1 PROCEEDINGS OF 248 th MEETING OF THE ERC-NCTE HELD ON 12 th 13 th January, 2018 The 248 th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 12 th 13 th January, 2018 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 248 th ERC Meeting. With the permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. Sl. No. Item No. Content ER The Proceedings of 242 nd & 247 th ERC meetings are hereby confirmed with the following amendment / review :- (1) The decision in respect of Adamas Institute of Teacher Education, Plot No.- 457,458, 459, 465, 458/496, Village- Sadarpur, PO- Jagannathpur, Tehsil- Barasat-1, Dist- North 24 Parganas, West Bengal (D.El.Ed.-Addl. Course) (Private) (West Bengal Board of Primary Education) (ERCAPP3539) in the 247 th meeting is as under: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, VTR and reply in response to SCN issued after LOI, the Committee discussed the matter in detail and observed as under: (i) LOI u/c 7(13) was issued on (ii) Reply from the institution has not been received within the stipulated period, which is already over. Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision. Adamas Institute of Teacher Education has been upgraded into Adamas University. NOC issued from West Bengal Board of Primary Education to conduct D.El.Ed. programme being an 1

2 affiliating / examining body to the Adamas University and the Committee accepted the NOC. A fresh Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued in the name of Adamas University. The institution be asked to submit the FDRs of Rs.5.00 and Rs lakh towards endowment fund and reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent. And, this application shall be treated in the name of Adamas University, Plot No.- 457,458, 459, 465, 458/496, Village- Sadarpur, PO- Jagannathpur, Tehsil- Barasat-1, Dist- North 24 Parganas, West Bengal for D.El.Ed. course. Previous Letter of Intent u/c 7(13) dated and subsequent communication thereon issued in the name of Adamas Institute of Teacher Education shall be treated as cancelled. (2) The decision in respect of Mahila Primary Teachers Training College Musapur, Plot No , Vill - Musapur, PO. - Musapur, Tehsil/Taluka - Korha, Town/City - Katihar, Dist - Katihar, Bihar (D.El.Ed.- Addl. Intake) (Government) (Bihar School Examination Board) (ERCAPP2029) in the 247 th meeting is as under: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and decided as under: VT be constituted. The above decision of ERC is rectified and may be read as under: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and decided as under: (i) The ERC in its 247 th meeting decided that (ii) The application bearing Code No. ERCAPP739 of the same institution has already been granted recognition for D.El.Ed. Course on with 50 intake from the academic session , followed by additional intake of 50 in respect of application bearing Code No. ERCAPP2335 issued vide order dated from the academic session (iii) Since, permission for additional intake of D.El.Ed. already granted to the same institution from the academic session , hence, the application bearing Code No. ERCAPP2029 for D.El.Ed.- Additional Intake cannot be considered again. The application of the institution bearing Code No.ERCAPP2029 be closed. (3) The decision in respect of B.N. Saha DAV Teachers Training College At-Sirsia, Near Giridih Block, Giridih, Badhupur Road, Dist-Giridih, Jharkhand (B.Ed.) (Private) (Vinoba Bhave University) (APE00581) in the 247 th meeting is as under: After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and decided as under: VT be constituted. 2

(4) The decision in respect of The West Bengal University of Teachers Training, Education Planning and Administration, 25/2 & 25/3, Ballygunge Circular Road, Kolkata, West Bengal [Formerly: David Hare Training College (Institute of Advanced Studies in Education), 25/3, Ballygunge Circular Road, Calcutta, West Bengal (B.Ed. and M.Ed. course) (Government) (Itself affiliating body) (File No. WB-S/E-3/1997 & APE00030) in the 242 nd meeting is as under: The institution viz. David Hare Training College (Institute of Advanced Studies in Education), 25/3, Ballygunge Circular Road, Calcutta, West Bengal has been granted recognition for both B.Ed. and M.Ed. courses respectively. The representation from Registrar of The West Bengal University of Teachers Training, Education Planning and Administration vide Ref. No. WBUTTEPA/RO/198/2017 dated has been received requesting to change the name of David Hare Training College (Institute of Advanced Studies in Education) to the new name of The West Bengal University of Teachers Training, Education Planning and Administration as this college has been upgraded by the Govt. of West Bengal into The West Bengal University of Teachers Training, Education Planning and Administration from the year 2014 wherein the existence of Teacher Education programme being converted as the Deptt. of Education under this University. The nomenclature of the institution viz. David Hare Training College (Institute of Advanced Studies in Education), 25/3, Ballygunge Circular Road, Calcutta, West Bengal be changed to The West Bengal University of Teachers Training, Education Planning and Administration, 25/3, Ballygunge Circular Road, Kolkata, West Bengal The Committee is of opinion that the Department of Education which was previously David Hare Training College (Institute of Advanced Studies in Education) be permitted to run the programme under this University. The above decision of ERC is rectified and may be read as under: The institution viz. David Hare Training College (Institute of Advanced Studies in Education), 25/3, Ballygunge Circular Road, Calcutta, West Bengal has been granted recognition for both B.Ed. and M.Ed. courses respectively. David Hare Training College (Institute of Advanced Studies in Education), 25/3, Ballygunge Circular Road, Calcutta, West Bengal be changed to The West Bengal University of Teachers Training, Education Planning and Administration, 25/2 & 25/3, Ballygunge Circular Road, Kolkata, West Bengal The Committee is of opinion that the Department of Teacher Education which was previously David Hare Training College (Institute of Advanced Studies in Education) be permitted to run the programme under this University. ATTENTION! The Committee unanimously decided that the institution may reply in response to the decision of the Committee uploaded on the ERC website without waiting for formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: for detail). 3. The institution needs to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 6. The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. Court Case Surendralal Das Teachers Training College, Plot No. 5007, 5008, 5516, 5505, 4300, 4301, Vill/Po- Anandanagar, Tehsil/Taluka- Bally Jagacha, Town/City- Howrah, Dist- Howrah, West Bengal (D.El.Ed.-Addl. Course) (Private) (West Bengal Board of Primary Education) (ERCAPP3724) That the permission to D.El.Ed. Course was summarily rejected vide ERC Order No dated on the ground of non-submission of registered land document with hard copy of the printout of online application. That the institution preferred W.P. No (w) of 2017 in the Hon ble High Court of Calcutta. The Hon ble High Court disposed of the matter on with a direction inter alia: Mr. Ghosh, learned Advocate on behalf of the respondent nos. 1 to 3 does not dispute the submissions on facts. It is, however, his submission that the consideration earlier was by reason of interference of Court and that is not the usual procedure. In view of the above, the petitioner, if makes an application offline to the said respondent, in particular to the respondent no. 3 for the recognition they seek, the said respondent, in the circumstances of having considered earlier, will consider and dispose of the same as expeditiously as possible. The Committee considered the order of the Hon ble High Court of Calcutta as well as representation of the institution dated , together with their documents. In view the above, the Committee decided as under: 4

