1 EXTRACURRICULAR DRUG AND ALCOHOL TESTING PROGRAM STUDENTS: The District s extra-curricular drug testing policy for extra-curricular activities for students in grades 9-12 is designed to both: 1. Ensure that our students who participate in extra-curricular activities do so in as safe and healthy atmosphere as possible. 2. Reinforce the idea of a drug-free school by having our most visible models, students who participate in extra-curricular activities, be drug-free. This procedure was developed by a committee of administrators, school board members, coaches, parents and students. This policy has been developed and adopted as a response to the developing problem of drug and alcohol use by Winnebago students and in particular, extra-curricular student participants. While the board encourages students to participate in extra-curricular activities it also believes the opportunity to try out for and participate in those activities is not an absolute right. Rather, it is a privilege offered to all students who are eligible. To try out for or to participate in any school sponsored extra-curricular activity, a student and his or her parent/guardian(s) must consent to random drug and alcohol testing. Failure to sign a Random Drug and Alcohol Testing Consent form will make a student ineligible to try out or participate in any District extra-curricular activities. This form must be completed online during the appropriate registration time for all extra-curricular participants. Transfer students who wish to participate in extra-curricular activities will be placed in the random testing pool when they sign the consent form at the time of enrollment. If a student fails to take the test when his or her number is drawn or tests positive when they take the test, the student will be deemed in violation of the Code of Conduct for Extra-Curricular Activities and placed on a Level 1 suspension. A Level 1 suspension results in a suspension equivalent to two-ninth s (2/9 s) of the regularly scheduled extra-curricular games or activities for that season or a minimum of one game or activity suspension. This Level 1 suspension will carry over to the next season of extracurricular participation should the current season end before the extra-curricular activity suspension is completed. If no events or contests remain in the activity, the student will be suspended in the next activity or season in which they participate. If a student fails to take the test or tests positive for illegal drugs or alcohol for a second time during the same school year they will receive a Level 2 suspension. A Level 2 suspension results in a student being ineligible for participation is extracurricular activities for one calendar year from the date of the second testing. Violations under the Extra-curricular Drug Testing Policy and Procedure are cumulative for that school year only. Therefore, at the start of the fall extracurricular season each student enters with a clean slate, unless they have a Level 1 or Level 2 suspension, which has carried over from the previous year. If the parent feels the test was not accurate they may request a confirmation test on the original specimen given by the student. If the results of the second test are negative, the District will pay for the second test. If the results of the second test are positive, the parents will pay for the test. If the results of the

2 second test or follow up test are negative, the students will be allowed to resume extra-curricular activities immediately. The results of any test administered under the terms of the policy shall be kept confidential and disclosed only to the students, his or her parents, and school officials designated by this policy. The test results will not be part of the student s permanent record but will be kept in a secure file in the Activities Director s office. No students shall be expelled or suspended from school as a result of a verified positive test conducted under this program other than when independent reasonable suspicion of drug and/or alcohol usage exists. If a student tests positive for illegal substances for a second time in the same school year, that student will be suspended from participation in extra-curricula activities for one calendar year. This program does not affect the District policies, practices, or right to search or test any student who at the time exhibits cause for reasonable suspicion of drug and/or alcohol use. Testing Program Procedures 1. Includes cooperative teams and individuals and any other sport or voluntary extra-curricular activity where no grade or credit is received that may be added by the Board. The list of extracurricular activities shall include but not be limited too: Art Club Chorus-Solo & Ensemble Boy s Soccer Bago Pride Boy s Cross Country Girl s Soccer Band-Organizational Girl s Cross Country Softball Band-Solo & Ensemble Dance Team Spanish Club Baseball Drama (play) Student Council Boy s Basketball Football Boy s Track Girl s Basketball Key Club Girl s Track Boy s Bowling Math Team Volleyball Girl s Bowling Musical Wrestling Cheerleading (fall) National Honor Society WYSE Team Cheerleading (winter) Robotics Chorus-Organizational Scholastic Team 2. To try out for or to participate in any school sponsored extra-curricular activity, a student and his or her parents/guardians (s) must consent to random drug and alcohol testing. Failure to sign a Random Drug and Alcohol Testing Consent form will make a student ineligible to try out or participate in any District extra-curricular activities. All students who wish to participate in the District s extra-curricular program must complete the online form prior to the start of their respective season. Those who do not meet this deadline may not tryout for or participate in extra-curricular activities until they are tested by our agency at their expense. Transfer students who wish to participate in extra-curricular activities will be placed in the random testing pool when they sign the consent form at the time of enrollment. 3. In order to maintain confidentiality the testing agency will assign a number to each student participating in extra-curricular activities. Testing will occur at anytime throughout the entire school year.

