3 Broward County Board of Rules & Appeals (BORA) History The Board of Rules & Appeals first met on January 10, On March 9, 1976, the voters of Broward County recognized the need for a single autonomous agency to write, modify, and interpret a uniform body of building codes applicable throughout the County. The County Charter was amended, as proposed by the Charter Review Commission, to establish the Broward County Board of Rules and Appeals as an arm of county government. Made up of professionals, some appointed by the Broward County League of Cities others by the Broward County Commissioners, Board members are volunteers who serve without pay. BORA works throughout the year to provide educational programs available to inspectors, contractors and design professionals, and to increase and improve the knowledge and performance of the persons certified by BORA pursuant to the Building Code. The Board convenes monthly, as needed, to consider proposed amendments to the Florida Building and Fire Prevention codes to hear appeals on decisions made by Building and Fire Code Officials, and to render formal interpretations on the precise meanings of code sections that may be disputed. Board members and staff are continually working to provide stronger codes and greater safety for all who live and work in Broward County, and are well represented in state, national, and international organizations developing codes and standards. Chief Code Compliance Officer Structural, Salary Range and Qualifications The pay range for this title is $72,444 to $115,621. The initial hiring salary is up to $94,033 with full benefits. The pay range is periodically reviewed by BORA and adjusted upward when appropriate. For appointment as the BORA Chief Structural Code Compliance Officer, an individual must meet the certification standards contained in 104.8, for certification of Chief Structural Inspector/Structural Plans Examiner. BORA provides the same employee benefits as Broward County and we participate in the Florida Retirement System (Pension Plan or Investment option). A county waiting period for health and life insurance benefits apply. The option of a take-home vehicle is available at an employee cost of $30.00 per week, $1, per year for employees who reside in Broward County (not available out of the County). Chief Structural Code Compliance Officer Hiring Process and Organizational Structure A screening committee, appointed by the Director, is being used to narrow the field of applicants. Out of the final group, a single recommended appointment will be brought to the Board by the Director for requested ratification. In the organization, there are a total of ten (10) positions, including Director, six (6) Compliance Officers, and a Clerical staff of three (3). 4 B Air Conditioning Contractor or Mechanical Journeyman, five (5) years of which shall have been construction experience in the Mechanical discipline and a minimum of one (1) year as a Mechanical Plans Examiner employed by a municipality or private company contracted with a municipality or School Board within the State of Florida and a minimum two (2) years as a Mechanical Inspector employed by a municipality or private company contracted with a municipality or School Board within the State of Florida. An applicant for Certification as a Chief Mechanical Inspector under the provisions of this section who is a graduate from an accredited school holding a Bachelor or an Associate of Science Degree in Mechanical Engineering may be credited for three (3) years for a Bachelor Degree or one (1) year for an Associate Degree of the required eight (8) years of experience. In addition to the aforementioned requirements: Each of the applicants shall possess a current Certificate of Competency as a Mechanical Contractor or Class A Air Conditioning Contractor issued by at least one of the following entities: A. Florida Construction Industry Licensing Board B. Broward County Central Examining Board of Mechanical Contractors and Specialty Mechanical Contractors C. Miami-Dade County Construction Trades Qualifying Board, Block proctored, issued on or after January 1, 1968 D. Florida Department of Business and Professional Regulation as an Engineer Certification of the Chief Plumbing Inspector. To be eligible for appointment as a Chief Plumbing Inspector, such person shall be certified as required by the State of Florida, BCAIB as a Plumbing Plans Examiner and as a Plumbing Inspector. Such person shall be certified by BORA and shall meet at least one of the following qualifications: Exception: Engineers are exempt from BCAIB certification only Six (6) years of combined experience as an Engineer in the discipline requested and having practiced for a minimum three (3) years and a minimum one (1) year as a Plumbing Plans Examiner employed by a municipality or private company contracted with a municipality or School Board within the State of Florida and a minimum two (2) years as a Plumbing Inspector employed by a municipality or private company contracted with a municipality or School Board within the State of Florida Eight (8) years of combined experience as a Master Plumber or Plumbing Contractor or Journeyman Plumber, five (5) years of which shall have been construction experience in the Plumbing discipline and a minimum of one (1) year as a Plumbing Plans Examiner employed by a municipality or private company contracted with a municipality or School Board within the State of Florida and a minimum two (2) years as a Plumbing Inspector employed by a municipality or private company Broward County Board of Rules and Appeals ~Effective June 30, 2015 contracted with a municipality or School Board within the State of Florida. Exception: Architects