1 1. Generally 1.1. In compliance with the Code of Virginia, sections , and through , every student must attend school on those days when school is in session during prescribed hours and summer school and after school if so required. The Superintendent shall promulgate regulations designed to foster compliance with the compulsory attendance laws of the Commonwealth of Virginia. 2. Definitions 2.1. Truancy means absenteeism without parental awareness and support Chronic Absences An excessive number of absences for all or any portion of the school day, which negatively impacts the student s instructional time and his/her academic success. The student s teacher and other appointed individuals will make this determination Superintendent The Division Superintendent or his/her designee. 3. Parental Cooperation in Remedying Excessive Absences 3.1. It is expected that parents will cooperate with the attendance officer and other school officials to remedy the student s attendance problem. Where direct contact with a parent cannot be made, despite reasonable efforts, or where parents otherwise fail to cooperate in remedying the student s attendance problem, the Superintendent or his/her designee may seek immediate compliance with the compulsory school attendance laws. The School Division attendance officer, with the knowledge and approval of the Superintendent, shall institute proceedings against any parent who fails to comply with the requirements of the compulsory attendance laws. 4. Report for Suspension of Driver s License 4.1. In addition to any other actions taken pursuant to this policy, if a student who is under eighteen (18) years of age has ten (10) or more unexcused absences from school on consecutive school days, the principal may notify the juvenile and domestic relations court, which may take action to suspend the student s driver s license. 5. Absences for Observance of a Religious Holiday 5.1. A student may be excused from school for the observance of a religious holiday. The parent/guardian of such student shall provide a letter to the student s school in advance of the planned absence notifying the school of the planned absence, the dates of the planned absence and the religious holiday being observed A student who is absent in accordance with this policy shall not be deprived of any award or eligibility or opportunity to compete for any award, or of the right to take an alternate test or examination, for which he or she missed by reason of such absence. 6. Attendance Reporting 6.1. Student attendance shall be monitored and reported as required by state law and regulations. At the end of each school year, each public school principal shall report to the Superintendent the number of pupils by grade level for whom an attendance conference was scheduled. The Superintendent shall compile this information and provide it annually to the Superintendent of Public Instruction Principals, attendance officers (if the School Board has appointed an attendance officer), and the Superintendent shall follow all legal requirements with regard to the compulsory school reporting requirements of state law. 1
2 7. Dismissal Precautions 7.1. Principals shall not release a student during the school day to any person not authorized by the student s parent/guardian to assume responsibility for the pupil. Students shall be released only on request and authorization of the parent or guardian. The burden of proof regarding the authority of the person to receive the student is on the requesting party. A formal check-out system shall be maintained in each Fauquier County public school. 3 7-2.4 (A) COMPULSORY ATTENDANCE PROCEDURES 1. Parent(S)/Guardian(S) Aware And Supporting Student s Absences 1.1. Sixth (6th) Absence of any Description - Secondary Students Only Documented personal contact from the school. A direct line of communication between school and parent(s)/guardian(s) is established Optional conference requested with parent(s)/guardian(s) or school to resolve any potential chronic absenteeism issues Student s attendance profile and information about the county attendance policy is provided in order to make the parent(s)/guardian(s) clearly aware of their responsibility under the law Tenth (10th) Absence of any Description - Administrative Contact Documented Elementary and Secondary Students Written notification of tenth absence will be made to parent/guardian Conference may be requested by the school to resolve chronic absenteeism issues (within five (5) school days). A plan for attendance improvement will be developed at this conference Attendance policy (attendance mandatory-all day, every day) outlined Fifteenth (15th) Absence of any Description - Administrative Evaluation of Absences and Parent(s)/Guardian(s) Involvement in Building Level Interventions Letter sent to parent(s)/guardian(s) containing the following information: Absences have been determined to be an issue of chronic absenteeism for one (1) or both of the following reasons: Failure of parent(s)/guardian(s) to cooperate with an attendance improvement plan; Parents inability to control/supervise the child with regard to school attendance; or Absences have been determined not to be an issue of chronic absenteeism for one (1) or both of the following reasons: Cooperation of parent(s)/guardian(s) and/or Extenuating circumstances have made the student s absences reasonable and not considered at this time to be an issue of failure to comply with the compulsory education law Continued cooperation between parent(s)/guardian(s) and school will be necessary to insure a minimum impact of the student absences. 1
