2 PART 1 - INTERPRETATION 1.1 In these bylaws: (a) (b) (c) (d) (e) "Act" means The Dental Disciplines Act; College" and CDSS means the College of Dental Surgeons of Saskatchewan; Certificate of Standing refers to a document in the CDSS License, Professional Corporations and Permit Policy that each provincial regulator completes and provides on behalf of a member or former member to support that persons licensure process in another jurisdiction; Consent to Release of Information refers to a document in the CDSS License, Professional Corporations and Permit Policy that a candidate completes and provides to support that person s licensure process in another jurisdiction; "good standing" means: (i)that an applicant s Certificates of Standing' has been assessed and is determined to have no information that would preclude registration or licensure, or (ii) that a member has met the qualifications, requirements and conditions of registration and licensure, including the CDSS Professional Practice Standard, Professional Conduct Conditions, Discipline Committee Orders, professional liability Insurance requirements and payment of applicable fees; (f) (g) (h) (i) (j) (k) (l) (m) professional corporation means a corporation which is registered as a professional corporation under The Professionals Corporations Act and these bylaws and which holds as valid permit from the College dentist means a registered member of the college; General Dentistry means not of a specialty in dentistry; Generalist or General Dentist means a CDSS Member who is not a specialist dentist; Specialty means a defined body of knowledge within dentistry that is recognized as such in Bylaw 2.3(2); Specialist means a CDSS Member licensed in a CDSS recognized specialty of dentistry; "NDEB Certificate" means the certificate (registration number) provided to a person by the National Dental Examining Board, upon successful completion of the National Dental Examining Board Certification Examination; "RCDC Certificate" means the certificate (registration number) provided to a person, by the Royal College of Dentists of Canada, upon completion of the Royal College of Dentists of Canada National Dental Specialty Examination in a specialty listed in 2.3(2); 4/12/ Page

3 (n) (o) (p) (q) (r) (s) (t) (u) Practice is used both as a verb and as a noun pursuant to common usage; Good character means compliance with the CDSS Good Character Standard; CDSS License, Professional Corporations and Permit Policy means the document containing the policies, procedures and conditions for license categories, professional corporations and permits. Competence means meeting the Competencies, Components, Indicators and KSAs referred to in the CDSS Professional Practice Standard. HIPA means the Health Information Privacy Act of Saskatchewan. PIPEDA means the Personal Information Protection and Electronic Documents Act of Canada. CDRAF MOU means the Canadian Dental Regulatory Authorities Federation Memorandum of Understanding (June 2014). Registrar means the registrar of the College, who is a member or previous member hired by the Council and who is thereby appointed and thereby delegated by the Council to perform the duties of registration, licensing, permitting, associated regulatory duties and other duties as determined by council. PART 2 REGISTRATION, LICENSURE, PROFESSIONAL CORPORATIONS, PERMITS License Categories of Registered Members: 2.1 The registrar shall register and license qualified members in one of the categories in section 2.3, 2.4 or 2.5 of these bylaws. Registers 2.2 (1) The College will establish and maintain a Member Register in which the names and contact addresses of all its members, their category of licensure and their specialty, if applicable, are recorded. (2) The College shall additionally establish and maintain a Corporate Register in which: (a) The name and contact address of each professional corporation, that is registered by the College pursuant to section 2.6 is recorded; and (b) The name of each director and each voting shareholder of each professional corporation is recorded. (3) The College will establish and maintain a Facility Register that will list the names of all Oral Healthcare Facilities that members are connected with pursuant to the DDA s25. (4) The contact address, electronicl address and phone number of a member must be supplied to The College, and kept current by the member, in order for the College to serve the member with communications and documents. FULL PRACTISING MEMBERS Generalist Members 4/12/ Page