and Engineers are exempt from BCAIB certification only Six years combined experience as an Architect or an Engineer having practiced within the HVHZ for a minimum three (3) years, a minimum of one (1) year as a Structural Plans Examiner within the HVHZ employed by a municipality or private company contracted with a municipality and a minimum of two (2) years as an Structural Inspector within the HVHZ employed by a municipality or private company contracted with a municipality Eight (8) years combined experience as a licensed General Contractor (Unlimited), minimum two (2) years construction experience in the Structural discipline within the HVHZ, Bachelor or Associates of Science Degree in Engineering, Architecture or Building Construction from an accredited school may be credited for a maximum of three (3) years for Bachelor Degree or a maximum of one (1) year for an for Associate Degree, minimum of one (1) year as a Structural Plans Examiner and a minimum of two (2) years as a Structural Inspector, of which one year may be Florida School Board Inspector experience, within the HVHZ An applicant for Certification as Chief Structural Inspector under the provisions of this section, who has passed BORA HVHZ Competency exam may substitute experience within the State of Florida for the required HVHZ experience requirements as specified in Section or th Edition (2014) FBC Building 1.7 Broward County Administrative Provisions
5 In addition to the aforementioned requirements: Each of the applicants shall possess a current Certificate of Competency as a General Contractor (Unlimited) issued by at least one of the following entities: A. Florida Construction Industry Licensing Board. B. Broward County Central Examining Board of Building Construction Trades (as Class A Unlimited General Contractor). C. Miami-Dade County Construction Trades Qualifying Board, Block proctored, issued on or after January 1, D. Florida Department of Business and Professional Regulation as an Architect or Engineer Appointment of the Electrical, Mechanical, Plumbing and Structural Plans Examiner. As set forth herein: There shall be appointed by each governmental AHJ a person qualified as set forth in the above and below Sections to serve as Plans Examiner in each discipline as stated above. To be eligible for appointment as a Plans Examiner, such person shall be certified by BORA Powers and Duties of the Electrical, Mechanical, Plumbing and Structural Plans Examiner. The Plans Examiner shall be responsible for duties as assigned by the Chief Inspector within his or her particular discipline. The Plans Examiner shall fulfill the duties of the Chief Inspector during the absence of the Chief Inspector with full responsibilities of the position within his or her particular discipline. The Plans Examiner shall examine all plans and/or specifications and applications for permits within his or her particular discipline. When approvals by other agencies having authority may logically be required to be affixed to the plans and/or specifications before approval by the Plans Examiner, such approval shall be affixed to the plans and/or specifications before examination by the Plans Examiner. If the application or plans and/or specifications do not conform to the requirements of all pertinent laws or regulations, the Plans Examiner shall reject such application in writing, stating the reasons therefore and citing the relevant code section(s). Plans and/or specifications which are rejected, as stated herein above, shall be returned for correction. Pen notations on mechanically reproduced plans and/or specifications may be accepted for only minor corrections. If the applications, plans and/or specifications, upon examination, are found to comply with the requirements of this Code, the plans and/or specifications shall be signed and marked approved Certification of the Structural Plans Examiner: To be eligible for appointment as a Structural Plans Examiner, such person shall be certified as required by the State of Florida, BCAIB as a Structural Plans Examiner and Structural Inspector. Such person shall be certified by BORA and shall meet at least one of the following qualifications: Exception: Architects and Engineers are exempt from BCAIB certification only An Architect or an Engineer in the discipline requested and having practiced within the HVHZ for a minimum of three (3) years, and a minimum two (2) years as an Broward County Board of Rules and Appeals ~Effective June 30, 2015 Structural Inspector employed by a municipality or private company contracted with a municipality within the HVHZ Seven (7) years of combined experience as a licensed General Contractor (Unlimited), five (5) years of which shall have been construction experience in the Structural discipline within the HVHZ, and a minimum of two (2) years as a Structural Inspector, of which one year may be Florida School Board Inspector experience, employed by a municipality or private company contracted with a municipality within the HVHZ Five (5) years experience as a Structural Plans Examiner or Structural Inspector, and three (3) years of construction experience in the Structural discipline, which shall have been within the HVHZ, and certified by BCAIB An applicant for Certification as a Structural Plans Examiner under the provisions of this section who is a graduate from an accredited school holding a Bachelor or Associate of Science Degree in Engineering, Architecture or Building Construction may be credited for three (3) years for Bachelor Degree or one (1) year for an Associate Degree of the required seven (7) years of combined experience for the Structural discipline An applicant for Certification as a Structural Plans Examiner under the