2 2 Message from the Dean Welcome to the Faculty of Law, the University of Dhaka. Thank you for your interest in the Faculty. The prospectus provides a general overview of the Faculty and its Department. The Faculty of Law, University of Dhaka is home for those law students who desire and deserve to make a change in the intellectual and practical premises of the law. Traditionally, the best students among those who qualify for admission to the University of Dhaka under B-unit (Arts Faculty) and D-unit (combines Science, Humanities and Business Studies groups) opt to study law. So, it can be legitimately claimed that the Faculty accommodates a group of very bright students of the country. At present, we have 43 full time academics, of whom 24 are PhD holders, having excellent academic records, expertise and experience in different aspects and areas of laws. The Faculty has 20 professors all of whom received their degrees from world renowned law schools. As a team, we believe that legal education must combine necessary aspects of modern teaching-learning praxis which is essentially a diverse yet balanced fusion of theory and practice. Law being among others, a technical subject demands an objective and material introduction and projection of technical details based on the mandates of law. Under the Faculty of Law we mould law students for a legal profession that is commensurate with a modern society. The graduates of this faculty with their skills, ethics and values work for building a society with justice and equality. We heartily endeavour to maintain the high standard of legal education. The Faculty, alongside necessary offices, staffs and teaching learning equipments are purposed to facilitate standard legal education. To support the students in their private and official matters, there is a Student Advisors Office where student counseling, advising and other services are provided to the students by the assigned teachers. It is noteworthy that the Faculty is now planning to extend its wings in furtherance of its commitment to provide legal education of global standard. To this end, the Faculty will soon open an Internship Office, an Outreach Office, a Research Desk and an E-library. The Faculty will arrange seminars and conferences on a regular basis. It will also engage in collaboration and exchange programs with other world renowned universities. I expect that the Faculty of Law in its journey through the twenty first century shall gradually gain the status of one of the best law schools in the world. 3 3 Message from the Chairman Greetings from the Department of Law, the University of Dhaka. The Department of Law running under the Faculty of Law began its journey from the foundation of the University in Graduates benefit in diverse ways from the unique advantages offered by the Department. Students here are offered a broad array of courses taught by faculty members who have gained expertise and recognition nationally and internationally in relevant fields. The faculty members are committed not only in imparting requisite knowledge to the students, but are also well versed in advising students on issues that range from course material, legal issues, and career goals to matters of personal interest. The Department offers a curriculum that has been designed to ensure that students acquire substantive knowledge, skills, and values essential for practicing law in the 21st century. The admission procedure sets a high standard, which prospective students have to fulfil before they can get enrolled into the Department. It trains students who, upon graduation, practice in all areas of the legal profession, both in the public and the private sectors. It boasts a host of eminent lawyers and judges who have made their marks in the legal profession as well as in the fields of public administration, diplomacy, academia, business and politics. Apart from drilling them in the art of representing clients, students are also trained about the utilities of public interest litigation and providing legal aid for initiating social change in meaningful ways. The Department also runs a Clinical Legal Education Programme, designed to provide an intensive training in active lawyering skills. The clinical sessions comprise of modalities that include inter alia the drafting of briefs, counselling, advocacy and negotiation. The Clinic is enriched by the generous support of participation of the Supreme Court Judges, legal NGOs and reputed practitioners. The Dhaka University Moot Court Society has been organising and participating in various Moot Court Competitions, both at home and abroad. Seminars and lectures are regularly organised by the Department where eminent legal scholars and academics participate. To make the Department collegial for teachers and students, the Chairman s office is currently involved in facilitating and implementing different renovation and development works in the Department. This includes renovating the classrooms, and building a Teachers Lounge, a separate Prayer Room, a Court Room, a Student Advisors Room, and a Computer Lab. The seminar library has been refurbished along with a modern conference room to facilitate academic seminars and meetings. It is expected that these new innovations will add significantly to the academic environment of the Department and enrich the overall teaching-learning expertise. 4 4 History of the Faculty of Law Standing in front of the sacred Shahid Minar resembling the sacrifice of the martyrs of the glorious Language Movement of 1952, the Faculty of Law is one of the three founding faculties of the University of Dhaka which started its journey with one Department (of Law) in From the Language Movement onwards, the students of this Faculty takes active part in all the great movements that shaped the history of the nation. Notably, five students of the Faculty sacrificed their lives in the 1971 Liberation War of Bangladesh. Being the pioneer in legal studies in the then East Bengal, the Faculty of Law is the oldest of all law faculties in Bangladesh. At its inception, Dr. Naresh Chandra Sen Gupta, DL (Calcutta), of the University Law College, Calcutta and a very prominent lawyer and academic of the undivided Bengal, was appointed as and Head of the Department of Law. Mentionable that the Faculty started its journey with 15 teaching staffs. Up to 1973 all Deans were selected by the University authority; but after the adoption of the Dhaka University Order 1973 the post of the Dean (who is the official Head of the Faculty) is decided through election in which full time faculty members vote. Lutful Kabir was the first elected Dean of the Faculty of Law. Initially the Department of Law under the Faculty used to offer LLB degrees, which in 1973 became 3 years LLB (Honours) degree and in 1977 LLB (Honours) was made a 4 years program. Now the Department also offers LLM in different fields, MPhil and PhD degrees alongside the basic undergrad LLB (Honours) degree. In its march of educating and disseminating legal knowledge among the peoples of Bangladesh, the faculty has been playing a cardinal role for almost a century. Its contribution in devising, strengthening and sensitizing the broader legal architecture of Bangladesh (both in terms of knowledge and expertise) is unparalleled. Over the years, the Faculty of law became the centre for excellence for legal education in Bangladesh. The Faculty gave birth to some of the finest legal minds and jurists of the country who contribute in enriching the legal, social and political arenas in various ways. It requires a special mention that the Father of the Nation Bangabandhu Sheikh Mujibur Rahman was a student of this Faculty. Further, this is the pride of Faculty of Law that its alumni are performing duties in different important positions including the Speaker of the Parliament, Chief Justices of Bangladesh, Judges of both the High Court Division and the Appellate Division of the Supreme Court of Bangladesh, famous lawyers, eminent human rights and NGO activists, journalists, intellectuals and internationally acclaimed academics. Each year a good number of graduates of the Faculty qualifies in the Bangladesh Civil Service and the Bangladesh Judicial Service examinations. Thus the Faculty of Law of the University of Dhaka has been playing the role of guardian of legal education in Bangladesh through its enlightening trajectory dedicated to people of the land.