4 2.3(1) Subject to any other provisions in these bylaws, a person having the following qualifications may be entered on the Member Register as a Generalist Member of the College and be issued a license to practice general dentistry; (a) Such person: (i) is of good character in accordance with the CDSS Good Character Standard; and (ii) produces a currently valid certificate of qualification or registration number from the National Dental Examining Board of Canada; or (iii) is relocating to Saskatchewan from another province of Canada and who is a licensed full practicing general member in good standing within such province immediately prior to his or her application to the College; and (b) Such person has paid the required fees and completed all required documents, including the following: (i) A College application form; (ii) A valid NDEB Certificate or registration number; (iii) A Certificate of Standing from any previous licensing jurisdictions; (iv) The Consent to Release of Information document from any previous licensing jurisdictions if applicable; (v) A criminal record check document that has been approved by council; (vi) The signed CDSS Good Character document; and (vi) Proof of the required general and professional liability insurance that will cover them and all employees of them and/or their professional corporations, including student members under their supervision; and has been approved by the registrar for registration and licensure as a generalist member with a full practice license. Specialist Members (2) Subject to any other provisions in these bylaws, a person having the following qualifications may be entered on the Member Register as a Specialist Member of the College and be issued a license to practice as a Specialist Member in one of the following specialties: (i) (ii) (iii) (iv) (v) (vi) (vii) (viii) (ix) Endodontics Oral and Maxillofacial Surgery Orthodontics Pediatric Dentistry Periodontics Prosthodontics Oral radiology Dental Public Health Oral Medicine and Oral Pathology, and in which the specialists practicing the above specialities are defined as follows: (i) "endodontist" means a certified specialist and only a certified specialist in the specialty of endodontics ; (ii) "oral and maxillofacial surgeon" means a certified specialist and only a certified specialist in the specialty of oral and maxillofacial surgery ; (iii) orthodontist" or "dentofacial orthopedics specialist means a certified specialist and only a certified specialist in the specialty of orthodontics or dentofacial orthopedics ; 4/12/ Page

5 (iv) "pediatric dentist" or pedodontist means a certified specialist and only a certified specialist in the specialty of pediatric dentistry; (v) "periodontist" means a certified specialist and only a certified specialist in the specialty of periodontics ; (vi) prosthodontist means a certified specialist and only a certified specialist in the specialty of prosthodontics ; (vii) "oral radiologist" means a certified specialist and only a certified specialist in the specialty of oral radiology ; (viii) "dental public health specialist" means a certified specialist and only a certified specialist in the specialty of dental public health ; (ix) "oral medicine and pathology specialist" means a certified specialist and only a certified specialist in the specialty of oral medicine and oral pathology". and such person would be restricted to practice solely within that specialty if they have the following qualifications: (a) he or she is a person who: (i) is of good character in accordance with the CDSS Good Character Standard; and (ii) has passed the Royal College of Dentists of Canada National Dental Specialty Exam (RCDC/NSDE) in at least one specialty recognized by the College; or (iii) is relocating to Saskatchewan from another province of Canada and who is a member with a specialty license that is equivalent to a CDSS recognized specialty and who is in good standing within such province, immediately prior to his or her application to the College; and (b) such person has paid the prescribed fees and completed all the required documents including: (i) A College application form; (ii) A valid RCDC Certificate or confirmation of specialty status; (iii) The Certificate of Standing from any previous licensing jurisdictions; (iv) The Consent to Release of Information document from any previous licensing jurisdiction, if applicable; (v) An criminal record check document that has been approved by council; (vi) The signed CDSS Good Character document; and (vii) Proof of the required general and professional liability insurance that will cover them and all employees of them and their professional corporations, including student members under their supervision; and has been approved by the registrar for registration and licensure as a Specialist Member. 4/12/ Page