provisions of this section, who has passed BORA HVHZ Competency exam may substitute experience within the State of Florida for the required HVHZ experience requirements as specified in Section , and In addition to the aforementioned requirements Each of the applicants shall possess a current Certificate of Competency as a General Contractor (Unlimited) issued by at least one of the following entities: A. Florida Construction Industry Licensing Board B. Broward County Central Examining Board of Building Construction Trades (as Class A Unlimited General Contractor) C. Miami-Dade County Construction Trades Qualifying Board, Block proctored, issued on or after January 1, 1968 D. Florida Department of Business and Professional Regulation as an Architect or Engineer. E Certification of the Electrical Plans Examiner. To be eligible for appointment as an Electrical Plans Examiner, such person shall be certified as required by the State of Florida, BCAIB as an Electrical Plans Examiner and as an Electrical Inspector. Such person shall be certified by BORA and shall meet at least one of the following qualifications: Exception: Engineers are exempt from BCAIB certification only An Engineer in the discipline requested and having practiced for a minimum of three (3) years, and a minimum of 5 th Edition (2014) FBC Building 1.8 Broward County Administrative Provisions
6 Board of Rules & Appeals Chief Code Compliance Officer Nature of Work This is advanced technical work, which ensures that the Building and/or Fire Prevention Codes and Standards applicable to Broward County are being enforced in a uniform manner throughout Broward County in accordance with the mandate of the Board of Rules & Appeals. These codes include the South Florida Building Code, the Florida Buildi~g Code, and the Florida Fire Prevention Code, as well as any other mandatory rules, regulations and adopted standards. Work involves ensuring that County and Municipal Building and/or Fire Code Inspectors perform their duties in compliance with established rules, regulations and codes, and maintain a high degree of proficiency. Reviews Building and/or Fire Code Inspection Departments and construction sites throughout Broward County to ensure uniform compliance with the applicable Building and/or Fire Prevention Codes. Work also includes public contact in giving information and receiving complaints. Considerable tact and courtesy are required in public contact work. The employee must exercise independent judgment and initiative in completing assignments and resolving construction-relateq problems. Work is performed under the direction of the Administrative Director. Assignments are received through conferences and written instructions, and work is reviewed by observation of results obtained. Illustrative Tasks Reviews each Building and/or Fire Code Inspection Department and the various phases of construction activity within their discipline in Broward County to ensure uniform compliance with applicable Building and/or Fire Prevention Codes, standards and related regulations at least four (4) times per calendar year. Informs the appropriate Building and/or Fire Code Official of the results of the review. Informs the Building and/or Fire Code Official of each department of all changes to the applicable Codes and Standards and provides on-site classes regarding these changes upon request. Ensures that inspectors are performing their duties in uniform of all applicable Codes and Standards within their discipline, and to the highest degree of proficiency. Review request for certification of Building and/or Fire Inspection personnel in their disci. pline. Prepares records and reports. Confers and/or corresponds with architects, engineers, contractors, building/property owners, inspectors, plans examiners, building and other public officials, and the general public concerning questions about the applicable codes, standards and related regulations. Serves as staff liaison to committees established by,the Board. Conducts a minimum of four (4) educational seminars within their discipline each calendar year. Such seminars shall be open to all interested parties.
7 Attends all meetings of the Board unless excused by the Administrative Director. Perfonns related work as required. Knowledge, Abilities and Skills Thorough knowledge of the applicable Building and/or Fire Codes, local amendments, environmental protection requirements, and national standards within their discipline. Thorough knowledge of the construction practices within their discipline. Thorough knowledge of modem development, current literature, and sources of infonnation in the field of construction and inspection within their discipline. Ability to understand and interpret construction plans, diagrams, blueprints and specifications.. Ability to express ideas clearly, orally and in writing. Ability to enforce applicable codes and standards within their discipline. Ability to establish and maintain effective working relationships with elected and/or appointed officials, architects, engineers, contractors, property owners and the public, dealing with persons of diverse cultural and linguistic backgrounds, regardless of race, religion, age, sex, handicap or political affiliation. Desirable Experience and Training. Experience in all phases of construction and inspection activities within their discipline. Graduation from a Community College with fonnal education in construction-related subjects, or any equivalent combination of training and experience. Necessary Special Requirements Certifiable as a Chief Inspector within their discipline by the Broward County Board of Rules & Appeals in accordance with the Florida Building Code as applicable to Broward County.
