1 Guidelines regarding the management of tuition fees for degree programmes and courses at Luleå University of Technology Background The Riksdag has decided to introduce application fees and tuition fees for students that come from countries outside the EU/EEA. More detailed regulations on this have been issued in Ordinance (2010:543) on application fees and tuition fees at higher education institutions. For the University, this means that tuition fees shall in future be paid by some of the University's students. As a result, the following guidelines for the management of tuition fees are established. 1. Scope of the requirement to pay tuition fees 1.1 Citizens from countries outside the EU/EEA Citizens of countries outside the EU/EEA shall pay tuition fees for studies in degree programmes and courses for which they have applied and been admitted and which are intended to be commenced on or later than Exemptions The following groups of students from countries outside the EU/EEA are not subject to the requirement to pay tuition fees: Family members of an EEA national who have a right of residence or a right of permanent residence in Sweden pursuant to Chapter 3a, Section 4 or Section 7 of the Aliens Act (2005:716) Family members of a Swiss national who have a residence permit in Sweden pursuant to Chapter 4, Section 16 of the Aliens Ordinance (2006:97), Those who have a permanent residence permit in Sweden, Those who for reasons other than studies have a temporary residence permit in Sweden, Those who have long-term resident status in Sweden pursuant to Chapter 5 a of the Aliens Act, 1

2 Those who have long-term resident status in another European Union state and have a residence permit in Sweden pursuant to Chapter 4, Section 9 of the Aliens Ordinance, Those who are students at a higher education institution abroad but are completing a limited section of a programme of study at a Swedish higher education institution within the framework of an exchange programme of partnership programme which means that no tuition fee is charged by the receiving higher education institution, Those studying within the framework of an exchange programme for which the Government has decided no tuition fee is to be charged A student required to pay tuition fees may complete a course or a degree programme without paying a tuition fee if the course or degree programme was commenced before 1 July If the studies are not completed by 31 December 2018, however, tuition fees are to be paid for the subsequent period. A student required to pay tuition fees may be admitted to and complete a course without paying an application fee or tuition fees if the course begins after 1 June 2011 but is to be completed no later than 31 August EU/EEA nationals EU/EEA nationals, i.e. nationals of Belgium, Denmark, Finland, France, Greece, the Netherlands, Ireland, Italy, Luxembourg, Portugal, Spain, the United Kingdom, Sweden, Germany, Austria, Cyprus, Estonia, Latvia, Lithuania, Malta, Poland, Slovakia, Slovenia, the Czech Republic, Hungary, Bulgaria, Romania and Iceland, Liechtenstein and Norway and Switzerland, do not need to pay fees to apply for or participate in degree programmes or courses in Sweden. 2. The legal basis of the tuition fee issue Notwithstanding the fact that students pay a fee for their studies at LTU, no relationship exists under civil law. This means that no agreement is to be signed or deemed to be entered. The rights and obligations of LTU and students derive instead from principles of administrative law. 2.1 Applicable rules of law Since the relationship arising from tuition fees is a matter of public law, the rules of the Higher Education Act and of the Higher Education Ordinance are also applicable to feepaying students. Also applicable are the regulations of general administrative law, such as the Administrative Procedure Act, the rules of public access to information and secrecy, the Data Protection Act etc. 2

3 2.2 LTU's decisions Decisions at LTU regarding education-related internal policy documents categorised as plans, rules, guidelines etc. also apply to students paying tuition fees. Both decisions on policy documents and decisions concerning an individual student constitute agency decisions. The equivalence principle applies, which means that students paying tuition fees are to be treated in the same way as all other students at LTU. 3. Fees at LTU 3.1 Determination of fees The Vice-Chancellor shall adopt regulations on the size of tuition fees. Principles for determining the size of tuition fees are adopted by the Vice-Chancellor (RE decision ). This decision also determines the price tags for the various disciplinary domains in the admissions round of The Vice-Chancellor or the person appointed by the Vice-Chancellor shall henceforth annually adopt applicable price tags for each admissions round. Price tags for each admissions round are to be published on the University website. 3.2 Semester payment and total cost Students admitted to a degree programme shall pay the same price throughout their education on a semester basis. In connection with admission to degree programmes, students shall be notified of the total cost of the programme applied for. 4. The rights of students paying tuition fees 4.1 Access to LTU's resources Payment of the tuition fee entitles students to the teaching and examination associated with the education for which they have applied and paid. This also includes access to the University's premises, library resources and technical resources, student health care, insurance cover, etc. 4.2 The right to complete education The student's right to education encompasses the right to complete the education that has been commenced and paid for. This includes the right to retake courses and examinations. 3

4 4.3 The right to change study specialisation In accordance with general rules adopted at LTU, the student is entitled, insofar as different study specialisations exist within the degree programme to which the student has been admitted, to change study specialisation within this degree programme. A change of degree programme is not possible without new application and admission. 4.4 Rectification etc. If a fee-paying student believes that LTU is deficient in the implementation of education, that the education does not live up to the quality or quantity promised, that the University has provided misleading information, that the student has been treated incorrectly etc., the question of rectification or compensation arises. Questions of rectification are handled primarily by LTU directly or following contact via the students' union. Otherwise, the channels for rectification or, at least, supervision provided in the form of the Swedish National Agency for Higher Education, the Higher Education Appeals Board, the Parliamentary Ombudsman, the Chancellor of Justice or the Equality Ombudsman are applicable. The question of possible compensation in the form of damages is settled through the regulation of the Tort Liability Act concerning government agencies. 5. Payment of tuition fees 5.1 The scope of the payment requirement Students in degree programmes pay a semester fee covering 30 credits and, where applicable, pay for additional credits applied for, according to the established price list. Students on courses pay on a semester basis for the number of credits applied for, according to the established price list. Students who have not completed their studies within the nominal programme length have the right to complete their studies without paying additional tuition fees. Students who complete their credit load in less time than the normal number of semesters must still pay fees for the total number of credits. Students who in the framework of their education carry out part of their studies abroad must still pay tuition fees to LTU. 4