6 (3) Where the person applying for registration and licensure is a non-practicing member or has not been fully licensed to practice dentistry in Saskatchewan or any other jurisdiction for a period of two or more consecutive years; or where the person applying for registration and licensure has not practiced a minimum 300 hours per year for a period of two or more consecutive years preceding the date of application for licensure in the College, such person shall additionally: (a) be subjected to assessments as the council may prescribe; (b) pay the required assessment fee; and (c) shall successfully complete such examinations and courses as prescribed by council; and this subsection shall have no application to persons who immediately prior to their application were students in a college, school or faculty of dentistry. (4) The licenses of Generalist Members and Specialist Members are subject to annual renewal as further set out in these bylaws and College License, Professional Corporations and Permit Policy. RESTRICTED PRACTICING MEMBERS Conditional Members 2.4(1) Subject to any other provisions in these bylaws, a person meeting the following criteria may be entered on the Member Register as a Conditional Member and be issued a restricted license with the following conditions and restrictions: (a) the person is of good character in accordance with the CDSS Good Character Standard ; and (b) he or she (i) has been a full licensed member of the College; or (ii) is the holder of a degree in dentistry or dental surgery and is licensed to practice dentistry in a jurisdiction recognized by the College; and (iii) shall be restricted pursuant to the College License, Professional Corporations and Permit Policy; (c) he or she desires registration solely for the purpose of: Full Time Faculty or Part Time Faculty Member (i) undertaking a Full Time Faculty or Part Time Faculty teaching position with the University of Saskatchewan College of Dentistry; or Itinerant Member (ii) presenting, conducting, engaging in or supervising a College approved graduate, undergraduate, clinical or research program on an Itinerant basis at, or under the sponsorship of, the University of Saskatchewan College of Dentistry or under the sponsorship of a College approved organization; or Forensic Member 4/12/ Page

7 (iii) participation as a member of a Forensic team sponsored by a College approved agency to assist with identification procedures associated with any disaster which should occur in Saskatchewan; or Humanitarian Member (iv) providing dental treatment in a jurisdiction outside of Saskatchewan wherein the provision of such treatment is under the auspices of a College approved Humanitarian project sponsored by a jurisdiction that requires the person to have a status of registration and membership in another jurisdiction; or Volunteer Member (v) practicing dentistry as an unpaid Volunteer in a Saskatchewan Health Region facility approved by the College; and, (d) such person has paid the required fees and completed all required documents including the following: (i) A College application form; (ii) proof of employment, sponsorship or volunteer privileges/positions approved by the College; (iii) a criminal record check document that has been approved by council; (iv) proof of the required general and professional liability insurance; and, has been approved by the registrar for registration and licensure as a Conditional Member. Student Members (2) Subject to any other provisions in these bylaws, a person meeting the following criteria may be entered on the Member Register as a Student Member and be issued a license to practice dentistry under the following conditions and restrictions: (a) the person is of good character in accordance with the CDSS Standard of Good Character ; and (b) shall be restricted pursuant to the College License, Professional Corporations and Permit Policy; (c) such person is: Undergraduate Student Member (i) an undergraduate student at the University of Saskatchewan College of Dentistry; or Penultimate Student Member (ii) an undergraduate student who, following successful completion of his or her penultimate year at a faculty or college of dentistry is employed by a Full Practicing Member in good standing with the College; or Intern Student Member (iii) an undergraduate student who, as part of his or her training, is under direct supervision of a Full Practicing Member while serving a period of Internship or residency within a University of Saskatchewan College of Dentistry facility or in a Saskatchewan health region facility or affiliate approved for undergraduate training by the University of Saskatchewan College of Dentistry; and 4/12/ Page

8 (d) such person has paid the required fees and completed all required documents, including the following: (i) A College application form; (ii) A criminal record check document that has been approved by council; (iii)the signed CDSS Good Character document; and (iv)proof of the required general and professional liability insurance, and has been approved by the registrar for registration and licensure as a student member. (3) Where the person applying for registration and licensure has not been fully licensed to practice dentistry in Saskatchewan or any other jurisdiction for a period of two or more consecutive years; or where the person applying for registration and licensure has not practiced a minimum 300 hours per year for a period of two or more consecutive years preceding the date of application for membership and/or licensure in the College, such person shall additionally: (a) be subjected to assessments as the council may prescribe; (b) pay the required assessment fee; and (c) shall successfully complete such examinations and courses as prescribed by council; and this subsection shall have no application to persons who immediately prior to their application were students in a college, school or faculty of dentistry. (4) The licenses of Restricted Practicing Members are subject to annual renewal as further set out in these bylaws and College License, Professional Corporations and Permit Policy. Non Practicing Members Associate Members 2.5(1) Subject to any other provisions in these bylaws, a person meeting the following criteria may be entered on the Annual Register as an Associate Member and will be eligible to receive the College newsletter, to access the member s website and not be issued a license to practice dentistry under the following conditions and restrictions: (a) such person: (i) has previously been a Full Licensed Member or a Conditional Licensed Member of the College; and (ii) is in good standing; and (iii) has paid the required fees. (2) the licenses of associate members are subject to annual renewal as further set out in these bylaws and College Licence Policy. PROFESSIONAL CORPORATIONS, PERMITS 4/12/ Page

