3 Article 1 : Agreement Objective The aim of this Agreement is to establish legal bonds between its partners in the context of a practical internship within the diploma curriculum at the Hosting institution. Article 2 : Internship Objective The objective of this training internship is to put into practice theoretical and methodological tools learnt in the training course, identify skills, and strengthen the professional objective of the intern. The subject of the internship is: The internship is part of the intern s training, and personal and professional project. It is part of their educational curriculum; they must attend it to obtain their diploma. Article 3 : Internship contents The internship program and objectives are defined by the intern supervisor within the Hosting institution and the teaching supervisor, who supervises the internship from the University according to the general curriculum of the training. The program must fit the intern s specialization field and skills. Any issue arising in the context of the internship should be reported to the teaching supervisor, especially if such issues jeopardize the intern s ability to benefit from the training. Objectives and program : Tasks given to the intern : Article 4 : Duration and terms Internship duration : The internship period runs from:.../.../20... to :.../.../20..., a duration of... hours,... weeks,... months, corresponding to... days. An internship cannot start before the Agreement is signed by both parties. The ending date cannot be after the one stated in the intern s training agreement. No internship extension can be planned without prior written agreement by the training agreement financing party (Pôle emploi, Fongecif, Conseil Régional, etc.). Internship terms The weekly presence of the intern in the company shall not exceed... hours. The internship is full time part time. (please indicate the number of hours per week and/or %:...) When the internship implies special working conditions (night shifts, Sundays, bank holidays, etc.), the nature and duration of such conditions must be indicated hereafter by the Hosting institution. In accordance with Article L of the French Labour Code, overtime is forbidden. Article 5: Status of the intern - supervision The intern s status is Continuous professional training intern. The intern is supervised on a regular basis by the University. The Hosting institution appoints one supervisor within the Hosting institution who is responsible for the internship technical follow-up and optimization. The intern may be requested to return to university and attend a given number of lessons or meetings that are deemed compulsory within the program. The University shall indicate the dates of such lessons or meetings to the Hosting institution. Supervision terms: Article 6 : Remuneration, benefits in kind, travel and accommodation fees The Hosting institution may grant a remuneration which is, in that case, subject to social taxes on the entire amount of remuneration. The Hosting
4 institution shall provide for all travel and accommodation expenses it requests from the student, as well as possible training fees, according to its ongoing standards. List of free advantages: Article 7 : Social protection 7.1 Sick leaves, maternity leaves, etc. During the internship, the intern s status remains the same as before it started. 7.2 Work and travel accidents, and work-related medical conditions. The intern is covered against work and travel accidents as well as work-related medical conditions under the usual terms of the French Code of social security. Employed intern: the intern s salary is provided by the employer. Unemployed intern: the intern s salary is provided by the government or Region. In case of an accident, the University shall take care of the declaration in the following cases: - on the location and inside the internship hours - on the intern s way from their place of residence to the internship location - on a mission demanded by the company with a compulsory mission order. Internships in foreign countries are subject to approval by the University. Authorization depends on the terms of the internship (CIF, Agreement with the Region, etc.). The intern must not leave without prior consent from the French Social security system. 7.3 Intern s health protection abroad *Applicable the students must apply for a form to uphold their health protection rights abroad. EU interns doing their internships within the European Economic Area must obtain the EHIC, European Health Insurance Card. * In all other cases, the French Social Security Office can take care of health-related expenses happening abroad once the intern returns, upon presentation of supporting documents. Reimbursement is based on the French health rates. As some important gaps are likely, the intern is strongly advised to choose a company and get a specific complementary health insurance for the duration of the internship. 7.4 Intern s workplace accident protection abroad 1. In order to come under the terms of the French law on workplace accidents, the internship must not : - Last more than 12 months, including extensions - Be paid an amount which is sufficient to open rights to a workplace accident protection in the foreign country - Be in any other institution that the Hosting institution presented in this Agreement - Be in any other country than the mentioned foreign country. Whenever the required conditions are not fulfilled, the Hosting institution undertakes to subscribe to the necessary policies to ensure the protection of the intern and make all necessary protection in case of an accident in the workplace. 2. The University, responsible for the workplace accident declaration, should receive prior written information sent by the Hosting institution within 48 hours. 3. To be covered, the accidents must have occurred: - on the location and inside the internship hours - on the intern s way from/to their place of residence to/from the internship location - on the intern s way from/to their usual place of residence in France (internship starting and ending dates) - on a mission demanded by the company with a compulsory mission order. 4. Whenever one of the conditions provided in is not fulfilled, the Hosting institution shall comply with the terms of this Agreement and subscribe to the necessary policies to ensure the protection of the intern and make all necessary protection in case of accidents in the workplace and on professional travel, as well as work-related sickness. 5. In all cases, - Should the intern have an accident in the workplace during the internship, the Hosting institution shall immediately inform the University - Should the intern have limited missions outside the Hosting institution or internship country, the Hosting institution must take all necessary measures to subscribe to the necessary policies to ensure the protection of the intern. Article 8 : Civil liability and insurance The intern must choose and subscribe to an insurance company covering their civil liability for
