1 MEMORANDUM OF UNDERSTANDING BETWEEN COLLEGE OF DuPAGE AND LEWIS UNIVERSITY This agreement is entered into between Lewis University, hereinafter "Lewis" and College of DuPage hereinafter "COD" to offer qualified students a convenient, cost effective, and streamlined approach for an enhanced 2+2 agreement for COD teacher preparation/education students leading to a Bachelor of Arts Degree in Combined Special Education/Elementary Education from Lewis University, hereinafter "combined education." With mutual institutional respect, our two institutions enter into a curriculum coordination agreement. The objectives of the Agreement are as follows: Offer COD students the ability to complete teacher preparation/ education and general education courses at College of DuPage which will be accepted for transfer toward a Combined Special Education/Elementary Education Bachelor of Arts Degree from Lewis University. Collaboratively advise students to enhance their education and streamline articulation between the two institutions. Jointly prepare students to take full advantage of the teaching opportunities in special and elementary education. Provide a more affordable and convenient pathway to complete the Bachelor of Arts degree in education in four years of time, rather than the traditional five years, if the enhanced 2+2 academic plan of study is closely followed by a student. Scope of the Program 1. All provisions of this Agreement are confined to the offering of the Bachelor of Arts Degree in Combined Special Education/Elementary Education by Lewis University and to the College of DuPage students admitted specifically into this programmatic option (the "Program"). None of the terms contained within this document are applicable outside of the Program. 2. Students must complete the courses outlined in the COD/Lewis University Enhanced 2+2 academic plan at COD prior to enrolling in any Lewis University courses offered as part of the Program. See ADDENDUM A. 3. Students who are enrolled in or have completed teacher preparation/ education classes and/ or an Associate of Arts degree at College of DuPage can be considered for admission to the Program. 4. Students in the Program will be required to complete a minimum total of 128 credit hours for the Bachelor of Arts degree from Lewis University configured in the following way for this specific major with the list of approved courses attached. a. Bachelor of Arts Degree in Combined Special Education/Elementary Education, 66 credit hours from COD and 62 credit hours from Lewis University. 1
2 5. College of DuPage students must have a cumulative GPA of at least 2.75/4.0 scale before enrolling in any Lewis University education courses. 6. For full admission to the College of Education students must pass either the State of Illinois Test of Academic Proficiency (TAP) or earn a minimum composite score of 22 with a minimum writing score of 16 on the ACT or SAT equivalent. COD will assist in guiding students to work on this requirement prior to the fifth semester. Students will not be allowed to progress past the sixth semester without meeting this state requirement. 7. Lewis University will offer the following courses on the campus of COD during the fifth semester of study for the students, providing there is sufficient enrollment for each class section. These courses are subject to change. Lewis will insure that COD students have the opportunity to enroll in a full academic load of a 12 credit hour minimum and that all courses offered meet the Combined Special Education/Elementary Education Bachelor of Arts major. For the Combined Special Education/Elementary Education major please refer to ADDENDUM A. 8. Students should apply for admission to Lewis University at least one full semester prior to their desired start date for enrolling in any Lewis University courses. 9. COD will charge tuition for their courses at their most current published rate. 10. Lewis University will charge tuition for the Program courses offered in the fifth semester of the Program onsite at COD at a rate of 60% of the most recently published traditional undergraduate credit hour rate at Lewis. Students will not be eligible for any additional Lewis University funded grants or scholarship aid. 11. Students in this Program will be restricted to enrolling only in the Lewis University courses offered onsite at COD during the fifth semester dependent on sufficient enrollment. In the event that Lewis University courses cannot be offered on the COD campus due to enrollment, COD students will be eligible to enroll in courses on Lewis University's main campus in Romeoville. The remaining three semesters of coursework must be completed at the Romeoville campus. 12. Financial aid will be initially processed and awarded through COD. Once a student attains junior status (75 credit hours completed), his/her financial aid will be subsequently 2
3 processed by Lewis University through a separate, signed consortium agreement between Lewis University and COD. 13. Lewis University and COD will be responsible for billing the student for the respective courses taken at each institution. Students who are delinquent in their payment of tuition and fees to either Lewis University or COD will be blocked from further registration at both institutions until payment is received. Lewis University and COD will promptly provide each other with all information regarding such delinquencies as necessary to meet this mutual obligation. Specific services COD will provide to Lewis: 1. COD will provide Lewis University with classroom and office space and furnishings, including telephone and internet access at no charge on COD's main campus in Glen Ellyn. 2. COD will assist Lewis University in the promotion and recruitment of students by distributing printed materials, providing mailing lists and contact information of interested students, and advising current and potential students of this degree program option. 3. COD will include information on their website promoting this degree program option. 