1 EUROPEAN FACULTY OF LAW IN NOVA GORICA Nova Gorica,
2 The European Faculty of Law in Nova Gorica is the only private faculty of law in Slovenia. It was founded in 2005, when it was the first faculty of law in Slovenia to follow the European Bologna model of study. What has distinguished this faculty from other faculties of law in Slovenia are its special dedication to international, most notably European, dimensions of teaching as well as emphasis on a special importance of practical aspects of legal theoretical foundations that are mostly taught at other faculties of law in Slovenia. In addition to teaching Slovene law students at the undergraduate and postgraduate level of study, the faculty aims at developing cooperation with related educational and research institutions in neighbouring countries and in the EU Member States, and broader, as well as providing international exchange of students and professors. For this purpose the faculty has obtained the Erasmus University Charter. It has already signed Erasmus bilateral agreements with the Univesity of Udine, the University of Duesto (Spain), Scuola Superiore Sant'Anna (Pisa), the University of Zagreb, the University of Leipzig and the University of Budapest. The Erasmus University Charter allows the faculty to offer its students and employees exchange with foreign higher education institutions in the field of practice, study, teaching, and training. The following study programmes are organized at the Faculty: - Undergraduate programme Law - Undergraduate programme Law and Management of Infrastructure and Real Estate Level - Postgraduate programme Law - Postgraduate programme Law and Management of Real Estate - Doctoral programme Law - Doctoral programme Law and Management of Real Estate 3 The registered office of the faculty is in Nova Gorica, where the classes are held at a modern urban campus, and two separate local units at Brdo pri Kranju and Ljubljana have also been accredited. In 2
3 terms of location, the faculty is linked to Gorica region and neighbouring Friuli-Venezia Giulia, and the content of its courses with the emphasis on European and comparative law is oriented into Europe and the international area. It should be noted that the faculty was founded when Slovenia was accessing the European Union and consequently it is originally oriented to the monistic view of the relationship between the EU law and Slovenian legal order. The Faculty is also dedicated to pay a special attention to the transfer of legal knowledge to students in the territory of SE Europe, and in this context a closer cooperation with the state and competent European institutions has been planned. In general, the location and social environment of the faculty provide good opportunities for the development of study activity as it is expanding in Primorska and especially in Nova Gorica. The location near the border allows for its close contacts in the legal field with institutions across the border and organisations of Slovenes who live abroad. FACULTY PROGRAMMES (1) Law I This three-year undergraduate study programme is organized as the first Bologna study level. It provides students with basic legal knowledge and qualifies them for lower positions regarding various legal professions in justice administration, business, local communities, or public administration. It is also possible to continue study at the two-year master programme Law 2, and thus qualify for all important legal positions in the above-mentioned areas. The first year of this programme includes the following mandatory courses: Introduction to Jurisprudence, Constitutional Law, Basics of Roman and Canon Law, Criminal Law, Criminal Procedure, Legal History, Comparative Constitutional Law, Foreign Legal Terminology. The second year of study brings mandatory Civil Procedure, Law of Obligations, Business Law, Financial Law, Introduction to Civil Law, Real Estate Law, Family Law, Law of Inheritance, Labour Law, Social Welfare Law. Finally, the third year comprises of the following courses: International Law, EU Law, Conflicts of Law, International Community and International Relations, Administrative Procedures and Judicial Review of Administrative Acts, Administrative Law, Public Administration. After graduating from this programme the student is awarded the title of Bachelor of Law (LL.B). 3
4 (2) Law II The postgraduate study programme is the second level of the mode of study under the principles of the Bologna Declaration. It is related to the first-level study programme Law 1, and they together represent a complete five-year study, leading to the professional title of Master of Law. Students may enrol to this programme after completing the Law 1. Graduates of the postgraduate programme Law 2 are able to continue academic education at all doctorate-level programmes. The postgraduate study lasts for two years or four semesters. In the first three semesters lectures, seminars, and study workshops are organised. The following courses and mandatory: Philosophy and Theory of Law, Democratic and Rule-of-Law State, Theory and Practice of Social State, Constitutional and International Criminal Law, European Civil Law, Modernisation of Public Administration, Comparative Law and Great Legal Systems, Constitutional and International Human Rights Law, EU Constitutional System. The entire fourth semester is dedicated to drafting and defending of the master's thesis. After the completion of the study a graduate is awarded the title of Master of Law (LLM). (3) Law III The doctorate programme Law 3 allows for a continuing faculty study, and simultaneously supplements and completes the existing programmes. In this way the study programmes of the European Law Faculty in Nova Gorica form a coherent whole. The main purposes of the doctorate-level study are as follows: students learn how to carry out independent scientific work; students learn how to carry out an extensive research in a narrowly defined legal field, and students learn how to draw up an original and extensive written work of scientific nature. The doctorate-level study leads to deeper knowledge in a narrowly defined field and the student should be able to appropriately apply usual methods of scientific work in the legal field. At the same time the 4
