1 PROCEEDINGS OF 262 nd MEETING OF THE ERC-NCTE HELD ON 24 th 25 th October, 2018 The 262 nd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 24 th 25 th October, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 262 nd ERC Meeting. Momin - State Representative of Meghalaya Shri Vijay Kumar Mishra - State Representative of Bihar Ms. Naorem Santa Devi - State Representative of Manipur Shri Pradeep Kumar Yadav - Regional Director (I/C), ERC & Convener As per the notice for meeting issued by this office, the 262 nd meeting of ERC scheduled from 24 th 25 th October, The Chairperson, ERC is unable to attend the meeting on 24 th 25 th October, 2018 and given consent to continue the meeting in her absence. The members present in the meeting hereby unanimously decided that in absence of Chairperson ERC, Dr. Pratap Indra Dash, State Representative of Odisha, ERC shall function as Chairperson for this meeting. At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate Sl. The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. 1

2 Clarification through Appeal Order on Appendix 4 of NCTE Regulations, 2014 ER about appointment of faculty in the pedagogy subject in B.Ed. Course (File No.3-4/NCTE/ERC/Reg/2018) Appeal Committee while deciding the matter of institution viz. Purbayan Educational Institution, Plot No , Street No.-West, Vill. - West Panchla, P.O.- Dhunki, Tehsil/Taluka- Panchla, Town/City- Howrah, Dist. - Howrah, West Bengal (ERCAPP4038) for consideration of one more unit of 50 for B.Ed. course remanded back the matter to ERC with the following observation in the appeal Order vide No /E /2018 Appeal/13 th Mtg.-2018/ 27 th & 28 th July, 2018/69869 dated : Norms and Standards for B.Ed. programme as contained in Appendix 4 of the NCTE Regulations, 2014 require 8 faculty in the pedagogy subject (Maths, Science, Social Science, Language). The Norms and Standards do nowhere mention that eight faculty required for pedagogy subjects should be proportionately divided among the four subjects. The demand for subject teachers differs from region to region and care should be taken that no pedagogy subject for which students are admitted is left unattended. The Committee noted the above observation of NCTE HQs. (ii) Minutes of the Selection Committee duly constituted as per norms of the affiliating body is not submitted. (iii) Affidavit on Rs.100/- non-judicial stamp paper regarding constitution of selection committee for appointment of faculty not submitted. (iv) Original affidavit on Rs.10/- Non-judicial stamp paper by the individual faculty not submitted. (v) Educational/professional qualification certificates of appointed faculty members not submitted. (vi) Original FDRs of Rs.5.00 lakh and Rs.7.00 lakh towards Endowment & Reserve fund after conversion into joint operation mode not submitted. Course) (Private) (The West Bengal University of Teachers Training, Education Planing and Administration) (ERCAPP ) (ID No.10568) As per decision of 250 th ERC Meeting, permission to B.Ed. course was refused vide order dated The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No /E-73811/2018 Appeal/13 th Mtg.-2018/27 th & 28 th July, 2018 dated remanded back the case to ERC for consideration of the list of faculty and other compliance points. Appellant is required to submit to ERC a complete compliance report in response to LOI within 15 days of the issue of Appeal orders. The ERC re-viewed the matter in accordance with the appeal order as well as representation dated from the institution for compliance of LOI and observed as under:- Faculties in Physical Education, Art Education and Music do not have NET/Ph.D. qualification as per Gazette Notification No.237 of NCTE published on (ii) Copy of UGC NET certificate in respect of faculties viz. Ms. Piyali Chanda and Mr. Sanjay Kumar mentioned at sl. No. 1 & 8 of the approved faculty list not submitted. 3