3 4. Eight percent (8%) of the total pool of students will be tested each time the tests are done. There will be up to 12 tests during the school year. The selection of students to be tested will be made randomly by the testing agency. The testing agency will provide the activities director/assistant principal with a list of those students who are to be tested on the day the testing agency comes to conduct the test. If the student is absent from school on the day of the test and the absence is unexcused, the student will be ineligible for extra-curricular participation until the next testing date. If the student is absent from school on the day of the test and the absence is excused, the student will remain eligible for extra-curricular participation but will automatically be tested on the next testing date. 5. No student will be given advance warning of the test. 6. Once the activities director or assistant principal receives the list of those students who are to be tested, they will accompany each student straight to the high school nurse s office. Once there, the students will stay under the guidance of the testing agency s personnel until the student is able to provide an adequate urine specimen. If the student is unable to produce a specimen, the students will be given up to 24 ounces of fluid. If the student is unable to produce a specimen within two (2) hours, the student will be ineligible for participation in extra-curricular activities until the next regularly scheduled test is administered and the results are negative. 7. Students will be instructed to remove all coats and wash their hands in the presence of the testing technician before entering the bathroom. The technician will wait outside the restroom until the student provides a sample. The students will have two minutes to produce the urine specimen. The commode will contain a blue dye so the water cannot be used to dilute the sample. The faucets in the restroom will be shut off. 8. Immediately after the specimen is taken the student will be escorted back to class by the athletic director or assistant principal. 9. Students and procedures for the test will be established by the testing agency. The testing agency may use a nine panel urinalyses of common illegal drugs and/or performance enhancing drugs, such as steroids, and a breath alcohol test. 10. The activities director/assistant principal will be notified of a student testing positive. The administration will notify the student and his or her parents of the results of a positive drug or alcohol screen. The student or his parents/guardians may submit any documented prescription or explanation of the positive test results or request a second test of the original specimen. This request to have the specimen tested again will be made within twenty-four (24) hours of the notification of the first positive test results. If this second test requested by the parents is negative the District will pay for the second test, if the results of the second test are positive the parents will pay for the second test. 11. If a drug or alcohol test is verified positive, the building principal will meet with the student and his/her parents/guardians. They will be given the names of counseling and assistance agencies. The student will be found in violation of the Code of Conduct for Extra-curricular Activities, and given the appropriate extra-curricular activity suspension. The student may not

4 participate in extra-curricular activities for the period of suspension and until a required followup test is completed and the results of the follow-up test are negative. 12. In order for the student to return to extra-curricular participation, a follow-up test is required after the suspension period is served or after such an interval of time that the substance previously found would normally be eliminated from the body, whichever comes later. The cost of the required follow-up test will be assumed by the District. If this follow-up test is negative, the student will be allowed to resume extra-curricular activities. If a positive result is obtained from the follow-up test, it will be considered a subsequent violation. 13. If a student tests positive for illegal drugs or alcohol for a second time during the same school year they will be ineligible for participation in extra-curricular activities for one calendar year from the date of the second testing. 14. At any time during the remaining school year, the school reserves the right to continue testing any participating student who had a verified positive test. 15. A student will be ineligible for all extra-curricular activities for the remainder of the school year if he or she pampers or cheats during the collection process. This will be reported to the parents/guardians. 16. The School District will pay for all initial random drug tests and any initial follow-up test necessitated by an invalid specimen, which was not due to tampering or cheating. Parents will pay for late sign up tests and requested second tests of positive results. Any follow-up test required by the District prior to returning to participation will be paid for by the District. Students and parents/guardians assume financial responsibility for substance abuse counseling.

5 WINNEBAGO HIGH SCHOOL # 323 Student and Parent or Guardian Consent Form for Extracurricular Participant Eligibility Random Substance Testing I wish to tryout for and/or participate in school sponsored extracurricular activities. I have read and understand the Board of Education s Extracurricular Participant Substance Abuse Testing Policy and agree to follow the said policy and procedures, including being subjected to random testing as a condition of participation in extracurricular activities. I understand that if I disobey the rules, I will be excluded from the opportunity to participate in extracurricular activities as provided in the Board s Policy and Procedures. I understand that I should ask Winnebago High School staff if I have any questions about the substance abuse testing program or results. I accept the method of obtaining urine samples, testing and analyses of such specimens, and all other aspects of the program. I agree to cooperate in furnishing such urine sampling, testing, and results as provided for in this program to the administration. This consent is given pursuant to all State and Federal Privacy Statutes and is a waiver of rights to non-disclosure of such test records and results only to the extent such disclosure is authorized by this program. This consent is valid for the current school year. I authorize the medical staff to take a sample of my urine or breath for the purpose of performing tests and otherwise screen the sample obtained from me for the presence of drugs, alcohol, tobacco, or other chemical substances. Also, I authorize the medical staff and laboratory to release the results of the testing, regardless of whether the results are negative or positive to the administration of Winnebago High School District # 323. I agree to participate in this program and release the testing organization/certified lab, Winnebago High School District # 323, and any of their employees, agents, and assigns from any liability arising out of my participation in this Substance Abuse Testing Program.