5 any damage they may cause to persons or property in the context of their internship. An insurance supporting document is attached to this Agreement. Regardless of the internship nature and country, the intern undertakes to subscribe to an assistance contract (health repatriation, legal assistance, etc.) and an individual insurance contract. The Hosting institution declares that it has subscribed to the necessary civil liability. Whenever the Hosting institution provides the intern with a car, it must first check that the intern is covered according to the terms of its car insurance. Whenever the intern uses their own car or someone else s car in the context of the internship, they shall expressly inform the insurance company of this car about how they intend to use it, and if applicable, pay for any insurance fees incurred. Article 9 : Discipline In the course of the internship, the intern must observe the discipline and interior rules of the Hosting institution, in particular as far as working hours and hygiene and security rules are concerned. Any disciplinary measure may only be taken by the University. In such a case, the Hosting institution reserves the right to terminate the internship, as long as it complies with Article 10 of this Agreement. Article 10 : End of internship Report Assessment The internship shall be assessed by both supervisors, in compliance with the grading procedures of the diploma. Once the internship is over, the Hosting institution provides the intern with an internship supporting document, fills in an assessment form (Annex 1), and sends it to the University. The intern shall provide the University with an internship report complying with educational rules at stake, which may imply a presentation. If so, the presentation in public, unless a derogation based on confidentiality matters is requested by the supervisors and granted by the University president or delegate. Any publication is subject to consent by the Hosting institution representative, and the teaching and intern supervisors. The Hosting institution supervisor or any other member of the Hosting institution may not request reimbursement from the University for any travel to the University for the preparation, process and validation of the internship. Article 11 : Absence and interruption of the internship Temporary interruption : In case of absence, the intern must inform the Hosting institution, training secretariat and teaching supervisor within 24 hours. In the course of the internship, the intern may take days off subject to approval by the Hosting institution and as long as the internship duration is met. Any other temporary interruption of the internship (sickness, maternity, unjustified absence, etc.) shall cause the Hosting institution to inform the University director in a letter. Sick leaves must be documented. Internship termination : In case one of the three parties (Hosting institution, University, or the Intern) wishes to terminate the internship, the two other parties must immediately be notified of such decision in a letter. The reasons for termination shall be reviewed in close collaboration. The termination decision can only happen once this reviewing phase is over. The internship may also be terminated for serious medical reasons. The most diligent party or university medical department will notify the other parties and submit an Annex to this Agreement regarding the required changes of terms or internship agreement termination. In the case of terminated paid internships, the salary amount is calculated pro rata according to the actual internship duration. Article 12 : Confidentiality Absolute confidentiality must be observed at all times. Henceforth, the interns shall never use information they obtained in publications or communications (including the internship report) without prior consent by the Hosting institution. Such commitment applies for the duration of the internship as well as after its termination. The interns shall not keep, take or copy any document or software belonging to the Hosting institution without its prior consent. In some cases, a confidentiality agreement may be signed. NB: As far as confidentiality is concerned regarding information contained in the internship report, the Hosting institution may request that the report distribution be limited and possibly some very confidential information withdrawn from the report. People who will read the report are entitled to secrecy and therefore shall not use or distribute any information contained in the report. Article 13 : Intellectual property Should the intern s work be subject to copyright or industrial property protected results (including software), the Hosting institution wishing to use
6 such data needs the intern s prior consent. An agreement may then be signed between the intern (author/inventor) and the Hosting institution. The scope of granted rights, possible exclusivity, destination, used documents and granting duration will need to be indicated, as well as the amount paid to the intern, if applicable. This also applies to internships in public institutions. Article 14 : Recruitment Should a work contract starting before the end of the internship be signed with the Hosting institution, this Agreement would become obsolete. The intern would no longer be under the University s responsibility and would need to be informed before signing the agreement. Article 15 : Applicable law relevant jurisdiction Any litigation arising from the interpretation of the terms of this Agreement should first imply amicable resolution. This Agreement is exclusively subject to the French legal system. Any litigation which is not resolved in an amicable way will be submitted to the relevant French jurisdiction. Any substantial change in the internship organisation implies an Annex to this Agreement.