4 (iii) The name of Ms. Piyali Chanda appointed as Asst. Professor also included in the faculty list of another institution viz.manikchak College of Education (D.Ed.), Plot No.381, 382, 382/653, 382/654, 382/65, Vill - Jalalpur, P.O.-Dallutola, Tehsil/Taluka - Manikchak, Town/City - Malda, Dist - Malda, West Bengal , which is contradictory. Show Cause Notice be issued to the institution as to why the application for permission be not refused on the above points. (Private) (The West Bengal University of Teachers Training, Education Planing and Administration) (ERCAPP4038) The institution was granted recognition for B.Ed. course vide Order No.ER (Part-3)/ERCAPP4038/ B.Ed./2017/52857 dated with an intake of 50(one basic unit) from the academic session Being aggrieved, the institution filed W.P.(C) No of 2017 in the Hon ble High Court of Delhi and the Hon ble Court disposed of the matter vide Order dated with direction to treat the present writ petition as a representation and decide the same by passing a reasoned and speaking order within six weeks. The matter was considered by ERC in its 250 th meeting held on February, 2018 and accordingly, reasoned order vide No dated issued to the institution. The institution preferred an appeal to NCTE HQs. against the order of ERC. The Appellate Authority vide its Order No /E-73620/2018 Appeal/13 th Mtg.-2018/27 th & 28 th July, 2018/69869 dated remanded back the case to ERC for revisiting the matter in accordance with the NCTE Regulations, 2014 and issuing appropriate recognition order. The institution is required to submit to ERC within 15 days of the issue of appeal order the additional list of faculty. The ERC re-viewed the matter in accordance with the appeal order as well as documents submitted by the institution vide letter dated and decided as under:- In addition to 50 intake already granted for B.Ed. Programme from the academic session earlier, the Committee decided that formal permission order under clause 7(16) of the NCTE Regulation, 2014 for existing B.Ed. Programme with another 50 intake from the session be issued to the institution, thus making the sum total grant of 100 intake Jharkhand Teachers Training College, Plot No , Street No.- New 6 Old 1, Vill. - Telaiya Basti, PO.- Jhumri Telaiya, Tehsil/Taluka - Koderma, Town/City - Koderma, Dist.- Koderma, Jharkhand (D.El.Ed.-Addl. Course) (Private) (University of Burdwan) (ERCAPP4165) As per decision of 214 th ERC Meeting, permission to B.Ed. course was refused vide order dated The institution preferred an appeal to NCTE HQs. against the refusal order of ERC and the Appellate Authority vide Order No /2016 Appeal/15 th Meeting-2018/1 st & 2 nd August, 2018/70549 dated remanded back the case to ERC for further processing of the application by taking note of the NOC and building plan. Appellant institution is required to submit to ERC a copy of building plan approved by Durgapur Municipal Corp. within 15 days of the issue of appeal order. Course)/2016/46309 dated with an intake of 50 (one basic unit) from the academic session The institution preferred an appeal to NCTE HQs. against the recognition order of ERC. The Appellate Authority vide its Order No /E-72674/2018 Appeal/13 th Mtg.-2018/27 th & 28 th July, 2018 dated remanded back the case to ERC for revisiting the matter and issuing order as per NCTE Regulations, The ERC re-viewed the matter in accordance with the appeal order and decided as under:- In addition to 50 intake already granted for B.Ed. The institution is required to submit the faculty list as per Gazette Notification No.237 of NCTE published on which stipulates that for the post of Principal/HOD, Ph.D. qualification is essential and for the post of lecturer either Ph.D. (as per UGC Regulations, 2009) or NET qualifications. Intake) (Private) (Lalit Narayan Mithila University) (ERCAPP3357) from the NCTE Hqrs. from time to time and VTR, the Committee discussed the matter in detail and decided as under: Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution. The institution which is already recognized for B.Ed./D.El.Ed. course(s) and sought recognition/permission for additional course/ additional intake are required to furnish the previous faculty list along with compliance of the Letter of Intent. The institution is required to submit the faculty list as per Gazette Notification No.237 of NCTE published on which stipulates that for the post of Principal/HOD, Ph.D. qualification is essential and for the post of lecturer either Ph.D. (as per UGC Regulations, 2009) or NET qualifications.