16 16 Bachelor Of Laws (Honours) A. Admission Students shall be admitted in the Bachelor of Laws (Honours) Programme in the Department of Law under the Faculty of Law as per the University Rules. Students must pass the 'B' (Kha) or 'D' (Gha) Unit admission test scoring minimum 14 in Bangla and 18 in English to get admitted into the LLB (Honours) programme at the Department of Law. B. Degree Requirements i. Duration of the Program The Bachelor of Laws (Honours) Programme shall be of four years. ii. Number of Courses, Credit Hours and Marks The Programme shall include 24 course units for a total of 2300 marks including 100 marks for viva voce. The total credit hours for the Bachelor of Laws (Honours) course will be 138 credit hours. C. Structure of the Programme Bachelor of Laws (Honours) is a four-year Program. All courses are compulsory. 18 18 D. Examination and Evaluation i. Evaluation and grading are determined on the basis of: - Tutorial examinations, - First and second term examinations and - Year final examination. ii. The distribution of marks for evaluation shall be as under: In-course examinations Tutorial Test/s 10% 1 st Term test (60 minutes duration) 10% 2 nd Term Test (60 minutes duration) 10% Year Final Examination (3 hours duration) 70% Total 100% iii. iv. There shall be internal and external examiners for each course of the final examination. The course teacher evaluates all the in-course examinations. The course teachers conduct the tutorial examinations while first and second term examinations are conducted by the Department. v. The question papers shall be in English and the duration of the final examination shall be of three hours. Students shall have to answer four questions out of eight questions for each course. vi. vii. viii. ix. Two examiners appointed by the respective Examination Committees shall evaluate year final scripts. If the difference between two examiners is more than 20 percent, the script(s) shall be examined by a third examiner and the average of the nearest two marks shall be treated as final marks. For each course, the average marks awarded by the year final examiners and the marks awarded by the course teacher for the in-course examinations, will be totaled and converted into letter-grades following a 4-point grading scale presented below (approved by the Academic Council of the University of Dhaka on ). At the end of every year final examination, the Examination Committee will hold a viva voice examination of 25% weightage. For the viva voice examination, a student will be awarded only one grade after the end of 4 th year. Attendance Policy: Only those students who have attended 75% of the general lectures shall be eligible to sit for the final examination. Students who have attended 60%-74% of the general lectures shall be considered as non-collegiate and may be allowed to sit for the final examination provided they pay the prescribed fine. Students who have less than 60% class attendance shall be declared as discollegiate and shall not be permitted to sit for the final examination.

A+, A and A- grades are indicative of excellent performance overall by a student, earning grade points of 4.0, 3.75, and 3.50, respectively. 2. B +, B and B- grades are indicative of very good performance overall by a student, earning grade points of 3.25, 3.00, and 2.75, respectively. 3. C +, C grades are indicative of satisfactory performance overall by a student, earning grade points of 2.50, and 2.25, respectively. 4. D grade is indicative of minimally acceptable passing performance overall by a student, earning a grade point of F grade is indicative of an unacceptable failing performance overall by a student, i.e., failing to earn any credit point. 6. I grade is indicative of a situation where a student, for non-academic reasons beyond his control, is unable to complete the full requirements of the course for not being able to sit for the year final examination. With the submission of valid and authenticated evidence of such reason(s), and the recommendation of the course teacher (to be reported to the Chairperson of the Examination Committee), the particular student shall be allowed to complete the year final examination with the next batch. Meanwhile, the student concerned will be promoted to the next year. If an I grade is not cleared with the next batch, the I grade shall automatically be changed to an F grade. A maximum of two I grades shall be allowed to a student in one year.