5 doctoral dissertation is an original contribution to Slovenian legal science. As such it may have certain practical significance, although that is not an essential objective of the doctorate-level study. Before writing and defending of their doctoral thesis students must also pass the following courses: Theory of Law, Law of the State, and International Law. When the conditions for the completion of the postgraduate doctorate study of Law 3 have been met, the candidate is awarded the following scientific title: Doctor of Law (LL.D or Dr.) (4) Law and Management of Infrastructure and Real Estate I This is an undergraduate three-year programme that represents the first Bologna level of study. Graduates of this programme are capable to run for junior associate positions in the area of law and management of infrastructure and real estate. They are eligible, however, to continue their master studies at the second Bologna level. The first year of this study encompasses the following courses: Fundamentals of Management, Fundamentals of Spatial Planning, Introduction to Real Estate Law, Registering of Real Estates, Real Estate Evaluation, Management Economics, Business Mathematics, Fundamentals of Architecture, Introduction to Administrative Law and Administrative Procedure, Municipal Infrastructure. The second year brings the following courses: Methods of Real Estate Marketing, Buildings Planning, Fundamentals of Staff Management, Transportation Infrastructure, Introduction to Business Law, Introduction to Law of Obligations, Energy Infrastructure, Introduction to Civil Procedural Law, Conducting of Infrastructure Projects, Telecommunication Infrastructure, Public- Private Partnership, Special Administrative Procedure. Finally, the third year is consisted of the following courses: Investment Processes and Building of Objects, Economics of Business Subjects, Objects Maintenance, Fundamentals of Tax Law, Project Management, Spatial Planning Law, Special Administrative Procedures, Public Procurement Law and Concessions. After the completion of the programme graduates are awarded the title of Bachelour of Law and Management of Infrastructure and Real Estate. 5
6 (5) Law and Management of Real Estate II The fundamental purpose of this postgraduate study is to create professional profiles for the most demanding work in various fields related to the issue of real estate in the territory of the Republic of Slovenia as well as in the European and international field. The masters study programme merges theoretical, methodological and applied disciplines, and ensures gradual development of interdisciplinary knowledge and at the same time continuity in education. Graduates with the title Master of Law and Management of Real Estate will acquire the skills and knowledge for efficient and professional managing of real estate legal matters, investments, real estate projects, and strategic and professional decisions related to real estate by applying up-to-date qualitative and quantitative techniques as well as up-to-date information systems. In relation with the field, this programme provides specialised professional education of interdisciplinary legal and other disciplines in the field of real estate management on the basis of groups of subjects of the theory and history of law, civil and commercial law, administrative law and European law, and knowledge in the field of spatial planning, architecture, real estate development, organisational environment, financial operations, valuation of real estate and investments, project financing and management, registration of real estate, real estate market and real estate marketing. Appropriate general legal education trains for legal and other professions related to real estate, and at the same time allows for continuation of academic or scientific-research work. The content of the programmes reflects the unique organisational, historical and cultural environment, comparable in its generality and specific in the sense of social and economic requirements. It is comparable internationally with other real estate programmes, mainly from the following aspects: comprehensive understanding of real estate issues, in-depth teaching of legal knowledge in the field of real estate and practical application of this knowledge, training for analytical and research work, international orientation to understanding and actions by profiled graduates of postgraduate studies. Graduates of postgraduate study programme Law and Management of Real Estate are able to continue academic education at all doctorate-level programmes, which require thorough theoretical and practical knowledge in fundamental fields of social or technical science. The following courses compose the two-year programme: Administrative Law and Administrative Procedure, Spatial Planning System, Concept of Real Estate, Law of Obligations, Valuation of Real Estate, Project Management, Real Estate Law, Planning of Residential Construction, Real-Estate Registration and Management of Real Estate with the Basics of Land Register Law. 6
7 Those who graduate from this programme are awarded the title of Master of Law and Management of Real Estate. (6) Law and Management of Real Estate III Doctorate study programme Law and Management of Real Estate Level 3 provides an opportunity for students to continue faculty education, which does not deviate from the field of law as the principal activity of the faculty, and at the same time directs education to special interdisciplinary knowledge in accordance with the needs of up-to-date community. General doctorate study programme Law and Management of Real Estate provides specialist education at Level 3, comparable in international context. Such integral design merges theoretical, methodological, and applicative disciplines. The fundamental purpose of the postgraduate study is to create legal professional profiles for the most demanding work in the field of law and management related to real estate. Graduates acquire the skills and knowledge for efficient and professional managing of legal matters in the field of real estate management by applying up-to-date qualitative and quantitative techniques as well as up-to-date legal information systems and in-depth research work. Before the writing and defending of their doctoral thesis students must also pass the following courses: Real Estate Law, Spatial Planning, Registering and Real Estate Management with the Fundamentals of Land Register Law, Real Estate Culture and Ethics. When the conditions for the completion of postgraduate doctorate study Law Level 3 have been met, the candidate is awarded the following scientific title: Doctor of Law and Management of Real Estate.