4. COD will list Lewis University on its website and in its catalogs as an affiliated organization. 5. To the extent necessary to fulfill this Agreement, COD will provide Lewis University parking, access to common areas, and other services commonly provided to COD faculty, staff, and students. 6. COD shall designate an individual to serve as a representative for the purpose of monitoring this Agreement and notify Lewis University of the person's name and contact information in writing prior to the upcoming semester. 7. COD will provide Lewis University exclusivity in offering a Bachelor of Arts Degree in Combined Special Education/Elementary Education. Specific services Lewis University will provide to COD: 1. Lewis University will provide onsite advisors at regularly scheduled times to meet with and advise students. 2. Lewis University will provide Program information to COD students seeking information on pursuing their degree with Lewis University in the COD offices and other appropriate spaces located on COD's campus. 3. Lewis University will develop and maintain a course cycle for COD students admitted to Lewis University under the terms of this Agreement. 4. Lewis University will list COD as an affiliated organization on its website and other appropriate printed and electronic materials. 5. Lewis University will provide the fifth semester classes on CO D's campus with minimum class sizes of twelve (12) students. 6. Lewis University shall designate an individual to serve as a representative for the purpose of monitoring this Agreement. Lewis University shall notify COD of the person's name and contact information in writing prior to the upcoming semester. 1. The term of this Agreement will commence on the date it is executed by both parties, and the term will continue for five years unless terminated in accordance with this Agreement. 3
4 2. Either party may in its sole discretion terminate this Agreement upon 180 days advance written notice to the other party. Termination by either party must be accompanied by a plan to allow all currently enrolled students to complete their program of study and obtain their degree under the terms of this Agreement. Additional Agreements 1. Both parties shall maintain all necessary and required accreditations with the appropriate accreditation agencies. In the event either party's accreditation is revoked or otherwise limited, this Agreement may be terminated immediately upon written notice by the other party. In the event of such termination for loss of accreditation, all participating students shall be accommodated to the extent possible at the institution that remains appropriately accredited. Any additional costs of such accommodations shall be paid by the institution that lost accreditation. 2. Lewis University agrees to hold harmless, indemnify, and defend COD, its officers, agents, trustees, employees, and representatives (collectively "Indemnities") from and against all losses, damages, judgments, claims, expenses, costs, and liabilities imposed upon or incurred by or asserted against one or more of the Indemnities, including reasonable attorneys' fees and expenses, arising out of the acts or omissions of Lewis, its officers, agents, or employees, under this Agreement. 3. COD agrees to hold harmless and indemnify Lewis, its officers, agents, trustees, employees, and representatives (collectively "Indemnities") from and against all losses, damages, judgments, claims, expenses, costs, and liabilities imposed upon or incurred by or asserted against one or more of the Indemnities, including reasonable attorneys' fees and expenses, arising out of the acts or omissions of COD, its officers, agents, or employees, under this Agreement. 4. Both parties will honor agreed upon curriculum and syllabi for COD coursework that is being accepted toward the Combined Special Education/Elementary Education Bachelor of Arts major and neither may make major revisions without collaboration and the consent of the other. 5. In the event of regulatory changes to program requirements for licensure, Lewis University will inform COD of such changes and work collaboratively to make curricular adjustments that are needed. 6. No agreements concerning the transfer or exchange of any asset of either party is intended or implied by this Agreement. Lewis University and COD are separate and independent institutions of higher education and by this Agreement both will continue to operate as separate institutions. The administrators of Lewis University and COD are authorized to sign, prepare, and implement plans of action and procedures necessary to effect this Agreement. 7. In no event shall either party be liable for any incidental, indirect, special, or consequential damages, including, but not limited to, loss of use, revenue, profit, or savings. 8. Each party assumes full responsibility for the payment of all federal, state, and local taxes it incurs as a result of this Agreement. 9. This Agreement is executed by an authorized representative of each party in the representative's official capacity only and the representative shall have no personal liability under this Agreement. 4

Neither party shall discriminate on the basis of race, color, religion, sex, national origin, ancestry, age marital status, physical or mental handicap, an unfavorable discharge from military service, or any other factor as prohibited by law, rule, or regulation. 11. Each party certifies that it maintains a written sexual harassment policy in conformance with 77 ILCS 5/ Each party certifies that it provides a Drug Free Workplace in compliance with the Drug Free Workplace Act, 30 ILCS 580/1 et seq. 13. This Agreement shall be governed by and construed in accordance with the substantive laws of the State of Illinois regardless of any conflict of laws provision. All disputes arising out of this Agreement, wherever derived, will be resolved in a court of competent jurisdiction. 14. Any modifications and amendments to this Agreement must be in writing and signed by authorized agents of both parties.