Promotion and the Final Degree A student must secure the following minimum Grade Point Average of a Year (YGPA) for promotion to the next year: 1 st year to 2 nd year nd year to 3 rd year rd year to 4 th year Promotion shall be year-wise, i.e. 1 st year to 2 nd year, 2 nd year to 3 rd year, 3 rd year to 4 th year and awarding of the degree. 2. Promotion from 1 st year to 2 nd year, 2 nd year to 3 rd year and 3 rd year to 4 th year shall be automatic. 3. A student failing to clear up the annual university or department dues of the year of study shall not be promoted to the next year. 4. A student will not be promoted to the next year if s/he obtains F grade in more than two courses or remains absent in more than one course in the year final examination, even if s/he obtains YGPA 2.00 or more. 5. A student must secure a minimum CGPA of 2.50 to earn a Bachelor of Laws (Honours) degree. G. Improvement/Retake Examination 1. A student earning F grade in one or two courses shall be allowed to improve the grade only once with the following batch. 2. A student who remains absent in only one course in the year final examination will be allowed to sit for the retake examination of that course only once with the following batch, with the permission of the Academic Committee, upon production of satisfactory evidence for abstention. 3. A student who remains absent in only one course and gets F grade in another course in the year final examination will also be allowed to sit for the retake examinations of both the courses only once with the following batch. 4. If a student obtains a grade lower than C in a course, s/he shall be allowed to retake the final examination of that particular course only once with the following batch for the purpose of grade improvement. 5. If a student obtains C or better grade in any course, s/he shall not be allowed to retake final examination of that course for the purpose of grade improvement. 6. If a student likes to improve the grade point earned in a course of fourth year for the Bachelor of Laws (Honours) degree, he/she must apply for such improvement examination before the certificate is issued. 7. Improvement shall not be allowed once the certificate is issued. 8. A student carrying grade F in any course shall not be awarded the degree unless he/she improves it by appearing at the year final examination with the next batch. 9. If the student gets F in the improvement examination, he/she shall automatically be dropped from the year and the student shall have to take readmission with the next batch, provided the student concerned is eligible for readmission. 10. For improvement of grade in a course, the student shall apply to the Chairperson of the Department at least 4 (four) weeks before the start of the year final examination.

21 21 H. Readmission I. Drop out 11. A student shall be allowed to improve the grade of a particular course only once. 12. No improvement shall be allowed for the in-course examinations and viva voce. 1. A student failing to get the requisite grade points for promotion from one year to the next may seek readmission with the immediate next batch. 2. For readmission, a student shall have to apply within one month after the announcement of the results of the concerned year. 3. On readmission, grades earned earlier by a student in the class of readmission shall cease to exist and the student has to retake all the course works and examinations. 4. A student shall not be allowed readmission in more than three years during the entire Bachelor of Laws (Honours) Programme. 1. A student failing to earn the YGPA for promotion from one year to the next year after taking second readmission shall be dropped out of the Program. 2. A student must complete the Bachelor of Laws (Honours) course in 6 consecutive years after which his/her studentship shall be cancelled. J. Adoption of unfair means in examinations Students adopting unfair means in examinations shall be treated according to Dhaka University rules. L. Degree Requirements For the degree of Bachelor of Laws (Honours) a student shall have to: Secure CGPA of Complete the Programme within a maximum of six consecutive academic years including the year of first admission within Programme.

23 23 Master of Laws (LLM) A. Name of the Programme Master of Laws (General and Specialized) B. Admission Only successful students of the Bachelor of Laws (Honours) Programme of the Department of Law, University of Dhaka shall be eligible to get admitted into the Master of Laws (General and Specialized) Program. C. Duration of the Program The Master of Laws (General and Specialized) Programmeshall be of one academic year. D. Degrees Offered The Masters Programme at the Department of Law shall consist of two streams i.e., (a) general Masters and (b) specialized Masters. The specialized Masters Programme shall be: Master of Laws in International Law Master of Laws in Human Rights Law Master of Laws in Comparative Law Master of Laws in Commercial Law Master of Laws in International and Comparative Law Master of Laws in Gender in Law E. Course Requirements i. Students shall be required to take any five of the courses offered by the Department. ii. iii. iv. Students shall have to submit a research monograph in partial fulfillment for the Masters degree. The students must choose the research topic from among the five courses they have chosen. Students shall have to appear in the viva-voce examination at the end of the Final Examination. F. List of Courses The Master of Laws, be it general or specialized, shall comprise of the following courses. However, the Academic Committee of the Department of Law shall decide as to the courses to be offered in any particular academic session.