9 2.6 (1) Subject to any other provisions in these bylaws, a corporation may be entered on the corporate register as a professional corporation of the College and be issued a permit where: (a) it meets the criteria set out in the Professional Corporations Act, College Bylaws and College License, Professional Corporations and Permit Policy, (b) it has paid the required fees, supplied and/or completed all required forms, provided proof of 5 million dollars of professional liability insurance for each member practicing within the corporation, and (c)has been approved by the registrar for registration as a professional corporation of the College. (2) The name of the corporation shall, in the opinion of the registrar, appropriately depict that the corporation is engaged in the business of providing dental services and shall otherwise be in compliance with the College Bylaws and the College Advertising Standard. (3) There shall be such restrictions or conditions on the permit of a professional corporation, as determined and set out by the Council in the College License, Professional Corporation and Permit Policy. (4) The registration and permit of a professional corporation is subject to annual renewal as further set out in these bylaws and College License, Professional Corporation and Permit Policy. (5) The Council may revoke a permit of a professional corporation as permitted or required by the Professional Corporations Act. Where a permit is revoked, the registrar shall send notice of that fact to the professional corporation and strike its name from the Corporate Register. (6) A professional corporation shall notify the registrar in writing within 10 days of any of the following changes: (a) in its name; (b) in the voting rights attached to any classes of its shares; (c) in the ownership of the issued shares of the professional corporation or in the ownership of the issued shares of a corporation holding non-voting shares in the professional corporation; (d) in the directors of the professional corporation; (e) in the status of a spouse holding non-voting shares in the professional corporation, or holding shares in a corporation holding non-voting shares in the professional corporation, or who is a beneficiary of a trust holding non-voting shares in the professional corporation; or (f) in the beneficiaries of a trust holding non-voting shares in the professional corporation. (7) Upon receipt of the notice referred to in subparagraph (6), the Council may: (a) continue the permit; (b) amend the permit to add or delete any terms or conditions; or (c) subject to the terms of the Professional Corporations Act, revoke the permit and registration of the professional corporation after such time period as it deems reasonable given the nature of the change. (8) Where a member is not of good standing, suspended or expelled and is providing the dental services within a professional corporation, he or she shall not be eligible to continue practicing within the corporation or otherwise. Review of Registrar s Decision Regarding a Professional Corporations (9) Any person who is aggrieved by a decision of the registrar with respect to: 4/12/ Page

10 (a) the registration of a professional corporation; (b) the issuance of a permit to a professional corporation; or (c) the revocation of the permit of a professional corporation; has such right to apply to council for a review of such decision as permitted by the Professional Corporations Act. Appeal of Registrar s Decision Regarding a Professional Corporations (10) A Corporation may, in accordance with the provisions of the Professional Corporations Act, appeal the decision of the council to court where: (a) the application of the corporation for registration, for a permit, or for renewal of a permit as a professional corporation is rejected; (b) its permit as a professional corporation is issued subject to terms and conditions; or (c) its permit as a professional corporation is revoked. Registration Fees 2.7 (1) Each person seeking registration and licensure as a member and each corporation seeking registration and permit as a professional corporation of the College shall pay the prescribed initial registration fee together with the annual fee, before being entitled to receive his or her registration and license to practice dentistry and, where applicable, registration and permit as a professional corporation. Annual Renewal 2.8 (1) To be eligible for the annual renewal of licensure, each member must: (a) be in good standing with the College; (b) complete the annual license renewal form that has been approved by Council; and (c) pay the required annual fee by January1 of each year in which they wish to be licensed. (2) To be eligible for the annual renewal of its registration and permit, each professional corporation must: (a) continue to meet the criteria set out in the Professional Corporations Act, these bylaws and College policy; (b) complete the required forms that have been approved by council; (c) pay the prescribed annual fee by January1 of each year in which the Professional Corporation wishes to have a permit for the practice of dentistry. (3) Where a member or a professional corporation is in arrears in the payment of fees, the registrar may renew the license or the permit, as the case may be, upon payment of the annual fee and the prescribed penalty for late payment. (4) Where a member is suspended at the time of annual renewal, the member may apply for renewal at the end of the term of his or her suspension by complying with section 2.11(1) and by paying the prescribed annual fee on the date of application. (5) Where the suspended member is the sole person carrying on the business of providing dental services in the name of a professional corporation, such professional corporation may also apply for its re-registration and permit at the end of the term of the member s 4/12/ Page