4 1.4. In the event absences are considered to be a failure to comply with the compulsory education law, the building administrator will inform the parent(s)/guardian(s) of the following action: A referral for failure to comply with the compulsory education law has been filed with Student Services. This referral will result in one (1) or more of the following: Referral to Child Specific Team (CST) or other appropriate intervention; Initiation of court proceedings against child (CHINSup); and/or Initiation of court proceedings against the parent(s)/guardian(s) (Code of Virginia, section ). 2. Parent(S)/Guardian(S) Unaware Or Not Supporting Student s Absences 2.1. First (1st) through Fourth (4th) Day of Student Absence Without Parental Awareness and Support Make a reasonable effort to notify the parent by telephone If contact is made, obtain an explanation for the absence 2.2. Fifth (5th) Day of Student Absence Without Parental Awareness and Support Reasonable effort for direct contact (in person or by phone) must be made Develop a plan to resolve nonattendance Plan must include reasons for student s nonattendance Attendance policy (attendance mandatory all day, every day) outlined in the contact made 2.3. Sixth (6th) Day of Student Absence Without Parental Awareness and Support Schedule a Child Specific Team (CST) meeting no more than ten (10) days after 6th absence Hold Child Specific Team (CST) meeting no more than fifteen (15) days after 6th absence 2.4. Next Absence After Child Specific Team (CST) Meeting Letter sent to parent(s)/guardian(s) containing the following information: Absences have been determined to be an issue of chronic absenteeism for one (1) or both of the following reasons: Failure of parent(s)/guardian(s) to cooperate with an attendance improvement plan; Parents inability to control/supervise the child with regard to school attendance; or Absences have been determined not to be an issue of chronic absenteeism for one (1) or both of the following reasons: 2
5 Cooperation of parent(s)/guardian(s), and/or; Extenuating circumstances have made the student s absences reasonable and not considered at this time to be an issue of failure to comply with the compulsory education law Continued cooperation between parent(s)/guardian(s) and the school will be necessary to ensure a minimum impact of the student absences In the event absences are considered to be a failure to comply with the compulsory education law, the building administrator will inform the parent(s)/guardian(s) of the following action: 2.6. A referral for failure to comply with the compulsory education law has been filed with the Department of Student Services. This referral will result in one (1) or more of the following: Referral to Child Specific Team (CST) or other appropriate intervention; Initiation of court proceedings against child (CHINSup); or Initiation of court proceedings against the parent(s)/guardians(s) (Code of Virginia, section ) In situations of obvious chronic absenteeism, the building administrator may make a referral for failure to comply with the compulsory education law to the Department of Student Services and the School Division attendance officer at his/her discretion prior to the 15th absence. 3
6 Adopted: 4/10/12 STUDENT ATTENDANCE AND ABSENCES/TRUANCY (B) PUPIL ACCOUNTING RECORDS 1. Teacher s Register 1.1. Purpose - The purposes of automated or other pupil accounting systems are for proper pupil accounting in the instructional program, for school administration, and for the distribution of major state school funds Local School Boards may select automated or other systems for pupil accounting and shall adopt rules and regulations for proper maintenance, retention, reporting, disclosure and accuracy of all pupil accounting information Such procedures shall comply with all applicable federal and state laws and regulations relating to pupil records The Superintendent of Public Instruction shall, from time to time, provide guidelines to local School Boards Teaching Day Defined - A teaching day is defined as a day on which the school is in regular session for the instruction of pupils When Pupil Counted Present - A pupil shall be counted present only when he/she is present for roll calls or is in attendance for approved participation at approved school-sponsored field trips or other approved activities or events A pupil reporting after roll call will be recorded present and tardy Approval of School-Sponsored Field Trips - All school-sponsored field trips and other activities or events for which pupil attendance may be counted shall be approved through procedures adopted by the School Board Absence Because of School Bus Not Reaching School, Etc. - If a school bus does not arrive at the school, regardless of the reason, and the children are unable to reach the school by other means of transportation, such children cannot be counted present When Pupil Dismissed Early - If a school is closed due to inclement weather, civil defense alert, or other emergencies, and the children are dismissed early, pupils may be counted present Excused full-day absences. - Excused full-day absences must not be counted as present under any condition Special Students Attending School in the Morning - Special students, including those in work-study and COE programs, who attend school in the morning and are released for work in the afternoon may be counted as present. 2. Pupil Transfers 2.1. For any pupil transferring from a Virginia public school, a certificate (on a form prescribed by the Superintendent of Public Instruction) shall be prepared certifying that such pupil has been removed from the roll of the school from which such pupil is transferring The effective date of removal from the roll shall be the date such pupil withdraws from the school and shall be included on the certificate. 1
7 2.2. Any pupil transferring to a Virginia public school from a Virginia public school shall present such certificate to the school to which the pupil is seeking entry This requirement does not apply to pupils transferring from a private school or a public school located outside of the Commonwealth of Virginia. 3. When Pupil Dropped From Roll 3.1. A pupil shall be dropped from the roll and marked Withdrawn : When a certificate of transfer is executed; When a pupil has been expelled (and not assigned to an alternative program by the School Board); When a pupil has been absent for fifteen (15) consecutive days or more; When a pupil is transferred to a state-operated institution or hospital; or When a pupil has been suspended for more than fifteen (15) days and the student is not enrolled in an alternative program. Suspended students assigned to an alternative program will be transferred. 2
