subject-matter specialists needed to strengthen the various divisions and, when appropriate, divisional representation may be sought in the selection of candidates. In appreciation and recognition of their service to this state and this country, the College District is committed to hiring and retaining veterans who want to continue their service to the nation by serving the College District community. Through the employment preference for veterans, the College District helps support qualifying individuals who wish to return to work after duty. For purposes of this policy, veteran and veteran with a disability shall have the meanings assigned to those terms by Texas Government Code and An eligible veteran shall mean the following: a veteran, including a veteran with a disability; a veteran s surviving spouse who has not remarried; and an orphan of a veteran if the veteran was killed while on active duty. The Chancellor shall promulgate regulations and procedures as may be necessary to implement the employment preference for veterans as set forth by this policy. The College District shall grant to all applicants who are eligible veterans a preference in employment over other applicants for the same position and who do not have greater qualifications. This preference shall apply to initial employment or appointment with the College District only and shall not extend to other employment events, including subsequent hiring, promotion, reassignment, or transfer. In the event of a reduction in workforce by the College District, the veteran employment preference shall apply to the extent the reduction involves other employees of a similar type or classification. A veteran s employment preference shall be given in the following order of priority: 1. A veteran with a disability. DATE ISSUED: 5/30/ of 5

2 2. A veteran. 3. A veteran s surviving spouse who has not remarried. 4. An orphan of a veteran killed while on active duty. The veteran s employment preference applies only to open positions posted by the College District on or after June 1, COMPETITIVE EXAMINATION CLAIM OF ELIGIBILITY COMPLAINT PROCEDURES LIAISON If a position with the College District requires, as a component of the employee candidate selection, a competitive examination (test) under a merit system, the College District shall award a veteran entitled to the veteran employment preference who has received at least the minimum test score a service credit of ten points added to the test score. A veteran with a disability shall receive a service credit of five additional points added to the test score. In order to claim the employment preference for veterans, eligible veterans must meet the qualifications for the position, including but not limited to, the training and experience requirements assigned to the position. Status as an eligible veteran shall not guarantee employment with the College District. An individual entitled to a veteran s employment preference shall not be disqualified as a candidate for a position with the College District due to age or an established service-connected disability if the individual is otherwise qualified to perform the duties of the position. All persons eligible to receive the employment preference for veterans must submit to the designated College District representative the necessary documentation to support a claim of eligibility. An individual who is entitled to a veteran s employment preference and who wishes to appeal a decision by the College District related to hiring or appointing the individual, or retaining the individual if there is a reduction in the workforce, may do so by filing a written complaint with the CEO of the location or his or her designated representative within five days of receiving notice of the decision. The location CEO or the designated representative shall determine whether the employment preference for veterans was correctly applied and respond to the complaint no later than the 15th day after the date he or she receives the complaint. The decision of the location CEO or his or her designated representative is final. The Chancellor shall designate a veterans liaison who shall function as a liaison between veterans employed by the College District and the College District administration. DATE ISSUED: 5/30/ of 5

3 APPLICATIONS EMPLOYMENT PRACTICES CRIMINAL BACKGROUND CHECK All applicants shall complete the application form supplied by the College District. Information in applications for all positions shall be verified before a position is offered. Any falsification of either information or credentials shall be cause for dismissal or denial to employ. The College District shall follow prudent personnel practices in the recruiting, interviewing, screening, and employing of all personnel. Under authority of Subchapter E of Chapter 51 of the Texas Education Code and the Fair Credit Reporting Act, (15 U.S.C. 1681b (b) et seq.), the College District shall require a criminal history check of its employees, applicants for employment, authorized volunteers, and employees of independent contractors who do business with the College District if the employment or relationship with the College District involves: 1. Regular contact with minors; 2. Accessing credit or debit card account numbers; 3. Handling of currency; or 4. Working in an area designated as a security-sensitive area. An area where there is regular contact with minors or where the above duties are performed shall be designated as a securitysensitive area. In addition, a college president may designate the entire college as a security-sensitive area. [For definitions, refer to (REGULATION).] The College District shall not employ a person or an authorized volunteer who has been convicted of any felony or misdemeanor involving any type of sexual contact with a child or abuse of a child that includes, but is not limited to, indecency with a child, injury to a child, or endangerment of a child if the person s employment or volunteer activity involves regular contact with minors. The College District shall not employ a person who has been convicted of any felony or misdemeanor involving any type of theft, burglary, robbery, fraud, computer crimes, telecommunication crimes, money laundering, bribery, or perjury as defined in the Texas Penal Code, as amended, if the person s employment involves access to debit or credit card account numbers, handling currency, or working in a security-sensitive area. The College District shall not contract with an independent contractor who permits any of his or her employees to have regular contact with minors as a result of the contractor s business relationship with the College District if an employee has been convicted of any DATE ISSUED: 5/30/ of 5

4 felony or misdemeanor involving sexual contact with a child or abuse of a child that includes, but is not limited to, indecency with a child, injury to a child, or endangerment of a child. If a person has been convicted of an offense under this policy except an offense involving a child, the College District may consider employment if the offense is a misdemeanor that is minor in nature, or the conviction occurred at least ten years ago and the person s background is otherwise clear. In this policy, a conviction includes deferred adjudication. CHARTER HIGH SCHOOL FER PART-TIME CONTRACTUAL NONCONTRACTUAL INTRODUCTORY PERIOD Since the College District has a charter high school at one of its colleges, the college is required to comply with laws that apply to open-enrollment charter schools. These laws include, among other things, that certain employees at this college undergo a National Criminal History Record Information Review by the Texas Education Agency, which includes fingerprinting. These laws require the use of different methods and standards than the College District requires when reviewing the criminal history of employees. After an employee, including an employee hired after the effective date of this policy, completes a criminal history review required by laws applicable to a charter school, the employee is exempt from a criminal history check conducted by the College District. To ensure compliance with law, no employee may refuse to provide services to a charter high school student who is enrolled at a college. The Chancellor may employ personnel for whom Board employment authorization is necessary on a temporary basis, pending Board authorization, when necessary to prevent a significant disruption of College District operations. The Board delegates to the Chancellor final authority to employ and dismiss part-time employees, including part-time faculty. [See A and DD] The Chancellor has sole authority to make recommendations to the Board regarding the selection of all full-time contractual personnel. The Board retains final authority for employment of all full-time contractual personnel. [See A] The Board delegates to the Chancellor final authority to employ and dismiss noncontractual employees on an at-will basis. [See C] The College District shall require an introductory period of 60 calendar days for all newly hired and rehired full-time staff employees to provide time to familiarize the employees with their departments and/or job responsibilities. 5 introductory period, each full-time staff employee shall accrue paid leave. However, vacation benefits shall not vest, and the employee shall not become eligible to use accrued vacation benefits until the expiration of the 60-day introductory period. Sick leave and leave for extenuating circumstances shall be eligible for use by full-time staff employees during the 60-day introductory period. [See DEC] A full-time staff employee may be dismissed at any time during the introductory period for any reason and without the right to appeal. Full-time staff employees who are terminated prior to the completion of the introductory period shall have no accrued leave credit. Completion of the introductory period does not guarantee continued employment with the College District. This provision shall not apply to full-time staff employees hired or rehired before June 1, ELIGIBILITY FOR INTERNAL APPLICATION Effective June 1, 2016, before an employee may be considered eligible to apply for a new position within the College District, the employee shall have served in his or her current position for no less than six months.