11 suspension, by complying with section 2.11(2), and by paying the prescribed annual fee on the date of application. Reinstatement of Expelled Members 2.9 Any person who has been expelled as a member of the College may apply for reinstatement as set out in section 41 of the Act, upon payment of the prescribed fee. Suspended or Expelled Members 2.10 (1) Where a member is suspended or expelled and is the sole person providing the dental services of a professional corporation, then the permit of such professional corporation shall be revoked as required by the Professional Corporations Act. (2) Where a member is suspended or expelled and is one of two or more persons providing the dental services of a professional corporation, he or she shall not be eligible to continue practicing within the corporation. PART 3 PROFESSIONAL PRACTICE STANDARDS Lawful Practice 3.1 All professional Corporations having permits and all practicing members of the College shall: (1) not contravene, while engaged in the practice of dentistry, any federal, provincial, municipal, health region or College law, bylaw, regulation or rule; and (2) abide by the terms, conditions or limitations of the member s license and shall not permit, counsel or assist any person who is not licensed or certified under the Act to engage in the practice of dentistry except as provided for in the Act and these bylaws. Service of Documents (3) Service of documents may be made by personal service pursuant to The Dental Disciplines Act section 52. (4) Service of documents may also be effected by an alternate mode including: (i) Courier; (ii) registered or ordinary mail; (iii) fax; or (iv) electronic submission (5) In the case of service by courier, a copy of the document must be: (a) left at the address for service with the person to be served; (b) left at the address for service with an adult person who appears to be an employee, agent, representative or household member of the person to be served; or (c) left in a mail receptacle at the address for service if there is no person described in clause (b) present: (i) at an address for service that is a residential address; or (ii) during regular office hours, at an address for service that is a business address. (6) In the case of service by registered or ordinary mail, a copy of the document must be placed in an envelope and mailed to the address for service of the person to be served. (7) In the case of service by fax, the document must be faxed to the fax number shown in the address for service of the person to be served and must include a cover page that sets out all of the following information: 4/12/ Page

12 (a) the sender s name, address, telephone and fax number; (b) the name of the person to be served; (c) the date and time of transmission; (d) the total number of pages transmitted, including the cover page. (8) In the case of service by electronic transmission: (a) the document must be electronically transmitted to the electronic transmission address shown in the address for service of the person to be served; and (b) the electronic transmission must set out all of the following information (i) the sender s name, electronic transmission address, telephone number, and the sender s fax number if there is one; (ii) the name of the person to be served; (iii) the date and time of transmission; (iv) the electronic file name of the document being transmitted, the name and date of the document being transmitted; (d) a request is made for notification that electronic delivery has been successful. Responding to the College (9) All members must: (i) respond to requests and orders of council, committees and officers of the College or their delegates; within the designated time; and (ii) fulfill the recommendations of, and agreements with the Council, committees and officers of the College or their delegates; within the designated time. CDSS Professional Practice Standard 3.2 All professional Corporations having permits and all practicing members of the College shall practice according to the CDSS Professional Practice Standard including all current council approved appended documents. CDSS Clinic Facility Permits 3.3 (1)All Facilities within which a member practices, or is connected to by employment or contract, must have a CDSS Annual Clinic Facility Permit that has been completed by the member and approved by the registrar. (1) Dental Clinic means a place which is used by or connected to (by employment or contract) a dentist, as defined in The Dental Disciplines Act, for performance of authorized practices with respect to a patient. (2) All Facilities within which a member practices, or is connected to by employment or contract, must have a CDSS Annual Clinic Facility Permit that has been completed by the member and approved by the registrar. (3) Annual Clinic Facility Permits must be renewed annually. Radiation Orders, Equipment (4) Members must comply with the Saskatchewan Radiation Health and Safety Act, The Regulations and the CDSS Radiation Standard (5) Dental Clinic as defined in the Radiation Health and Safety Regulations means a place in which radiation equipment is used by or under the direction of a dentist, for diagnostic or therapeutic purposes with respect to a patient; (6) Members must make specific orders or maintain a written protocol for ordering diagnostic tests and imaging, including radiographs, to be performed by dental therapists, hygienists and assistants, unless in the case of dental therapists 4/12/ Page