5 5.2 Fee requirement upon approved leave from studies and non-completion Students who intend to apply for approved leave from studies in order to avoid the requirement to pay a tuition fee shall submit an application for approved leave from studies to a study adviser no later than on the final date for payment of the tuition fee. The equivalent is applicable to students who intend to interrupt their studies. 5.3 Payment procedures Tuition fees shall be paid on a semester basis on one occasion. Instalments or annual payments are not possible. Payment of tuition fees is made, after receiving notification, via the internet (the LTU website) using the charge cards MasterCard/Visa or to LTU's bank account Handling of stipends Where applicable, in determining the tuition fee to be invoiced to an individual student, stipends from LTU or other awarder are to be deducted. In order to be released from payment, an individual student who receives a stipend or the equivalent from an external awarder shall where the awarder is to make payment directly to LTU be able to present original funding certification in conjunction with application. Where the studies of an individual student are financed through stipends from an external awarder and the awarder intends to make payment directly to the University, this awarder is to be invoiced directly from the University. 5.4 Payment deadlines Applicant students Payment of tuition fees in connection with application to a degree programme or course shall be made no later than three weeks after notification of the autumn or spring admission decision. The customer invoice informs the applicant of the latest date for payment and the effect of non-payment. Where the applicant's tuition fees are to be paid off in the form of stipends or by other means directly to the university, a payment period of 30 days may be considered. 5

6 5.4.2 Active students Active students in degree programmes shall make payment of tuition fees no later than five days before the start of the autumn or spring semester Payment reminders If the payment of tuition fees is not completed on time, a payment reminder will be issued immediately after the due date, comprising a payment period of one week. 5.5 Effect of non-payment Applicant students - lost place Applicants for a degree programme or course at LTU who have not fulfilled their requirement to pay the first tuition fee on time will lose their place Active students - suspension Those who have been admitted to and commenced a degree programme or course, and have not paid the tuition fee within one week of a reminder, will be suspended from that education through a decision by the Financial Manager. In such cases, the reminder shall contain a statement that suspension will be considered if the fee is not paid on time. Decisions on the suspension of a student who has not paid the tuition fee take effect immediately and are in force until full payment is made. Suspension due to late payment does not confer the right to a reduced fee. 6. Repayment of tuition fees Repayment of tuition fees for a semester that has already commenced is not possible except in the cases stated below. 6.1 Absence of residence permit Students who have paid tuition fees, but are not granted a residence permit in Sweden, and for whom the admissions procedure is interrupted, are entitled to recover all the tuition fees paid excluding bank charges. 6.2 Early non-completion Students in degree programmes who interrupt their studies before 1 October/1 March in their first semester at LTU are entitled to repayment of half of the tuition fees paid, excluding bank charges, regardless of the reason for non-completion. 6

7 Application for repayment is submitted to a study adviser, which after preparation is submitted to the Financial Manager for a repayment decision. 6.3 Special grounds In the event of serious illness or death with regard to the student, the student's partner or member of the immediate family, it is possible to apply for repayment of tuition fees for the semester that has already commenced. Application for the repayment of tuition fees, including accompanying documentation, must be submitted in writing to a study adviser for preparation. Decisions are made by the Financial Manager. The extent of repayment will then amount to a sum equivalent to the unused portion of the semester fee paid. 6.4 Credited courses Students in a degree programme who have been granted credit transfers from courses at another higher education institution as part of their education at LTU are entitled to a repayment of tuition fees to an extent equivalent to the credited courses. 7. Suspension and expulsion of students 7.1 Attempts at misleading/cheating or disruptive behaviour Cheating and disruptive behaviour, including discrimination matters on the part of a feepaying student, are dealt with and decided by the University's Disciplinary Committee. Decisions may be appealed to the Administrative Court. In particularly serious situations, where there is deemed to be a risk that a student, due to mental disturbance, alcohol or drug abuse or serious crime, could cause personal injury or damage to valuable property, expulsion from studies may be considered. Such matters are dealt with and decided by the Higher Education Expulsions Board following a report from the University. 7.2 Non-payment Non-payment results in suspension from studies. Suspension decisions are made by the Financial Manager. 7.3 Meaning of the suspension decision A suspension decision means that the student is suspended from all teaching, such as supervision, examination and other activities, and from other resources within the framework of education at the University. 7

8 Degree certificates or course certificates may not in matters involving the non-payment of tuition fees be issued until the tuition fees have been paid. Suspension from studies with reference to non-payment, or to a decision of the Disciplinary Committee, the Administrative Court, the Higher Education Appeals Board or the Higher Education Expulsions Board, does not confer entitlement to a repayment of tuition fees. 7.4 Appealing a suspension decision Decisions on suspension due to non-payment shall be accompanied by information on how to appeal and may be appealed to the Higher Education Appeals Board. 8