(Private) (The West Bengal University of Teachers Training, Education Planning and Administration) (ERCAPP2701) That the recognition to B.Ed. Course of the institution was refused u/s 14(3)(b) vide ERC Order No dated That the institution filed AST No. 244 of 2017 before the Hon ble High Court of Calcutta to quash the order dated The Hon ble High Court disposed of the matter on with the following directions: Considering the submissions as advanced by the learned Advocates for the respective parties and perusing the records, I direct the respondent Nos. 2 and 3 to take step to grant recognition in favour of the petitioner / institution thereby condoning two days delay, as has been prescribed in the statute, for obtaining NOC under clause 7(16) of the NCTE Regulation 2014 for B.Ed. course from the Academic Session , within a period of four weeks from the date of communication of this order as in respect of Yeaqub Ali B.Ed. College, the NCTE has granted recognition hereby condoning the delay. Needless to mention that this case would be treated as a special case by the respondent NCTE that will not create any precedence. In view the above, the Committee decided as under: Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution. The institution be asked to submit the FDRs of Rs.5.00 and Rs lakh towards endowment fund and reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent. ER APPEAL CASE National College of Education, Vill:- Gopidhanwat, Street/ Road:- Nunia Tola, Taluka/Mandal:- Pokhraira, Town / City:- Gopidhanwat, Dist:-Muzaffarpur, Bihar (B.Ed.-Addl. Intake) (Private) (Babasaheb Bhimrao Ambedkar Bizaree University) (ERCAPP ) (ID No.9057) The institution was granted recognition under clause 7(16) for conducting B.Ed. Courses vide Order No dated with an intake of (Existing Additional 50 = 150 intake) from the academic session by the ERC, NCTE. The institution preferred an appeal against the recognition orders of ERC and The Appellate Authority vide Order No /E-13363/2017 Appeal/19 th Meeting-2017/61404 dated remanded back the case to ERC with a direction to consider the submission of the appellant about their having two lecturers in Mathematics, and take further action on the appellant s request for one more additional unit (50 intake) of B.Ed. as per the provisions of the NCTE Regulations, The ERC re-viewed the matter in accordance with the appeal order and decided as under: In addition to 150 intake already granted for B.Ed. course from the academic session earlier, the Committee decided that formal permission order under clause 7(16) of the NCTE Regulation, 2014 for applied B.Ed. Programme with another 50 intake from the session be issued to the institution, thus making the sum total grant of 200 intake. 5

6 Ramuni Devi B.Ed.College, Vill - Manjurahi, Street/ Road - NH - 2, Taluka/ Mandal - Aurangabad, Town/ City - Manjurahi, Dist. - Aurangabad, Bihar (B.Ed. & D.El.Ed.) (Private) (Bihar School Examination Board & Maulana Mazharul Haque Arabic & Persian University) (ERCAPP ) (ID No.7264) The institution was granted recognition under clause 7(16) for conducting B.Ed. and D.El.Ed. Courses vide Order No dated with an intake of 50 (one basic unit) each from the academic session by the ERC, NCTE. The institution preferred an appeal against the recognition orders of ERC and The Appellate Authority vide Orders dated remanded back the case to ERC with a direction to consider the request of the appellant for the second unit in the B.Ed. & D.El.Ed. courses and take further action as per NCTE Regulations, The appellant is directed to forward the list of faculty members to the ERC within 15 days of receipt of the orders on the appeal. The ERC in its 246 th meeting considered the appeal order; accordingly, show cause notice was issued on and documents relating to appointment of required faculty submitted by the institution vide letter dated (on the basis of proceedings uploaded on ERC website) received on In view the above, the Committee decided as under: In addition to 50 intake each already granted for B.Ed. and D.El.Ed. courses from the academic session earlier, the Committee decided that formal recognition order under clause 7(16) of the NCTE Regulation, 2014 for applied B.Ed. and D.El.Ed Programme with another 50 intake each from the session be issued to the institution, thus making the sum total grant of 100 intake each.