13 and dental hygienists, the diagnostic radiographs are performed within their authorized practice. Agreements and Leases 3.4 No member of the College shall enter into any agreement, including a lease of premises pursuant to which the amount payable by or to a member directly or indirectly is related to the amount of fees charged by the member or by a person licensed or registered under any legislation regulating a health discipline, unless the agreement is a contract for services with: (i) another member or members, or allied personnel; or (ii) A corporation, partnership, or other entity controlled by a member or members; Employment and Business Relationships 3.5 No member of the College shall, except with the consent of the council, act as employee, assistant, agent, partner, officer, shareholder or otherwise howsoever, engage in the private practice of their profession for the benefit, or advantage of any corporation, or of any person who is not duly qualified and lawfully entitled to practice either dentistry or medicine in Saskatchewan, or in such a way that any such company or unqualified person may make thereby profit, reward or advantage, either directly or indirectly, unless: (i) provision is provided for the same by another federal or provincial act; (ii) in the case of a corporation, such corporation is a professional corporation under these bylaws; or (iii) in the case of employment of the member, the employer is a person, corporation or other legal entity referred to in section 25(1) of the Act. 3.6 Each member shall be responsible for ensuring that any professional corporation of which it is a director complies with these bylaws and its permit; Supervision 3.7 Every member connected to a facility having CDSS Annual Facility Permit shall provide general oversight and supervision of the oral health services provided in that facility. Delegation 3.8 Members may delegate procedures and tasks within their authorized practices and under the restrictions and conditions of the CDSS Practice of Dentistry, Facilities Standard. Advertising 3.9 (1) The only persons who are permitted to advertise are Full Practicing Members as provided with in these bylaws and the CDSS Advertising Standard. (2) Advertising, promotion and other external marketing activities must be accurate and not be capable of misleading the public; and must: (a) Not misrepresent the facts, (b) Be untruthful, not false (c) Not be misleading, deceptive, fraudulent 4/12/ Page

14 (d) Be objectively verifiable; (e) Not include personal feelings, beliefs, Interpretation, opinions testimonials (3) Advertising, promotion and other external marketing activities must be professional and observe the dignity and ethics of the profession and therefore should not include: (a) Uniqueness, Comparisons to other providers; (b) Undignified statements; (c) Deprecating statements about other members; (d) Statements in bad taste that could harm the profession; (e)promises of better results or unjustified expectations; (g) Coercion, duress, harassment to take advantage of physical, emotional, financial duress; (h) Coupons and giveaways (i) Reference materials, techniques, equipment PART 4 QUALITY ASSURANCE Quality Assurance Committee 4.1(1) The Quality Assurance Committee shall be composed of a minimum of three persons, one of whom shall be a member of council. The Quality Assurance Committee shall assist the membership in a co-operative manner to provide quality care to the public that meets the CDSS Professional Practice Standard. (2) The Quality Assurance Committee may appoint any one or more of its members or other persons as assessors and delegate to persons so appointed the authority to conduct an assessment and following the assessment to report thereon to the Quality Assurance Committee. Practice Enhancement Review Program 4.2(1) Every member of the College shall co-operate fully in allowing Quality Assurance Committee assessors to: (a) enter and inspect any dental practice facility to which they are connected by employment or other contract; and (b)have access to inspect all books, records, correspondence and other documents or electronic data related to the dental practice, including the right to make copies thereof; and shall provide all information as requested by the assessor and appear before or confer with the Quality Assurance Committee or any of its assessors when requested to do so. (2) Following a Quality Assurance Committee assessment, the Quality Assurance Committee may require the member to make such changes to his or her procedures, attend such courses, or successfully complete such further examinations as the Quality Assurance Committee determines as necessary; Referral to Professional Conduct 4.3 (1) Following a Quality Assurance Committee assessment, the Quality Assurance Committee may refer any matter which has come to the attention of the Quality Assurance Committee or an assessor, including professional incompetence or professional misconduct, to the Professional Conduct Committee. (2) Where the member refuses or fails to co-operate with the Quality Assurance Committee or any of the assessors, or fails to fulfill the requirements or conditions of the Quality Assurance Committee as prescribed pursuant to section 4.1(4) the Quality Assurance Committee may refer the matter to the Professional Conduct Committee Critical Incident Reports 4/12/ Page

