1 PROCEEDINGS OF 161 st MEETING OF THE ERC-NCTE HELD ON 19 th -20 th SEPTEMBER, 2013 The 161 st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 19 th - 20 th September, 2013 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 161 st ERC Meeting. Prof.(Dr.) P.C. At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. No. Item No. 1 ER Content Confirmation of the Proceedings of 160 th ERC meeting, 26 th -27 th August, 2013 at Bhubaneswar. Confirmed The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. The Committee in its 159 th meeting decided to conduct inspection of 95 B Ed Colleges of Jharkhand under Rule 17 as per the direction of Honorable High Court of Jharkhand at Ranchi. The decision was communicated to NCTE Hqtr. Later NCE Hqtr. decided conducts the inspection of these institutions under Rule 13 of Regulation 2009 as the honorable Supreme Court of India restricted the Regional Committees to conduct inspection under Rule 17 in the matter of Adarsh Shiksha Mahavidyalaya & Others Vs. Subhash Rahangdale & others [2012 (2) SCC 425]. Hence the committee revised it decision to withdraw the decision taken in its 159 th Meeting. The committee noted the decision of the Appeal Committee. 1

The committee noted the decision of the Appeal Committee Mahatma Gandhi Antarrashtriya Vidyapeeth, Plot NO. 5, Vill- Bharauliya, Po- Laxmipur, Tehsil- Mottihari, Dist.- Purba Champaran, Bihar (Private) (Baba Saheb Bhimrao Ambedkar Bihar University) (Code No. APP1149) The Appeal Committee considered the case of the institution and remanded back to the ERC, NCTE, Bhubaneswar with a direction to issue a show cause notice to the appellant institution and take further action as per the Regulations. Regulations and guidelines issued by NCTE Hqrs. and noted that the institution has not submitted any reply in response to ERC deficiency letter dated on the following grounds: The land is not in the name of institution / society/trust. Submitted Sale deed registered on is in the name of individual and certified on which is not acceptable as per NCTE Regulations Possession /Mutation Certificate from concerned Govt. authority not submitted. (iii) Building Plan submitted in A4 size paper approved by Mukhiya on However, blue print of building plan mentioning plot no. khasra no. total area and built up area approved by Govt. civil authority not below the rank of Jr. Engineer of the Government. - not submitted. (iv) Notarized copy of (conversion of land utilization from agriculture to non-agricultural Purpose) CLU issued by the Competent Civil authority in the prescribed format not submitted. (v) Undertaking in the prescribed format not submitted. (vi) Non Encumbrance Certificate issued by concerned Govt. Authority not submitted. (vii) Letter of permission regarding enclosure of column 5 from concerned Govt. authority not submitted. (viii) The institution /society is running C.P.Ed. and D.P.Ed. Courses without the recognition of the NCTE. The institution needs to clarify this aspect. Show Cause notice be issued to the institution as to why the recognition to the institution be not refused on the above points.