15 4.3 Where a member has experienced a critical incident during the practice of dentistry a Critical Incident Report must be filed with the Quality Assurance Committee as soon as reasonably achievable. Assessments for Professional Conduct Committee Investigations 4.4 When requested to do so by the Professional Conduct Committee, the Quality Assurance Committee may provide an assessment of a matter and provide a report to assist in a Professional Conduct investigation pursuant to the Act. Prescription Review Program 4.5 (1) The College may participate in the Prescription Review Program established in Saskatchewan. (2) The Prescription Review Program shall apply to all dosage forms of the drugs listed in the panel of monitored drugs under the Prescription Review Program bylaw of the College of Physicians and Surgeons of Saskatchewan. (3) Prescriptions for drugs covered by the Prescription Review Program shall be prescribed and dispensed by a member according to the policies and procedures agreed to by the College of Dental Surgeons of Saskatchewan, the College of Physicians and Surgeons of Saskatchewan, the Saskatchewan Registered Nurses Association and the Saskatchewan (4) The office of the Registrar may gather and analyze information pertaining to the prescribing and dispensing of medications to which the Prescription Review Program applies in Saskatchewan for the purpose of limiting the inappropriate prescribing/dispensing and inappropriate use of such drugs. In order to fulfill that role, the office of the Registrar may, among other activities: (a) Generally, provide education to members in order to encourage appropriate prescribing and dispensing practices by members; (b) Alert members to possible inappropriate use of medications to which the Prescription Review Program applies by patients to whom they have prescribed or dispensed such drugs; (c) Alert members to possible inappropriate prescribing or dispensing medications to which the Prescription Review Program applies; (d) Make recommendations to members with respect to that member's prescribing and dispensing of medications to which the Prescription Review Program applies; (e) Require a member to provide explanations of his or her prescribing and dispensing of medications to which the Prescription Review Program applies. In making requests for an explanation, the office of the Registrar may require the member to provide information about the patient, the reasons for prescribing and/or dispensing to the patient, and any knowledge which the member may have about other narcotics or controlled drugs received by the patient; (f) Cause information, concerns or opinions of general application to the profession to be communicated to members without identifying the particular member to whom such information relates; (g) Provide information gathered in connection with the Prescription Review Program to another health professional regulatory body including the Saskatchewan College of Pharmacists, the Saskatchewan Registered Nurses Association or the College of Physicians and Surgeons of Saskatchewan provided the information gathered is required by that body to perform and carry out the duties of that health professional regulatory body pursuant to an Act with respect to regulating the profession. Where the personal health information relates to a member of the health professional body seeking disclosure, disclosure by the office of the Registrar of that information may only be made in accordance with The Health Information Protection Act, and in particular section 27(5) of that Act.. (5) The College or the Prescription Review Program may enter into an agreement with a 4/12/ Page

16 person or organization to do any or all of the following: a) access and analyze information in the prescription review database pertaining to members prescribing and dispensing; b) advise the College of concerns pertaining to members prescribing and dispensing; c) advise the College of possible inappropriate use of medications to which the Prescription Review Program applies by patients to whom members have prescribed and dispensed such medications; d) provide general education to the College and its members pertaining to prescribing and dispensing of Prescription Review Program medications; and e) alert the College to possible inappropriate use of medications, to which the Prescription Review Program applies, by patients to whom a member has prescribed or dispensed such medications. 4/12/ Page
